City Clerk • 5 Agenda No. 4. 3 • STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: Bill Marshall, San Jacinto Unified School District Superintendent Via: Dennis Halloway, City Manager DATE: October 15, 1996 SUBJECT: Resolution in Support of Measure "T" RECOMMENDATION: Adopt Resolution No. 96- in support of Measure "T" - San Jacinto Unified School District Construction Bond. BACKGROUND Measure T is a $6,500,000 local school construction bond initiative that will provide vitally needed funds for the San Jacinto Unified School District. These funds will allow the district to build a much needed middle school. • It is important to point out that with the passage of State Proposition 203 in the March 26, 1996, election, San Jacinto Unified School District will be receiving more than $5.5 million from the state for the construction of a new middle school. The School District must provide matching funds for this project. It is critical that Measure T pass on the November 5, 1996 election to provide the matching local funds while the state has money to fund the project. - Approved Other Denied Continued Die Tabled - Amended Yale._._ Informational Arghdrawn RESOLUTION NO. 96- • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, IN SUPPORT OF MEASURE "M" - SAN JACINTO UNIFIED SCHOOL DISTRICT SCHOOL CONSTRUCTION BOND WHEREAS, California's school population is growing by an average of 160,000 students each year creating a need for more classrooms so that students will have an opportunity to learn in an educationally appropriate environment; and WHEREAS, San Jacinto Unified School District's schools are overcrowded. Monte Vista Middle School was build for approximately 485 students, but currently houses 952 students; and WHEREAS, the shortage of classrooms has forced the San Jacinto Unified School District to convert spaces such as electrical supply rooms and a bus garage to classrooms, offices and library facilities; and WHEREAS, the San Jacinto Unified School District has an immediate need for construction of a new middle school; and WHEREAS, many buildings and classrooms at Monte Vista Middle School are 30+ years old and need new heaters, wiring, plumbing and other security features; and WHEREAS, the lack of adequate school facilities within the San Jacinto Unified • School District hurts the quality of education in our community; and NOW THEREFORE, BE IT RESOLVED, that the San Jacinto City Council supports MEASURE "T" which is a local school facilities bond on the November 5, 1996 ballot. Lee, City Clerk SUBJECT: Chamber of Commerce Request - Amend Directional Sign Program (KIOSK) RECOMMENDATION: Provide direction to staff as deemed appropriate.. BACKGROUND: The attached request was received from the Chamber of Commerce to amend the directional sign program. Patti Drusky will be present to answer questions. It would be appropriate for Council to direct staff on the disposition of this issue. Approved Ochet Denied ,Continued Dale Tabled • Amended 1k Intonational wdrawn October 9, 1996 • To: San Jacinto City Council From: Patti Drusky, San Jacinto Chamber of Commerce January 5, 1993 the City Council passed resolution 2089 authorizing the San Jacinto Chamber of Commerce to manage the directional sign program within set guidelines. Since that time the program has been operating very successfully for both the Chamber and the local new home developers. In September of 1994 I took over management of the Chamber which also included the management of the directional sign program. The labor for putting out the signs and bringing in the signs each weekend was subcontracted out to Phoenix Programs who had been doing the labor since the adoption of the resolution. I was dependent on Phoenix Programs to continue to provide the labor within the guidelines of the resolution. The City seemed satisfied with the management of the program so 1 had no cause to suspect any difficulties. In August of 1996 the Chamber found it necessary to subcontract with a new entity to provide the labor for the program. Phoenix Programs worked with the Chamber and the new subcontractor to ensure a smooth transition. However, two weeks after the termination of Phoenix Programs the Chamber was contacted by the City to pick up directional signs that Code Enforcement removed due to placement outside of the resolution guidelines. More than half of the placed directional signs for that weekend • were removed by Code Enforcement. The Chamber then met with Community Development Director, Brian McNabb to determine why there was a problem. Indeed, the placement of the directional signs for at least the past two years was in violation of the resolution guidelines but until that weekend had not been enforced. The Chamber then met with the subcontractor and required that