Richard Miller, City Clerk October 7, 2014 TO: The Honorable Mayor and Members of the City Council FROM: Rick Miller, City Clerk SUBJECT: Continuance of the Proclamation of the Local State of Emergency due to the Severe Winter Storms that began on April 29, 2014 RECOMMENDATION: Staff recommends that the City Council, by motion, approve to the continuance of the Proclamation of the Local State of Emergency due to the Severe Wind Storms that began on April 29, 2014. DISCUSSION: On April 30, 2014 the Director of Emergency Services/City Manager proclaimed the existence of a local emergency resulting from the severe and damaging winter storms that began on or about 8:00 a.m. on April 29, 2014. Government Code section 8630 requires the City Council to ratify any local emergency proclaimed by a local official such as the Director of Emergency Services/City Manager within seven days. Thereafter, the City Council shall at least once every 30 review the need for continuing the local emergency. ALTERNATIVES: 1) Consent to the continuance of the Proclamation of the Local State of Emergency (Staff Recommendation). 2) Do Not Consent to the continuance. FISCAL IMPACT: The City’s ability to obtain or continue to receive federal, state or regional disaster/emergency relief funding may be impacted if the City Council does not Consent to continue the proclamation of the local state of emergency. Substantial budgetary impacts are apparent for recovery efforts to include substantial employee overtime salaries; purchases of materials, supplies and equipment; use of private contractors/force labor; and other repairs to city right-of-way facilities (Preliminary estimates range from thirty to eighty thousand dollars). Budgetary assistance and reimbursement is available from Federal Emergency Management Agency (F.E.M.A.) PACKET PAGE: 1 AGENDA ITEM 3A.1 for related costs for limited recovery efforts to critical infrastructure including: electrical, power, telecommunications, water supply, public safety, and transportation. BACKGROUND: Government Code Section 36934 requires that all ordinances shall be read in full either at the time of their introduction or their passage. However, Government Code Section 36934 allows the waiver of this requirement by regular motion adopted by majority vote if the title of the ordinance is read. This waiver can be accomplished at the time of each ordinance action, or as a standing waiver, accomplished as a consent calendar motion. In order to stream-line the process for the passage of ordinances, the City Attorney and staff propose the second option, which is the waiver of any and all ordinances on this agenda. ALTERNATIVES: Approval: Approve the addition of the attached language to all future agendas of the City Council, thus waiving the full reading of all future ordinances. Denial: Do not approve the agenda language and, instead, before the passage of any ordinance and after the reading of its title, make a motion that must be adopted by majority vote that allows a waiver of the full reading. FISCAL IMPACT: None PACKET PAGE: 5 AGENDA ITEM 3A.2 October 7, 2014 TO: The Honorable Mayor and Members of the City Council FROM: Rick Miller, City Clerk SUBJECT: Amendment of the Conflict of Interest Code Pursuant to the Political reform Act of 1974 RECOMMENDATION: Staff recommends that the City Council, by motion, adopt Resolution No. ____ approving and adopting the amended Conflict of Interest Code pursuant to the Political Reform Act of 1974. DISCUSSION Pursuant to the Political Reform Act (the “Act”), the City Council directed staff to: (1) conduct a review of the City’s Conflict of Interest Code (“Code”) to determine if a change in the Code was necessary; (2) revise the Code as necessary based upon such review; and (3) submit the amended Code to the City Council for adoption and approval, in accordance with Section 87303 of the Act. During the review process, staff found that updates and amendments to the City’s Conflict of Interest Code are necessary. A redlined version of the proposed amended Code is attached. The Political Reform Act of 1974, Government Code Section 81000 et seq. (the “Act”), requires all public agencies to adopt and maintain a Conflict of Interest Code. The Act further requires that agencies regularly review and update their conflict of interest codes as necessary as directed by the code-reviewing body or when change is necessitated by changed circumstances (Sections 87306 and 87306.5). The City Council is the City’s code-reviewing body. As the code-reviewing body, the City Council directed that the Code be reviewed and, if a change in the Code was necessary, that a revised Code be prepared and submitted to the City Council for adoption and approval. During this review, staff found that amendments to the Code are necessary. Attached is a legislative (redlined) version of the proposed amended Code. The proposed revisions are based on the establishment and recognition of new positions that must be designated and include language provided by the Fair Political Practices Commission to help clarify disclosure requirements. BACKGROUND: The Treasurer’s Report is required to be presented to the governing body at least quarterly in accordance with California Government Code Section 53600 et. seq. DISCUSSION: Total Cash and City Investments decreased 2.26% during the month. This includes cash, cash in bank and cash with trustee. The attached Treasurer’s report is a “snapshot” report of our cash position on the last day of the month in all of our accounts. A section demonstrating compliance with the adopted Investment Policy, a schedule of CDs, and a chart depicting historical interest rates for certain positions is also included. Detailed statements of investments from Chandler Asset Management and BLX Group have also been included. Also attached is a “Memorandum” from BLX Group regarding the