BACKGROUND The Community Development Block Grant (CDBG) program is a Federal program designed to fund projects that will assist low and moderate-income persons in each city, or eliminate "slums and blight." Funds are allocated based upon the City's population and the number of low and moderate-income households in the City. It is estimated that the City will receive approximately $205,000 in CDBG funds for the 2001- 2002 Program Year. Eighty-five percent (85%) of the funds ($174,250) are required to be spent on City-sponsored programs. The remaining fifteen percent (15%) of the funds (S30,750) are allowed for public service projects. The requirements for the two types of projects, and a description of the application process are included below: City-sponsored Projects The Federal Government has issued strict eligibility criteria for use of CDBG funds. In order to assess a proposed activity's eligibility for funding, the City must determine if the activity: 1. Is included in the listing of eligible activities in the CDBG Regulations. (Buildings for the general conduct of government, i.e. City Hall facilities are ineligible). 2. Meets one of the national objectives: a. Benefits low and moderate-income persons. b. Addresses slums or blight. c. Meets an urgent community development need. 3. Costs appear reasonable and necessary. In addition, the City must ensure that the activity will not violate the certification that at least 60 of the City's allocated block grant funds will benefit low and moderate-income persons over one. two, or three consecutive program years; and complete the environmental review and clearance procedures. Examples of eligible activities are as follows: * Disability Accessibility Upgrades * Acquisition or disposition of real property * Public facilities and improvements * Clearance/demolition * Interim assistance (i.e., floods or earthquakes) * Relocation * Loss of rental income * Housing rehabilitation * New housing construction * Code enforcement * Historic preservation * Commercial or industrial rehabilitation * Special economic development Examples of projects which have been funded by CDBG monies in past program years: Community Center Improvements 7th Street Water & Sewer Line Construction Downtown Sidewalk Project Vernon Street Water Line Sallee Park Rehabilitation Victoria Avenue Renovation and Water Service Enhancement Enhancement of Accessibility to the Community Center Estudillo Mansion Restoration Public Service Projects The Council may grant up to 15% of the CDBG allocation in any given year for Public Service projects. For the 27th year program, it is anticipated that $30,750 will be available for distribution. In order to qualify for CDBG funds, an organization must provide: 1. A new public service, or 2. Provide a quantifiable increase in the level of the service above that which has been provided by or on behalf of the City. Public Service projects may qualify for block grant funds if they meet the following specific criteria: 1. The service is available to all residents in a particular area and at least 51% of those residents are low or moderate-income persons. 2. The service is limited to a specific group of people at least 51% of who are low and moderate-income persons (the following groups are presumed by HUD to meet this criterion: abused children, battered spouses, elderly, homeless, disabled or illiterate persons and migrant farm workers); 3. The service is part of an activity designed to alleviate existing conditions and the grantee certifies that those conditions are a serious and immediate threat to the health or welfare of the community, they are of recent origin or recently became urgent, the grantee is unable to finance the activity on its own and other sources of funds are not available (example: major catastrophes such as floods or earthquakes.) Eligible CDBG funding categories for public service funds are as follows: • Child Care • Health Care • Job Training • Recreation Programs • Education Programs • Public Safety Services • Fair Housing Activities • Services for Senior Citizens • Services for Homeless Persons • Drug Abuse Counseling and Treatment • Energy Conservation Counseling and Testing Below is an annual list of the agencies that have previously been funded: • FY 94/95 • FY 95/96 • FY 96/97 FY 97/98 Phoenix Programs, "Jobs Unlimited" $17,869 Phoenix Programs, "Jobs Unlimited" $12,858 Alliance for the Mentally Ill $10,000 La Vista Alcohol Recovery Program S 10,500 Retired Senior Volunteer Program $6,161 San Jacinto Community Outreach Center $18,250 Alternatives to Domestic Violence $3,000 La Vista Alcohol Recovery Program $5,000 Community Pantry $5,000 San Jacinto Community Outreach Center S 14,000 • FY 98/99 • FY 99/00 • FY 00/01 San Jacinto Community Outreach Center Senior Day Care Center Center Against Sexual Assault Department of Community Action VIP Tots La Vista Alcohol Recovery Program Retired Senior Volunteer Program Center Against Sexual Assault Care-A-Van Transit California Family Life Center Valley Restart