sign placement from that point on must follow the resolution guidelines. The major violation was that placement of signs was to be in half mile intervals only but signs we being run the full length of the approved streets. The subcontractor immediately revised the placement to meet the existing guidelines. However, to meet the half mile requirement limited the amount of directional signs that could be placed. After revising all the placement maps to meet resolution guidelines we found that less than half of the signs requested by developers could be put out. This poses not only a major cut in income to the Chamber from the developers but it also restricts the exposure the developers are seeking. The Chamber is therefore requesting that the City Council consider amending the guidelines to allow placement of directional signs in quarter mile intervals. This would allow adequate sites for the exposure the developers need. The Chamber will continue to monitor the placement and removal of directional signs to ensure control and • accountability. City Attorney Brown noted for the record that the need for the action was immediate and arose subsequent to the posting of the Agenda. Approval to add the matter to the agenda would require a 4/5ths vote. At the hour of 6:10 P.M. Councilmember Solorio arrived in Council Chambers. A MOTION was made by Councilmember Cornett and seconded by Councilmember Smedley to add the High School Parade permit as agenda item number 5.6 on the consent calendar. Motion carried on a 5-0 vote. Bob Zambon requested the City obtain assistance from the Railroad company to repair the crossing at Esplanade near State Street, which had deteriorated. • October 1 1996 Mayor Conner inquired of staff what the status was of the widening at that location? Community Development Director McNabb advised that the City had applied for the program for 90% state funding, but it would take about two years before funding would be obtained. 40 REDEVELOPMENT AGENCY None 5.0 CONSENT CALENDAR - CITY COUNCIL A MOTION was made by Councilmember Smedley, seconded by Councilmember Cornett. to approve the consent calendar as presented. Police Chief Holmes. in response to Council inquiries regarding the cost and liability issues. stated the Police Department was involved in the process each year. and although there was a potential for liability, any problems of the past had been rectified. and the parade required street closures (Idlywild and Main Street) utilizing reserves and on duty personnel for escort 6.0 PUBLIC HEARING None 7 0 CITY DEPARTMENTS 7 1 Committee/Commission Appointments 7.1 1 Library Task Force Louise Koetters advised that no applications had been received for the two public at large positions and she needed more time to make contacts. Received clarification from Council that members of the Friends of the Library who were interested could also participate as members at large. COUNCIL CONSENSUS to continue the appointment to the next meeting October 15, 1996. 7.1 .2 Planning Commission Councilmember Smedley advised that the rotation of the Planning Commission. unlike the Council's terms alternating 2 and 3 at a time, the Planning Commission was 2, 2 and 1 . He suggested that the appointment be for one year to make the rotation the same as Council. • October 1 , 1996 City Attorney Brown. in response to Council inquiry. thought a change was technically a consensual process and the appointment could be made with that understanding. but it was a two step process and would require amending the Planning Commission by-laws, and could make the appointment subject to the forthcoming change. or wait and bring back an amendment and make the appointment then. Mayor Conner inquired if there was an interest in extending the incumbents term one year? Councilmember Smedley advised he had thought about that. and felt Council should also amend the by laws to cap out the number of terms an individual served. Commended Mr. Hixson's 12 years of loyal service, but felt that term limits would afford Council the opportunity to bring new people aboard. Councilmember Williams was not opposed to the current structure and did not feel terms limits was necessary, since Council had the option to appoint new members. • A MOTION was made by Councilmember Cornett, seconded by Councilmember Smedley. to appoint Tim Dunlap to fill the term of office beginning October 30, 1996, and expiring October 30, 2000. Motion carried on a 4-1 vote with Councilmember Williams dissenting. City Attorney Brown inquired if Council wished staff to bring back an amended ordinance to limit terms'? Mayor Conner suggested a written report be brought back to Council. 