TO:City Council
REQUESTED
BY:Kevin White, Community Development Director
APPROVED
BY:Travis Randel, Interim City Manager
SUBJECT:Annexation of 43.68 Acres into the City of San Jacinto (Annexation A), Tentative Tract Map 34271, & Lot
Line Adjustment 22-01 (P22-004)
RECOMMENDATION:
The Planning Commission recommends that the City Council:
1. DETERMINE that the proposed Project will not have a significant effect on the environment with the incorporation of
mitigation based on the findings set forth in the case record and ADOPT a Mitigated Negative Declaration (MND) and
Mitigation Monitoring and Reporting Program, pursuant to the California Environmental Quality Act (CEQA);
2. ADOPT Resolution No. 4151 to AUTHORIZE the Annexation of 43.68 acres into the City of San Jacinto, subject to
review and approval of Annexation A by the Riverside Local Agency Formation Commission (LAFCO); and
3. ADOPT Resolution No. 4152 to APPROVE Lot Line Adjustment 22-01 and Tentative Tract Map (TTM) 34271
subject to the Recommended Conditions of Approval and upon approval of the Annexation A by LAFCO. (P22-004).
DISCUSSION:
On September 22, 2026, the Planning Commission, after holding a Public Hearing, adopted Planning Commission Resolution
No. 26-03, recommending that the City Council approve Project P22-004.
Project P22-004 is a proposal by Cornell Kasbergen to annex two lots totaling 43.68-acres into City of San Jacinto. The project
also includes a Lot Line Adjustment to adjust lot lines of the two existing parcels, and TTM 34271 to subdivide a 41.74-acre
portion of the property into 151 single-family residential lots and 7 lettered lots. The build-out of the project would include the
construction of single-family homes and the development of onsite roadways, off-site road improvements, detention basins,
parks, paseos, and on-site landscaping.
The project site is located within the unincorporated area of Riverside County, outside the City's incorporated boundaries. The
Riverside County’s General Plan Land Use Designation for the site is Agricultural and the current zoning is A-2-10. The
project is also within the City of San Jacinto's Sphere of Influence (SOI) which is a planning boundary outside of the City’s
legal limits. The SOI identifies areas likely to be annexed and is intended to ensure the efficient provision of services,
discourage urban sprawl, and prevent premature conversion of agricultural and open space lands. The City’s adopted General
Plan 2040 designates the project site for Low Density Residential land use. On January 20, 2026, the City Council adopted
Ordinance No. 26-01, establishing the City’s pre-zoning designation of Residential, Low Density, which would take effect
upon annexation approval.
Annexation Process
Annexation of property into the City requires authorization by the City Council. If authorized, the proposed annexation is
submitted to the Riverside Local Agency Formation Commission (LAFCO) for review and consideration. LAFCO has the
authority to approve, modify, or deny proposals for annexations and other changes to local agency boundaries. Therefore,
while City Council authorization is required for the City to pursue an annexation, the annexation cannot be completed unless
and until it is approved by LAFCO and all applicable statutory requirements and procedures have been satisfied. The LAFCO
process includes public notice and a hearing before the Commission, at which affected property owners and other members of
the public have an opportunity to provide testimony regarding the proposed annexation. Property owners within the affected
territory are also provided an opportunity to submit written objections and, where applicable, initiate or participate in a protest
proceeding pursuant to State law. Depending on the level of protest received, the annexation may be subject to additional
procedures or an election before it can be completed.
Disadvantaged Unincorporated Community
The project is located within the San Jacinto Disadvantaged Unincorporated Community (DUC) No 2. A DUC is defined by
the State of California as an area of inhabited territory located within an unincorporated area of a County in which the annual
median household income is less than 80 percent of the statewide median income. In accordance with State annexation law,
including the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, annexation proposals must include the
entire DUC area. Annexation A constitutes a portion of the DUC No 2 area. In 2022, the City Council adopted a resolution to
initiate the annexation of 143.62 acres (Annexation B) which constitutes the remainder of the San Jacinto DUC No 2.
Authorization is needed for both Annexation A and B to allow LAFCO consider either application however, Annexation B will
be considered under a separate Agenda Item.
ANALYSIS:
The applicant seeks to develop their property and has opted to process development applications through the City in lieu of the
County of Riverside. The applicant desires to develop the site with single family homes with a density above 3 dwelling units
per acre which is not consistent with the County of Riverside General Plan or Zoning. Annexation of the unincorporated area
into the City of San Jacinto would allow the property to be developed in accordance with the City's General Plan and the
established prezoning. The City’s General Plan designates the site Low Density Residential (LDR), which allows for the
development of single-family dwellings with a density range of 2 to 7 units to the acre. The project site has been prezoned
Residential, Low Density (RL) Zone, which is consistent with the LDR designation and allows the subdivision of land with the
approval of a Tentative Tract Map.
Annexation would provide several benefits to the surrounding community, and the City as a whole, including the elimination
unincorporated County territory located immediately adjacent to incorporated areas of the City. Annexation would also support
the City’s long-term planning efforts and provide local governmental representation to existing and future residents and
property owners within the annexation area. Upon annexation, the City of San Jacinto would assume responsibility for local
governmental and administrative services, including planning and community development, local street maintenance, and
applicable municipal services. Existing service providers would generally remain unchanged, including Riverside County Fire
Department, Riverside County Sheriff ’s Department, Riverside County Library System, Riverside County Animal Services,
Riverside Transit Authority, local utility providers, and the San Jacinto Unified School District. The City would continue
providing water service, while sewer service would be provided consistent with the project’s approved service arrangements.
Lot Line Adjustment
The 43.68-acre property is comprised of two parcels. Parcel A is 7.36 acres, and Parcel B is 36.32 acres. The project proposes
to modify the parcel boundaries in a manner that would increase the size of Parcel A to 41.74 acres and reduce the size of
Parcel B to 1.94 acres. The 1.94-acre area proposed for Parcel B is designed in a manner to encompass an existing residence
and accessory structures, with appropriate setbacks that are consistent with the RL zone. Parcel 1 is proposed to be subdivided
as illustrated in Tentative Tract Map 34271.