Center Alternatives to Domestic Violence Care-A-Transit Family Service Association Habitat for Humanity Senior Day Center Valley Resource Center Assistance League of Hemacinto $10,799 $10,000 $5,000 $1,550 $1,413 $5,000 4,128 $5,000 5,000 5,000 $5,000 7,500 $5,000 $5,000 S3,500 S5,000 $5,000 5,000 Application Process Applications for Public Service projects have been sent to several public service agencies and are available at City Hall. Completed applications are to be submitted to the City Clerk's office no later than 5:00 pm on November 10, 2000. BUDGETARY IMPACT: The CDBG program provides additional funds for infrastructure projects that assist low and moderate-income households and can also used to leverage other funds for economic development purposes. The CDBG program funding allocation decisions are made prior to the development of each fiscal year budget. October 19, 2000 AGENDA ITEM 4.1 TO: The Honorable City Council FROM: Bob Lavin, Public Works Superintendent SUBJECT: Receive Oral Report from Andre Landscape Service RECOMMENDATION: Receive oral report. BACKGROUND: Andre Landscape Service is under contract with the City to provide landscaping services within City parks, parkways, and medians. Each month they provide the City Council with an oral report regarding those services. JUSTIFICATION: The City Council has requested the monthly reports. BUDGETARY IMPACT: None ATTACHMENTS: None October 15, 2000 AGENDA ITEM 4.2 TO: The Honorable City Council FROM: Jake Wager, City Manager SUBJECT: Approve Professional Service Agreement to Facilitate Team Building Workshop - Garcia Overstreet and Associates RECOMMENDATION: By motion, approve Professional Service Agreement with Garcia Overstreet and Associates for an amount not to exceed $2,500 to facilitate Team Building Workshop BACKGROUND: On April 22, 2000, the City Council of the City of San Jacinto participated in a Team Building Workshop, which also involved the senior management group of city staff. Garcia Overstreet and Associates acted as facilitator for the workshop. The net product of the workshop was a set of goals and objectives as determined by the participants. Following the retention of services of a new City Manager, the Council asked that an implementation plan be developed based on the newly established goals and objectives. That implementation plan was adopted by the Council on September 6, 2000. The Council has now requested that a follow-on Team Building Workshop take place on Saturday, November 18, 2000. In order to afford a sense of continuity from the prior workshop, staff is recommending that Garcia Overstreet and Associates be retained to once again act as facilitators. JUSTIFICATION: This workshop meets the Council's goals and objectives as set during the April 22, 2000 workshop. BUDGETARY IMPACT: Sufficient funds are available in the adopted FY 2000-2001 budget. This item falls under the amount for which the City Manager is authorized for. However, due to the Council's high level of interest, it is appropriate that the Council take direct action in approving the professional service agreement. ATTACHMENTS: - Professional Service Agreement October 19, 2000 AGENDA ITEM 5.1 TO: The Honorable City Council FROM: Tim Hults, Planning Director SUBJECT: Extension of the Subdivision Agreement for Tract 28224, H & F Development, Inc. (south side of Seventh Street, east of Ramona Expressway) RECOMMENDATION: Staff recommends that the City Council extend the Subdivision Agreement for Tract 28224 for a period of two years, to expire September 30, 2002. BACKGROUND: Tract 28224 encompasses 12.72 acres with 86 single-family lots located on the south side of Seventh Street east of Ramona Expressway, and due to continued slow development activity in the City at this time, the property owner is requesting that the Agreement be extended. The bonds are still in full force and effect with the property owner making continued payments on the bond premium. Staff does not anticipate a need for public improvements for some time. Additionally, the tract is consistent with the policies set forth by the Zoning Ordinance and General Plan. Therefore, staff does not anticipate a need to call the bonds for this tract within the next two years. ,I1 JSTIFICATION: Slow development activity in the City at this time. ATTACHMENTS: None. DR. October 19, 2000 AGENDA ITEM NO. 5.2 TO: The Honorable City Council FROM: Bernard Simon, Finance Director SUBJECT: Approve Professional Service Agreement with O'Connor & Company Securities for CFD No. 2 Bond Underwriter RECOMMENDATION: Approve Professional Service Agreement with O'Connor & Company Securities to serve as the underwriter in connection with the CFD No. 2 workout. BACKGROUND: The City is close to reaching an agreement on the terms of an MOU with the majority bondholder in CFD No. 2. The MOU covers the proposed terms of the restructuring of the District's 1989 Special Tax Bonds, the credit bid process, tax savings for existing homeowners and development issues relating to the remaining undeveloped