Johnson, City Manager SUBJECT: Supplemental Appropriation for LLPD2 Zone 76 RECOMMENDATION: Staff recommends that the City Council appropriate $32,429 in account 376 -8831-500-3405 (LLPD2 Zone 76 - Contract Services) for the replacement of two damaged CalSense Controllers. BACKGROUND: Since the early 2000s, the City has required that parks and city landscaping be equipped with CalSense irrigation controllers. These controllers allow for the remote operation of irrigation systems, and automatically adjust irrigation levels based on weather forecasts, resulting in healthier field turf, and financial savings due to water conservation. On February 27, 2024, at 9:00 pm, Public Utilities on-call staff responded to a hit and run call from the Riverside County Sheriff’s Deputies responding to a vehicle collision at Millet Park (also known as LLPD2 Zone 76). As a result of the collision, two of the City’s CalSense controllers were destroyed. The CalSense controllers need to be replaced to avoid damage to the field turf from the lack of irrigation. The approved budget for Zone 76 did not include the replacement of these controllers prior to the accident as they were in good working order. LLPD2 regulations require that funds spent in an LLPD2 zone must be connected directly to specific projects (e.g., playground replacement, turf maintenance, concrete replacement). Since replacing the Calsense controllers are not specifically authorized in the FY2023-2024 budget, the Zone requires an additional appropriation to proceed. Staff obtained quotes for the purchase and installation of a replacement CalSense controller. The cost breakdown is as follows: Purchase of CalSense (CS3000) controllers $21,035.00 Tax @ 8.75% $1,840.56 Installation of CalSense controllers* $5,323.19 Construction Contingency (15%) $4,229.81 TOTAL $32,428.56 *Installation includes labor to trench 25ft, resplice all 80+ station wires from washout, install sleeves for new double Y CalSense controller, form, pour, and finish concrete pedestal, install the controller, and reconnect all station/electrical wires 3.A.6 Packet Pg. 72 FISCAL IMPACT: Approval of this item has no impact on the General Fund. Johnson, City Manager SUBJECT: Ordinance No. 24-06. An Ordinance Adding Chapter 9.46 to Title 9 of the San Jacinto Municipal Code E RECOMMENDATION: Staff recommends that the City Council conduct a first reading by title only of Ordinance No. 24-06: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, ADDING CHAPTER 9.46 (UNLAWFUL POSSESSION OF A CATALYTIC CONVERTER PROHIBITED) TO TITLE 9 (PUBLIC PEACE, MORALS, AND WELFARE) OF THE SAN JACINTO MUNICIPAL CODE, ESTABLISHING REGULATIONS PROHIBITING THE UNLAWFUL POSSESSION OF CATALYTIC CONVERTERS IN THE CITY. DISCUSSION: Catalytic converters are an external component of a vehicle, accessible from the underside of a parked car. They convert most of a vehicle’s emissions into less harmful forms, improving air quality and vehicle performance. As part of their construction, catalytic converters contain valuable materials such as platinum and palladium, rare metals that command ever-increasing prices on the recyclables market. Catalytic converter thefts are on the rise because individuals are incentivized to commit catalytic converter thefts for multiple reasons. These reasons include (1) the ease and undetectable nature of committing such thefts, potentially in a matter of seconds and through the use of common tools such as a reciprocating saw; (2) the ability to recycle catalytic converters at scrap metal yards for high dollar returns ranging from $200 to $1,200 per catalytic converter; and (3) loopholes in legislation protecting criminals from prosecution unless a victim can be identified. There is currently no City of San Jacinto (“City”) legislation applicable within the City of San Jacinto to directly define and punish catalytic converter thefts absent an identifiable victim. Additionally, there is currently no City, State, or Federal legislation applicable within the City of San Jacinto requiring individuals to provide proof to law enforcement as to how they obtained catalytic converters in their possession. This limits law enforcement’s ability to (1) protect the public by preventing catalytic converter thefts and (2) seize suspected stolen catalytic converters when there is no identifiable victim present. As a result, preventing and punishing these crimes at present is nearly impossible due to the ease and speed with which catalytic converter thefts can be committed and the difficulty of tracing a particular catalytic converter back to its prior owner (the victim), because catalytic converters typically have no identifying markers. 3.A.7 Packet Pg. 78 The Legislature has enacted, and the Governor has signed into law, Senate Bill (SB) 1087 and Assembly Bill (AB) 1740, which generally prohibit (1) individuals from purchasing a used catalytic converter from anyone other than certain specified sellers, including automobile dismantlers, automotive repair dealers, or an individual possessing documentation, as specified, that they are the lawful owner of the catalytic converter; and (2) requires core recyclers to keep a detailed written record, including the year, make, and model of the car from which a catalytic converter was removed, as well as a copy of the vehicle’s title, prior to purchasing a catalytic converter from a seller. The Legislature has not expressed its intent, whether explicitly or impliedly, to occupy the field of catalytic converter theft legislation. Pursuant to Article XI, Section 7 of the California Constitution, the City has broad discretionary power to make and enforce within its limits all local, police, sanitary, and other ordinances and regulations not in conflict with general laws. Individuals in possession of stolen catalytic converters are able to recycle them for substantial profit at relatively low risk, while victims are forced to commit to costly repairs. By criminalizing the mere possession of an unattached catalytic converter absent proof of ownership or lawful possession, this ordinance would combat this criminal practice by: (1) achieving deterrence by establishing zero-tolerance for catalytic converter thefts; (2) establishing