The proposed subdivision of the 41.74-acre property would create 151 lots that range in size from 7,215 square feet to 13,044
square feet. In addition, the project includes lettered lots for the development of detention basins, parks, paseos, and landscape
areas. The subdivision has a density of 3.48 dwelling units per acre, which is consistent with the RL Development Standards
and LDR land use designation of the General Plan. The project will ultimately enable the construction of 151 single-family
homes with the approval of a Site Plan & Design Review (SPDR) which will ensure that the placement of the homes conforms
to the setbacks shown on the proposed maps. The proposed subdivision complies with all applicable development standards as
highlighted in the table below.
The Tentative Tract Map is bordered by Ramona Expressway to the north, Alessandro Avenue to the West and Vernon Street to
the east. All three roads are proposed to be improved in a manner consistent with the General Plan Circulation Element, which
designates Ramona Expressway as an Arterial Road with a width of 128 feet, Alessandro Avenue and Vernon Street as a
Collector Road, with a width of 66 feet. On the south side of Ramona Expressway, the developer will be required to dedicate
additional right-of-way, install additional paving, construct curb, gutter, and sidewalk, landscape the parkway, and provide a
Class I Multi Use Trail. In regard to Alessandro Avenue and Vernon Avenue, the developer will be required to dedicate
additional right-of-way, construct curb, gutter and sidewalk, and landscape the parkway. The street improvements will ensure
the project has adequate access and improve vehicular circulation in the area.
Vehicular access to the internal sections of the development will be provided from three new east-west oriented streets (Streets
“A”, Street “E” and Street “G”). Streets A and G are proposed to connect to Alessandro Avenue with Street A located in the
northern half of the property and Street G on the southern end of the property. Street E provides access from Vernon Street on
the east side of the property. The conditions of approval will require dedication of these access roads and all internal streets to
be consistent with the standard for local streets with a 60-foot right-of-way. Specifically, the conditions will also require the
construction of 40-foot-wide asphalt paving, 6-inch curb and gutter 20 feet from centerline, a 10-foot-wide parkway,
landscaping, sidewalk, and streetlights.
A traffic study was prepared for the project to determine whether traffic generated by the proposed subdivision would
adversely affect the level of service at nearby intersections. The traffic study identified two intersections that would be
impacted by the project to a level requiring improvements. Accordingly, the developer is required to install a traffic signal at
the intersection of Ramona Expressway and Alessandro Avenue to address traffic conflicts and provide improved access
control for existing and future residents. In addition, the developer is required to provide a fair-share contribution toward
improvements at the intersection of Vernon Avenue and Main Street.
Drainage/Basin
TTM 34271 includes three drainage facilities, including a combination park and basin in the center of the project site (Lot E), a
combination park and basin at the southeast corner of Ramona Expressway and Alessandro Avenue (Lot A), and a drainage
basin that is located on the northside of Ramona Expressway, northwest of the termination of Vernon Avenue (Lot F). On-site
runoff will be collected and conveyed through the proposed storm drain system and streets to the designated drainage facilities
for treatment and detention prior to discharge. A Preliminary Water Quality Management Plan (WQMP) was submitted for the
project and confirms that the proposed drainage facilities have been sized and located appropriately to serve the development.
A Final WQMP will be required prior to grading and construction to ensure that appropriate water quality facilities and Best
Management Practices are implemented.
Parks and Open Space
The project includes a 2-acre combination park and basin located in the central portion of the site (Lot E), and a 1.48-acre park
and basin that is located directly south of Ramona Expressway (Lot A). Lot A includes the basin at the southeast corner of
Ramona Expressway and Alessandro Avenue, a .57-acre park at the corner of Ramona Expressway and Vernon Avenue, as well
as a 10 foot wide trail that connect the two design features. The proposed 2-acre park/basin will include open turf play fields,
shade structure, tot lot play structure and swings, 1/2 court basketball, picnic tables, 4 park benches, drinking fountain, trash
receptacles and pedestrian walkways.
Other onsite park/open space includes: pocket parks, entry landscaped parklets, and paseo/park trail connections. The project
would be required to pay Development Impact Fees in accordance with the City of San Jacinto Development Fee Schedule. In
addition, the proposed project would be annexed into Community Services District No. 2020-1 to offset the cost of
maintenance for Landscaping and Parks.
Public Comments
Prior to the Planning Commission Hearing, City Staff held a community meeting to discuss Annexation A and B. During the
meeting Staff from Community Development, Engineering and Public Utilities explained the annexation process, each of
the prezones established, development standards, the benefits of the annexation and city services. At the meeting 4 persons
indicated they were in favor of the annexation proposal and no persons indicated they were in opposition. Prior to the Planning
Commission meeting, public notices were mailed and published in the Press Enterprise. During the comment period, one
comment was received in opposition to the proposed annexation. The commenter expressed concerns regarding increased taxes
and fees, additional regulation, infrastructure and public service impacts, potential decreases in property values, and political
and legal consequences.
In response to the concerns raised the following points are noted:
Property Taxes and Fees: Annexation would not affect property taxes for existing properties. As properties develop,
they would be subject to applicable City fees and assessments, including Community Facilities District (CFD)
assessments and Development Impact Fees (DIFs), as required.
Regulations: Although annexation would subject the area to applicable City regulations, legally established uses and
structures permitted by Riverside County would generally be allowed to continue. New development, structures, and
uses would be subject to applicable City requirements.
Infrastructure and Public Services: The City has existing infrastructure and service capabilities to support the
annexation. Annexation would also provide access to municipal services, including Sewer and City-maintained roads.
Property Values: The comment expressed concerns regarding potential negative impacts on property values.
Annexation would bring the area under City jurisdiction, facilitating future development opportunities to be reviewed
under applicable City standards and zoning that are consistent with the General Plan.