7.2 Russian/Aerospace Visit - October 20, 1996 Priscilla Pastor made a presentation and requested financial assistance+ on luncheon costs in the amount of $120.00. and indicated a need to block some parking space for the busses. It was suggested she discuss the blocking of parking with the Police Department. Further, Finance staff could determine where the expenditure would come from in the budget. Ms. Pastor was reminded there was only one meeting left for any additional requests. 411 October 1 , 1996 • A MOTION was made by Councilmember Smedley, seconded by Councilmember Cornett. to approve the $120.00 expenditure for the luncheons Motion carried on a 5-0 vote 7.3 Street/Alley Abandonment (Assembly of God Church) Community Development Director McNabb made a presentation as contained in the staff report on file with the City Clerk. Councilmember Cornett requested to see the Master Plan and suggested the new Council be brought up to speed on the issue before considering any joint issues. Stated the building on the church property needed to be addressed. Felt the CDF should be consulted prior to considering the closure of First Street. Was not opposed to moving forward with other agencies. however, did not favor sitting down to discuss issues until the City had their act together Mayor Conner voiced major concern regarding the closure of First Street. he saw it as a major artery since it was larger than the average residential street. He noted the problems at the old Hemet High School and the properties on Devonsnire when streets were closed. Noted there was a strange , arrangement at the location in question: weird easements and telephone poles in the middle of the alley, commercial use for access to the Circle K. access to the Lions Kitchen, and a residential garage access. Went on to note the property needed to be cleaned up, could not see a plan for parking, the egress from the school was terrible (suggested closure of the parking there), in general there was still a lot of work to be done to rectify the many problems at the site and the school district was not interested in considering the issue prior to the November elections. Councilmember Cornett requested the matter be tabled. John Palmer stated he wished to oe on record, that any condemnation procedures from First Street to Estudillo and Ramona would be met with resistance from property owners. Stated Estudillo was only 30 feet wide and routed tremendous traffic and the closure would reduce CDF response time Councilmember Smedley concurred with Ms. Cornett, that the City get their act together and bring the matter back at a later date. • • October 1 , 1996 City Manager Halloway requested clear direction from Council on how staff was to proceed Councilmember Cornett identified the following. 1 Council needed to see the master plan. 2. Address the problems with the building and what should the City involvement be? 3. Regarding the street closure. CDF needed to the consulted. 4 Was parking a viable option without closing the street? S. Generally. there was a lack of information and some of the questions needed to be answered first 6 After addressing the items listed above. then would be willing to meet with the Church and School 7 Would like the matter tabled until staff had some answers Mayor Conner suggested a meeting with Gordon Houston. the City Manager and Mayor to discuss tearing down the building, but obviously the City could not incur the $20-30.000 cost to do so. Suggested working with Mr. Houston • as the first step, possibly by the next week. Councilmember Smedley suggested directing staff to bring back an item for street closure that Council could vote on. He was concerned about setting a precedent by abandoning the street and future abandonments for the purpose of parking. City Manager Halloway noted that the City could not simply give away an asset and it would require an appraisal. Councilmember Cornett reiterate° the concerns of the Mayor and stated they needed more answers before talking to other organizations. 7.4 AB 3229 Funding - COPS Grant (Continued from September 17, 1996) Citizens Option for Public Safety Funding Councilmember Smedley inquired it the hiring of another officer was actually a real consideration? Police Chief Holmes noted it was an option. but not brought forward because of the potential for lay off, but what they needed were vehicles. i October 1 . 