downgrade of Dell bonds held as investments. Please read this document, as it explains an exception to the adopted Investment Policy. Although this is an exception currently, it was in compliance with our Policy when purchased. The downgrade does affect the investment’s market value, so if the investment were to be sold today, it would be sold at a significant loss. FISCAL IMPACT: None. BACKGROUND: CADO San Jacinto, LLC is the owner of Tentative Tract Nos. 31037, 31037-1 AND 31037-2, an approximately 159 unit residential project. As a condition of the development approvals for the project, the developer was required to construct a public park at the project. On June 2, 2005, City Ordinance No. 05-18 was adopted establishing certain development impact fees to be paid as a condition to the issuance of land use entitlements within the City. Section 5 of Ordinance 05-18 authorizes the City Manager, when he or she determines that the public interest would be served by such an agreement, to execute agreements on behalf of the City with applicants in order to provide a credit to the applicant against certain DIF Fees, in exchange for the applicant’s construction and dedication of public improvements, upon reasonable terms and conditions as may be determined on a case by case basis. In this case, CADO has provided a detailed engineer’s estimate of the costs of constructing the public park. This amounts to $934,720.18. The project would normally be required to pay park DIF fees in the amount of $478,590. However, because the project built the public park, Ordinance No. 05-18 provides that the project should receive a credit, in this case in the amount of the project’s DIF fee obligation. The developer will not receive any reimbursement; only a credit. The credit may be assigned to the ultimate builder of the three tracts, but not to any other project in the City. ALTERNATIVES: 1) Approve Agreement (Staff Recommendation). 2) Do not approve Agreement. PACKET PAGE: 83 AGENDA ITEM 3A.7 3) Continue or take no action. FISCAL IMPACT: This credit agreement is contemplated as part of the development impact fee program that was adopted in 2005. Specifically, the development impact fee program contemplates that some developers will oversize (or provide up-front funding) for projects that are to be funded by development impact fees. Therefore, while this fee credit agreement will provide a credit against impact fees that would otherwise be due to the City, those credits will come solely from the park development impact fee portion. Thus, there will be no impact to the City’s general fund. Developer is the owner and developer of property located within the City, which property has received development approvals from the City, including Tentative Tract Nos. 31037, 31037-1 and 31037-2, (“Tract Map” or “Project”). A legal description of the property is attached as Exhibit “A” (the “Property”). A map of the Property is attached as Exhibit “B”. B. As a condition of the development approvals for the Property the Developer’s predecessor in interest was required to construct those park public improvements identified on Exhibit “C” (the “Improvements”). The estimated cost of the Improvements is also set forth in Exhibit “C”. C. On June 2, 2005, City Ordinance No. Ordinance No. 05-18 was adopted establishing certain development impact fees (“DIF Fees”) to be paid as a condition to the issuance of certain entitlements within the City. A summary of the DIF Fees is attached hereto as Exhibit “D”. Section 5 of Ordinance 05-18 authorizes the City Manager, when he determines that the public interest would be served by such an agreement, to execute agreements on behalf of the City with applicants in order to provide a credit to the applicant against certain DIF Fees in exchange for the applicant’s construction and dedication of public improvements, upon reasonable terms and conditions as may be determined on a case by case basis. D. The parties wish to enter into this agreement to satisfy legal requirements regarding the use of public funds so that Developer can receive credit from those DIF Fees for which fee credits may be made because of the construction and dedication of the Improvements (“Subject DIF Fees”). AGREEMENT NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby acknowledged, and the mutual promises contained herein, it is agreed as follows: Section 1. Purpose of the Agreement. Developer, or its predecessor in interest to the Property, has caused the Improvements to be designed, engineered, permitted and constructed, and the City shall credit the Developer the Fee Credit Amount, as defined PACKET PAGE: 85 AGENDA ITEM 3A.7 16498.60269\9316632.2 and pursuant to the conditions contained herein. Section 2. Dedication of Improvements. The Developer hereby agrees to convey, if it has not already done so, to the City, and the City hereby agrees to accept the Improvements. Section 3. Fee Credit. Developer acknowledges that, as of the Effective Date of this Agreement, the DIF Fee obligation of the Project’s Parks and Open Space Facilities DIF Fee is approximately Four Hundred Seventy-Eight Thousand Five Hundred Ninety Dollars ($478,590) (“Subject DIF Obligation”). The parties further acknowledge that the estimated cost of the Improvements set forth in Exhibit “C” equals approximately Nine Hundred Thirty Forty Thousand Seven Hundred Twenty Dollars and 18/100 ($934,720.18) (“Engineer’s Estimate”). Developer shall receive a credit (“Fee Credit”) against the Project’s Subject DIF Obligation in the amount of the Engineer’s Estimate. The Fee Credit may be used as a credit against only the Parks and Open Space Facilities DIF Fee Obligation, which DIF Fees may be adjusted from time to time by the City, pursuant to the Mitigation Fee Act (A.B. 1600). This Agreement and the Fee Credit may be assigned, in whole or in part, by Developer, but only pursuant