properties. It is now an appropriate time to select an underwriter to negotiate the sale of the bonds to be sold as part of the restructuring. It is important to bring in an underwriter at this time so the City's bond counsel and financial advisor can benefit from their input on the proposed refinancing structure as it pertains to the marketing of the series of the bonds secured by existing homes to the investing public, as well as the terms and conditions that may be established for the resale of the new district bonds (which will initially be owned by Elliott Associates) once development of the remaining property occurs. JUSTIFICATION: Proposals for underwriting services were solicited from four firms having experience in the area of restructuring troubled or defaulted CFD bonds. The City received proposals from Kinsell, Newcomb & De Dios, Inc., Solana Beach; O'Connor & Company Securities, Newport Beach; Seidler-Fitzgerald Public Finance, Los Angeles; and Stone & Youngberg, San Diego. Relevant underwriting experience was the key factor in determining which firm to select for recommendation to the City Council. The experience in restructuring troubled or defaulted land secured financing, in addition to the use of the credit bid process of each firm is shown below: Kinsell, Newcomb & De Dios O'Connor & Company Securities Seidler-Fitzgerald Public Finance Stone & Youngberg Bond Issues 4 7 5 7 Credit Bid 1 1 1 1 Several of the restructurings completed by O'Connor & Company Securities are for districts located in Riverside County, including transactions for the Val Verde Unified School District CFD 88-1, County of Riverside CFD No. 87-5 (Wild Rose) and City of Lake Elsinore CFD No. 93-1. In addition, the firm has underwritten numerous land secured bonds in neighboring communities such as Perris and Beaumont, which brings an added familiarity with bond marketing characteristics which may be unique to our area, as well as knowledge of what merchant builders in the area are looking for and doing. This will give the City some additional expertise in evaluating the development proposal made by Elliott Associates together with their consultant, Sage Development. BUDGETARY IMPACT: None. Fees paid to the underwriter are funded with proceeds of any bonds issued by the District. MINUTES SPECIAL MEETING SAN JACINTO CITY COUNCIL September 13, 2000 SJUSD Board Room 2045 S. San Jacinto Avenue San Jacinto, California ORGANIZATION 1.1 Mayor Williams called the regular City Council meeting to order at 5:50 p.m., with the following members present: Conner, Good, and Williams Absent: Carlson Buydos and Ayres 1.1 San Jacinto Avenue Pavement - Additional Work Authorization Additional paving on San Jacinto Avenue between Ramona Expressway and Idyllwild Drive, including county area on the east side of San Jacinto Avenue - Trautwein Construction. Mayor Williams called on City Engineer Motlagh who presented his staff report dated September 13, 2000, and reported the waterline construction on San Jacinto Avenue is near completion. The project limited Idyllwild Drive to the south and Ramona Expressway to the north. He noted Measure "A" funds in the amount of $200,000 had been allocated in the current fiscal 2000-2001 for the pavement of San Jacinto Avenue. The proposal submitted from Trautwein construction was $75,000 for the City pavement section and $85,000 for the county pavement section. Riverside County Transportation Department has agreed to reimburse the City for the east side of the road, which is in their jurisdiction. Mayor Williams asked about the timing of the M.O.U. with the County of Riverside. City Engineer Motlagh responded it might take between 2-3 months to complete. Council Member Good asked about the road closure related to the project, and asked if it would be a permanent closure. City Engineer Motlagh responded it would be a temporary closure. Council Member Conner was pleased to see this project being constructed, and looked forward to see the pavement rehabilitation done. 1 M/S/C (CONNER/GOOD) to authorize the expenditure of $75,000 for additional pavement along west side of San Jacinto Avenue between Ramona Expressway and Idyllwild Drive (City side), and $85,000 on the east side (County side) to be reimbursed by the County. . Ayes: Conner, Good, and Williams Noes: None 1.2 Buena Vista Retention Ground Water Recharge Project City Manager Wager stated a motion was not needed for this item, and suggested the City of San Jacinto entered into a M.O.U. with the City of Hemet. Mayor Williams called on City Engineer Motlagh who summarized his staff report dated September 13, 2000 and reported the Riverside County Flood Control Basin was in the process of being evaluated by staff for a potential retention basin. He reported the area had been analyzed and there was a good chance to install a well. He asked for authorization to work with the City of Hemet, and also suggested the hiring of an experienced consultant in the field to work on the project. City Manager Wager responded they