1 996 • Mayor Conner noted the officer level had already been raised to 24. and there would be two more the following year Councilmember Cornett voiced concern over expanding the lease program for the next three years and the Possible drain on the general fund. Suggested the consideration of the transcription service wnich would provide more officer time on the street. Clarified she was not discounting the need for vehicles Mayor Conner inquired what the COPS funding would provide in terms of vehicles for an outright purchase? Police Chief Holmes stated each equipped vehicle cost about $28,000. without a camera and computer. Councilmember Smedley suggested participating in the purchase of used vehicles from Salt Lake City. Noted the cost was $20,000 plus the cost of decals and a cage. Some of the vehicles offered has only 16.000 miles on them. With the possible passage of Proposition 218, the City would be facing serious money shortages and he was unwilling to commit to leases for 411 the next four years. Police Chief Holmes noted that the program was geared more for smaller communities. and the vehicles were being sold to offer them a profit. However, San Jacinto was not a small community, but rather was considered an average size and vehicles were needed with less mileage. If a vehicle purchase was not possible then would rather hire an officer and take the chance of a lay off the following year. Mayor Conner noted that the City of Lake Elsinore, in considering Proposition 218 would be facing a layoff of employees, reducing their staff of 69 to 44 immediately upon passage. With San Jacinto wanting to add officers, clearly they did not have 10-20 people they could cut. With the uncertainty. suggested the purchase of 2-3 new cars would be a legitimate expenditure. Would prefer the purchase of brand new vehicles with a guarantee for $28,000 than used at $20,000. Councilmember Cornett agreed. 4111 • October 1 , 1996 Councilmember Williams noted that during budget discussions. Council direction was to support the vehicle assignment Program to extend the life of the vehicles. which would cost a little up front but would be cost saving in the long run The program was supported by the Public Safety Financing Committee, along with police expansion No doubt there was no guarantee on the legislation and continued funding so suggested consideration of half the funding to further the program. In keeping with what the community wants, additional officers and no funds. then maybe they should look at contracting with the Sheriff However that did not seem to be the goal desired then Council needed to step uo and do the things necessary to support the Police Department. It was not easy to predict the future. but felt the funding would be in place. so rather than not fund at all, suggested funding half at a cost of $67.000 Police Chief Holmes noted that option two on page two would provide economy but get more for less. Councilmember Cornett requested that prior to the next meeting. that the Budget Subcommittee meet to review the matter Felt it was imperative to be • fiscally responsible and a need to assure citizens by reviewing the police budget, since they had already gone through the other department budgets, to see what funding could be pulled to support the purchase. Councilmember Smedley understood what Mr. Williams was saying; but was concerned about the 3-4 year commitment of funding without a guaranteed source of revenue. To commit beyond one year of funds he considered to be reckless Clearly the leases would not be forgiven if the funding were lost and then there would be further impacts if Proposition 218 passed. Councii was being asked to spend $460,000 with only a $55,000 funding guarantee Would agree to a cash purchase or an additional officer. Mayor Conner suggested the matter be considered by the Budget Subcommittee to look at the purchase of two cars or spend only half the lease money and come back with a recommendation at the next meeting. Halloway, City Manager DATE October 15, 1996 SUBJECT: 1) QUIT CLAIM BY CITY OF ACCESS RIGHTS ALONG THE RAMONA EXPRESSWAY TO MCCLEISH GROUP 2) APPROVAL OF FINAL PARCEL MAP 28377-1 RECOMMENDATION • 1 . Approve the attached quit claim deed removing the restricted access at one point along the south side of the Ramona Expressway, approximately 1 80 ft. west of Sanderson Avenue. 2. Approve Final Parcel Map 28377-1 and authorize its recordation. DISCUSSION The City approved Tentative Parcel-Map 28377 on May 1 5, 1996 creating the potential for parcelization of th,e. 7.37 acre lot on the southwest corner of Sanderson and the Ramona Expressway. Concurrently, a Conditional Use Permit was approved for a mini-market, gas station, and car wash. This phase of the Parcel Map will allow the sale of the corner to the owners of the mini-market. In the process of checking the Parcel Map, it was determined that when the County acquired the Right-of-Way for the Ramona Expressway, it also acquired abutters rights which limited access to the Expressway. In approving the Conditional Use Permit and Parcel Map,te City allowed access at a location not envisioned by the County. Halloway, City Manager DATE: October 15, 1996 SUBJECT: TRAFFIC SIGNAL DESIGN CONTRACT RECOMMENDATION Approve additional traffic signal