• Councilmember Cornett stated it was her understanding that the program was
on the last year, unless the City rebid. She wanted to be certain that the
mechanism was in place to do so, and that staff knew to follow up on it.
Interim City Manager Alberg stated the item had been pulled from the last
agenda in an attempt to negotiate reduced hours, because of the many
activities at the facility, which raised the issue of additional funds for support of
the program, but that was not well received. However the question was did the
City want to continue the program. which itself was well received. There
would be an outline and bidding for continuation of the program.
ITEM PULLED FROM CONSENT FOR SEPARATE DISCUSSION:
5.7 Warrant Register
Finance Director Herrera advised that the warrants for Kammeyer &
Associates were for the tot lot retrofit, which was approved by Council March
19th, for a total of $10,027. It was for architectural work for the design of the
Sallee tot lot. The retrofit for Rancho Park would be reimbursed by CDBG
funding.
Councilmember Cornett noted that on Rancho Park, Council had voted twice
for some sort of safety material under the equipment, and that had not been
• done, and inquired if that was what the charges were for?
Interim City Manager Alberg stated that was part of the work, the design was
to bring the park in compliance with ADA standards.
Councilmember Cornett stated the approval for the ADA compliance had been
approved by Council about five years ago, and it was discussed to install a
safety cushion of material under the play equipment at Villines Park, but to
date, it was still just packed hard dirt. Voiced concern regarding liability.
Concerned that the specific issue had been discussed on both prior occasions
when expenditures were approved and the work had not been completed.
Community Development Director McNabb assured Council that the safety
material would be installed. Clarified for Council that the prior approvals of
expenditures were specifically to meet ADA compliance, which had been in
excess of $60,000. In response to Council inquiry, advised that siimilar
projects at other parks were being funded through the LLMD.
i
Councilmember Williams requested that staff bring back to the next meeting •
the information related to prior approvals relating to the projects, including
similar approvals whose sources of funding were the CFD, LLMD and CDBG.
Questioned the justification for certain charges to the CFD when the facility
benefitted the entire community, not just the residents paying the CFD. He
would like the City Attorney to review the ability to make charges for the park
facility to the CFD.
Finance Director Herrera clarified that the $5,000 was for architectural plans
only, according to the description on the bill.
Interim City Manager Alberg stated that the contract entered into was for the
redesign of the facility.
Community Development Director McNabb, in response to Council inquiries,
stated that none of the $60,000 + package was for design and that there was
separate allocation of funds for different phases of the work, identifying project
one as phase one of Sallee Park to upgrade and change equipment to meet
the safety standards and comply with ADA, part of which would come from
CDBG. Project two was a contract to design the ADA retrofit for Rancho Park
and the other tot lot, to bring them in compliance, with the funding for that to
be from CFD #2. The actual funding for the work would be addressed during
budget, and it was mentioned that funding would be available from CFD#2.
Staff had previously outlined three projects related to Rancho Park and the two
remaining were a bike way parallel to Mountain Avenue and the upgrade of the
water system. The Council had directed that two projects would be done with
financing from CFD #2 for the construction plans. The payment being made
was a progress payment for the design. The City was not committed to using
CFD funds and could use other revenues.
Finance Director Herrera clarified for Council the total contract was $10.027
for the Sallee Park, Rancho Park and Villines (north retention basin).
Councilmember Cornett stated in the future she would like better information
before agreeing to a contract, and would like to know more information before
voting.
A MOTION was made by Councilmember Williams, seconded by Mayor
Conner, to approve warrant numbers 43148 through 43281, dated May 31,
1996 in the amount of $255,132.60 and Payroll check numbers 7299 through
7370 dated April 26, 1996. Motion carried on a 3-0 vote with Councilmembers
Smedley and Solorio absent.

• COUNCIL CONSENSUS that staff bring an update to the next meeting, with
the budget, on the funding and revenue sources for the proposed projects,
including what was chargeable to what source.
6.0 PUBLIC HEARINGS

7.0 CITY DEPARTMENTS
7.1 Overview of City Water Enterprise
Water Superintendent Grajeda made a presentation as contained in the staff
report on file with the City Clerk. Stated the City had already purchased water
from EMWD and staff needed direction if Council wished to resolve that costly
expense. The fact was, even if they had more water, they could not move it
without changing out some lines. If Council would provide some direction staff
could come pack with a proposal to increase rates.
