A Resolution of the Idy1Iwi1d Fire Protection District Authorizing an Amended and
Restated Joint Exercise of Powers Agreement with the City of San Jacinto Forming
the Idyllwild-San Jacinto Regional Fire Authority
WHEREAS, the City of San Jacinto and the Idyllwild Fire Protection District each have the
authority under California law to provide fire protection, emergency medical and related
services within their respective jurisdictions;
WHEREAS, the City and the District are both public agencies authorized and
empowered to contract with the other Party for the joint exercise of powers under the
Joint Exercise of Powers Act, Sections 6500, et seq., of the California Government Code;
WHEREAS, by jointly exercising fire protection, emergency medical and related
services with the District, the City is able to provide a public benefit to its constituency;
and
WHEREAS, the District desires to create and establish the Idyllwild-San Jacinto
Regional Fire Authority for the purposes set forth in the Amended and Restated Joint
Exercise of Powers Agreement.
NOW THEREFORE, BE IT RESOLVED AS FOLLOWS:
The Idyllwild Fire Protection District Board of Commissioners hereby
approves that certain Amended and Restated Joint Exercise of Powers Agreement
Creating an Agency to be known as the Idyllwild-San Jacinto Regional Fire
Authority, which is attached hereto. The President of the Board is authorized and
directed to execute the Joint Exercise of Powers Agreement on behalf of the
District.
2. The Idyllwild Fire Protection District hereby finds and determines that
approval of this Resolution and execution of the Amended and Restated Joint
Powers Agreement is exempt from review under the California Environmental
Quality Act (Pub. Resources Code, §§ 21000 et seq.) ("CEQA") and the State
CEQA Guidelines (Cal. Code Regs., tit. 14, §§ 15000 et seq.) on several separate
and independent grounds. Approval of this Resolution and execution of the
Amended and Restated Joint Powers Agreement does not constitute a "project"
for purposes of CEQA under State CEQA Guidelines sections 15378(a) and
1 5378(b) on grounds these actions have no potential to result in either a direct
physical change or a reasonably foreseeable indirect physical change in the

environment, and instead constitute government organization, fiscal, and
administrative activities. Further, even if these actions constitute a "project" for
purposes of CEQA, the categorical exemptions in State CEQA Guidelines section
15301 (Existing Facilities) and section 15320 (Changes in Organization of Local
Agencies) would apply. None of the exceptions to these categorical exemptions
listed in State CEQA Guidelines section 15300.2 are applicable. Finally, these
actions are also exempt under State CEQA Guidelines section 15061(b)(3), the
"commonsense" exemption, because it can be seen with certainty that these
actions will not result in a physical change in the environment. The Fire Chief is
hereby authorized and directed to file a Notice of Exemption with the Riverside
County Clerk's Office within five (5) calendar days following the adoption of this
Resolution.
3. The custodian of the record of proceedings for this action shall be the Fire
Chief / District Clerk, whose offices are located at 54160 Maranatha Dr., PO Box
656, Idyllwild, CA 92549.
PASSED AND ADOPTED at the Special Meeting of the Idyllwild Fire Protection
District Board of Commissioners held Thursday, July 28, 2016.
