Johnson, City Manager SUBJECT: Designation of Applicant’s Agent Resolution for Non-State Agencies RECOMMENDATION: Approve Resolution No. 3793, Designation of Applicant’s Agent Resolution for Non-State Agencies and designate the City Manager, Deputy City Manager and City Clerk as the City’s authorized agents. DISCUSSION: The California Office of Emergency Services requires that non-state agencies such as the City of San Jacinto submit a Cal-OES Form 130 every three years. The Form documents the City Council’s authorization of an agent to act on behalf of the City for purposes of receiving disaster assistance from state and federal agencies, including FEMA. Approving the Form now will enable the City to efficiently apply for and request public assistance as the need arises. The Form will be applicable to the COVID-19 emergency, as well as any other disaster over the next three years. Staff is proposing that the City Council designate the City Manager, the Deputy City Manager and City Clerk as the City’s authorized agents. FISCAL IMPACT: There is no fiscal impact for approving the resolution. Designating an authorized agent may ultimately have a positive fiscal impact because it will enable the City to request public assistance from federal and state agencies to seek recovery of costs related to the COVID -19 emergency. Johnson, City Manager SUBJECT: City Seal RECOMMENDATION: Staff recommends that the City Council review and approve the proposed City Seal, and adopt as the official City Seal of the City of San Jacinto. DISCUSSION: On May 10, 2019, the City Council announced a public design contest, which ran through June 2, 2019, for the creation of an official City Seal. The goal was to provide San Jacinto residents the opportunity to submit ideas to update the City Seal with a more current image. The Cit y Seal would then be used on letterhead, documents, employee business cards, on-line webpages and the City’s social media platform, vehicles, clothing, and other paraphernalia to promote the City. The submission contract signed by the entrants addressed that the entries were to take into consideration the following: important local events, geography, assets, history, and goals and aspirations of the City. The hope was that the Seal would become a symbol that best represents San Jacinto’s past, present, and future. The entrants gave the City the irrevocable and exclusive right to use the design as its official Seal in any capacity the City sees fit. Citizens should not have felt reluctant to submit entries based on artistic talents. Judging was based on originality, design, and content. The final artwork to prepare the S eal for formal use was to be administered by the City. During the August 7th, 2019 council meeting, the City Council declared the Seal design submitted by Irasema (Edee) Gaviria as the winner of the contest. The other design was submitted by her husband Richard Graviria. Pictured here is the Seal design submitted by Edee Graviria that depicts the Estudillo Mansion, North Mountain with the “S” illuminated, an agriculture field, and a representation of Native Americans to honor the Soboba Band of Luiseno Indian Tribe. 4.1 Packet Pg. 99 BACKGROUND: During the presentation and review the design submittals, the City Council directed the City Manager to make artistic and refined a djustments to the submittal to create a more representative Seal for the Cit y. The images representing the Soboba Band of Luiseno Indian Tribe were to be shared and agreed upon by the Tribe, in its sole discretion. The City Manager met with Tribal Administrator Michael Castello, who shared the submittal with the Tribal Council. The Tribal Council reviewed the image and determined that it was not a proper representation of the Soboba Band of Luiseño Indians, and provided the City with an approved image. Pictured here is the final draft of The City Seal being presented to the City Council. The City Manager followed Council’s direction and assigned Assistant to the City Manager Cynthia Espinosa as lead on the project. After many hours of work with the City’s graphic artist, the City Manager presents this to Council for approval as the new City Seal. The City Council liked the quadrant design, and with a unique design the quadrants were kept. The City Council also liked the four elements of North Mountain with the “S”, the Estudillo Mansion, the agriculture fields, and a representation of the Soboba Band that they would submit to represent them. To create a timeless, classic City Seal look and feel, the mountains were enhanced to be able to depict the “S” on it more bold and clear, and its peaks were made more visible. The Estudillo Mansion was expanded and turned at an angle to add a blazing sun shining on it. The agriculture field is adorned with a barn and windmill. The Soboba Tribal Council approved logo was placed into the seal, so that the entire image is visible, as well as using the same feathers on the outer ring as the Tribal logo on the Seal. The changes made to the revised final Seal creates an official City Seal that stands the test of time, is timeless and a classic representation of a City Seal. The City Manager believes that it feels like San Jacinto and represents who we are past, present, and into the future. It enhances what we are and produces a professional forward looking, historical representation of San Jacinto. 4.1 Packet Pg. 100 The Cit y Seal would be phased in for use on letterhead, documents, employee/elected business cards, on-line webpages and the City’s social media platform, vehicles, clothing, and other City paraphernalia. The phase in is so as not to create a financial burden on the City by replacing all materials at the same time. It would not replace the San Jacinto logo, but would complement and enhance it. Where appropriate, both the City Seal and the City Logo would be used so as not to confuse the public and/or other local or regional organizations and agencies. Staff recommends that the City Council approve the proposed City Seal, and adopt as the official City Seal of San Jacinto. FISCAL IMPACT: The new seal, if approved, is not intended to create a fiscal impact to the City’s budget. As items are ordered, the new seal would be added to them in replacement of the logo. If the seal were to be placed on vehicle s that are alread y outfitted with the City of San Jacinto logo, consideration of the cost to fix and the size of the seal would be paramount. 