Councilmember Cornett suggested that the matter needed to be addressed in
the budget process and there was a need to identify the shortfalls. Suggested
that the information be given to the Budget Subcommittee in the next couple
weeks, possibly by next week, to review before considering a rate increase.
• Lengthy discussion of the Master Plan prepared by Kennedy/Jenks
Consultants from 1992. Staff clarified the various categories of capital
improvements.
Mayor Conner inquired what was the difference in the ES2 and 3 tables, how
many years was the plan for and when would improvements start and how did
it relate to the annexation. Generally what was the status?
Community Development Director McNabb stated that in the master water
plan the ES2 table represented existing development, and stated it was
inadequate to serve the existing need during a peak load. It was
recommended those improvements be high priority. Based on staff
recommendation it became Council policy for a new well. The ES3 table was
for future development and the priority level was more of a guess and
contingent upon development.
Councilmember Williams felt the plan was not accurate, because since 1992
there had been $2 million in bonds issued for the work, was that separate?
Water Superintendent Grajeda stated it was separate.
•
Mayor Conner disagreed, stating that some of the ES2 had been taken care
•
of, such as the Vernon and Second Street area.
Water Superintendent Grajeda stated that Vernon Street was not complete
and nothing had been done to resolve what had been presented.
Councilmember Williams noted he did not want the impression to be made
that the bonds were for no reason, there was a clear reservoir, new meters,
and a filtration system. There had been obvious improvements and clearly
there were still more to do over the long range. Stated the City needed to
decide if they were going to stay in the water business or not, and if so, they
needed to make the improvements. If they did not, then sell the business to
EMWD and then all would have to pay those rates, which would be an
increase. If the City continued, felt the City's increase would be less. Would
like to look at some options, by looking at such things as connection fees,
thinking the City could do it with just an incremental rate increase and still
operate at a break even point, and if not, would have to consider what to do.
Community Development Director McNabb noted the FX table were future
projects related to tract development and were not complete. The E2 was
complete, as was some of Vernon. Felt the plan needed to be evaluated and
implementation planned or to look at another version. Staff was looking to
replace the Victoria water line, and De Anza called for the installation of a 12
inch line, and Victoria needed to be upgraded from 8 inch to 12 inch and with
that accomplished that would be the equivalent of E7.
Councilmember Williams voiced concern at being able to accomplish the plans
at the $92.00 cost quoted.
Mayor Conner requested that staff look at the ES3 and future plans, because
of the need and ability to fund. Felt the ES2 was not current and needed
review since it had been four years since the plan was prepared. Suggested
that the document be reviewed line by line to determine if they were still
priorities and look at phasing the work and determine what needed to be done
immediately. Look at whether another well was needed, and possibly looping
the wells together. Staff could provide an outline of the meter connection fees
comparing the fees of neighboring agencies to assure complete cost recovery.
That was a revenue source not yet addressed by the Budget Subcommittee.
Then staff could bring back rates and fees to Council, and determine how to
amortize the improvements and Council could review all of it simultaneously.
Councilmember Williams requested to expand the scope of the
recommendation and prepare the study, in addition to including what was
outlined by the Mayor, include a review of capital improvements, both existing
and future priorities, and the capital facilities program be reviewed and
prioritized from the operating point of view, those being the most essential, in
conjunction with the rate outlines, etc. Then Council could discern a program
of work and the cost. He would be willing to put that in the form of a motion.
Mayor Conner noted they needed a consensus and it seemed they all agreed
on the direction for staff.
Councilmember Cornett stated she would like to review the existing numbers
and see where they were losing money.
Finance Director Herrera indicated he had the sense that Council would like
the expanded program of work in the near future, and he could draft a memo
on the program of work but it would not be appropriate to evaluate all the
information in two weeks, but could outline a time line.
Councilmember Cornett noted that reading the audit reports, determining why
the water enterprise was losing money should be a priority before the budget
cycle was complete this month.
8.0 MAYOR/COUNCILMEMBER REPORTS/DISCUSSIONS
8.1 1996-97 Budget Committee Report - Lcontinued from mtg. 5/28/96)
Councilmember Cornett stated the subcommittee would continue meeting and
changing the way they approach and look at the budget. They had been
getting some good information from the Interim City Manager and help in
changing the focus to get a better handle on what had to be done. They were
working to get special funds self standing without transfers and advances.