Political Representation and Local Decision-Making: Although the area is currently represented by the County, the
City makes many land use and development decisions affecting the area. Annexation would provide affected property
owners with the opportunity to participate in City elections and local government decisions concerning matters that may
affect their properties. The residents would continue to participate in the election of the County Supervisor.
ENVIRONMENTAL ASSESSMENT:
The project has been reviewed in accordance with the California Environmental Quality Act (CEQA) and the State CEQA
guidelines. The City as the lead agency prepared an Initial Study to determine the potential environmental impacts of the
project. The Initial Study evaluated the project based on a total of 152 residential lots, which includes the 151 new residential
lots proposed through TTM 34271 and one existing residential lot containing the existing residence. The existing residence
will remain following the proposed Lot Line Adjustment; therefore, the Initial Study appropriately evaluated the project based
on 152 total residential lots, although only 151 new residential lots are proposed as part of TTM 34271.
The Initial Study and Mitigated Negative Declaration (IS/MND) was circulated for a 30-day public comment period via the
publication of a Notice of Intent on May 13, 2026. In addition to the publication, the IS/MND was submitted to the State
Clearing House for posting (SCH No. 2026050849). One comment was provided. The comment letter was issued by the
Department of Toxic Substances Control (DTSC), outlining DTSC’s recommendations regarding potential contaminants of
concern (COCs). The MND did not identify recognized environmental conditions (RECs) requiring immediate subsurface
investigation. Additional soil sampling was also conducted, and no pesticides or heavy metals were detected in the shallow soil
samples.
The mitigation measures required to reduce or mitigate the impacts of this Project on the environment are included in the
Initial Study and will be made enforceable through the Conditions of Approval for the Project. As a result, it is recommended
that the Planning Commission adopt a Mitigated Negative Declaration for this Project.
CONCLUSION:
The public hearing for this Project was advertised on or before October 10, 2026. Additionally, notices were directly mailed to
property owners within 300 feet of the project site. As of the writing of this report, no other correspondence or comments have
been received.
Based on the analysis contained in this report, staff finds that the proposed annexation, Lot Line Adjustment, and TTM 34271
are consistent with the City’s General Plan, applicable Development Code requirements, and Municipal Code standards,
subject to the recommended Conditions of Approval. The proposed project has also been evaluated pursuant to CEQA, and
staff recommends adoption of the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program.
Staff recommends that the City Council ADOPT Resolution No. 4151 and Resolution No. 4152, recommending that the City
Council authorize proceedings for the annexation of the project site into the City of San Jacinto and to approve the associated
Lot Line Adjustment and TTM 34271, subject to the review and approval of LAFCO and satisfaction of all applicable
requirements.
FISCAL IMPACT:
Based on the estimated revenues and expenditures projected to be generated by the proposed development, the Proposed
Annexation Area would result in a net positive fiscal impact to the City.

A. The Project is consistent with the General Plan and all applicable provisions of
the Municipal Code;
B. The Project will not be detrimental to the public interest, health, safety,
convenience, or welfare of the City.
SECTION 4. SUBDIVISION FINDINGS.
1. The proposed subdivision of land has been found to be consistent with
the Development Code, General Plan, and the San Jacinto Municipal
Code.
The proposed Tentative Tract Map (TTM 34271) is consistent with the San
Jacinto Municipal Code as it was reviewed in accordance with applicable Titles,
including Title 16 & 17. Specifically, TTM 34271 is consistent with the RL
Development Code Standards as discussed within the Staff Report and furthers
the intent of the General Plan by facilitating residential development as planned
within the Low Density Residential Land (LDR) Use Designation. In add ition,
the Project implements the following General Plan goals.
Land Use Goal 2: A City that manages and directs growth so that the
community and its neighborhoods are protected and
enhanced.
Specifically implementing policy 2.1 & 2.2
• The project proposes the subdivision to allow for the future development
of single-family residences to support the growth of the City. The
subdivision will enhance the existing neighborhoods by providing a
development that is consistent with surrounding u ses. Additionally, the
future development would provide open space areas.
2. The tentative map does not propose to divide land, which is subject to a
contract entered into pursuant to the California Land Conservation Act of
1965, or the land is subject to a Land Conservation Act contract but the
resulting parcels following division of the land will be of an adequate size
to sustain their agricultural use.
The project site is not subject to a contract pursuant to the California Land
Conservation Act of 1965 as detailed in the analysis completed through an
Initial Study/Mitigated Negative Declaration. In addition, the projects title report
did not have indication of a Williamson Act Contract.
3. The site is physically suitable for the type and proposed density of
development proposed by the tentative map.
The Project proposes to subdivide the property into 151 single-family lots for
residential use. This type of use is allowed by the Residential, Low Density (RL)
zone. In addition, the subdivision is consistent with the density range of the Low
Density Residential Land Use Designation provided in the applicable land use
and zoning designation. Furthermore, the proposed subdivision will be an
Docusign Envelope ID: 1355B310-D923-8554-804A-B038000BCB87
expansion of existing residential uses located west and south of the project site.
The ultimate development of the project will be served by existing facilities such
as sewer, water, natural gas, and electricity that are available within adjacent
roadways. The site is in close proximity to various parks, and is also within close
proximity of North Mountain Middle School and Rose Salgado Elementary
School.
4. The design of the subdivision and the proposed improvements, with
conditions of approval, are either:
a. Not likely to cause significant environmental damage or
substantially and avoidably injure fish or wildlife or their habitat; or
An Initial Study was prepared for the Project to assess any significant
environmental impacts. The Initial Study determined, based upon
substantial evidence from technical report(s), that no significant impact
to fish or wildlife or their habitat would occur as a result of the proposed
subdivision with the incorporation of mitigation measures. A Mit igation
Monitoring and Reporting Program was prepared as part Initial Study
and will be implemented following the approval of the project.
b. An environmental impact report under which a finding has been
made pursuant to Public Resources Code Section 21081(a)(3) that
specific economic, social, or other considerations make infeasible
mitigation measures or project alternatives identified in the
environmental impact report
The project’s impacts were not significant enough to require the
preparation of an environmental impact report. An Initial Study was
prepared for the Project to assess any significant environmental impacts,
and it was determined that a Mitigated Negative D eclaration is the
appropriate level of environmental document. Therefore, findings
pursuant to Public Resources Code Section 21081(a)(3) are not
necessary.