to a written assignment and assumption agreement, executed by both Developer and the assignee setting forth the precise amount of Fee Credit that is proposed to be assigned/assumed. No assignment shall be effective (and the City shall have no obligation to honor any purported assignment) unless and until a fully executed copy of such assignment and assumption agreement has been provided to the City Manager and is either in the form attached hereto as Exhibit “E” or is approved by the City Manager, which approval shall not be unreasonably withheld. Section 4. Representations, Warranties and Covenants of the Developer. The Developer makes the following representations, warranties and covenants for the benefit of the City, as of the date hereof: (a) Organization. The Developer represents and warrants that the Developer is a California limited liability company duly organized and validly existing under the laws of the State of California, is in good standing under the laws of the State, and has the power and authority to own its properties and assets and to carry on its business as now being conducted and as now contemplated. (b) Authority. The Developer represents and warrants that the Developer has the power and authority to enter into this Agreement, and has taken all action necessary to cause this Agreement to be executed and delivered, and this Agreement has been duly and validly executed and delivered on behalf of the Developer. Section 5. Representations, Warranties and Covenants of City. City makes the following representations, warranties and covenants for the benefit of the Developer: (a) Authority. The City shall not be obligated to advance any of its own funds or any other costs incurred in connection with the Project. This Agreement is not, and shall not be construed as, a statutory development agreement as authorized by Government Code sections 65864 et seq., and this Agreement shall not be interpreted as limiting the authority of the City to adopt and amend regulations concerning permitted uses of property, the density or intensity of use, the maximum height and size of proposed buildings, provisions for the reservation or dedication of land or the payment of impact fees for public purposes. Proposals would be solicited informally from appropriate, high quality vendors. Based on response from vendors, submit to Council for consideration at November 18th Council meeting. DISCUSSION: Street sweeping is considered to be a quality of life and an environmental best management practice as related to the National Pollution Discharge Elimination System (NPDES) programs. The process of street sweeping helps the City to remove trash, leaves and fines from the gutter system, thus reducing potential pollutants from affecting downstream watersheds while enhancing the aesthetic appearance of the residential and commercial neighborhoods. However, the effectiveness of the street sweeping program is severely hampered by parked vehicles which prevent the sweepers from reaching the gutter line in order to accomplish an effective and efficient sweeping program. The City is currently subject to implementing various efforts designed to reduce bacteria and nutrients under the Lake Elsinore / Canyon Lake Total Maximum Daily Loading (TMDL) which was adopted by the Regional Water Board, and participates in the Comprehensive Nutrient Reduction Plan (CNRP) that was recently approved by the Regional Board in 2012. Enhanced street sweeping is a key component to compliance with both these water quality requirements. Section 22507.6 of the California Vehicle Code permits local authorities to establish by ordinance or resolution a prohibition or restriction on the parking or standing of vehicles for the purpose of street sweeping. Several cities within Riverside County currently prohibit parking on the day of the street sweeping between the hours of sweeping operations, typically between 7AM and 3PM. These cities include Perris and Riverside. The City of Perris has operated their program for over eight years, and issues approximately 6,400 citations each year. The penalty for a citation is $45.00 if paid within 21 days, and $90.00 if paid after 21 days. Citations that are not paid within 60 days are automatically forwarded to the Department of Motor Vehicles and a lien is PACKET PAGE: 99 AGENDA ITEM 5.1 placed on the vehicle’s registration. This results in approximately 90% recovery rate for enforcement fines for Perris. The City of Riverside in August 2013 conducted an audit of the City’s Public Parking Services Division which included both street sweeping citations and public parking violations. This audit covered fiscal years 2009/10 through 2012/13. During this time, Riverside issued 156,477 street sweeping citations. According to the audit report, the combined street sweeping and parking enforcement programs generate fines of $4.5 million against enforcement expenses of $1,186,400. FISCAL IMPACT: The City has conducted a preliminary estimate of the costs and revenues associated with the establishment of the City’s program, using similar data and information from the City of Perris. San Jacinto proposes to use third party vendors for both the issuance and processing of citations. This is different from the City of Perris’ program in that the City proposes to use an outside parking citation vendor to issue citations versus hiring an additional employee. The City has received an initial estimate of $45.00 per hour for a fully equipped, single person parking enforcement officer in a marked vehicle with appropriate electronic citation issuance and processing equipment. We estimate that the one-time expenses for establishing the program would be $114,300 for installation of approximately 500 signs as required by the Vehicle Code, as well as administrative costs associated with developing the ordinance and establishing the