BACKGROUND: The Housing Element is one of the state-mandated elements of the General Plan. State law requires Housing Elements to be updated periodically to reflect changing housing needs and conditions. All cities and counties within the Southern California Association of Governments (SCAG) region are required to update their Housing Elements for the 2008-2014 planning period. On October 1, 2009 a study session was held with the City Council and Planning Commission to review the City's Draft Housing Element. Please refer to Attachment A for the study session staff report containing an overview of Housing Element requirements and key issues. State law requires that the Draft Housing Element be submitted to the California Department of Housing and Community Development (HCD) for review, and that cities consider the comments of HCD prior to adoption of the Housing Element. Following the Council/Planning Commission study session last October, the draft Housing Element was sent to HCD for review and on December 3, 2009 a letter was received (Attachment B) with HCD's recommended revisions to the element. The revised draft Housing Element and Technical Appendix (Attachments E and F) Page 1 of 2 include revisions in response to HCD comments, which are shown in strike Gut/underline format and summarized in the matrix provided in Attachment C. At the study session, staff and consultant will discuss HCD's comments and proposed Housing Element revisions, and respond to questions from the Council and Planning Commission. If the proposed revisions are acceptable to Council and Planning Commission, staff requests authorization to submit the Revised Draft Housing Element to HCD for second review. ENVIRONMENTAL ANALYSIS: At this stage of the Housing Element process, staff is only presenting the Draft Housing Element to the Planning Commission and City Council for review, comment, and authorization to submit the draft document to HCD. During the time that the Draft Housing Element is being reviewed by HCD (approximately 60 days), it is customary for the environmental documentation to be prepared and noticed as required by the California Environmental Quality Act (CEQA). In this way, when the proposed final Housing Element returns to the Planning Commission and City Council for review and adoption, the environmental documentation will be completed and ready for action at the same time. RECOMMENDATION: Review the Revised Draft Housing Element, receive comment, provide direction as appropriate, and authorize staff to resubmit the Revised Draft Housing Element to the California Department of Housing and Community Development for second review. BUDGETARY IMPACT: A consultant contract for assistance in preparing the Housing Element was budgeted antf-appre"8 --. No additional costs are anticipated at this time. 1.S y Ci F 130,000 ATTACHMENTS: Attachment A — Staff report of October 1, 2009 Attachment B — HCD Review Letter of December 3, 2009 Attachment C — Summary of HCD Comments and Proposed Responses Attachment D — Public Meeting Notice and mailing list Attachment E — Revised Draft 2008-2014 Housing Element Attachment F — Housing Element Technical Report and Appendices Page 2 of 2