sanctions for possessing stolen catalytic converters; (3) prohibiting the falsification of information in documents and records used to verify ownership or lawful possession of a catalytic converter; (4) preventing criminals from profiting from the sale and recycling of stolen catalytic converters; (5) providing indirect justice to the victims of catalytic converter theft cases that have gone or will go unsolved for the reasons discussed above; and (6) minimizing the fiscal and personnel impact on the City of San Jacinto and the Riverside County Sheriff’s Department by reducing the time invested in deterring and investigating catalytic converter thefts. By implementing the attached Ordinance, the City will prohibit the unlawful possession of catalytic converters in the City, discouraging this increasingly-common criminal activity. The City will further prohibit the falsification of information in documents and records used to verify ownership or lawful possession of a catalytic converter. FISCAL IMPACT: None. An Ordinance Adding Chapter 9.46 to Title 9 of the San March 19, 2024 TO: City Council REQUESTED BY: Stuart McKibbin, City Engineer APPROVED BY: Robert A. Johnson, City Manager SUBJECT: AD2003-1, 2023 Maintenance Cycle RECOMMENDATION: Staff recommends the City Council take the following actions: 1. APPROVE the plans and specifications for the AD 2003-1, 2023 MAINTENANCE CYCLE Project; 2. REJECT the bid protest of VSS International, Inc. as meritless; 3. AWARD the construction contract to the lowest responsible bidder submitting a responsive bid, American Asphalt South, Inc., for the sum of $2,495,489.60; 4. APPROPRIATE funding for the maintenance projects in the various zone Funds; 5. ALLOCATE 10% of the total bid for each bid schedule for administration, inspection, and testing; 6. ALLOCATE 10% of the total bid for each bid schedule for construction contingencies; 7. AUTHORIZE the City Manager to execute the construction contract. BACKGROUND: The Assessment District was formed in 2003 (AD2003-1) to collect revenue through property tax assessments on an annual basis for street improvements within the boundaries of AD2003 -1. The cost of street improvements inside the boundaries rises on an annual basis and collecting enough revenue to make improvements of a significant nature typically takes two to three years. The road sections selected are based on the Pavement Condition Index (PCI) of the streets and are selected from the lowest PCI areas first. Roughly, 25 street miles of improvements will be made this year on approximately 24 road segments inside AD2003-1. The general work for AD 2003-1, 2023 MAINTENANCE CYCLE project (the “Project”) is twenty-four physically separated residential tracts across the City of San Jacinto (the “City”). The locations shown in the plans will require various methods of maintenance, including application of slurry seal, grind and overlay of asphalt concrete, full depth removal and replacement of asphalt concrete and aggregate base, and the removal and replacement of damaged concrete sidewalks, curbs, and gutters. As part of the work, the Contractor shall furnish all labor, technical and professional services, supervision, materials, equipment, tools, and incidentals as required by the plans, specifications, and contract documents. Each of the twenty-four tracts has its own maintenance fund and consists of the following: 4.1 Packet Pg. 86 Zone 1) TR-28858 Zone 7) TR-29917 Zone 14) TR-30335 Zone 21) TR-32155 Zone 2) TR-30644 Zone 9) TR-30944 Zone 15) TR-32352 Zone 33) TR-32499 Zone 3) TR-30878 Zone 10) TR-30462 Zone 16) TR-31097 Zone 35) TR-31701 Zone 4) TR-31035 Zone 11) TR-31037 Zone 17) TR-31246/TR-33106 Zone 36) TR-32518 Zone 5) TR-29859 Zone 12) TR-30481 Zone 18) TR-31794 Zone 37) TR-33693 Zone 6) TR-31036 Zone 13) TR-30603 Zone 20) TR-30942/TR-31296 Zone 39) TR-31886 DISCUSSION: The City advertised the Notice Inviting Bids for the Project online in Planet-Bids on January 31, 2024, and in The Press-Enterprise on February 6, 2024. On March 6, 2024, the City received four bids ranging from $2,495,489.60 to $3,298,276.12, American Asphalt South, Inc. (“American Asphalt”) submitted the lowest bid in the amount of $2,495,489.60. The following is a summary of the bid results: • American Asphalt South, Inc. - $2,495,489.60 • VSS International, Inc. - $2,820,120.00 • All American Asphalt - $3,129,894.46 • Pavement Coatings Co. - $3,298,276.12 VSS International, Inc. (“VSS”) submitted to the City a formal bid protest letter dated March 8, 2024, alleging that American Asphalt should be deemed non-responsible due to American Asphalt’s failure to properly answer the question on Public Contract Code Section 10162 Questionnaire (“VSS Bid Protest”). A copy of the VSS Bid Protest is attached to this staff report. A copy of the City Bid Protest Response to VSS, dated March 12, 2024, is attached to this staff report, and incorporated herein by reference. A “responsible bidder” means a bidder that has demonstrated the attribute of trustworthiness, as well as quality, fitness, capacity, and experience to satisfactorily perform the public works contract. (Pub. Cont. Code, § 1103.) The City has the discretion to determine whether a particular bidder is sufficiently qualified to perform the work based on the qualifications presented by the bidder. American Asphalt has performed work satisfactorily for the City before, and engineering staff contacted American Asphalt’s references. These agencies are all satisfied with American Asphalt’s work. After a review of American Asphalt’s bid and supporting documentation, staff considers American Asphalt a responsible bidder. As such, City staff recommends the City Council reject VSS’s protest that American South is not a responsible bidder and award the construction contract to the lowest responsible bidder submitting a responsive bid - American Asphalt. FISCAL IMPACT: Project costs will be paid with funds from the appropriate Assessment District #2003-1 zones. No general funds will be used. In the case of not enough funding in some of these zones, the planned work will be re-scoped or delayed until funding is sufficient. 4.1 Packet Pg. 87 ATTACHMENTS: Bid Protest Letter from VSS International, Inc.