program. We estimate on-going costs of $231,000.00 per year and up to $400,000.00 per year in fines, based on potential issuance of approximately 6,000 violations per year. Actual fine amounts would depend on public compliance with the street sweeping program. ALTERNATIVES: The alternative to enhancing street sweeping would be a voluntary program that focuses on attempting to educate residents via door hangers, or public information messages. Both are considered to be less effective due to the variability and transient nature of on-street parking. ATTACHMENTS: None. PACKET PAGE: 100 AGENDA ITEM 5.1 October 7, 2014 TO: The Honorable Mayor and Members of the City Council FROM: Tim Hults, City Manager SUBJECT: Authorization to provide advance written notice to the County of Riverside requesting public safety service reductions in the event the City does not receive supplemental revenue RECOMMENDATION: Staff recommends that the City Council, by motion: 1. Adopt Resolution No. 3535, authorizing staff to provide advance notice to the County of Riverside requesting reductions in police and fire services provided pursuant to agreements with the County of Riverside if the City does not receive supplemental revenue; and 2. Authorize a 25% reduction in the City’s work force, close City offices every Friday, reduce customer service hours to 7 hours daily and reduce watering and maintenance activities at all non-LLPD#2 parks, parkways and medians by 70% if the City does not receive supplemental revenue. DISCUSSION Over the past several years, the City has taken a number of steps, including furloughs, staff reductions, travel restrictions and the elimination of special events, to bring General Fund expenditures down. Unfortunately, such measures have not been adequate to keep pace with the significant revenue reductions that have occurred since 2007. As such, the City has used its fund balance (reserves) to meet its obligations and maintain services levels. Such fund balance is now approaching critical levels. Therefore, the City Council took action to place a Utility Users Tax (UUT) on the November 4, 2014 ballot. However, should the UUT fail, the Council has directed Staff to explore extensive cuts to minimize the use of the fund balance in order to balance operational expenditures with corresponding revenues. In FY 2016/17, without new revenue or extensive cuts, the City would not be able to meet its obligations. Going into this fiscal year, the projected use of fund balance was $4.85 million, which included the subsidy to the public safety CFD. The total General Fund allocation for City employee salaries and benefits is approximately $4 million. As such, in order to reduce operational expenditures to balance with corresponding revenues, cuts to public safety services are necessary. PACKET PAGE: 101 AGENDA ITEM 5.2 Staff recommends the following expenditure reductions to minimize the use of fund balance and approach balancing operational expenditures with corresponding revenues. The recommended expenditure reductions would have to cross all service functions, including Police, Fire, and city services. Pursuant to the contract for law enforcement, Police services can be reduced up to 10 percent of the contract amount. Anything more than that amount requires 12 month written notice. The Fire services contract allows for cuts, but does not specify an amount, with 120 days written notice. While the contract does not specify an amount, state law provides that a public vote is required prior to terminating fire service. The contract does require that the proposed positions to be eliminated be identified. As such, staff is recommending that one station be closed and that all the positions assigned thereto be eliminated. The public safety cuts noted above would result in an expenditure reduction of about $2.43 million. As such, another $2.4 million in cuts and/or the use of fund balance is necessary to balance. Therefore, a 25% reduction in the City’s work force would reduce expenditures by about $1 million. The 25% reduction would be the equivalent of 13 full- time employees, leaving only 38 employees. With such a drastic cut in personnel, I recommend that the City offices be closed every Friday and customer service hours be reduced to 7 hours daily. The remaining hours each day would be devoted to such tasks as mandatory reporting, file maintenance and document preparation. Additional expenditure reduction measures include reducing watering and maintenance at all non-LLPD#2 parks, parkways and medians by 70%. This would result in a savings of approximately $350,000. The combined cuts noted above would reduce expenditures by approximately $3.78 million. The remaining balance of $1.07 million could be made up by fund balance and revenue enhancement measures. Revenue enhancement measures including a paramedic service fee, charging the water and sewer enterprise for the use of city facilities, a franchise tow agreement, a street sweeping parking enforcement program and a DUI reimbursement program have the potential to generate approximately $750,000. All of those measures are being developed and the Council will see them coming forward in the next couple of months, regardless of whether the UUT passes or fails. In closing, if the UUT fails and the cuts noted above are not made, the fund balance on June 30, 2015 is estimated to be $7.8 million (anticipates that the revenue measures noted in the immediately preceding paragraph are implemented). Based upon the same level of expenditures over revenues (including the revenue measures noted in the immediately preceding paragraph) the City’s entire fund balance, including the asset replacement fund, would be exhausted in Fiscal Year 2016/17. At that point, the Council would have no choice but to make even more drastic cuts to avoid insolvency and the potential ramifications related thereto.
