The 1972 amendments to the Federal Water Pollution Control Act (known as the Clean Water
Act or CWA) provide the statutory basis for the NPDES permit program and the basic structure
for regulating the discharge of pollutants from point sources to waters of the United States.
Section 402 of the CWA specifically required EPA to develop and implement the NPDES
program. At the Regional level, the Santa Ana Regional Water Quality Control Board is charged
with the responsibility to implement all elements of the Clean Water Act. This is accomplished
via a regional permit that is issued to all Co-Permittees within the county. In the county, the
Riverside County Flood Control and Water Conservation District (RCFCWCD) acts as the
principal Permittee for the administration of the NPDES program, while the cities, including San
Jacinto are Co-Permittees.
In 1998, the Santa Ana Regional Water Quality Control Board designated Lake Elsin ore and
Canyon Lake in the Lake Elsinore and San Jacinto Watershed as impaired water bodies because
of high levels of algae in both lakes, and low oxygen levels in Lake Elsinore that were attributed
to excessive nitrogen and phosphorous levels flowing in from the watershed. As such, the
Regional Board was required to establish a Total Maximum Daily Load (TMDL) for both lakes.
In December 2004, the Regional Board amended the Basin Plan to incorporate nutrient TMDLs
for both lakes. The Basin Plan Amendment requires the adoption of an implementation plan by
the various stakeholders, either collectively or individually, setting forth specific actions that all
parties will undertake to meet the TMDL requirements.
Since the cost to the individual stakeholders for individually implementing the TMDL was
considered prohibitive, on June 18, 2012, the various parties enacted an agreement to form the
Lake Elsinore and Canyon Lake TMDL Task Force to undertake the various studies, plans and
actions necessary to comply with the regulatory requirements established by the Regional Board.
The Task Force is administered by the Santa Ana Watershed Protection Authority (SAWPA) and
coordinates all the various monitoring activities, develops special studies and other activities
agreed to by the Task Force. Currently, the Task Force is completing a significant revision to the
3.A.4
Packet Pg. 56
original TMDL, which is expected to be approved in 2019 by the Regional Board, the State
Water Resources Control Board and the Federal Environmental Protection Agency. A copy of
the original agreement is shown as Attachment 1.
The original agreement was for a five-year period, ending in June 2017. The proposed
amendment is administrative in nature, and extends the original term from 2017 to 2020, with an
option to extend the agreement further to June 2022 on recommendation of the Task Force
Administrator and consent of the Task Force.
FISCAL IMPACT:
The current cost to the City for implementation of the Lake Elsinore/Canyon Lake TMDL Task
Force is $29,122 for Fiscal Year 2018-2019, less a one-time credit from accumulated Task Force
reserves of $6,326, which result in a net cost to the City of $22,796. Future Task Force costs in
FY2019-20 through FY2021-22 may be approximately $30,000 due to additional
implementation tasks.

TO: City Council
REQUESTED BY: Habib Motlagh, City Engineer
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: Subdivision Agreement Amendment No. 1 Tract 28224-1
RECOMMENDATION:
Staff recommends that the City Council approve Subdivision Improvement Agreement
Amendment No. 1 for Maravilla Partners, LLC, Tract 28224-1. Located at Ramona Expressway
and Seventh Avenue.
DISCUSSION:
On July 18, 2001, the approved Subdivision Improvement Agreement for Tract 28224-1 listed
the conditions that were mutually agreed upon between the City and Royce Partners, L.P. a
Nevada Limited Partnership. The development of the Tract ceased and Royce Partners, L.P. did
not complete the agreed upon improvements.
Maravilla Partners, LLC is proposing to complete the balance of public works improvements to
Tract 28244-1, and as such is responsible to post new securities and agreements.
The City Engineer’s office reviewed the cost estimate, the City Attorney completed review of the
attached agreements, and as such, both recommend approval by the City Council.
FISCAL IMPACT:
All costs associated with completion of public works improvements are the responsibility of the
developer.

TO: City Council
REQUESTED BY: Habib Motlagh, City Engineer
APPROVED BY: Robert A. Johnson, City Manager
SUBJECT: 2018 Downtown Pavement Rehabilitation Project
RECOMMENDATION:
Staff recommends that the City Council adopt plans and specifications for the 2018 Downtown
Pavement Rehabilitation Project and direct the City Clerk to publicly advertise for bid.
DISCUSSION:
The City’s Engineering Department has identified 40 street/road segments and/or entire
roadways that have deteriorated and are in need of being improved and has strategized to provide
a program to complete these areas under one project.
Utilizing a combination of funding from Measure A, Gas Tax, SB-1 and General Funds as set
aside in the Capital Improvement Project budget, the City Engineer has designed the 2018
Downtown Pavement Rehabilitation Project to include rehabilitation of the following segments
and/or entire roadways:
Palm Avenue from Investor Place to Cottonwood Avenue, including Investor Place,
Enterprise Avenue, Fig Street, Sage Avenue, Oleander Drive, Quince Drive,
Clover Street, Maple Court, Camphor Court, Birch Lane, Sycamore Lane,
Grand Avenue from Industrial Way to its cul-de-sac terminus, including Industrial Way,
Greco Court, Bissel Place, Irwin Street, Evans Street, El Monte Street, El Centro Street,
Hewitt Street from Shaver Street to Esplanade Avenue,
Old Mountain Avenue,
Quandt Ranch Road, Ella Mae Lane, Marjorie Lane, Nanci Lane, Ann Street,
Carrie Street, Verbena Court, Rolling Meadows Court, The Willows Road,
Blue Ridge Lane, Win Court, Raintree Lane, Porterfield Drive, Bettina Way,
Marcy Way, Leonard Way, Dennis Way, and Wateka Street.
The adopted 2018-2019 budget for Capital Improvements Projects includes #11-006, entitled
“Downtown Street Improvements.” This project has been budgeted to improve the deteriorated
pavement by grinding and overlaying the distressed area(s).
A project exhibit is attached to this report that reflects the areas of the roadway(s) that will be
improved. During construction, signage will be posted along the section of roadway identifying
the project and the contractor performing the work.
The preliminary schedule for this project is as follows:
