Motion carried on a 4-0 vote with Mayor Conner absent. 3 September 17, 1996 • 5.6 Job Descriptions/Pay Ranges - Administrative Clerk Trainee, Administrative Intern, and Finance Supervisor Lengthy discussion with the following Council concerns noted: 1. The Budget Subcommittee had not met with the City Manager to look at the numbers, and it was desired to see some actuals prior to implementing additional expenses. particularly in areas where the revenues had not justified the action. 2. Wished to see the affects of raises and approved MOU's, with a financial review. Like to wait and place a hiring freeze until the actual figures were reviewed. City Manager Halloway, in response to Council inquiries clarified that the Finance position was approved in the budget, and was promotional, not a new hiring. The other two positions were approved by the Interim City Manager, after budget approval the Department Head felt it more beneficial to use a reduced amount of funding and split the funds between two positions, one which was approved in the budget. The net result was a cost savings of $6,000. The issue of a hiring freeze would be separate • from what was proposed. Staff was only seeking an approval of the job descriptions and salary ranges. If Council did not want implementation, then that direction could be given to staff. 3. Feeling that staff would not implement if that was the direction of Council, but Council could proceed with the approval of the job description and salary ranges. However, they were approved in the budget by Council and would actually result in a savings. This kind of action by staff should be encouraged. City Manager Halloway stated staff would not proceed with filling the positions and would wait for the actual fund balances, which he hoped would be available the following week. 4. Took issue with the fact that the process would have proceeded without approval from Council, had the new City Manager not stepped in and diverted the process to Council. 4 • September 17, 1996 • 5. Did not see what the issue was, the expenses were all budget approved and was simply a matter of staff splitting one position into two resulting in a savings. Both were part time positions and there were no guarantees, and the resources could be utilized at the convenience of the City. 6. There had been several budget adjustments, such as the one for Gas Tax, and other increased expenses which impacted the General Fund and the fund balances needed to be reviewed to assure there was a source of funds for the proposed positions. 7. The campaign promise of the new Councilmembers was to increase personnel for the Police Department, above increased personnel in other departments. Would support a hiring freeze for 90 days to six months, and address the issue at mid-year budget time. Requested that a hiring freeze be agendized for the next meeting for discussion. Community Development Director McNabb explained the staffing plans, and how they changed at budget time with the retirement of one employee, resulting in a revised plan for staffing and the cost savings realized. Explained that the Intern was a local business owner who had volunteered during the summer, at his own expense to hire personnel for his business. The plan was to allow that individual to complete special projects started, and mandated by the state. 8. Concern that Council, by not proceeding with the hiring, was micro- managing. 9. Obviously there were not three votes in support and Council needed to move on. Stated if it had been budgeted there was a need to fill the void of personnel no longer present and the other positions was an existing staff person. Council could continue the matter to the next meeting, but hoped they would keep all the issue in mind when the matter came back. City Manager Halloway stated Council could approve the job descriptions and salary ranges as proposed and staff would not fill those positions until staff had met with the Budget Subcommittee to review fund balances. • 5 September 17, 1996 4111 A MOTION was made by Councilmember Williams, seconded by Councilmember Solorio, to just approve the salary ranges and job descriptions as presented and not hire as stated by the City Manager. Motion carried on a 4-0 vote, with Mayor Conner absent. Mayor Pro Tem Smedley reiterated his request to agendize the subject of a hiring freeze. 5.9 Budget Amendments Resolution Councilmember Cornett stated her concerns as follows: 1 . That all purchases were being done through the City's computer consultant, Les Pricer. 2. It was the Budget Subcommittee's understanding that all departments of the City would be brought under one umbrella for computer equipment, and some departments were missed. 3. The proposed file server would be useful after the consolidation as well. City Manger Halloway pointed out it was not possible to link the Police 1111 Department due to their own security and the distance to other offices. Some of the City's equipment was vintage and it was hoped that some could be salvaged and upgraded, but could not link them to the file server. A MOTION was made by Councilmember Cornett, seconded by Councilmember Williams, to adopt Resolution No. 96-39, authorizing a capital budget of $4,096 for the purchase of a file server for 312 East Main Street, and$48,000.00 for vehicle repairs and maintenance. Motion carried on a 4-0 vote with Mayor Conner absent. RESOLUTION NO. 96-39 RESOLUTION OF THE CITY COUNCIL AMENDING THE BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1, 1996 AND ENDING JUNE 30, 1997 6 • September 17. 