Soboba Springs Mobile Estates consists of 254 mobile homesites with a population of over 317 Senior Citizens. The Community was first constructed in 1970 and is known to be one of the finest Manufactured Home Communities in the Hemet Valley. The average age of the Homeowners in Soboba Springs Mobile Estates is 75 years, with 15 homeowners over 90 plus years of age. Our Community has elaborate recreation facilities, a reflection lake, driving range and a putting course, all providing an unparalleled lifestyle for our active Seniors, within a peaceful surrounding which is one of the main reasons our residents moved here. We have seen only sketchy uncommitted plans of the Tribe's intended development. It is very difficult to visualize the Tribe's proposal without an adequate project description in an EIS that includes, without limitation, conceptual plans showing buildings, elevations, traffic circulation, land use planning and landscaping buffering, and placement of the Waste Water Treatment Plant. Consideration for annexation of the 535 acres should include detailed plans of the proposed development, normally required by cities and counties. The documentation provided at the Public Scoping Meeting by the Tribe was grossly insufficient to achieve a conclusive environmental review and comment. Further, it has been established the tribe has been directed to other locations which should be considered and would be compatible to the surrounding communities. You should also know that in 1981 and 1982 EPM (Soboba Springs Mobile Estates "Owners") and prior owners the Daon Corporation entered into "Easement Agreements", which were recorded on December 31, 1981 and February 5, 1982 in Riverside County. The easement agreements allowed for a secondary ingress and egress, land for RV storage, which is the land described as the Horseshoe Grande (exhibits are attached). These easements are now the obligation of the Soboba Band of Luiseno Indians, as they now hold land title. The property impacted by these easements cannot be taken into trust for the Tribe under applicable law, including, without limitation, 25 C.F.R. 151.13 until these title restrictions are addressed through negotiations by the Tribe and BIA with us. To date this is still unresolved. It is our understanding that Class III gaming is generally prohibited on land acquired and placed into trust for the Tribe after October 17, 1988 , according to 25 U.S.C. Section 2719 of IGRA. This is the single most IMPORTANT issue: the Tribe has other land or other locations where the Casino/Hotel operation should go. The impacts on Soboba Springs Mobile Estates and on the nearby long established neighboring residential communities are staggering. There are few if any mitigation measures which satisfy the environmental effects thrust upon the many that have established their homes in this area within the City of San Jacinto. The proposed expansion discussed a "Wastewater Treatment Plant", however, the Tribe has not shown the proposed location for the plant. Prior presentation had placed the sewage treatment plant to border our property on the North West corner; this is totally missing from the application which is a gross omission. Any such proposal must be included within • Page 2 February 8, 2012 the application for consideration. The prevailing winds would constantly bring unavoidable odors to this Senior Community. The mere existence of which will cast a shadow of disdain on any residential area. There must be other land available for this Wastewater Treatment Plant. We ask that other options be analyzed as alternatives to the construction of an on-site waste treatment plant by the Tribe. Public Safety, where should we begin? In the last four years there have been three front page articles of high speed chases with bullets flying (see the attached articles). There has been a history of small arms fire coming from the reservation. Bullets being shot into the air have on many occasions' penetrated roofs or landed within the Soboba Springs Mobile Estates. Fortunately to date, no one has been injured by the stray bullets. In the past the Fire Department has not even enter the Soboba Reservation without a Sherriff's escort. Traffic is unbearable during Casino Special Events even without the proposed expansion. It is not unusual for our residents to be delayed over two hours, due to the roads being virtually blocked and over taxed. There have been no allowances for law enforcement and emergency services during these high traffic times. Emergency vehicles have been known to drive off the roadways to bypass jammed traffic leading into the reservation. This is an ongoing detriment to our community. Traffic studies must take into account traffic volumes including impacts during special events. What will the plans be for widening the existing bridge and roads, traffic controls and traffic management? Does the Tribe have an adequate evacuation plan in the event of an emergency? Who will be responsible for these expanded problems which are not currently being taken seriously? We are a Senior Community who relies on "First Responders" on a regular basis. The delays for emergency First Responders, even today, is life threatening before the expansion of the proposed project. The proposed