MEMORANDUM
TO: Honorable Mayor and Members of Council

SUBJECT: Item 3A.6 on February 18, 2010— Consent Calendar
Honorable Mayor and Members of Council,
The City Attorney has informed me that the date highlighted below should
be inserted into the DR Horton "Villages" Development Agreement.
Therefore, tonight's action on this item should include this date.
Line V Basin V. OWNER shall, at its sole cost and expense, design, and
construct Line V and basin V on the Property, as set forth in Exhibit "G" (the
"Line V and Basin V"), as required by the draft master drainage plan and as set
forth in the City Engineer conditions of approval, dated December 16. 2009,
which conditions of approval are hereby incorporated into this Agreement as
though fully set forth herein. The Line V and Basin V improvements shall be
subject to review and approval of the City and RCFC. In the event the scope and
nature of the Line V and Basin V change materially from the version envisioned
in the draft master drainage plan, then OWNER will perform such drainage
improvements as may be reasonably necessary to remove the Project from the
Line D tributary.