They were also working on a policy to address transfers, and that they only be
by resolution. They were beginning to get a clear picture on revenues and
intended to have a balanced budget. Staff was working on the figures and a
final budget was expected in three weeks. The budget had been reviewed with
staff and the Interim City Manager was about half complete with changes and
would have something next week..
Councilmember Williams questioned that the rest of Council would only have
two weeks to look at the budget?
Councilmember Cornett noted that they would devote most of the next meeting
to the budget, with the full Council for input and discussion, and unless there
was something really glaring, they could approve it the following week.
1
Councilmember Williams had expected to discuss the budget that evening, •
because the subcommittee had been working on it for weeks and did not feel
two weeks was enough time to sort through it. Would like something in
advance to have access to the information.
Mayor Conner noted that the budget process this year would bring a balanced
budget and there should not be major issues, like the previous year when the
Council was running scared and could not make a decision. Related how
quickly the RTA had approved their budget, which was significantly higher.
Councilmember Cornett noted that the subcommittee had met with each
department and they had a study session with the full Council to determine
what was out there and they had just been waiting for the revenue figures in
order to roll back the wish lists of the departments. Now they were just
massaging the final figures to determine what had to go and what would stay.
Council was over loaded with upcoming meetings with the past City Attorney
interviews and the upcoming City Manager interviews.
8.2 Appointment of Ad Hoc Subcommittee to Review Chamber of Commerce
Contract (from mtg. 5/28/961
Councilmember Williams offered to volunteer and stated that Councilmember
Solorio had also indicated a willingness to volunteer. He had been involved in
the initial contract and attended a VEDC meeting, which may dove tail and
•
help with the discussions with the Chamber. Indicated there may also be a
separate level with the VEDC down the road.
Mayor Conner appointed Councilmembers Solorio and Williams to serve on
the Ad Hoc Chamber Contract Subcommittee.
8.3 Ad Hoc Subcommittee Report on Utility Billing Policy on Delinquent Accounts
and Landlord Pay
Councilmember Cornett noted their report was delivered the prior evening, but
did not address the statute of limitations on collecting back charges.
Suggested that the City Attorney be consulted and the Finance Department do
a random sampling on the un-billed accounts. That would be a long process,
but the good news was that every address that was legitimate was being billed.
Of the 161 people billed, the ones that did not sign up for the past two months
were ready to go to collection. Some would fall within the exemptions and
when modified would not be sent for collection. Finance would go immediately
to the other water agencies and determine water consumptions and could tell
if the exemption would apply and contact them to bring proof and apply, then
the charges would be waived, with the rest going to collection.
S
• Finance Director Herrera, in response to Council, indicated that staff would
include a letter with the bills, to be more cost efficient and less time consuming
in the process. Noted the vacancies could now be tracked. Of the 31
addresses provided by OK Associates, they would be notified the next day by
him personally.
Mayor Conner noted the effort took a lot of hard work and commended all for a
job well done.
Councilmember Cornett, in response to Council inquiry, noted staff was
looking at software which would track the vacation status and some nominal
fee for the service would be implemented, in exchange for the reduced rate.
Councilmember Williams suggested some nominal fee, as a revenue
equalizer, for a change in the bins, which would generate more work for staff.
Finance Director Herrera noted that had not been addressed, but they would
next look at an ordinance for late payment charges to deal with the high
delinquency rate, which would be an incentive to pay timely, and they would
add Councilmember Williams suggestion.
Interim City Manager Alberg, in response to Council, noted the variable can
rate would be a matter for discussion with OK Associates and the contract,
• including the tipping fees. Advised they had received a letter request from OK
Associates for a cost of living increase effective August 1st.
Councilmember Cornett suggested the contract was due for review and
wished the City Attorney would address that.
City Attorney Brown indicated that they would normally review any adjustment
requests having to do with the CPI, and they would be happy to do so on this
and bring back their review.
Councilmember Cornett suggested that review be brought back at the next
meeting for a vote of the Council.
City Attorney Brown suggested Council could entertain a motion to adopt the
policy they wished to set forth.
Mayor Conner noted the City Clerk had recommended not taking action at the
present meeting, in the absence of the report until that day.
Councilmember Williams inquired if the fees could be brought back at the next
meeting?