5. The design of the subdivision of land and the type of improvements are
not likely to cause serious public health problems.
The implementation of the proposed conditions will ensure that the Project will
not be detrimental to the public interest, health, safety, convenience, or welfare
of the City or the future residents of the development. As previously mentioned,
an Initial Study was prepared for the proposed subdivision, which analyzed
items that can cause public health problems such as Air Quality, Hazardous
Materials, and Public Utilities. It was determined through the Initial Study that
with incorporation of mitigation measures, the impacts to public health problems
would be less than significant.
6. The design of the subdivision provides for future passive or natural
heating or cooling opportunities in the subdivision to the extent feasible.
Docusign Envelope ID: 1355B310-D923-8554-804A-B038000BCB87
The design of the subdivision will provide for future passive cooling opportunities
with the implementation of building setbacks, impervious surface requirements,
landscaping requirements, including required street trees, and open space
areas. This can also include configuration to permit orientation of a structure to
take advantage of shade and prevailing breezes. Furthermore, natural heating
opportunities can be provided with orientation of a structure in an east -west
alignment for southern exposure.
The proposed project is a subdivision only; however, subsequent development
will be analyzed and conditioned through a Site Plan and Design Review. As
part of the Site Plan and Design Review process, the Planning Department will
ensure that natural heating and cooling opportunities are explored to the extent
feasible and condition the project accordingly.
7. The design of the subdivision and the type of improvements will not
conflict with easements acquired by the public at large for access through
or use of property within the proposed subdivision, or the design of the
alternate easements which are substantia lly equivalent to those
previously acquired by the public will be provided.
Per the title report provided by the project applicant, the site consists of one
easement for either of both pole lines, conduits or underground facilities and
incidental purposes. As shown in the proposed site plan, the Tract Map as
designed and conditioned will not conflict with these existing easements.
8. The subdivision is consistent with the City’s parkland dedication
requirements (per the Quimby Act), as applicable, in accordance with
Chapter 16.75 (Parkland Dedication and Fees).
The developer will be required to pay Development Impact Fees related to
Parks in accordance with Chapter 16.75 of the Municipal Code, which will
provide future park land, and improvements to parks.
SECTION 5. RECOMMENDATION OF APPROVAL. Based upon the foregoing, the
Planning Commission hereby recommends that the City Council:
A. Adopt the Mitigated Negative Declaration for the Project and adopt and
implement the Mitigation Monitoring and Reporting Program;
B. Authorize the Annexation of 43.68 acres located south of Ramona
Expressway, between Alessandro Avenue and Vernon Avenue ;
C. Approve Tentative Tract Map No. 34 271 to subdivide the property into 151
single-family residential lots and associated lettered lots for roadways,
drainage, parks, and landscape areas, subject to the Conditions of
Approval; and,
D. Approve Lot Line Adjustment 22-01 to reconfigure lot lines; and
Docusign Envelope ID: 1355B310-D923-8554-804A-B038000BCB87
E. Direct staff to file a Notice of Determination in accordance with the California
Environmental Quality Act.
SECT ION 6. RECORD OF PROCEEDINGS. The documents and materials that
constitute the record of proceedings upon which this Resolution is based are located
at the City of San Jacinto, 595 South San Jacinto Avenue, San Jacinto, California
92583. The custodian of the record is the Community Deve lopment Department. This
information is provided pursuant to Public Resources Code Section 21081.6 .
SECTION 7. RECOMMENDATION TO CITY COUNCIL. As the Project includes an
Annexation, final action on the Project rests with the City Council and LAFCO. The

Annexation A (P22-004)
&
Annexation B (P22-084)
Subject: Formal Objection to Proposed Annexation (Case No. P22-004)
To the San Jacinto Planning Commission,
I am writing to formally oppose the proposed annexation identifled as Case No. P22-004. The annexation
would bring approximately 189 acres of currently unincorporated Riverside County land into the City of
San Jacinto's jurisdiction, including approximately 44 acres proposed for a 151-home residential
development.
My opposition is based on the signiflcant and lasting negative impacts this annexation may have on
affected property owners, residents, and businesses.
I purchased my property within this annexation area with the understanding that it was located in
unincorporated Riverside County and would remain subject to Riverside County regulations, services,
land use policies, and taxation. My investment and long-term plans for the property were made based on
those expectations. Annexation into the City of San Jacinto would fundamentally change the governing
authority over my property and could result in additional taxes, fees, permits, regulations, development
restrictions, and municipal requirements that were neither anticipated nor contemplated at the time of
purchase. Property owners should not be forced to accept a substantial change in jurisdiction and
governance that may negatively affect property rights, property values, future development opportunities,
and the character of the community without clear and compelling evidence that the beneflts outweigh
the costs. As a directly affected property owner, I am concerned that this annexation shifts decision-
making authority away from Riverside County and imposes new obligations and uncertainties that could
have long-term consequences for residents and businesses in the affected area.
Higher Taxes, Fees, and Financial Burdens
Annexation will place property owners under a new layer of government with the ability to impose
additional fees, assessments, permit costs, utility charges, and other municipal expenses. While the City
promotes potential beneflts of annexation, there has been insufficient disclosure regarding the actual
flnancial burden that residents and property owners may face. Annexation should not be used as a
mechanism to expand the City's tax and fee base at the expense of current County residents.
Increased Regulation and Loss of Property Rights
Residents currently governed by Riverside County regulations will immediately become subject to City
zoning ordinances, development standards, permitting requirements, and code enforcement practices.