1996 6.0 PUBLIC HEARING - UNADVERTISED 6.1 AB 3229 Funding - COPS Grant Police Chief Holmes made a presentation as contained in the staff report on file with the City Clerk and noted that the Public Safety Subcommittee had met and determined this was the best way to spend the funds, to expand the vehicle program initiated 2.5 years ago. Councilmember Williams indicated the Subcommittee considered the funding for additional bike officers, mobile data computers and the vehicle lease and reached the conclusion if the funding were allocated for only two years, it would be easier to make an adjustment to a capital item. The original vehicle program was intended to increase the life of the vehicles, and the grant would be an appropriate use. Additional manpower would be of no use if there were no vehicles for them to drive. Councilmember Solorio felt this was the best approach, a pay as you go and it was justified, and was in keeping with the campaign promises of the new Council. • Mayor Pro Tem Smedley voiced concern, and although he was supportive of increasing funding for the Police Department, he felt the risk to using the funds for vehicle leases was if the funding were not approved the following year, and could not support a four year commitment for the vehicle leases. If funding did not continue then it would come from the General Fund. He had been talking to the sponsor of the bill, who was unsure of the funding for the following year. Chief Holmes noted that the worse case scenario would be, if funding ceased, that there would be a total expense of $13,000, which $3,000 could be budgeted annually to meet the need. This was a critical issue for the officers to have the vehicles and would address a current need. • 7 September 17, 1996 Mayor Pro Tern Smedley could not support committing for future expenditures with the uncertainty of the funding, but would support the one time expenditure for whatever could be obtained with the funds. Also took issue with the requirement of the legislation to supplement existing services and not supplant, and questioned if the proposal complied, using the League of Cities formula? Noting the bill was specifically written to prevent the abuse of the use of the funding. The proposal would commit the Council to approving the lease funding of $11,000 after the leases were paid. Councilmember Cornett inquired if the matter had been reviewed by the Finance Department? Chief Holmes stated this was not a General Fund issue, it was separate and apart, with its own public hearing. Lengthy discussion on the existing lease program of $111,000, and its completion in Fiscal Year 1997/98. Chief Holmes noted the proposal was not supplanting funds budgeted. Mayor Pro Tern Smedley inquired if the City Attorney was familiar with the • legislation. City Attorney Brown indicated he generally was. He offered to write an opinion on the proper structure to ensure that funds were not supplanted. Would be reluctant to discuss the matter further at the meeting. Chief Holmes indicated the matter was not an urgency, that the City had 60 days to act. City Attorney Brown suggested the matter be continued to the October 1, 1996 meeting to avoid further scrutiny on the possible city actions. Councilmember Cornett requested that the figures be broken down for the Finance Department and the Budget Subcommittee for review and to determine what the actual obligation would be? Thought there were also some alternatives, prior to Council taking an action. 8 • September 17, 1996 Chief Holmes noted they would break it down for the Subcommittee and that the only deadline was to order by November 1, 1996, or be out for another year. Mayor Pro Tern Smedley did not recall that the vehicle acquisition was a part of the Public Safety Financing Committee and suggested alternatives be presented for Council review, and Subcommittee recommendation. Councilmember Williams stated the scope of the Public Safety Financing Committee was not to determine the number of things to purchase, rather to look at the overall staffing and future of the community, and they kicked around issues like the bike patrol, mobile data computers and potential funding sources. The vehicle program goal was to extend the life of the vehicles and lease, as opposed to purchasing, allowing the acquisition of more vehicles. A one time purchase would only allow the purchase of 2.5 vehicles. Mayor Pro Tern Smedley agreed the matter needed to proceed, but the program was so new, that even the oversight committee had just been appointed, and suggested they be brought in to review the proposal. CityAttorneyBrown felt it was a matter of policy and a need to go forward with some creative work around the legal issues. Thought