design contract with Kimley-Horn and Associates, Inc. in the amount of $1 ,800.00 for the design of a signal interconnection between the signals proposed at State Street and Ramona Boulevard, and State • Street and Cottonwood Avenue and authorize the City Manager to execute same. DISCUSSION As you are aware, the City received ISTEA funds to install a traffic signal at State Street and Ramona Boulevard. The City also subsequently decided to install a signal at Cottonwood and State, based on signal warrants. Due to the one signal being Federally funded and on a State Highway, Cal Trans must approve the plans. In their review, they have required that the two signals be interconnected. Kimley- Horn, the engineer designing the signals, has given us a proposal in the amount of $1 ,800.00 for the required work. Staff recommends that the City Manager be authorized to execute the added contract, so the plan check can proceed further. (Kimley-Horn)to perform additional traffic engineering design services in conjunction with the State Street Traffic Signal Design Project currently near completion. This letter agreement is submitted in accordance with our discussions with Mr.Francisco Sanchez, and sets forth our proposed • Scope of Services,Schedule, and Fee. PROJECT UNDERSTANDING The traffic signals proposed for State Street at Cottonwood and Ramona Street, which we are under contract to design, will be separated by a distance of approximately 1/2 mile. In their latest review,Caltrans has requested that the two signals be interconnected and tied to the Caltrans TMC via a phone drop at the State Street/Ramona Expressway intersection. The interconnect and phone drop would allow Caltrans to remotely input synchronized timings between the two proposed traffic signals and the existing traffic signal at State Street and the Ramona Expressway. The Caltrans request has been discussed with Mr. Francisco Sanchez,at the City, who has indicated that the City has decided to pursue the installation of interconnect. Accordingly, revision of the plans, specifications, and estimates prepared for this project are needed. SCOPE OF SERVICES Kimley-Horn will revise the plans, specifications, and estimates previously prepared under this project,to include the design of an underground, twisted pair interconnect on State Street from Cottonwood Avenue to Ramona Street and from Ramona Street to Ramona Expressway. Following completion of this task, the revised PS&E will be submitted to the City and Caltrans for review and comment. Halloway, City Manager DATE: October 15, 1996 SUBJECT: PLANNING COMMISSION TERM LIMITS RECOMMENDATION Staff recommends that the City Council introduce the attached ordinance, waive the reading of the ordinance in full and read by title only. DISCUSSION On October 1, 1996, the Council directed Staff to prepare an amendment to the Planning Commission ordinance in order to establish term limits for Planning Commissioners. Presently, each Planning Commissioner is appointed by the City Council for a 4 year • term, with no limitation on the number of terms that an individual Commissioner can serve. Based upon Council direction, Staff has added Section 2.24.080 to Chapter 2.24 of the City Municipal Code to address Planning Commission term limits. The added language would establish a limit of two consecutive full terms. In situations where a Commissioner is appointed to fill an unexpired term, the remaining period of the unexpired term would be not be included in the term limitation. BACKGROUND The Accessibility Appeals Board was established by Council Resolution on January 23, 1996. The Accessibility Appeals Board considers appeals and provides direction on accessibility issues, including interpretations of Code sections and enforcement actions • undertaken by the Building Official. The Accessibility Appeals Board, when convened, consists of five members, who serve on an as needed basis. The five members of the convened Board can vary from meeting to meeting, based upon the availability of the seven individuals appointed by the City Council. The overall membership of the seven member Board is structured with three disabled individuals, three construction related professionals, and one person who is an at large member with no specific membership requirements. Due to an overwhelming response and desire to serve on the Board from the handicap sector of the community, Staff is recommending that the Board membership be expanded. Staff recommends that the active Board consist of 7 members, convened from a list of ten individuals appointed by the City Council. Staff is proposing to add one additional member to each category of the Board. The resultant Board structure would consist of four disabled individuals, four construction related professionals, and