Johnson, City Manager SUBJECT: San Jacinto Valley Connect - ATP Cycle 2 RECOMMENDATION: Staff recommends that the City Council rejects all bids for San Ja cinto Valley Connect, funded by Active Transportation Program (ATP) Cycle 2, received on November 13, 2018; and re- advertise. DISCUSSION: Five (5) bids were received on November 13, 2018, pursuant to the San Jacinto Valley Connect – ATP Cycle 2 advertisement on October 18, 2018. The lowest bidder, Hardy & Harper, Inc., requested that the City withdraw its bid due to errors and discrepancies in calculations, and the City Engineer recommends that the City accept the request. The other bids are higher than expected and budgeted. Therefore, staff recommends that the City Council reject all bids, and direct staff to evaluate the plans, quantities, and cost comparisons. Subsequently, since this is a state funded project, staff has requested a time extension to complete the project from the California Transportation Commission (CTC) and the Riverside County Transportation Commission (RCTC). Staff expects to return to the City Council in February/March 2019 for consideration of bid award. FISCAL IMPACT: Minimal cost to reevaluate the project scope. Johnson, City Manager SUBJECT: FY 2018-19 Continuing Appropriations RECOMMENDATION: Staff recommends that the City Council approve a continuing appropriati on decrease of $74,405 from original designated fund balances for construction-in-progress projects encumbered at June 30, 2018 into the FY 2018-19 Budget. SUMMARY: This budget action adjusts the FY 2018-19 Budget for continuing appropriations on capital projects that were in progress in the prior fiscal year, but not yet completed at June 30, 2018. BACKGROUND: The original budget generally requests appropriation of funds for new expenditures and capital projects, or for construction-in-progress projects requiring additional funding. It is generally assumed that budgeted expenditures are completed in the year the budget is adopted. However, some expenditures, particularly capital projects, may not fully complete within the same budget cycle, requiring carryover into subsequent budget years. DISCUSSION: Resolution No. 3721, adopting the Fiscal Year 2018-19 budget, authorizes in Section 7 the carryover of unexpended, unencumbered Capital Project Funds, estimated at $21,937,265, including Successor Agency projects totaling $41,405. The actual carryover amount for City Capital Projects from June 30, 2018 is $21,862,860. The total budget adjustment to City Funds is a decrease of $74,405, which is the difference between the initial budget estimates and the actual carryover amounts. There were no Successor Agency carryover adjustments. FISCAL IMPACT: An estimate of the proposed continuing appropriations was assumed in establishing the adopted FY 2018-19 budget. Total budget adjustment decrease to City Funds is $74,405. Johnson, City Manager SUBJECT: Reimbursement Agreement with D.R. Horton RECOMMENDATION: Staff recommends that the City Council approve the Reimbursement Agreement with D.R. Horton for Sewer Improvements Adjacent to Tract 30597. DISCUSSION: Due to the downturn in the economy and the housing bust of approximately 10 years ago, the City of San Jacinto has multiple unfinished residential housing tracts, which negatively affect the surrounding homes, landscape areas, economy and quality of life of residents. In the past year, San Jacinto has been very aggressive and successful in its recruiting efforts of commercial/retail establishments as seen with the recent openings and approvals of Starbucks, Aldi Grocery, Pacific Dental, Top Grill, Mason Jar Ranch Bistro and Brew Pub, Wienerschnitzel, Sonic, 7-11, and Mountain View Plaza. In the 2018 residential growth segment, the City has seen enormous growth in new homes; in fact, more than 10 times the past nine year average. KBHome, Lennar, DR Horton, William Lyon, Richmond America, Signature Homes, and Frontier have combined for a total of 341 residential building permits to date – with more on the way. The City expects to be in the neighborhood of 400 by the end of the calendar year. Since joining the City, the City Manager, along with the City’s Development Team Members, has been actively recruiting residential development companies to collaborate with the City of San Jacinto to complete unfinished housing tracts. Multiple factors affect the decision of residential developers to complete unfinished tracts including, but not limited to, aging infrastructure (sewer, water, streets, curb, gutter, sidewalk, streetlights, etc.), catch basins, and park areas that may not have been accepted by the City at the time of the original development. The City Manager and Development Team have been in discussions with DR Horton, one of California’s largest residential development companies, since June regarding the disposition of two unfinished tracts. Tract 30597 (known as Palisades), the development surrounding Catalpa Park, located near 7th Street and Cawston Avenue, has 83 unfinished lots; and Tract 30507 (known as Palmia), near Hewitt Street and Washington Avenue, has 31 unfinished lots. A concern from the City’s standpoint is the sewer sags in the completed, but unaccepted areas, adjacent to Tract 30597. DR Horton’s position is that since the sags are in the built portion adjacent to its impending purchase, and even though the City never accepted the sewer for that area, the City should collaborate with them and share the burden of repairing the sags, so that DR 4.1 Packet Pg. 90 Horton is able to connect to it with the development of the Tract. The Palmia Tract is not party to the Reimbursement Agreement, although DR Horton is purchasing both tracts. The City Council has created an Economic Incentive Program as a negotiation tool for the City Manager to use for development projects and other economic opportunities. The Reimbursement Agreement outlines the work to be performed by DR Horton, adjacent to Tract 30597, to correct the sewer sags with the understanding that the City would reimburse the Developer up to $75,000. The economic benefit of the Reimbursement to the City would include the following:  The completion of 83 new residential units in the Tract nearest to Megan Cope Elementary School;  New sewer, water, storm drain, streets, street lighting, curb, gutter, sidewalks and landscaping in the unfinished portion of the tract;  Sewer sag solutions in the adjacent tract;  A refurbished Catalpa Park;  A restored Catch Basin with new pumps; and  Additions to the City’s Public Safety CFD. The City Manager recommends approval of the Reimbursement Agreement as developed by the City Attorney and agreed to by DR Horton. FISCAL IMPACT: Funding is available in CIP #18-007 (Economic Development Incentives). DISCUSSION: The first Tuesday of January 2019 is January 1, a national holiday. Alternatives for meeting dates are: 1. Adjourning the business of the January 1 meeting to the third Tuesday, January 15, 2019, thereby having only one meeting in January; or 2.