This represents a signiflcant reduction in local property rights and fiexibility. Property owners who
purchased land under County regulations should not have the rules changed simply because the City
desires to expand its boundaries. Many current and future uses of private property may become more
restricted, more expensive, or entirely prohibited.
Loss of County Governance and Replacement with City Control
Property owners will lose the beneflts and protections associated with County governance and become
subject to City policies and regulations. The City has not adequately demonstrated that its oversight,
code enforcement, planning requirements, or administrative processes will provide a clear beneflt that
justifles this transfer of authority. Residents should not be forced into a different form of local
government without compelling justiflcation.
Infrastructure and Public Service Concerns
The proposed annexation and associated residential development will create additional demand on
roads, water systems, sewer infrastructure, drainage facilities, parks, police services, and flre protection.
The City has not clearly demonstrated how these services will be expanded and maintained without
placing additional burdens on existing residents and taxpayers. Growth should not be approved unless
infrastructure is already capable of supporting it or guaranteed funding is in place to prevent existing
residents from subsidizing future development.
Negative Impacts on Property Value and Property Use
The City cannot guarantee that annexation will increase property values. In fact, increased regulation,
higher fees, stricter development standards, and additional compliance requirements may reduce the
desirability and usefulness of affected properties. Property owners should not be forced to accept
uncertainty regarding the future value and use of their land for the beneflt of speculative future
development.
Political and Legal Consequences
Annexation fundamentally changes who makes decisions affecting residents and property owners.
Landowners who are currently represented through County government will become subject to City
Council decisions, municipal ordinances, planning regulations, and future policy changes over which
they currently have no vote or infiuence. This is a substantial political and legal change that should not be
minimized.
Unforeseen Future Consequences
Once annexed, there is no practical way to undo the decision if adverse impacts occur. Future City
Councils may increase fees, adopt more restrictive regulations, alter zoning designations, impose new
development requirements, or expand municipal obligations. Residents are being asked to accept
unknown long-term risks without adequate assurances or protections.
Conclusion
The City has not provided sufficient evidence that the beneflts of annexation outweigh the risks and
burdens imposed on affected property owners. The proposal creates substantial uncertainty regarding
taxes, fees, regulations, property rights, infrastructure demands, governance, and future land use
restrictions.
For these reasons, I strongly urge the Planning Commission to reject the proposed annexation or, at a
minimum, postpone action until a comprehensive analysis of the flnancial, regulatory, legal, and
property-rights impacts has been provided to affected residents and property owners.
Sincerely,
Sean Harrison

Council; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution have
occurred.
NOW THEREFORE, BE IT RESOLVED, determined, and ordered by the City
Council of the City of San Jacinto, California, as follows:
SECTION 1. Based on the record before the City Council, including all written and
oral evidence presented to the City Council, the administrative record of the written and
oral evidence submitted to the Planning Commission, and the findings set forth in the
resolution the Council Authorizes the Annexation of 43.68 acres known as Annexation A.
SECTION 2. Based upon the whole of the record before it, including the Initial
Study and all supporting information, the Planning Commission finds that:
A. The Mitigated Negative Declaration has been prepared in compliance with the
California Environmental Quality Act (CEQA);
B. The Mitigated Negative Declaration reflects the independent judgment of the
City;
C. There is no substantial evidence, in light of the whole record, that the Project,
as mitigated, will have a significant effect on the environment; and
D. The mitigation measures identified in the Mitigated Negative Declaration are
hereby adopted and shall be implemented through the Mitigation Monitoring
and Reporting Program.
SECTION 3. Based upon the entire record, including all written and oral evidence
presented, and the findings set forth in the staff report and incorporated herein by
reference, the City Council finds that:
A. The Project is consistent with the General Plan. Specifically, the project
meets the following Goals and/or Policies.
Resolution No. 4151
Policy LU 2-6 Annexation: Continue to annex land within the City’s Sphere
of Influence to promote compatibility between new and existing uses.
Annexation B area is located within the City’s Sphere of Influence. Annexation
would bring the affected properties within the City’s jurisdiction and allow future
land use decisions to be evaluated under the City’s General Plan, zoning
regulations, and development standards, thereby supporting the policy’s objective
of promoting compatibility between new and existing uses.
Goal LU-1: A community with a land use plan that accommodates a mix of
uses to meet current and future needs.
The proposed annexation is consistent with General Plan Goal LU -1, which seeks
to establish “a community with a land use plan that accommodates a mix of uses to
meet current and future needs.” The annexation area includes a range of existing
uses and is designated for various land uses under the City’s General Plan,
including Low Density Residential, Medium Density Residential, Mixed Use,
Public/Institutional, and Commercial. Annexation would bring the area within the
City’s jurisdiction and allow future land use decisions to be evaluated within the
City’s established planning framework to help accommodate the community’s
current and future needs.
B. The Project will not be detrimental to the public interest, health, safety,
convenience, or welfare of the City.
The annexation would allow the City to provide local governmental services and
ensure that the development occurs in accordance with the City’s planning,
infrastructure, and public service requirements. Public services, including fire
protection, law enforcement, water, and other essential services, would continue
to be provided by the responsible agencies. These provisions would ensure that
the Project is developed in a manner that protects public health , safety, and
welfare.
SECTION 4. The documents and materials that constitute the record of
proceedings upon which this Resolution is based are located at the City of San Jacinto,
595 South San Jacinto Avenue, San Jacinto, California 92583. The custodian of the

authorized and directed to administratively update the maps, figures, exhibits, and other
graphical representations contained within the City of San Jacinto General Plan 2 040,
including its individual elements, as necessary to accurately reflect the revised municipal
boundaries resulting from the annexation.
Resolution No. 4151
Such administrative updates shall be limited to conforming the depicted municipal
boundaries to the legally established boundaries of the City and shall not modify any
adopted General Plan land use designations, policies, goals, objectives, development
standards, or other substantive provisions of the General Plan.