anticipate working with the City of Hemet and would bring it back to Council at the appropriate time. Mayor Williams commented this was a good start foundation with the City of Hemet and was interested in having the Council Water Subcommittee meet with staff and prepare a formal agreement. Council Member Conner stated that City of Hemet has the desire to join us in our water development because part of the basin is in the City of San Jacinto. He indicated most of the City sewer is exported out and felt this project had the ability to capture the storm drain. The basin is within 2000 ft. from the water line in California, and it was a good idea to tap into it during the winter. Anything owned underground belongs to the City, which is beneficial to San Jacinto. He also indicated this was a good project and there were funds available from the water revenue bonds to finance this project. M/S/C (WILLIAMS/GOOD) to meet with Hemet City Officials to explore the potential of water recharge at Buena Vista Basin and other projects of mutual interest to both cities, and to bring it back to Council. JIM POTTS, TREASURER City Of San Jacinto October 19, 2000 AGENDA ITEM 5.7 TO: The Honorable City Council FROM: Habib Motlagh, City Engineer SUBJECT: Approve Program Supplement Agreement No. M005 to Administering Agency-State Agreement No. 08-5075 — State Street Sidewalks RECOMMENDATION: By motion, approve the Program Supplement Agreement No. M005 to Administering Agency-State Agreement No. 08-5075, covering the engineering cost of $17,706 (estimated), for the design of State Street sidewalks; authorize the Mayor to execute the agreement; and direct the City Clerk to forward the executed agreement and a Minute Order of the action to Caltrans. BACKGROUND: On October 7, 1999, the City of San Jacinto applied for Transportation Enhancement Activities (TEA) funds for the installation of approximately 16,000 linear feet of sidewalk and 26 handicap accessible ramps. This project involves the installation of missing link sidewalks along State Street between Community College Drive and Esplanade Avenue. The completion of this project would create better accessibility and comply with American with Disabilities Act. Furthermore, the installation of these improvements will improve the accessibility to RTA bus stops, and bus shelters may be built for the comfort of the riders. This project was approved, and what is being presented to you herein is the Supplemental Agreement which will secure the funds for the preliminary design of this project. No street widening is proposed at this time. The plans have been submitted to Caltrans for issuance of a permit. Upon this approval, we will proceed with preparation of specifications and formal submittal to Caltrans for authorization to proceed with bid advertisement, expected by January 2001. BUDGETARY IMPACT: This project is included in the current Fiscal Year 2000-2001 budget under Measure "A" Funds. The approximate cost of the project is $350,000. The breakdown of the construction funding is as follows: • TEA grant totals $264,000. • Measure "A" funds in the amount of $86,000 would be utilized to offset the construction cost. CITY DEPARTMENTS 4.1 Ratify Approval of Conditional Use Permit 5-00 by the Planning Commission - Service Station and Mini Mart - State and Dillon Street Mayor Williams called on Planning Director Huits who summarized his staff report dated October 5, 2000, seeking to reestablish a service station and mini mart on the east side of State Street at Dillon Avenue. He also reported the Planning Commission debated on the existing driveway issues on State Street and Dillon Avenue. However, the Planning Commission approved the elimination of the driveways as conditioned by the City Engineer, but allowed the existing driveway on State Street to remain as currently exits. Mayor Williams asked what basis the Planning Commission used to allow the driveway to remain. Planning Director Hults responded that the Planning Commission felt that reducing the driveway width from 80 ft. to 40 ft. would be a burden on the project. City Engineer Motlagh addressed the Council and commented the City has been using the County Standards that call for a 40 ft. width driveway based on the size and shape of the property. The existing driveway is too close to the intersection, presenting a potential traffic hazard. Vice Mayor Ayres asked about the impact of this project on the upcoming Sidewalk Project on State Street. City Engineer Motlagh responded there was no impact, as the developer would be responsible for the construction of the sidewalks in front of his property. City Engineer Motlagh and Planning Director Hults responded to Council Member Conner regarding questions dealing with the layout of the project and the relation of the pump islands to the driveway location. Planning Director HuIts commented that the Planning Commission in approving this project, was to enhance the looks of the area, and bring a tax generating business to town. Council Member Carlson Buydos