HAND SPEAKER SLIPS TO THE CITY CLERK PRIOR TO THE
START OF THE MEETING.
My name is Patricia Mayne. I live at 1766 Carrera Drive, San Jacinto.
In light of the recent update on the fee to trust acquisition proposal
presented by Rose Salgado, we felt it appropriate to also address this issue
to the City Council.
Save our Communities (SOC) is a group of citizens who live in close
proximity to the Soboba Reservation. Our mission statement reads:
SOC is opposed to the conversion of the Horseshoe Grande land from
fee to trust and subsequent annexation to the Soboba Band of Luiseno
Indian Reservation. We desire this land to remain with its current
boundaries, jurisdictions and zoning.
We worked diligently with the City to voice our communities' opposition
to this fee to trust proposal and to impart the knowledge we acquired
regarding this legal process. Over 400 citizens, many vulnerable elderly
retirees, and hundreds of acres are involved.
Subsequently, the City adopted a Resolution opposing the fee to trust
acquisition and commercial venture for a variety of reasons.
Contrary to some beliefs that this acquisition would be good for our
community, the facts that were presented to the City Council, the Riverside
Board of Supervisors, the State Legislators and the BIA are that:
I. The Tribal Compact of 1999 allows the Soboba tribe to
operate two gaming facilities on reservation land. If the fee to trust passes,
the Tribe may choose to run more than one casino.
2. This would double the environmental impacts on our rural,
light residential neighborhoods.
3. Casino development requires the explicit recognition of risk
factors which takes into consideration the public attitude and the concerns
of affected local governments to ensure the continued rights of all citizens.
Our community citizens have voiced opposition to the proposal.
4. Removal of the Horseshoe Grande property from the
property tax rolls, a major source of local funding for schools, parks,
recreation, transportation services, law enforcement and District Attorney
and jail facilities will directly affect the quality of life of the non -Indian
community whose scarce tax dollars provide for local government services
to the existing casino.
5. It is believed that there has been no TASIN money from the
Tribe for the last two years to mediate casino impacts on the San Jacinto
community.
6. An expansion of gambling would be detrimental to our
citizens as proven by published studies on gambling's negative effects on
family stability, the elderly who gamble away their retirement savings and
those with gambling addictions who may turn to stealing to feed their
addiction.
7. Reputable studies prove that what would seem like a boost in
jobs, in reality show only a shift in jobs, low wages and an increase in child
welfare assistance.
8. Gambling facilities bring an increase in crime to surrounding
communities, resulting in a lowered quality of life and an increase in city
emergency services and response.
9. The critical aquifer and blue line water source would be
situated under reservation land, creating a complicated control of this water
source and a draw -down of already low water supplies.
10. The three light residential neighborhoods and one privately
owned ranch would become jurisdictional islands of city and county land
surrounded by tribal reservation land creating a precedent setting myriad of
problems.
11. Lake Park and Soboba Road would become Indian
Reservation Roads (IRR) if the fee to trust is approved and the law states
that the tribe would have full law enforcement authority over its members
and non-members on that highway. They may stop people to check
sobriety, driver's licenses, and other issues and may detain citizens to
deliver to state or federal authorities.
12. According to the Soboba Tribal Compact of 1999, no matter
what mitigation agreements are formulated to address these issues, the
fact is that the tribe is not legally bound by mitigation agreements.
We are asking the City Council for the following considerations:
1. For every member to become familiar with the Draft
Environmental Statement on CD or on the website:
httpliteam.entrix.com/clientsite/Soboba.nsf
2. Renew the City's commitment to the current Resolution in
opposition of the fee to trust acquisition.
3. If not already accomplished, immediately determine the
members of the City Council Tribal Affairs Committee and meet with SOC
to discuss this issue.
4. Review the file of materials SOC has presented to the City
in order to become fully aware of the negative impact this fee to trust
acquisition and subsequent commercial enterprise would have on the
citizens of the City of San Jacinto and on their quality of life.
5. Create city/tribal meetings on this issue and include
members of the affected communities.