the proposal would supplement the existing and not supplant, but maybe some additional work was needed on the lease extensions, which was comparing apples with oranges. A MOTION was made by Councilmember Cornett, seconded by Councilmember Williams, to continue the matter to the October 1, 1996, meeting. Motion carried on a 4-0 vote with Mayor Conner absent. Councilmember Solorio requested a written opinion of the legislation's author regarding the concerns of the League of Cities. City Attorney Brown urged liaison with the state legislators, but indicated he would prepare his own opinion and suggested the City not be seeking opinions from the state. • 9 September 17, 1996 7.0 CITY DEPARTMENTS 7.1 KIOSK Program - Resolution Designating Streets for Off Site Directional Signs Community Development Director McNabb made a presentation as contained in the staff report on file with the City Clerk. Councilmember Williams voiced concern regarding the lack of maintenance of the KIOSKs in the past. Patti Drusky, Chamber Representative, indicated that the program was changing, including new materials for sign construction, which would be stronger and more weather resistant. In the past the Chamber lacked the staff for maintenance, but that had changed. A MOTION was made by Councilmember Solorio, seconded by Councilmember Williams, to adopt Resolution No. 96-41 , adding Hewitt Street, Esplanade Avenue and part of State Street to the off site directional sign (KIOSK) program. Motion carried on a 4-0 vote, with • Mayor Conner absent. RESOLUTION NO. 96-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, ADDING LOCATIONS TO THE DIRECTIONAL SIGNS PROGRAM PREVIOUSLY ESTABLISHED BY RESOLUTION 2089 AS IDENTIFIED IN EXHIBIT "A" ATTACHED HERETO 7.2 Parking In-Lieu Fee - Resolution & Agreement (Peacock Financial) Senior Planner Hults made a presentation as contained in the staff report on file with the City Clerk. Mayor Pro Tem Smedley recalled a prior meeting with Peacock Financial, where staff indicated additional off site parking would not be required due to the proximity of the City lot. i0 • September 17, 1996 Community Development Director McNabb did not share that recollection and clarified that the cost was to assist in off setting the cost to the City for the City lot. Because of the proximity of the City lot, 5 stalls were required and with the lack of access at the rear, the developer selected to pay the fees, pursuant to City ordinance. In response to Council inquiry, advised that the Chamber had the same options, but had not requested it as Peacock Financial did. The term was requested by Peacock Financial. Confirmed that a promissory note was signed for the funds. A MOTION was made by Councilmember Cornett, seconded by Councilmember Smedley, to adopt Resolution No. 96-42, establishing the parking in-lieu fee in the amount of $1,906.00 per stall, and authorize the Mayor to execute the agreement with Peacock Financial to pay the $9,530.00 over a ten year period in-lieu of constructing the five off street parking stalls for the Virginia Lee Hotel commercial office conversion. Motion carried on a 3-1 vote, with Mayor Conner absent and Councilmember Solorio dissenting. 8.0 MAYOR/COUNCILMEMBER REPORTS/DISCUSSIONS • 8.1 Review of 1996/97 City-to-City Recycling - Solorio/Cornett Councilmember Cornett, requested, and by Council consensus, the matter was continued to the next meeting October 1, 1996. Bob Zambon suggested that Council consider utilizing some the annexed land and put up their own MRF, and then turn the operation over to private industry to run. 8.2 Councilmembers Requests/Reports Councilmember Williams indicated the Subcommittee had met with Chamber representatives on the contract and would have additional information to report at the next meeting. The City Manager gave an overview of goals and objectives and clarification was obtained on the museum. The Chamber was continuing to work with the property owner on the tourist center. Councilmember Solorio indicated the meeting was well received by all and looked forward to future meetings. • 11 September 17, 1996 IP Mayor Pro Tern Smedley indicated recent enthusiasm for the Chamber's opportunity to put together a strategic plan for economic development for the City. Suggested that the future League session, he was trying to schedule, include the school district and the college. Also suggested a study session jointly with the Planning Commission to assist them on the direction to expect from the Council regarding zoning, economic development and the General Plan. With the upcoming term expiration on the Planning Commission, suggested the terms expiration be on a 2-3 ratio, rather than a 2-2-1. COUNCIL CONSENSUS to schedule a joint City Council/Planning Commission study session, with Community Development Director McNabb and City Manager Halloway setting the agenda items for consideration. Halloway, City Manager DATE: October 1, 1996 SUBJECT: EXTENSION OF THE SUBDIVISION AGREEMENT FOR TRACT 23789 TERRA NOVA RESIDENTIAL L.L.C. (EVANS STREET - RANCHO SAN JACINTO) RECOMMENDATION Staff recommends that the City Council extend the Subdivision