The City Manager, or designee, is further authorized to make corresponding
administrative updates to the City's official maps, geographic information systems,
planning documents, and other applicable records to accurately reflect the completed
annexation.

NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF SAN JACINTO:
SECTION 1. Based on the record before the City Council, including all written and oral
evidence presented to the City Council, the administrative record of the written and oral
evidence submitted to the Planning Commission, and the findings set forth in this
Resolution, the City Council approves Tentative Tract Map 34271 and Lot Line
Adjustment 22-01 subject to the Conditions of Approval and Completion of Annexation
“A” by LAFCO.
SECTION 2. Based upon the whole of the record before it, including the Initial Study
and all supporting information, the Planning Commission finds that:
A. The Mitigated Negative Declaration has been prepared in compliance with
the California Environmental Quality Act (CEQA);
B. The Mitigated Negative Declaration reflects the independent judgment of
the City;
C. There is no substantial evidence, in light of the whole record, that the
Project, as mitigated, will have a significant effect on the environment; and
Subdivision
In addition,
the Project implements the following General Plan goals.
In addition, the project's title report
did not have indication of a Williamson Act Contract.
3. The site is physically suitable for the type and proposed density of
development proposed by the tentative map.
The Project proposes to subdivide the property into 151 single -family lots for
residential use. This type of use is allowed by the Residential, Low Density (RL)
zone. In addition, the subdivision is consistent with the density range of the Low
Density Residential Land Use Designation provided in the applicable land use
and zoning designation. Furthermore, the proposed subdivision will be an
expansion of existing residential uses located west and south of the project site.
The ultimate development of the project will be served by existing facilities such
as sewer, water, natural gas, and electricity that are available within adjacent
roadways. The site is in close proximity to various parks and is also within close
Page 4 of 7
proximity of North Mountain Middle School and Rose Salgado Elementary
School.
A Mitigation
Monitoring and Reporting Program was prepared as part Initial Study
and will be implemented following the approval of the project.
b. An environmental impact report under which a finding has been
made pursuant to Public Resources Code Section 21081(a)(3) that
specific economic, social, or other considerations make infeasible
mitigation measures or project alternatives identified in the
environmental impact report.
The project’s impacts were not significant enough to require the
preparation of an environmental impact report. An Initial Study was
prepared for the Project to assess any significant environmental impacts,
and it was determined that a Mitigated Negative Declaration is the
appropriate level of environmental document.
The design of the subdivision will provide for future passive cooling opportunities
with the implementation of building setbacks, impervious surface requirements,
landscaping requirements, including required street trees, and open space
areas. This can also include configuration to permit orientation of a structure to
Page 5 of 7
take advantage of shade and prevailing breezes.
7. The design of the subdivision and the type of improvements will not
conflict with easements acquired by the public at large for access through
or use of property within the proposed subdivision, or the design of the
alternate easements which are substantially equivalent to those
previously acquired by the public will be provided.
Per the title report provided by the project applicant, the site consists of one
easement for either of both pole lines, conduits, or underground facilities and
incidental purposes. As shown in the proposed site plan, the Tract Map, as
designed and conditioned, will not conflict with these existing easements.
Lot Line Adjustment
1. All original lots involved were legally created or are conforming lots.
The two lots involved were legally created as documented in the record of survey.
2. The adjustment does not create a greater number of parcels than originally
existed; the adjustment does not delete any parcels.
There are two existing lots, and two lots will remain after the lot line adjustment.
3. The resulting lot(s) conform with the city's general plan, development code,
and adopted building codes.
The proposed lots conform to the General Plan, Development Code , and Building
Codes.
4. The adjustment does not cause existing uses of the property to be out of
compliance with any provisions of the municipal code.
The existing residence will be in compliance with the municipal code.
SECTION 4. The documents and materials that constitute the record of proceedings upon
which this Resolution is based are located at the City of San Jacinto, 595 South San
Jacinto Avenue, San Jacinto, California 92583. The custodian of the record is the City
Clerk. This information is provided pursuant to Public Resources Code Section 21081.6.
Section 5. Severability. If any provision of this Resolution or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Resolution which can be given effect without the invalid provision
or application, and to this end the provisions of this Resolution are severable. The City
Council hereby declares that it would have adopted this Resolution irrespective of the
invalidity of any particular portion thereof.

BY:Travis Randel, Interim City Manager
SUBJECT:Annexation of 143.62 Acres into the City of San Jacinto (Annexation B) (P22-084)
RECOMMENDATION:
The Planning Commission recommends that the City Council:
1. DETERMINE pursuant to the California Code of Regulations the project is exempt from CEQA as the project is
consistent with the General Plan policies for which an EIR was certified, CEQA Guidelines Section 15183; and
2. ADOPT Resolution No. 4153 to AUTHORIZE the Annexation of 143.62 acres within the City’s Sphere of Influence
(P22-084).
DISCUSSION:
On September 22, 2026, the Planning Commission, after holding a Public Hearing, adopted PC Resolution No. 26-04,
recommending that the City Council Authorize the Annexation of 143.62 Acres (Annexation B) into the City of San Jacinto
(P22-084).
Annexation B is generally located south of Bergin Street, north of Artesia Street, east of San Jacinto Avenue, and west of
Vernon Avenue. The project site is currently occupied by single family residences, agricultural businesses, outdoor storage
operations, and a number of accessory structures. In addition, several vacant parcels exists within the annexation area. The
project is located within the City’s Sphere of Influence (SOI). An SOI is a planning boundary outside of the City’s legal limits
that may reasonably be expected to be annexed into a City. SOI's are intended to ensure the efficient provision of services,
discourage urban sprawl, and prevent premature conversion of agricultural and open space lands. Although properties within
the City’s SOI are identified in the City’s General Plan, properties remain subject to Riverside County’s land use regulations
until they are annexed into the City.