asked if the hours of operation had been restricted due to the proximity to residential districts, and asked that 2 the Council advertise this project for a public hearing to consider the hours of operation, the location of the existing driveway, and the sale of alcohol. Nader W. Sarkis, 1484 Corte Rosaire, San Jacinto, project applicant addressed the Council about the ABC regulations that do not allow gas stations to apply for an ABC licenses since 1996. The driveway issue was addressed and provided his point of view, and the rationale for keeping its current width to allow for more space for the pump islands. He further commented he operates the Alliance Gas Station on Florida Avenue between Palm and Gilbert Streets in Hemet. Council Member Good asked of the applicant if he had searched for a better location than the proposed one. Nader W. Sarkis was confident his proposed location was a good location, and he would improve the area by the enhancement of the improvements to the property. Planning Director Hults addressed the Council regarding the zoning of the property and the surrounding areas, which comply with the General Plan. He also reported some of the properties are existing non-conforming uses. He mentioned the first public hearing was scheduled for October 19, 2000, and that funding decisions needed to be made by December 21, 2000, for the submittal of applications to County EDA by January 08, 2001. He also asked if the Council wanted the Area Director Association to participate in the review of the applications. 3 Vice Mayor Ayres asked that the CDBG Subcommittee review the applications and provide recommendations to the rest of the Council. Mayor Williams suggested that the Council Subcommittee work with the Area Director Association to screen the applications and provide recommendations to the rest of the Council. Council Member Good concurred with Vice Mayor Ayres comments. Council Member Carlson Buydos asked for City Manager's recommendations for the review of applications received for funding. City Manager Wager responded he could provide background information based on his experience with the City of Bakersfield, which had an advisory group that provided ideas and recommendations. However, the decision rested on the Council. For City Projects, staff prepared a staff report to the Council with a recommendation for city-funded projects. Staff also reviewed service organizations applications as well. Mayor Williams agreed to switch from Area Director Association to Council Subcommittee to review the funding requests at a separate meeting, and provide recommendations for Council action. Mayor Williams suggested that the Council Subcommittee consider a childcare service theme for San Jacinto to assist working families who need assistance with childcare services. Council Member Carlson Buydos suggested the Council consider a theme based on the diversity of needs in the community (old and young), for dependent care. City Manager Wager suggested the commitment of the 85% of CDBG funds for job attraction, which has proven to be very successful in other cities, and suggested the use of the City Community Center for dependent care project. BAKCGROUND: In February 2000, the City of San Jacinto undertook one of its largest ever public works project. The construction of the Lake Park Drive bridge represents not only its largest public works project in terms of dollars but also represent a historic bridging of the San Jacinto River, thus the project affords for the first time in the city's history, an all weather connection to what has in the past occasionally become a severed island of the City and to the sovereign Soboba Tribe. The videotape contemplated would record the project's progress from concept through construction and up to completion. As you are aware, we are anticipating the bridge opening on December 2, 2000. Included in Parsons Brinckerhoff contract, is a requirement to maintain videotapes of the project as construction continues. It is anticipated that these videotapes will be combined and professionally formatted to be viewed during the formal bridge ceremony. JUSTIFICATION: Part of a community's future is its ability to recognize the making of its own history. The proposed videotape will memorialize for the future part of San Jacinto's history in the making. The Lake Park Bridge is also one of San Jacinto's most significant Public Work's project, which became reality due to the efforts and hard work of many people would memorialize that hard work for the future. BUDGETARY IMPACT: While no specific provisions for the videotape have been included in the bridge's budget nor have specific provisions been made in the FY 2000-2001 budget, staff believe that sufficient funds may be available. This becomes even more possible if additional private contributors can be secured. This would include all private companies involved in the projects who would choose to make a contribution towards the creation of the videotape. ATTACHMENTS: - Professional Service Agreement