Agreement for Tract 23789 for a period of two years, to expire September 1 , 1998. DISCUSSION The replacement Subdivision Agreement for the subject Tract was executed and became • effective on September 1, 1995, when Terra Nova purchased the property. Due to slow development activity in the City, at this time, the property owner is requesting that the Agreement be extended. The bonds are still in full force and effect. Although Terra Nova is building homes currently, the absorption rate dictates that it will be approximately two years before all the public improvements have been completed. Additionally, staff does not anticipate a need to call the bonds for this tract within the next two years. Halloway, City Manager DATE October 1 , 1996 SUBJECT: ADOPT-A-PARK PROPOSAL RECOMMENDATION Receive and file. • BACKGROUND On August 6, 1996, Diane Tavenner asked the City Council to consider an Adopt- A-Park Program, whereby civic organizations or businesses would regularly provide some level of park maintenance in trade for a sign acknowledging their efforts. The Council seemed interested in the program but wondered who would administer it. Staff suggested that the Kiosk Program might be the appropriate entity because signs are involved, and the Chamber of Commerce is supposed to be marketing the Kiosk Program to businesses. Staff met with the Chamber. They agreed that it would be a natural extension of the Kiosk Program. However, it is staffs view that the Chamber is not far along on their business marketing, and therefore it would be premature to really involve the Kiosk Program. Unless the Council directs otherwise, staff would propose to send a letter to serviceAy)szo determine if they would be interested in policing a park once or " .twice a month, or to sponsor one week of maintenance by Phoenix Programs. • AGENDA ITEM NO. -S CITY OF SAN JACINTO STAFF REPORT TO: Honorable Mayor and City Council Members FROM: Brian McNabb, Director of Community Development via Dennis R. Halloway, City Manager DATE October 1 , 1996 SUBJECT: CONTRACT WITH PHOENIX PROGRAMS TO CLEAN THE MAIN STREET EET RECOMMENDATION Authorize staff to prepare and execute a contract with Phoenix Programs to cle Main Street area, pursuant to quote of September 9, 1996. an • BACKGROUND Phoenix Programs had been cleaning Main Street regularly until the end of last fiscal year. Cleaning included hand sweeping the sidewalk trash,up emptying trash cans, and watering trees. This program was financed gfrom LLMD funds. Presumably, in an effort to save money, this program was eliminated by previous staff. Since that time, the general cleanliness of the Main Street area has deteriorated. Maintaining a higher standard will either require a concerted effort of all property owners or a higher level of effort by the City. The City staff is too small to dedicate the resources necessary to provide the required maintenance. Asking the businesses to work together is ideal, but will require administrativ oversight to be sure everyone upholds their end of the maintenance (assuming they agreed in the first place.) g Staff recommends contracting with Phoenix Programs in the amount of S120. 0 per week which will also include weeding the parking lot and tree wells. Fundin would be derived from LLMD and/or gas tax. If the Council agrees, staff willll prepare the necessary agreements. • PHOEN I H PROGRAMS, INC. 1370 S. Halloway, City Manager DATE October 1 , 1 996 SUBJECT: LETTER FROM ASSEMBLY OF GOD CHURCH REQUESTING THE NEGOTIATION OF AN AGREEMENT RECOMMENDATION Direct staff as appropriate. • BACKGROUND Approximately two years ago, the City Council and the San Jacinto Unified School District Board of Trustees held a joint meeting regarding possible joint facilities. One of the Facilities was the expansion and joint use of Sallee Park. A master plan concept was subsequently submitted and it was determined implementation would be a phased approach. Sallee Park and Monte Vista Middle School occupy an entire block except a parcel which is owned by the Assembly of God Church. The Sallee Park Master Plan excluded the church's property, although it would have been a better plan if their property had been included. The Assembly of God Church has expressed a desire to expand which requires additional parking. The land for the parking is the land adjacent to Monte Vista Middle School. The church is aware of the City's and School District's desire to enhance the middle school and park. The church has requested the City (and probably the School District, as a third party) negotiate an agreement which would address, among other things, transfer -- of the- church" land to the City, construction of a joint parking facility, abandonment of an alley, and the conversion of First Street to a parking lot. Staff has discussed these ideas with school staff a number of times and a draft plan has been prepared, and can be presented to either the City Council or a joint • meeting of the Council/School Board, as deemed appropriate. Staff asked the church to submit the attached letter as a means to start a public dialogue. Dear Brian, During our meeting the morning