City Attorney Brown felt that looking at the agenda, the public could determine
the action contemplated and the report contained a recommendation. It was a
close call, but if Council wanted to avoid problems they could bring the matter
back at the next meeting.
Councilmember Cornett did not want any problems.
Mayor Conner suggested the matter be brought back at the next meeting.
COUNCIL CONSENSUS to direct the City Clerk to agendize the matter for the
next meeting.
City Attorney Brown suggested that if Council was contemplating
subcommittees bringing reports with recommendations for action, which they
were anxious to move along, that a reference be added to the report which
would indicate some action which would provide adequate notice to the public
and avoid having to come back again for adoption.
8.4 Pre-meeting Sessions with City Attorney
City Attorney Brown stated from his interview it was clear there were a number
of issues requiring clarification related to billing utility issues, etc., and
suggested there would be some value in discussing with the Council, as a
whole, some broad brush issues and some legal issues.
•
Interim City Manager Alberg felt there was a need for some review of
procedures, the information processes and philosophical issues, which would
raise questions. The proposed approach would be a more informative process
and eliminate some of the discussion so Council could concentrate on the
issues at hand without being diverted by information that was not adequate or
relevant. Suggested that Council meet an hour before their regular meetings
to have the dialog, with no action being taken. It would be a time to be
informed in emerging issues and time to give some direction. This would help
to get Council out of a reactive mode and into a supportive mode, in making
the public aware of what they were working on, instead of always reacting to
situations being brought by the public. The sessions would be open to the
public.
Mayor Conner suggested in conjunction with that, as part of the investigative
process, there were a number of issues and Council had hired a firm to tackle
some big jobs and something needed to be done to get the City Attorney
involved in the pending litigation and get something in motion.
•
• City Attorney Brown advised he had met with staff and was making progress
on getting up to snuff quickly on the contracts, etc, but had not seen anything
that would cause any un due concern. On the other hand, there were a
number of broad issues ranging from labor and employment, to water laws,
etc, land issues and long range planning, Council relationships, RDA,
intergovernmental relations, special districts, etc. This would be a matter of
Council policy if they wanted to talk about those together before making policy
decisions on those issues, and help Council develop a vision of their priorities.
Councilmember Williams suggested that it begin a the next meeting.
Suggested that the City Attorney could even bring people as appropriate to the
process, working with the City Manager.
Mayor Conner felt the suggestion sounded interesting, and the interview
process had been a great learning process for the Council and he was looking
forward to learning more from more the members of their firm. It was Council
consensus to start the next meeting on June 18th, at 5:00 P.M. for that
purpose.
Mayor Conner related he had attended the League conference in Sacramento and learned a
lot. Was looking forward to continuing that education process next fall in Anaheim.
At the hour of 7:21 P.M. Council recessed.
• At the hour of P.M. Council reconvened, with all members present, except

SUBJECT: EXTENSION OF THE SUBDIVISION AGREEMENTS FOR TRACTS 22665
AND 22665-1, PALOMAR SAVINGS AND LOAN (SOUTH OF SEVENTH
STREET, WEST OF PALM AVENUE).
RECOMMENDATION
Staff recommends that the City Council extend the Subdivision Agreements for Tract
22665 and 22665-1 for a period of two years, to expire July 21, 1998.
DISCUSSION
The original Subdivision Agreements for the two maps were executed and became
• effective on July 21, 1992. Both Agreements were extended in July 1993 for a two year
period. Due to the lack of development activity in the vicinity of the site at this time, the
property owner is requesting that the Agreements be extended an additional two years.
The bonds are still in full force and effect, as the premiums have been paid and been kept
current. Additionally, the site and the surrounding area are substantially vacant with no
development pending. Therefore, Staff does not anticipate a need to call the bonds for
this tract within the next two years. As such, the requested two year extension is not
inappropriate.

SUBJECT: AWARD OF ANNUAL LANDSCAPE MAINTENANCE CONTRACTS
RECOMMENDATION
Award the contract for Landscape Maintenance to D & J Landscape, of Winchester, for
• a bid of $9,660 and authorize the Mayor to execute the contract on behalf of the City.
FISCAL IMPACT
The 1996-97 Proposed Budget includes $122,500 for landscape maintenance contracts.
These funds are generated through the Landscape, Lighting and Park Maintenance
Districts. The recommended bid, including discount, is $9,660, which, when added to
the existing contracts with D & J Landscaping, totals $109,896. All of our landscaping
contracts total $116,076.