4.1 Packet Pg. 101 April 7, 2020 TO: City Council REQUESTED BY: Robert Johnson, City Manager APPROVED BY: Robert A. Johnson, City Manager SUBJECT: Discussion and Direction to pursue Section 115 Irrecovable Trust RECOMMENDATION: That the City Council discuss a Section 115 Irrevocable Trust Program and provide direction to the City Manager. DISCUSSION: After reading an article and position paper, the Mayor reached out to the City Manager to investigate the benefit of the City of San Jacinto investing in an Internal Revenue Code (IRC) Section 115 Irrevocable Trust to pay down future CalPERS retirement obligations. The City Manager contacted the City Attorney for more information and then reached out to his colleagues and found that the City of Temecula recently adopted a Resolution Authorizing Participation in the Public Agency Retirement Services (PARS) Post-Employment Benefits Trust Program. While the two cities are drastically different in pension obligations and revenue generation, the City Manager received valuable information from the City of Temecula City Manager and Finance Director, to be able to provide information to the City Council to discuss and provide direction. The City contracts with CalPERS to provide employees a defined-benefit pension plan, funded through employee contributions, employer contributions, and investment earnings. Historically, CalPERS’ investment earnings were projected to yield 7.75% annually (lowered to 7.5% in 2013). In December 2016, the CalPERS Board lowered the earnings assumption fro m 7.5% to 7.0% that would be phased in over a three year period. The change in the investment earning assumptions results in significantly higher employer contributions and liabilities. The primary benefit of a Section 115 Irrevocable Trust is the flexibility of investment options available to the Trust that cities are prohibited from utilizing. The broader investment options have the ability to generate higher yields and investment earnings, thereby increasing the assets held in trust. In 2012, the Government Accounting Standards Board (GASB) issues Statement No. 68, Accounting and Financial Reporting for Pensions. GASB 68 requires that governmental employers that sponsor Defined Benefit plan (i.e., CalPERS) must recognize a net pension liability (unfunded accrued liability) on their balance sheet. This is the difference between the City’s total pension liability (actuarial accrued liability) and actual plan assets. GASB 68 became effective for fiscal years starting after June 15, 2014. As of June 30, 2019, the City’s net 4.2 Packet Pg. 102 pension liability was $11,454,495, based the plans’ most recent valuation report (June 30, 2018). To reduce the GASB 68 net pension liability figure, the City’s only prior option was to commit additional funds to CalPERS, in excess of its annual required contributions, to reduce its unfunded liability. A Private Letter Ruling received by PARS from the IRS established that a city could create a separate trust to “pre-fund” its CalPERS unfunded liability. (Private Letter Rulings are only applicable to the applicant, and the City would have to file for its own, if necessary.) This would provide the City with an alternative to sending funds to CalPERS, which will allow for greater local control over the assets, investment by a professi onal fund management team selected and monitored by the City, with future excess contributions transferred to CalPERS at the City’s discretion. To date, over one hundred twenty (120) public agencies have adopted the Pension Rate Stabilization Program (PRS P) through PARS including the County of Riverside, City of Temecula, City of Huntington Beach, City of Brea, City of Pasadena, City of Beverly Hills, City of Glendale, City of Daly City, City of Fountain Valley, City of Pasadena, and the City of Redwood City. It should be noted that the City of Temecula and the City of Fountain Valley had successful 2016 general 1% sales tax ballot measure proposals. Funds generated from new sales tax revenue created opportunities for the cities to find creative solutions for paying down each cities net pension liability. For instance, the City of Temecula used $8M in seed money and added another $1M over the first two years of the program to realize an estimated $145K in savings per year, over the next 21 years. Some expected benefits offered by the PARS PRSP include:  Contributions placed in an exclusive benefit trust could address the City’s Net Pension Liability  Investment flexibility with Section 115 Irrevocable Trust compared to restrictions on City investments (Govt. Code 53216)  Increased risk diversification of plan assets through different asset management  Investments can be tailored to the City’s unique demographics  Oversight and control of fund management selections, monitoring of performance and ability to replace fund management based on performance criteria  Increased flexibility on the use of trust assets (i.e., trust assets can be accessed at any time as long as the assets are used to fund the City’s pension obligations and defray reasonable expenses associated therewith)  Lower investment management and administrative expenses compared to CalPERS  Potential for positive rating agency and investor consideration In an effort to assist public agencies address and manage the GASB 68 liability, PARS has developed the PARS Post-Employment Benefits Trust Program. PARS has assembled leading professionals to provide the City with the necessary services required under one program to pre- fund pension liabilities through an IRS reviewed program. The program has been established as a multiple employer trust, so that public agencies regardless of size can join the program to receive the necessary economies of scale to keep administrative fees low and avoid any setup costs. To properly offset liabilities, funds must be set aside in an exclusive benefit, irrevocable trust 4.2 Packet Pg. 103 that cannot be accessed by creditors in order to be accounted for as assets to fund the liability on the City’s financial statements. The trust permits the City, under federal and state law, to invest in a more diversified array of investments to maximize investment returns long term and reduce the City’s liability. Contrarily, the biggest negative of the Trust is the fact that it is irrevocable, and any funds deposited into and earned by the Trust can only be withdrawn to pay CalPERS contributions. Additionally, in order to be effective and most beneficial, a large amount of initial funding would have to be identified. The City Manager is recommending that the City Council discuss and provide direction to move forward with:  The creation of a Pension Rate Stabilization Policy  Drafting a Resolution authorizing the City to participate in the PARS Post-Employment Benefits Trust Program  Engaging a firm to assist in calculating long range projection of CalPERS rates under new assumptions, as of December 2016  Identifying an amount of funds for the creation of a Section 115 Irrevocable Trust, as well as future funding sources FISCAL IMPACT: A properly and adequately funded Section 115 Irrevocable Trust that obtains a higher performance than CalPERS’ investments would be fiscally positive for the City. If the City used the Trust to either pay CalPERS directly or reimburse the City for its annual employer contributions, this action would alleviate budgeted expenditures that amounted to $1.287 million for FY 2019-20. If the City used the Trust to pay down the current unfunded liability, this action would decrease the City’s future required employer contributions, again alleviating a certain amount of budgeted expenditures in future years. 4.2 Packet Pg. 104