two at large members. The notice of appeal must be in writing on a form provided by the Board, and the notice must be filed and the fee, if required, paid at the office of the Building Official. The notice of appeal shall be sufficient if it identifies the act, order or determination appealed from, or sought to be ratified, and states wherein it is erroneous, invalid, or valid, as the case may be. The operations of the act, order or determination appealed from is suspended by the filing of the notice of appeal and until the determination of the appeal. Section 5. Notice: The Building Official or his/her designee, shall fix the time and place of the hearing on the appeal. Halloway, City Manager DATE: October 15, 1996 SUBJECT: LETTER OF SEPTEMBER 13, 1996 REQUESTING DELETION OF RESIDENTIAL FIRE SPRINKLER REQUIREMENTS FOR VILLAGE IV OF SOBOBA RECOMMENDATION • Direct staff as appropriate BACKGROUND The City received the attached letter from Pacific Developments who represents the buyer of 52 lots within Village IV of the Villages of Soboba. The letter request the City to either delete the fire sprinkler requirement for the entire City, or at the very least, waive the requirement for his homes. The rationale for the request includes: 1. The pressure required for the sprinkler system is too high and the system is subject to leakage as a result. 2. Having the sprinklers worry the occupants because of a possible leakage. 3. Residents have deactivated their sprinklers as a result of one leak. 4. Sprinklers increase the cost of a house. Buyers would rather pay a lower price. 5. Sprinklers are not necessary, due to the Country Club being constantly irrigated. • 6. The fire station was close enough to allow a 3-4 minute response. • The staff is looking for City Council direction on this matter. However, we do feel some information is important to give to the Council. 1 . The Soboba Specific Plan required the construction of a fire station on the project side of the River, due to the distance from existing facilities as well as the lack of a bridge. 2. Sprinkler systems operate at 60 pound of pressure. However, the system is tested at 200 pounds for three hours. The water pressure in this area is apparently fairly high. If there are pressure surges, it is possible a fitting could loosen. The pressure issue can be handled by the installation of a pressure regulator that will reduce the pressure to 80 pounds. 3. Staff had not been informed of a leak until we began confirming the information in this letter. We are unaware of anyone with their sprinklers turned off. We are aware of at least one of pressure regulator installation. 4. There has been no significant change to the positioning of the fire station in relation to Soboba Development. Any project beyond 1 .5 miles of the station has a greater chance of a fire "flash-over" due to a longer response time. Flash-over can occur as quickly as five minutes from commencement. Unless the Fire • Department was in their turnouts and in the east side of town, there is no way Soboba would be a five minute response (the response to the Chamber explosion was approximately 8 minutes.) On behalf of HDB, we would respectfully request consideration of an exemption from the requirements of the above—referenced City ordinances for the construction of the remaining homes in Soboba Springs, and to be placed on the next City Council docket for a hearing on this matter, on Tuesday, September 24, 1996, for your Council's consideration of a recission or an amendment to the applicable ordinances, as appropriate. In support of our request for City Council consideration of recission or amendment of the subject ordinances, we would offer the following summary of background information for your consideration. SUBDIVISION INFORMATION Soboba Springs, located with access from the intersection of Soboba Road and Chabella Drive, was originally a master—planned community of about 1,200 homes. The development currently includes 109 completed detached single-family, tile—roof, residences (1,024-1,337 sq. ft. gross floor area), with 58 additional homes yet remaining to be completed on 4,000 sq. ft (minimum) graded lots. The current inventory of completed homes has been in existence for about seven years. The first home sales were in 1989. About 40 of the completed homes and undeveloped lots are located contiguous with the irrigated, grassy fairways of the Soboba Springs Country Club Golf Course, along the project southern and southwestern boundary property lines. About 12 of these fairway lots are owned by HDB, and would be developed with the same, or similar floor plans and sizes as the existing homes. • Mr. Brian McNabb September 13, 1996 Page Two • A 1988 Declaration of Covenants, Conditions, and Restrictions and