casino/hotel will result in devastating consequences for the area. Public safety, traffic, air pollution, noise, overpowering lighting and signage, view restrictions, unlimited hours of operation, residential to commercial buffering, utilities, and sanitation are all issues of major concern. The residents of Soboba Springs Mobile Estates choose their homes for the peace and tranquility of the rural residential setting. Most have lived in the city and were impacted by the increasing traffic, pollution, noise and lighting accordingly. Currently, the Soboba Casino has four spot lights that permeate the sky each and every evening. Will the Tribe continue to use such lighting when next door or become considerate of their neighbors by restricting the operation to localized lighting on the new facilities? Outdoor concerts have been routinely held on the Soboba Reservation. Our community has been affected by noise, traffic and debris thrown from cars as they leave the reservation. If this proposal is approved will this bring these venues to our back door without consideration? Placing a casino/hotel/outdoor amphitheater/multi story parking structures (sp) across the street from Soboba Springs Mobile Estates will create an irreversible undesirable character to our beautiful residential community. In past years, our residents have been impacted by decisions made by Tribal members, i.e., holding Day/Night racing on a dirt bike track radiating the surroundings with the constant reverberation of roaring motorcycles and dust. Our expressed concerns to the Tribal Council were met with, "it is out of our control" as though the parcel was not within tribal control. Several months later after a number of related injuries and tragically a death, this activity was fmally stopped by the Tribe. History has not demonstrated confidence that our issues will be taken seriously by the Tribe. If the additional land is taken into trust by the BIA for the Tribe, we anticipate loss of local governmental CONTROL which now protects our property and environmental issues from those that don't care. The land in question is now under the domain of the City of San Jacinto with General Plans, Zoning Laws, Ordnances and Building Codes along with State law all designed to regulate land use development and construction. What restrictions will govern and mitigate the proposed development by the Tribe under Federal law if this land is taken into trust. Where is the oversight? We have been promised Federal controls under Federal Regulations; however such regulations have never offered resolution in the past. We respectfully ask you to reference a few "news articles" enclosures which better provide an overview of events, "No arrests in gun battle incident on Soboba Reservation", "Shots fired at Riverside Cowl?), sheriff's deputies' patrol car during chase", 'Tour injured after crash on Soboba Reservation near San Jacinto", "Ex-Soboba leader gets prison", "Residents fighting tribes hold rally". Such "Newspaper Headlines" are a representation of historic Tribal activities providing justification for our concerns regarding the proposed "Fee-to-Trust" Application. By taking the desired additional land into trust, we understand the Tribe would be exempt from the current local zoning and will no longer be subject to the City's General Plan and Land Use. The residential nature of this existing area would be overwhelmed by an extraordinary use normally away from residential land uses. The congestion that comes with a large • Page 3 February 8, 2012 scale casino and hotel operation, encompassing our quiet community will become a non-conducive commercial activity amidst a long established residential setting. If unmitigated, the residential character will be lost forever. The Tribe should at least agree to subject itself to the City of San Jacinto's local land use process for development standards and building codes enforcement for any such expansion project. This is done in other local communities, such as by the Agua Caliente Band in the City of Palm Springs. Where the Tribe works with the City and agrees to be subject to local planning oversight by the City, which has and should maintain the compatibility with all future development. Soboba Springs Mobile Estates has been protected by such ordinances which govern zoning, planning and respective set-backs for the adjacent properties. We have a 70 acre parcel constituting the Horseshoe surrounding the park of which a small part will be used for a fire station, service station and road. What happens to the remainder of the land under Tribal Rule? What will be next and who has control? The construction of the hotel and casino project will bring additional environmental concerns to all Soboba Springs' residents being burdened by corresponding noise, dust and vibration and many other adverse impacts. Measures are insufficient to mitigate these nuisances. What impact is this annexation and proposed project going to have on local services? We already know the Fire Department and Paramedics have had problems entering the reservation without a police escort, SEE ENCLOSURE "Cal Fire to require sheriff's escort for Soboba calls". While it has been publically acclaimed that the Tribe has entered into a PENDING agreement with