BACKGROUND
On May 23, 1996, the City Clerk received bids for the maintenance of additional
landscape areas throughout the City. A bid summary and last year's low bids are shown
on the following page.

Each bidder was asked to submit a bid on each landscape location and a bid for doing all four
locations.
Mentone Supply Turf submitted a bid by the month, which was contrary to the bid requirement
of an annual bid. Nonetheless, D & J Landscape is the low bidder when Mentone's bid is
annualized.
D & J Landscape has offered a bid of $9,660.00 to perform all the four landscape locatio•
This bid reflects a 20% discount for awarding all four locations to them. D & J has been working
for the City for the past three years and has done good work.

RE: RANCHO PARK SECURITY
RECOMMENDATION:
1. Authorize Valley-Wide Recreation and Park District to expand
• their use and control of the park.
2. Authorize control of the tennis courts by Valley-Wide.
3. Provide all-night security lighting at the park.
4. Consider Police Department report regarding volunteer citizens'
patrol.
BACKGROUND:
At the City Council meeting of May 21, 1996, representatives of the Rancho
San Jacinto Homeowners' Committee addressed the Council on the operation
of Rancho Park. The citizens group presented a strategy to improve public
safety and enjoyment at the park site.
The first element of the homeowners' strategy was to allow expanded use,
scheduling, maintenance and control of the park by Valley-Wide Recreation
and Park District. Mr. Sam Goepp, General Manager of the Valley-Wide
• Recreation and Park District has agreed to increase the level of activity at
Rancho Park by scheduling activities year-round, rather than during only the
summer months.
•
By adding Coed Softball, Church Softball and Men's Softball to the current
program of Girls' Softball, the ballfields would be in use at least three days
each week between February and November. There would be up to two
games a night, at 6:00 p.m. and 8:00 p.m. Valley-Wide is willing to maintain
the ballfield, but not the remainder of the park.
The second element of the homeowners' strategy was to provide increased
security measures at Rancho Park. Suggestions included: locking the tennis
courts and the entire park at 10:00 p.m., opening a portion or all of the park,
installing a lockable gate at the entrance to the parking lot on Esplanade
A venue, and allowing the security lights to remain on all night. Staff has
considered the homeowners' suggestions as follows:
a. Lock the tennis courts. Valley-Wide Recreational and Park District is
willing to manage the tennis courts. However, anyone wishing to use
the courts would have to check out a key at the Valley-Wide office.
h. Lock the park after closing. Fencing the park would require about •
1,500 feet of fencing at a cost of at least $15,000 for a modest chain
link fence. Locking the park each evening would be a costly program
unless volunteer could be found to take on the responsibility. Locking
the parking lot by installing a gate at the entrance could be
accomplished for less than $1,000 but, again, a program for locking
and unlocking the gate, 365 days a year, would require a dependable
volunteer or a City-financed work program.
. Provide security lighting all night. Changing the timer to leave lights
on all night is relatively simple. The cost of the additional hours of
lighting has not been estimated, but should not exceed $100 per
month.
The third element of the homeowners' strategy was to establish a trained
local citizen patrol "to observe and report incidents occurring at the park."
The City's Police Department has indicated a willingness to provide training
to some type of volunteer patrol. This issue is presented in a separate report
from the Police Department.

DATE: June 18, 1996
SUBJECT: FOLLOW-UP FROM JUNE 4TH MEETING REGARDING VILLINES TOT
LOT (NORTH), AND USE OF LLMD AND CFD NO. 2 CONSTRUCTION
FUNDS
RECOMMENDATION
Direct staff as appropriate.
•
BACKGROUND
At the Council meeting of June 4, 1996, the following questions were raised regarding the
northerly tot lot on Villines:
1. Is the latest design contract solving the safety problem which exists due to
the lack of a "soft" surface beneath the play equipment. The safety
problem was discussed five years ago.
2. What are the options to pay for the retrofits? Can LLMD funds pay for
these improvements?
3. Was the design cost of $10,000 reasonable?
Staff will attempt to address these questions in the order listed above.
1. The preliminary design from Kammeyer & Associates does call for the
installation of 12" of wood fiber beneath all of the play equipment. This
surface, or an equivalent alternate, should eliminate the safety issues as we
• understand them.