Reservation of Easements (CC&R's), is currently in effect, the conditions of which are regularly monitored and enforced by the local Homeowner's Association, which is comprised of local permanent residents. FIRE CONTROL REQUIREMENTS All existing homes include interior residential fire sprinkler systems (approximately 150 psi main working pressure limits), required by City ordinance, with individually activated sprinkler heads in each room and separate interior areas. All homes also include large(25 sq. ft. floor area)fire access, exterior side, alcove areas. Activation of the sprinkler systems is owner/resident—controlled, and the CC&R's require that sideyard access remain clear and open to the alcove areas. Adherence to these conditions is ostensibly monitored by the Architectural and Landscaping Committee. OPINION OF RESIDENTS AS TO SPRINKLER SYSTEMS A recent survey of Soboba Springs' residents as to the justification and necessity of the fire control requirements has provided the following information. The majority of residents believe that the sprinkler systems are unnecessary and burdensome, as confirmed by Soboba Springs' home owner/resident, Ms. Hilda Sweeny of 1856 Carrera Drive There have been several instances of accidental activation of the independent sprinkler systems, which have resulted in water damage and very disturbing consequences to a number of the elderly owner—residents. Most • residents are far more concerned about accidental activation of the systems, or about actual structural failure of the 150 psi high water pressure systems, than they are about the presumed additional fire protection provided by the interior sprinklers. One family of residents experienced burst pipes and fittings in their absence, and upon return to their home after several days of continual high water pressure leakage, was confronted with thousands of dollars in damage to the structural interior of their home, their furnishings, floor and wall coverings, and personal belongings. The damage also included extensive collapse of ceiling materials. This family incurred substantial additional expense in time and for temporary relocation living accommodations during the many weeks required for repairs and replacements. Their insurance company covered a portion, but not all of the expenses, and of course could not compensate them for the overall trauma of the entire event, and for the subsequent and continuing fear of a repeated sprinkler system failure. Following the above—described event, the subject resident, and many other Soboba Springs' residents have simply deactivated their sprinkler systems for fear that a similar failure would occur in their homes. The general consensus of opinion among residents throughout the area is that the sprinkler systems are unnecessary and a source of constant anxiety. Most residents have indicated that they would have much preferred to purchase their homes at a lower price (most are on retirement, fixed incomes) than have to pay an increased purchase price for a home required to have sprinkler systems. This is an important deterrent to consideration of home purchase, especially where, as here, these systems are know to fail and cause substantial damage, and are susceptible to frequent accidental activation. Most of the residents also expressed the opinion that the imposition of the sprinkler system requirements was particularly senseless given the location of Soboba Springs contiguous to the constantly irrigated Soboba Springs Country Club Golf Course. They also believed that the ordinance was not fairly applied to other surrounding area • residences, which are not required to have interior sprinkler systems, thus allowing a lower purchase price and lower property tax burden. Pacific Developments Mr. Brian McNabb September 13, 1996 Page Three • HOMEOWNER'S ASSOCL4 TION POSITION Mr. Kenneth Brass, Soboba Springs' home owner/resident, at 828 Verona Avenue, telephone(909)654-6824, is Chairman of the Homeowners Association Architectural and Landscaping Committee, and is a retired Fire Battalion Chief of the City of Torrance Fire Department. Mr. Brass has indicated that he believes the required sprinkler systems to be an unnecessary expense, and a source of constant concern over additional water damage expenses to and for Soboba Springs residents, and he would strongly support removal of the requirements for any future construction within the development. The basis for Mr. Brass' support of the removal of further sprinkler system requirements is that the distance between Soboba Springs and the City of San Jacinto Fire Department, at 132 South San Jacinto Street, is about 2.6 miles, and the current response time would be expected to be about 3-4 minutes, given the relatively light traffic on the most likely