of June 7, 1996 we discussed the several proposals that would benefit the • City, the School District, and our church. Since these proposed ideas would effect the City, the School District, and our church, I suggest that we join together in a three party effort to create a synergy that would greatly help all three parties. Our Master Plan presently shows the expansion of our church building and the addition of a pre-school/day care. During our meeting, you informed us that due to the off sets proposed, we would need to own the alley separating our property. It is located between Estudillo and 1st street. You thought that it could be vacated by the city and transfer the ownership to the respective property owners. I am requesting that you start the process to vacate the alley, and set up a meeting between the involved property owners to make this transition. Another item of discussion centered on parking. We recognize that with an increased seating capacity we would need increased parking. We discussed ideas the City has with the land across 1st street. The proposal was to condemn 1st street and make 1st street, as well as the land we own there, into a public parking area for the City, School, and ourselves to utilize. We would need to donate the land to the City, and the City would guarantee that the church would have full access to the parking area, as well as grant street side parking which gives us the total parking needed for the expansion. At the present time, we view this favorably and would like to continue working towards this end. Thank yo i •) co , Sn Jacinto Assembly of God Pastors Gordon and Nonda Houston 300 W. CITY OF SAN JACINTO STAFF REPORT DATE: October 1, 1996 TO: Honorable Mayor and Members of the City Council FROM: City Council Public Safety Sub-Committee, and Nathaniel Holmes III, Chief of Police via Dennis Halloway, City Manager SUBJECT: Citizens Option for Public Safety Funding RECOMMENDATION: Receive for information and provide staff with direction. FISCAL ANALYSIS: Varied. BACKGROUND: The City Council requested other suggestions and/or options for the expenditure of the AB 3229 funds we are due to receive in October. • The below listed items/options were presented to the Budget Ad Hoc Committee during the budget process. The first vehicle options are lower cost ways to replace some of the fleet, but still do not address the concerns relative to the likelihood of continued funding. The next option is for the addition of personnel which as you can see would not work and was not requested for obvious reasons. First we would end up with a funding shortfall in a shorter length of time than if we leased the vehicles, and we would also risk having to lay off employees should our revenue sources not improve. Finally there are presented several options for the purchase of items of technology. The down side of this is the question of the actual visible impact on law enforcement services to the community, and the requirement in AB 3229 that the funds be utilized for "front line" law enforcement services. In studying the issue of how to spend the funds the City Council Public Safety Sub- committee and I looked hard on the best value for our dollar. High on my list of considerations was which option would have the most visible and significant impact on crime and our ability to serve the community, and the directions of Council for the past several years to increase officer visibility on the streets. At a meeting in July Councilwoman Cornett also provided direction that the fleet was critical and we would • have to find a way to obtain vehicles. Staff Report AB 3229 Funding Page 2 The final concern was the critical nature of the condition of the fleet and recognizing the fact that regardless of what we did with these funds we would still need to find funding to replace some of the fleet. Vehicles As part of the vehicle replacement plan we had proposed to replace half of the fleet in fiscal year 1994-95, and replace the other half in this fiscal year (1996-97). We would be able to issue vehicles to all patrol personnel, which would extend the life of the cars and provide a higher police presence and profile in the community. This would require that, with the present staffing, we have a fleet of 21 marked units, and 7 unmarked units. This would give us 2 marked pool cars. The present fleet includes 12 marked units and 7 plain units, of which 1 is out of service due to the high cost of repairs and a second has over 100,000 miles and is running very poorly. Both of these need to be declared surplus. Thus we have truly only 5 serviceable plain units. Option 1 Of the current marked police patrol fleet 3 are 1992 Chevrolets with from 60,000 to 80,0C)0 miles on them. Additionally one of the 2 year old leased Fords has over 65,000 miles and is driven by 4 personnel, 24 hours per day. Of the unmarked units we have two which are 1988 and 1989 year models and have over 100,000 miles on them, both of which need to be declared surplus. And one of the new Fords has over 60,000 miles. At the very minimum I would recommend that we obtain 5 marked units and 2 unmarked units We would retain