Annexation B was initiated by the City Council in 2022, after the City of San Jacinto received a proposal by
Cornell Kasbergen to Annex two parcels totaling 43.68 acres into the City of San Jacinto (Annexation A) which is directly
adjacent to project. That proposal included an application to subdivide a portion of the area into 151 lots for the development
of single-family homes. Annexation A and B are located within the San Jacinto Disadvantaged Unincorporated Community
(DUC) No 2. A DUC is defined by the State of California as an area of inhabited territory located within an unincorporated
area of a County in which the annual median household income is less than 80 percent of the statewide median income. In
accordance with State annexation law, including the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000,
annexation proposals must include the entire DUC area. Annexation A constitutes a portion of the DUC No 2 area. The
proposed project constitutes the remainder of the San Jacinto DUC No 2. Authorization is needed for both Annexation A and B
to allow LAFCO consider either application.
General Plan & Zoning
The County of Riverside has four General Plan designations within the annexation area which includes, Rural Residential,
Rural Community – Low Density Residential, Agriculture, and Medium Density Residential. County Zoning within the
annexation area includes 6 zones: Agriculture-1-5 (A-1-5), Agriculture-2 (A-2), Agriculture-2-10 (A-2-10), Residential-
Agriculture (R-A), Residential 3 (R-3) Residential-1 (R-1). In many cases the County Zoning is not consistent with the County
General Plan which can create ambiguity and complicates planning entitlements.
In 2022, General Plan 2040 was adopted by the City Council, which designated properties within the annexation area as Low
Density Residential (LDR), Medium Density Residential (MDR), Mixed Use (MU), Public/Institutional (PI), and Commercial
(C). In January of 2026, the City Council approved Ordinance 26-01 to establish prezoning for the Annexation Area. The
prezones include: Residential, Low Density (RL); Residential, Medium Density (RM); Mixed Use (MU); and Public
Institutional (PI). Each of the zones are consistent with the corresponding General Plan Land Use Designations, which
provides certainty for developers and property owners. If the annexation is completed, the established prezones would
automatically go into effect.
The LAFCO process includes public notice and a hearing before the Commission, at which affected property owners and other
members of the public have an opportunity to provide testimony regarding the proposed annexation. Property owners within
the affected territory are also provided an opportunity to submit written objections and, where applicable, initiate or participate
in a protest proceeding pursuant to State law. Depending on the level of protest received, the annexation may be subject to
additional procedures or an election before it can be completed. Accordingly, City Council approval does not guarantee that a
proposed annexation will ultimately be approved or completed, as the proposal remains subject to LAFCO review, public
participation, and any applicable protest proceedings.
ANALYSIS:
The project is consistent with the General Plan and the City's long-term planning objectives. Annexation of this unincorporated
area into the City of San Jacinto would provide several benefits to the affected properties, surrounding community, and the
City as a whole. Annexation would eliminate pockets of unincorporated County territory that are surrounded by, or located
immediately adjacent to, incorporated areas of the City. Annexation would also support the City’s long-term planning efforts
and provide local governmental representation to residents and property owners within the annexation area.
Annexation would facilitate properties connecting to City sewer services and allow future infrastructure and public
improvements to be considered as part of the City's broader Capital Improvement Program. It would also allow future
development and land use changes to be evaluated in conjunction with existing and planned development and infrastructure in
surrounding areas. Upon annexation, the City of San Jacinto would assume responsibility for local governmental and
administrative services, including planning and community development, local street maintenance, and applicable municipal
services. Existing service providers would generally remain unchanged, including Riverside County Fire Department,
Riverside County Sheriff ’s Department, Riverside County Library System, Riverside County Animal Services, Riverside
Transit Authority, local utility providers, and the San Jacinto Unified School District. The City provides water service to the
area which would remain unchanged.
The project has been reviewed in accordance with the California Environmental Quality Act (“CEQA”) and the State CEQA
Guidelines. The City of San Jacinto, as the lead agency, evaluated the proposed annexation, including the City's adopted
General Plan land use designations and pre-zoning for the annexation area.
The proposed annexation is consistent with the City's General Plan and the pre-zoning classifications adopted for the
annexation area. The City's General Plan land use designations for the area include Low Density Residential (LDR), Medium
Density Residential (MDR), Mixed Use (MU), Public/Institutional (PI), and Commercial (C). The corresponding pre-zoning
classifications adopted by the City are Residential, Low Density (RL); Residential, Medium Density (RM); Mixed Use (MU);
and Public Institutional (PI). The proposed pre-zoning classifications are consistent with the City's General Plan land use
designations.
The City's General Plan and associated environmental impact report previously evaluated the potential environmental effects
associated with the City's planned growth, land use patterns, development capacity, infrastructure, public services,
transportation, and other environmental considerations. The proposed annexation would place the affected properties within
the City's jurisdiction and implement the land use framework established by the City's General Plan and pre-zoning.
Based on the City's review, Annexation B is consistent with the General Plan for which an environmental impact report was
previously certified. Therefore, the project qualifies for the exemption provided under Section 15183 of the CEQA Guidelines,
which applies to projects that are consistent with a general plan for which an environmental impact report has previously been
certified. Section 15183 allows additional environmental review to be limited to potentially significant effects that are peculiar
to the project or site, or other effects not adequately addressed in the prior environmental document.
The City determined that the proposed annexation does not result in new or substantially more severe environmental effects
than those previously analyzed in the certified General Plan Environmental Impact Report. The annexation would not establish
a new land use framework beyond the General Plan designations and pre-zoning adopted for the area. Accordingly, no
additional environmental review beyond the applicable Section 15183 exemption is required for the proposed annexation.
Following City action, the proposed annexation would be submitted to the Riverside Local Agency Formation Commission
(LAFCO) for consideration.
CONCLUSION:
The public hearing for this Project was advertised on or before October 10, 2026. Additionally, notices were directly mailed to
property owners within 300 feet of the project site. As of the writing of this report, no other correspondence or comments have
been received.