We have searched the minutes back to July of 1990, and have found
nothing regarding a previous mention of this issue. •
2. As outlined in the attached staff reports and minutes the sources to pay for
park improvements are limited. They include:
a. Park Development fees - Collected from developers to aid in
achieving the City goal of five acres of park per 1000 people.
Therefore, these funds should be used for new park purposes, not
retrofit. The current balance in this fund is $208,468.16 as of April
30, 1996.
b. CFD #2 construction funds - The City sold $26,000,000 worth of
Mello-Roos bonds to build the facilities within Rancho San Jacinto,
to City standard. As the play areas do not meet City standard
regarding the American with Disabilities Act, and there still remains
construction money, an argument can be made that this is a
justifiable use of CFD #2 funds. Whatever construction funds remain
unspent will be used to redeem bonds. This bond redemption will
only benefit the developers in the short term.
c. LLMD - Funds can be used for the construction and maintenance of
a variety of items including our retrofit project. The catch for FY
1996-97, is that the project must be mentioned in the engineer's
report and funding must be adequate to cover the new expense.
The Council approved the preliminary engineering report which did
not include any construction proposals and also proposed no
increase in the rates. Attached is a copy of the types of projects
allowed by LLMD laws.
d. Park Grants - State and Federal Park Grants are occasionally
available on a competitive basis.
3. The City sought design contracts for the park retrofits and the Sallee Park
from the two area firms which had done extensive work for the City in the
past. The contract for $10,027 was awarded to Kammeyer & Associates,
which was the lower of the two proposals by $1,473.00. In the context of
the construction budgets, the design contract is about 6.5% which is a very
normal cost. We may have been able to achieve a slightly better price if we
had solicited proposals from other firms. However, our recent experience
with other firms is that they were not as responsive, due to their not being
in the area.

• STAFF MEMORANDUM
To: Mayor and Members of the City Council
From: Interim City Manager Lyle W. Alberg
Date: June 18, 1996
Subject: David Kahn Senior Day Care Center
Recommendation:
Give staff direction on how to proceed.
Background:
In the mid-1980's, the San Jacinto Community Center was expanded, utilizing Federal
• Community Development Block Grant (CDBG) funds contributed by Third District
County Supervisor Kay Ceniceros. One of the conditions of these funds was that the
David Kahn Senior Day Care Center would be allowed to occupy a portion of the
Community Center, rent free, for five years. This five-year period was up in the early
1990's. At that time, a Council committee was formed to meet with members of the
Center's Board of Directors to develop a new agreement. Even though there were
meetings held, no agreement was developed. However, in the meetings, the Day Care
Center's Board and Executive Director committed to pay a monthly stipend to help
toward utilities as well as assumed some of the maintenance and upkeep
responsibilities. As a result, the Day Care Center has been contributing $150 per
month since that time, which was then increased last year (initiated by the Day Care
Center) to $200 per month.
The Day Care Center uses approximately 1900 square feet of the Community Center
building, and an additional 1880 feet in outside "patio" space. Their hours of operation
are Monday - Friday, 8:00 a.m. - 5:00 p.m. They are the exclusive users of the space.
Although the space is made available during the evenings, and on the weekends to
other Community Center user groups, who need meeting space.
The City pays for the utilities (gas, electric, and water) that are used by the Day Care
Center as well as provides some basic custodial service. The costs of the utilities for
this portion of the building are estimated to be approximately $2105 per year, with the
major share of this cost being electricity. The City also makes major building repairs,
• such as air conditioning and heating maintenance and repairs as well as roof repairs.
r
David Kahn Senior Day Care Center
Page Two •
For their part, the Day Care Center pays for and does their own interior building
maintenance repair, IE. painting, carpet replacement, etc. Additionally, the Day Care
Center pays for their own liability insurance, provides their own bathroom supplies and
does some minor daily custodial work, IE. emptying trash cans, vacuuming, etc. They
also paid for, and built, the new patio area that was constructed several years ago.
The City Council should consider whether at this point you would like to enter into a
formal agreement with the David Kahn Senior Day Care Board of Directors which would
formalize the relationship, establish each party's responsibilities in writing, set a monthly
rent amount and provide a period of time in which the Day Care Center Board and staff
would know that they would be able to continue their program at the San Jacinto
Community Center. Prior to his resignation, former City Attorney Jim Cox drafted an
agreement, that is on file in the City Clerk's Office.