the best Chevrolets as pool cars and reduce the mileage accumulating on the new Ford. We would dispose of two of the old high mileage unmarked cars and replace them with one, and would use the second to reduce the high mileage on the newer unmarked Ford. This option would cost about $55,000 per year on a four year lease/purchase. However this would not move us toward our issued vehicle goal of increased police presence on the street. Option 2 The second option would be to add 7 marked and 2 plain units to our lease. We would • retain the 2 best Chevrolets as pool cars and dispose of the 4 least serviceable plain Staff Report AB 3229 Funding Page 3 units. This would bring our fleet up to 18 marked units, and the 7 required plain units. We would be able to go to a limited assigned vehicle program with a couple of personnel sharing cars. This is estimated at $67,000 per year for four years. In F/Y 1997/98 we would again add 7 marked units to our lease and dispose of the last 2 of the Chevrolets, should they last that long. This would bring our fleet up to 21 marked units with the ability to issue vehicles to all patrol personnel. This is estimated at an additional $71,000 per year for four years. Option 3 The final option for vehicle replacement would be to add 12 marked and 2 plain units to our lease this year. We would again dispose of 4 plain units and 4 marked units which are high mileage and unserviceable. This coupled with our existing fleet of 9 newer marked cars would give us 21 marked units which would allow for an immediate assigned vehicle program and would assure that the units should last 6-7 years. This cost is estimated at $115,000 per year for the four years. • Due to the manufacturingcycle y the earliest that we can get marked units delivered would be in January of 1997. Since under all three options we are adding to our existing lease we have the option of making the payment at the end of the year instead of the beginning. Thus our first payment would be due in January of 1998 should we wish to take advantage of this plan. Should we elect to purchase vehicles with the grant money we would be very limited in that a fully equipped police patrol vehicle costs approximately $28,000.00, plus another $3,500 for an mobile data computer. Personnel Recommendations have been made to increase the number of sworn personnel by 4 as soon as possible. The present first year costs presented by the Finance Director are $59,045 per officer,($32,922 salary, $15,803 in fringe benefits, and $10,320 in overhead costs). Staff Report • AE3 3229 Funding Page 4 Technology Transcription Services My first recommendation would be to reinstate the transcription services which were deleted, due to a lack of funding, last year. When this program was deleted we saw our officer unavailable time go up by about 45-60 minutes per 24 hour period. The cost for this service is estimated at approximately $50,000 per year. Mobile Data Computers (MDC) Mobile Data Computers allow an officer to run warrant and wanted vehicle and person checks from their vehicle. They are also able to complete reports and transmit them to the department from their vehicles. Departments which have these have noticed greater productivity, in all areas including arrests and recovered stolen vehicles. The cost of MDC's is estimated at about $3,500 per vehicle. They would be added as part of our vehicle lease/purchase and purchased in that manner. Mobile Video Cameras • Vehicle mounted video cameras are an asset in prosecution and liability reduction, however I am unaware of any studies which will quantify the savings in liability costs due to their use. They cost approximately $5,500 each, and could also be included in the vehicle lease/purchase. Computerized Muq/Bookinq System A computerized mug/booking system eliminates the need for film, film processing, and filing and storage of mug photographs after they are processed. Photographs are instead stored on the computer and can be recalled almost instantly. Most computerized mug/booking programs also have the ability to assemble a photographic line-up for suspect identification/elimination. This saves a great amount of the investigators time hand searching and assembling photo line-ups. Complete computerized mug/booking systems cost approximately $10,000. Computer Systems and Programs It is necessary to bring our entire police department computer network up to date and our budget request this year starts towards this goal. There are numerous computer programs which we should have to assist in criminal investigations, and crime prevention. These include crime analysis, link analysis, and crime mapping programs. • The department also has a need to upgrade the computers in the department from mere Staff Report AB 3229 Funding Page 5 work stations which are over 5 years old. It would cost us about $40,000 to upgrade our computer system to one to meet our needs in the 90's, minus what we have budgeted this year out of Prop 172 funds. Finally as we can all see some of these expenditures would be stretching the term "front line" law enforcement services as the Assembly Bill requires.