The proposed Annexation B, consisting of 92 parcels totaling approximately 143.62 acres, is consistent with the City's General
Plan, adopted pre-zoning, Sphere of Influence, and long-term planning objectives. The proposed annexation would establish a
more logical and contiguous municipal boundary, provide a consistent land use planning framework, and allow the affected
area to be incorporated into the City's local governmental structure. As discussed in this report, certain local governmental and
municipal services would transition to the City upon completion of the annexation, while other services would continue to be
provided by existing regional agencies and service providers.
Accordingly, the Planning Commission recommends that the City Council authorize the initiation of proceedings with the
Riverside Local Agency Formation Commission (LAFCO) for the annexation of 92 parcels totaling approximately 143.62
acres (Annexation B).
FISCAL IMPACT:
A fiscal impact analysis was prepared by the City to analyze the impact the project would have on the City of San Jacinto
General Fund. Based on the estimated revenues and expenditures projected to be generated by development in accordance with
General Plan 2040, future development within the Proposed Annexation Area would result in a net positive fiscal impact to the
City.

NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING COMMISSION OF
THE CITY OF SAN JACINTO:
SECTION 1. Recitals. The foregoing recitals are true and correct and are incorporated
herein by reference.
SECTION 2. Environmental Determination. Based upon the whole of the record before
it, including the Initial Study and all supporting information, the Planning Commission finds
that pursuant to the California Code of Regulations the project is exempt from CEQA as
the project is consistent with the General Plan policies for which an EIR was certified,
CEQA Guidelines Section 15183.
The City's General Plan and associated environmental impact report previously evaluated
the potential environmental effects associated with the City's planned growth, land use
patterns, development capacity, infrastructure, public services, transportation, and other
environmental considerations. The proposed annexation would place the affected
properties within the City's jurisdiction and implement the land use framework established
by the City's General Plan and pre-zoning.
Based on the City's review, Annexation B is consistent with the General Plan for which
an environmental impact report was previously certified. Therefore, the project qualifies
for the exemption provided under Section 15183 of the CEQA Guidelines, which ap plies
to projects that are consistent with a general plan for which an environmental impact
report has previously been certified. Section 15183 allows additional environmental
review to be limited to potentially significant effects that are peculiar to the project or site,
or other effects not adequately addressed in the prior environmental document.
SECTION 3. Findings. Based upon the entire record, including all written and oral
evidence presented, and the findings set forth in the staff report and incorporated herein
by reference, the Planning Commission finds that:
A. The Project is consistent with the General Plan and all applicable provisions of the
Municipal Code;
B. The Project will not be detrimental to the public interest, health, safety,
convenience, or welfare of the City.

Environmental Quality Act.
SECTION 5. Record of proceedings. The documents and materials that constitute the
record of proceedings upon which this Resolution is based are located at the City of San
Jacinto, 595 South San Jacinto Avenue, San Jacinto, California 92583. The custodian of
the record is the Community Development Department. This information is provided
pursuant to Public Resources Code Section 21081.6.
SECTION 6. Recommendation to City Council. As the Project includes an Annexation,
final action on the Project rests with the City Council and LAFCO. The Planning

WHEREAS, on October 20, 2026, this resolution was fully considered by the City
Council; and
WHEREAS, all other legal prerequisites to the adoption of this Resolution have
occurred.
NOW THEREFORE, BE IT RESOLVED, determined, and ordered by the City
Council of the City of San Jacinto, California, as follows:
SECTION 1. Based on the record before the City Council, including all written and
oral evidence presented to the City Council, the administrative record of the written and
oral evidence submitted to the Planning Commission, and the findings set forth in the
resolution the Council Authorizes the Annexation of 146.32 acres.
SECTION 2. Based upon the whole of the record before it, the City Council finds
that pursuant to the California Code of Regulations the project is exempt from CEQA as
the project is consistent with the General Plan policies for which an EIR was certified,
CEQA Guidelines Section 15183.
Therefore, the project qualifies
for the exemption provided under Section 15183 of the CEQA Guidelines, which applies
to projects that are consistent with a general plan for which an environmental impact
report has previously been certified. Section 15183 allows additional environmental
review to be limited to potentially significant effects that are peculiar to the project or site,
or other effects not adequately addressed in the prior environmental document. The
project does not include any development or construction and therefore no additional
environmental effects have been identified.
Resolution No. 4153
SECTION 3. Based upon the entire record, including all written and oral evidence
presented, and the findings set forth in the staff report and incorporated herein by
reference, the City Council finds that:
A. The Project is consistent with the General Plan. Specifically, the project meets the
following Goals and/or Policies.
Public services, including fire
protection, law enforcement, water, and other essential services, would continue
to be provided by the responsible agencies . These provisions would ensure that
the Project is developed in a manner that protects public health, safety, and
welfare.
SECTION 4. The documents and materials that constitute the record of
proceedings upon which this Resolution is based are located at the City of San Jacinto,
595 South San Jacinto Avenue, San Jacinto, California 92583. The custodian of the
record is the City Clerk. This information is provided pursuant to Public Resources Code
Section 21081.6.

SECTION 5. Administrative Updates to General Plan Exhibits and Official City
Maps. Upon the effective date of the annexation, the City Manager, or designee, is hereby
authorized and directed to administratively update the maps, figures, exhibits, and other
graphical representations contained within the City of San Jacinto General Plan 20 40,
including its individual elements, as necessary to accurately reflect the revised municipal
boundaries resulting from the annexation.
Such administrative updates shall be limited to conforming the depicted municipal
boundaries to the legally established boundaries of the City and shall not modify any
adopted General Plan land use designations, policies, goals, objectives, development
standards, or other substantive provisions of the General Plan.
The City Manager, or designee, is further authorized to make corresponding
administrative updates to the City's official maps, geographic information systems,
planning documents, and other applicable records to accurately reflect the completed
annexation.
Any proposed modification that would constitute a substantive amendment to the General
Plan shall be processed separately in accordance with applicable provisions of state law.