emergency route from the Fire Station to Soboba Springs. FIRE DEPARTMENT RESPONSE Mr. Stephen Overton,Fire Engine Driver/Engineer for the City of San Jacinto Fire Department,Fire Station#25, located at 132 South San Jacinto Street, telephone (909) 654-7912, has confirmed that the emergency response time to Soboba Springs would be about 4 minutes, following a route north along South San Jacinto Street, then east along East Main Street/Lake Park Drive, then northwest along Soboba Road, to Chabela Drive. Pacific Developments conducted 30 separate, timed drives along this route in a private vehicle, traveling at legal speed limits, daily, at morning, noon, evening, and early morning hours, and the average travel time from Fire Station • #25 was approximately 4 minutes. Engineer Overton indicated that the fire sprinkler ordinance was required, not because Soboba Springs was in a high fire hazard area, but rather to contain fires, and to save manpower expenditures. He indicated however, that the City of San Jacinto Fire Department currently is under contract with the Riverside County Fire Department, which has expanded the City of San Jacinto's fire fighting resources and capabilities. As such, the City reports all fire incidents to a central data collecting agency through the City's Fire Prevention Officer, Mr. Robert Wilson, telephone (909)487-7321. Engineer Overton indicated that no fire response has been required in the seven years since Soboba Springs has been developed. EFFECTS ON AVAILABILITY OF AFFORDABLE HOUSING When originally marketed in 1989, houses were offered for abut $98,900 to about $124,900, with those homes adjacent to the golf course being the more expensive. 1993 and 1994 home sales ranged from about $90,000 to about$115,000 for non—golf course frontage homes. The requirements for interior residential sprinkler systems at Soboba Springs, can add as much as $1,500 to $2,500 to the cost of any of the new homes, depending upon the floor plan and upon the sprinkler system specified. This is a substantial additional expense to pass along to new home buyers, particularly to those senior citizens on relatively modest, retirement fixed incomes. Some fire insurance premium rebates (about $100/year) are available for sprinkler system homes, but the difference in additional premiums to also cover related water damage, more than offsets the slight reduction. EFFECTS ON AVAILABILITY OF AFFORDABLE HOUSING(Continued) Soboba Springs is not a"seniors only"community, but a majority of the residents are retired senior citizens and the community has been marketed to be attractive to low and moderate income families to meet the increasing demand for such affordable housing. HDB Developments desires to be able to sell homes affordable to senior citizens, and • well as to other age groups with limited incomes. Pacific Developments Mr. Brian McNabb September 13, 1996 Page Four Substantial development fees are currently being required to complete the construction of additional low and moderate income homes on the remaining lots in Soboba Springs, and the sales of over 50 additional homes will substantially increase the property tax base for the City of San Jacinto, to help offset the Fire Department manpower and operating costs, which is already being assisted by the County of Riverside, as previously mentioned. ORDINANCE REQUIREMENTS AND SUGGESTED COUNCIL ACTION As currently applied, Ordinance Number 1014, amends Ordinances 975 and 976 to require residential sprinkler systems in detached, single—family homes, located beyond approximately one and one half mile from the Fire Station(Fire Station#25). The Ordinance states that this is to provide adequate fire protection for new construction in the event of flashover, i.e, the spreading of a fire from one home to another, which the Ordinance states may happen in as little as four minutes(italics added). Given the "approximate" nature of the basis for the Ordinance requirement, and the summarized background information, specific to the Soboba Springs development, as presented in this letter, we would respectfully request that the Ordinance be rescinded, amended, or in the alternative, that a project—specific exception be granted by your City Council, to allow the additional homes to be constructed at Soboba Springs without the requirement for interior fire sprinkler system installation. We greatly appreciate your attention to this matter, and the assistance of your staff, and of other City of San Jacinto Departments in providing us with factual information relative to the subject of our request. After you have 41) had an opportunity to review the information provided herein, we would be pleased to answer any questions you may have, or to provide you with additional pertinent information.
