Section 7. CEQA Compliance. The City has determined that approval of the Purchase and Sale Agreement, along with the proposed rehabilitation work, is not a project subject to environmental review pursuant to the California Environmental Quality Act of 1970 (CEQA), as amended, and the Guidelines promulgated thereunder. Specifically, the City’s approval of the Purchase and Sale Agreement, combined with the planned rehabilitation activities, is determined to be exempt from CEQA review under several applicable exemptions including, among other things, the following: Existing Facilities Exemption (State CEQA Guidelines § 15301) - The Project involves negligible or no expansion of use beyond that existing at the time of the City's determination. The Property is currently used for industrial purposes, specifically for storage and warehousing. The proposed rehabilitation work, including new fencing, paving, landscaping, security enhancements, minor interior remodeling, and electrical and mechanical upgrades, are all activities that fall under the category of operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving Docusign Envelope ID: 0690D69A-4E94-408E-AADE-76BC0F796937 Resolution No. 4040 Page 3 of 5 negligible or no expansion of existing or former use. Therefore, the Project qualifies for this exemption as it involves the continuation of the existing industrial use with minor improvements. Replacement or Reconstruction Exemption (State CEQA Guidelines § 15302) - This exemption covers the replacement or reconstruction of existing structures and facilities where the new structures will be located on the same site and have substantially the same purpose and capacity as the structures replaced. The proposed paving and minor interior remodeling constitute the replacement and upgrading of existing facilities without altering their use or capacity. The improvements aim to enhance the functionality and safety of the Property while maintaining its current use for storage and warehousing, ensuring that the overall purpose and capacity remain unchanged. Minor Alterations to Land Exemption (State CEQA Guidelines § 15304) - The new fencing, landscaping, and paving are considered minor public or private alterations in the condition of land, water, and/or vegetation which do not involve the removal of healthy, mature, scenic trees. These activities are minimal in nature and involve changes that do not significantly affect the topography or existing natural conditions of the Property. The landscaping improvements, for instance, will enhance the visual appeal of the Property without impacting any significant environmental resources. Small Structures Exemption (State CEQA Guidelines § 15303) - The installation of new security cameras and sensors, as well as minor electrical and mechanical upgrades, falls under this exemption for new construction or conversion of small structures. These improvements are small in scale and involve the addition of equipment that will enhance the security and operational efficiency of the Property without introducing any substantial environmental impacts. The minor electrical and mechanical upgrades are aimed at improving the existing infrastructure without significant alterations to the Property. Common Sense Exemption (State CEQA Guidelines § 15061(b)(3)) – Further, this exemption applies as it can be seen with certainty that the proposed activities have no potential to result in significant environmental effects. The acquisition and intended use of the Property for storage and warehouse purposes, along with the outlined rehabilitation work, will not change the basic use of the Property or introduce any new significant environmental impacts. The activities involved are straightforward improvements and upgrades that do not expand the footprint or capacity of the existing facilities in a manner that would create significant effects. The acquisition and proposed rehabilitation work, including the expansion of the existing corporate yard, are determined to be exempt from CEQA review based on the above exemptions, ensuring that the Project has no significant environmental impacts.