CITY OF SAN JACINTO
STAFF REPORT
TO: Honorable Mayor and City Council Members
FROM: Brian McNabb, Director of Community Development
via Lyle W. Alberg, City Manager
DATE: June 18, 1996
SUBJECT: CALL FOR PROJECTS BY RCTC USING INTERMODAL SURFACE
TRANSPORTATION EFFICIENCY ACT (ISTEA) FUNDS
RECOMMENDATION
• Direct staff to submit projects for ISTEA funding.
DISCUSSION
In anticipation of the reauthorization, by the Federal Government, of the ISTEA program,
ROTC has called for Projects for FY 1997-98 and FY 1998-99, using Cal Trans estimates
of funding apportionments.
There are three sources of funding available under this program.
1. Surface Transportation Program (STP) - Formula Program. It is anticipated
the City is entitled to receive $138,000 over two years for eligible projects.
2. STP - Discretionary Program. Approximately $9 million is available for
eligible projects through a competitive process. Fifteen percent (15%) of
this money may be considered for planning projects.
3. Congestion Management/Air Quality (CMAQ)- Discretionary Program. An
estimated $12 million is available for projects which relieve congestion or
improve air quality.
•
The Competitive Criteria for STP/CMAQ funds include:
•
1 . Measure A projects identified in the County Strategic Plan
2. Economic Development
3. Project Readiness
4. Regional, multi-jurisdiction, or CMP roadway improvements not included as
Measure A projects.
5. Air Quality enhancements
6. Geographic balance
7. Areas having more than 100,000 population
At this time there is no priority order or weight assigned to these criteria. RCTC will be
developing this after applications are submitted.
The City Council must determine which funding it wants to pursue so that applications
can be submitted by the July 8th deadline (June 24th for planning projects.)
Staff recommends two projects for consideration under the category of Discretionary •
Funds:
1 . The extension of the Ramona Expressway between Seventh and Cedar as
a joint project with the County and the City of Hemet. The City already has
an allocation of $400,000 towards this project, and the County has
approximately $700.000. The amount of this application would be
approximately $2 million.
2. A joint planning project with the City of Hemet providing a more detailed
study of the Highway 79 Corridor. We propose to initially ask for $75,000.
The Council can commit the STP formula funds for any number of projects. However,
they must be cognizant that funds would not be available for several years. Possible
projects include:
1 . The Ramona Expressway extension Seventh to Cedar
2. Widening any existing portion of the Expressway
3. Resurfacing Warren Road, south of Cottonwood
•
4. Widening of Sanderson
5. Traffic signals at Cottonwood and Sanderson
6. Widening of San Jacinto Avenue south of Commonwealth.
If possible, the Council should attempt to select projects that can be assigned matching
funds, addresses a traffic safety or congestion issues, implement a master plan, and
helps achieve economic development goals.
The City has few projects that might qualify for CMAQ funding. The only Congestion
Management Plan roadway in the City is the existing Highway 79. Otherwise we might
submit some sort of bikeway project. CMAQ funds require a 11 .47% match.

• MEMORANDUM
•
TO: Mayor and Members of the City Council
FROM: Refuse/Recycling Council Sub-Committee Members
David Solorio and Debbie Cornett
DATE: June 18, 1996
RE: Utility Billing Audit & Policies
RECOMMENDATION: It is requested that the City Council adopt the following policies
to assist the utility billing system of the City:
Landlord Responsibility on Rental Properties: The City of San Jacinto
furnishing water, refuse/recycling or sewer for residential use to a tenant shall
not seek to recover any charges or penalties for the furnishing of such City
utilities to or for the tenant's residential use from any subsequent tenant on
account of non-payment of charges by previous tenants. The City may,
however, require that service to subsequent tenants be furnished on the account
• of the landlord or property owner.
Vacancy Status: Residential accounts will be exempt from paying
refuse/recycling charges (and City sewer, if applicable) if the water consumption
on the residential dwelling unit equals 100 cubit feet of water or less during a
one-month period. It will be the responsibility of the resident to provide proof of
water consumption to the City if the resident maintains a water account at
EMWD or LHMWD.
Vacation Status: Residents who leave their properties for more than 30 days
(Snowbirds) will be allowed to shut off water service and refuse/recycling/City
sewer for a period not to exceed 120 days. On the billing day of the month
following the 120th day, the City will initiate automatic water billing and
refuse/recycling/City sewer unless the resident requests an extension. It will be
the responsibility of the resident to request any extension for Vacation Status.
