SUBDIVISION, LOCATED ON THE WEST SIDE OF KIRBY

WHEREAS, on May 7, 2009, the City Council of the City of San Jacinto
("City Council") conducted a duly noticed public hearing on Tentative Tract Map (TTM)
34664, at which time all persons wishing to testify in connection with the TTM were
heard and the Application was comprehensively reviewed and approved; and
WHEREAS, the effective date of the TTM was June 20, 2009 and was
valid for two years to June, 20, 2011: and
WHEREAS, Government Code Section 66452.22 has extended the
expiration of said TTM to June 20, 2013; and
WHEREAS, Government Code Section 66452.23 has extended the
expiration of said TTM to June 20, 2015; and
WHEREAS, Government Code Section 66452.24 has extended the
expiration of said TTM to June 20, 2017; and
WHEREAS, Municipal Code Section 16.12.150 provides for three one-
year extensions of time for tentative subdivision maps; and
WHEREAS, the on November 20, 2017, the Planning Commission
approved the first extension of time for TTM 34664; and
WHEREAS, the on September 17, 2018, the Planning Commission
approved the second extension of time for TTM 34664; and
WHEREAS, this request was brought before the City Council on August
20, 2019, at which hearing evidence both written and oral evidence was considered;
and
WHEREAS, all other legal prerequisites to the adoption of this Resolution
have occurred.
NOW, THEREFORE, BE IT RESOLVED, ordered and determined by the City Council
of the City of San Jacinto:
SECTION 1. The City Council has reviewed and analyzed the proposed
extension of time for TTM 34664, prior to making its decision for a final extension for
TTM 34664 for a period of twelve (12) months. Based on the entire record before the
City Council, all written and oral evidence presented to the City Council concludes that:
A. Conditions affecting TTM 34664 have not substantially changed
since the TTM was approved.
B. There are no substantial changes proposed to TTM 34664 or the
Conditions of Approval.
C. No substantial changes have occurred which result in new
environmental effects and therefore no revisions are needed to the Mitigated Negative
Declaration.
SECTION 2. In accordance with the Subdvvison Map Act Government Code
Section 66410 et seg., based on the entire record before the City Council and all written
and oral evidence presented to the City Council, the City Council finds as follows:
A. The proposed subdivision is designed, to the extent feasible to
provide for passive or natural heating or cooling opportunities because the lot size and
the orientation do not preclude roof orientation for solar applications or passive
applications such as eave design and landscaping used for shade.
B. The proposed subdivision and the provisions for its design and
improvement are consistent with the General Plan for the City of San Jacinto because
the land use designation is Medium Density Residential, which allows residential
densities between 5.1 and 10.0 units per acre. The proposed TTM is designed at a
density of 7.19 dwellings per acre. Provisions for design and improvements promote
the goals and objectives of the General Plan.
C. The TTM provides for land uses compatible with the surrounding
area, as the properties surrounding it are designated residential, with either existing
residential developments or vacant land available for residential development, and the
provisions for design and improvements of the tract promote the goals and objectives of
the General Plan as infrastructure facilities (water, sewer, street, flood control and solid
waste) around the project site will be maintained and expanded to meet the future
growth of the community.
D. The proposed project is consistent with City standards, ordinances,
and policies in that the minimum lot size is provided, and the streets have been
designed to be consistent with the Circulation Element of the General Plan.
E. The Subject Site is physically suitable for the type and density of
development proposed in the TTM because the project is developed at a density below
what is permitted by the General Plan and is designed to comply with the lot dimension
requirements of the Planned Unit Development and the required right-of-way width for
the streets.
F. The subdivision design and improvements proposed in the TTM are
not likely to cause substantial environmental damage or substantially injure fish or
wildlife or their habitat because no development will occur in any significant habitat of a
rare or endangered species of plant, animal, or insect, or any fragile or unique biotic
community.
G. The subdivision design and type of improvements proposed in the
TTM are not likely to cause serious public health problems because all development
and public improvements will be performed per the requirements of all applicable
standards and codes, including the zoning and building codes.
H. The subdivision design and type of improvements proposed in the
TTM will not conflict with easements acquired by the public at large for access through
or use of the Subject Site because all easements will be vacated.
1. The discharge of waste into an existing sewer system from
development proposed in the TTM will not cause a violation of existing requirements
prescribed by the local water quality control board because all dwellings will be required
to obtain connection permits prior to occupancy.
SECTION 3. Pursuant to section 66412.3 of the Government Code, based on
the entire record before the City Council and all written and oral evidence presented to
the City Council, the City Council finds the third extension of time for TTM 34664 may
help the City of San Jacinto meet its regional housing needs because the development
will provide a balanced residential environment with access to employment
opportunities, community facilities, and adequate services.
SECTION 4. Based on the entire record before the City Council and all written
and oral evidence presented, the City Council finds the proposed TTM complies with
CEQA for the following reasons:
The proposed project is consistent with the original Mitigated
Negative Declaration adopted on May 7, 2009 and will not
result in significant adverse environmental effects because no
revisions to the project have been made.
SECTION 5. Based on the entire record before the City Council, findings and
conclusions in the prior Section and all written and oral evidence presented, has
determined that conditions affecting TTM 34664 have not substantially changed, since
the TTM was originally approved and hereby approves the third and final twelve (12)
month extension of time for TTM 34664 to June 20, 2020.
SECTION 6. Effective Date. This Resolution shall become effective upon its
adoption.