Change of Commercial Refuse/Recycling Service: All commercial
refuse/recycling accounts requesting a change in refuse/recycling bin size will
receive such service; however, the effective date of the service change, for
billing purposes, will be the end of the month in which the work order for the
service change was signed by the customer.

It is also requested that the City Council receive and file results of the windshield survey •
of the O.K. & Associates refuse account audit.
BACKGROUND: Over the last six months, the Council Refuse/Recycling Sub-
Committee has been working with staff to address two major problems in the City's
utility billing system: 1)Delinquency rate and 2)Unbilled refuse accounts.
There is a need to adopt utility billing policies that will assist in decreasing the
delinquency rate. Staff expects to bring back to the Council a resolution for late
penalties & other charges in the coming months.
The four policies recommended for adoption as shown above have the impacts to the
system as follows.
IMPACTS OF POLICIES:
Landlord Responsibility on Rental Properties: The majority of delinquent
accounts are rental properties. Staff would expect an increase in utility revenue
and a decrease in the delinquency rate if delinquent property utility accounts
were placed under the responsibility of the landlord or property owner.
Vacancy Status: Exempting residents who own vacant properties from the
mandatory refuse/recycling (and in some cases sewer) will provide relief to those •
customers who are not "users" of the service. Depending on the number of
customers affected, the vacancy status exemption will mean a revenue loss to
the system. The reason for the 100 cubit feet threshold is that 100 cubit feet is
just enough water to maintain the lawn of a residential dwelling and yet not
enough to allow a person to live at the property.
Vacation Status: Exempting Snowbirds from mandatory utility service charges
will allow the billing system to freeze their charges for 120 days and then
automatically reinstate the charges on the 120th day. Currently, the number of
requests for Vacation Status is less than 50 per year. Information regarding
vacation status will handled on a case-by-case basis as requests are made by
customers.
Change of Commercial Refuse/Recycling Bin Service: Since the City does
not currently have included in its refuse/recycling rate resolution any charge for
commercial customers who ask to change their refuse/recycling bin service,
there are a number of customers who take liberties in regularly changing their bin
service. There is a significant amount of administrative time in processing the
customer's phone call, work order, computer billing input, pro rating of charges
and communication with OK & Associates and City to City Recycling staff every
time a bin size is changed by a commercial customer.

O.K. & ASSOCIATES AUDIT
City staff did a windshield survey on the accounts identified by O.K. & Associates as
being unbilled. The results were as follows:
Address vacant/inactive 50
No such address 22
Unknown address/Can't find 9
Did not come in to sign up but now getting a bill 161
Did come in to sign up and now getting a bill 127
Accounts always getting a bill but incorrect charge 54
Total accounts identified by O.K. & Associates 423
The 161 accounts that received a bill in March but did not sign up for service and did
not pay their March and April bills will be going to collections this month. A number of
the 161 accounts are customers who may be exempt from refuse/recycling charges if
the above policy on "vacancy status" is approved by Council.
The 54 accounts which O.K. & Associates identified as being charged an incorrect
amount have been changed. There have been several customers that have refuted the
new service level charges and staff has been addressing these on a case by case
basis.
• In summary, of the 423 ac
counts ccounts identified by O.K. & Associates, 288 (161 + 127)
accounts were never billed a refuse/recycling charge. In dollar terms, there were 288
accounts which should have been billed; at current rates of $16.78 per month, the 288
accounts generate a monthly revenue to the City of $4,833.
NEXT STEPS ON O.K. & ASSOCIATES AUDIT
Although a bill is now being sent to all of the 288 accounts identified in the O.K. &
Associates audit, the Council will need to make a decision on whether to retro charge
customers for the months prior to the audit. The Council Sub-Committee will be
meeting with O.K. & Associates during this month regarding the retro charges on refuse
service after two items of information is provided by staff:
1) Statute of limitations on the number of years the City can go back and charge
customers for services. The new City Attorney will be asked to do this research.
2) Through a random sample, an estimate will be made on the revenue lost as a
result of the unbilled accounts identified by O.K. & Associates.
This information will provide the Committee with both the legal ramifications as well as a
dollar estimate of lost revenue from the unbilled accounts.