the Riverside County Sheriff just what does that mean? The Tribe must be able to beyond a doubt demonstrate under State law ensuring that public safety needs are adequately met if the Annexation is approved by the BIA. Economics always comes into play, especially when combinations of intense uses are imposed upon residential properties. It becomes quite clear that the proposed uses of the land surrounding our mobilehome community and the homes therein will be dramatically impacted, particularly if strong mitigation measures are not imposed. Our residents have had the benefit of the quiet enjoyment of this private community for 35 plus years. Most have placed their nest egg in their homes. They have justified concerns that the proposed project will deflate their property values. We ask the City to consider the impact this proposed project will have on the property values in all of the neighboring residential communities. Please understand we do not want to stand in the way of the Tribe's progress; however, the BIA must address all "potential conflicts of land use which may arise", under 25 CFR 151.10(f), before acting on the Tribe's application. The bottom line is the Tribe has other building locations for the Horseshoe Grand project. It does not belong on the proposed site. The recently submitted application does not provide an adequate "buffer zone" around our mobilehome park proportionate to the proposed development. Should the site location be reconsidered, we can then support in all ways the Tribes effort to have a new Casino/Hotel. We are sure should this happen there will be no opposition. We have in the past enjoyed good relations with the Tribe and stand ready to work with them and the BIA. Should this application be approved, we are MOST concerned about the governmental authority and accountability the Tribe will have towards the City, Soboba Springs and other surrounding neighbors. These concerns must be addressed prior to the approval of the application. Thank you for your time and consideration in evaluating our aforementioned concerns. Sincerely, Edwin J. The Press-Enterprise A recent surge in violent incidents has prompted Cal Flre to change policy and require firefighters to wait for a sheri f f ' s e s c o r t b e f o r e responding to emergency calls on the Soboba Indian Reservation. The new policy does not include emergency calls from the Soboba Casino, where firefighters will proceed in as usu a l , s a i d C a p t . Fernando i-lerrera. Battering escalates. The American Cancer Society Relay For Life is a life-changing event that gives everyone in communities across the globe a chance to celebrate the lives of people who have battled cancer, remember loved ones lost, and fight back against the disease. At Relay, teams of people camp out at a local high school, park, or fairground and take turns walking or running around a track or path. Each team is asked to have a representative on the track at all times during the event. Because cancer never sleeps, Relays are overnight events up to 24 hours long. Each year, more than 3.5 million people in more than 5,000 communities in the United States, along with additional communities in 19 other countries, gather to take part in this global phenomenon and raise much-needed funds and awareness to save lives from cancer. Thanks to Relay participants, we are creating a world with more birthdays — a world where cancer never steals another year of anyone's life. Visit RelayForLife.org. Celebrating Survivors A survivor is anyone who has ever heard the words "You have cancer." We invite all cancer survivors in the community to attend Relay For Life because they are the reason we Relay. Our goal is to create a world where more people survive cancer — so they can celebrate another birthday. This year, more than 11 million people will be able to do that thanks to the support of millions of dedicated Relay participants. Survivors are the guests of honor at Relay. Relay events may offer survivors special T-shirts or sashes or hold a special reception for survivors and caregivers. Most Relays open with the Survivors Lap, where survivors lead the way around the track while participants honor and applaud them. Being a part of the Survivors Lap allows survivors to celebrate what they've overcome while inspiring and motivating their community to fight. Survivors are proof that cancer can be defeated. For more information on how to participate in this year's Survivors Lap or other activities, please visit RelayForLife.org. A Chance to Remember One important aspect of the American Cancer Society Relay For Life is the opportunity for people to come together to remember loved ones lost to cancer and honor those who have won their battle. One of the most moving parts of the event is the Luminaria Ceremony. As the sun sets over campsites and darkness falls, the night is brightened by the glow of illuminated bags called luminaria, each bearing the name of someone who has battled cancer. Some celebrate cancer survivors, while others help us honor and remember those gone too soon. All represent someone special who has been profoundly affected by cancer and the family and friends who continue to fight back in their honor. Would you like to honor or remember someone with a luminaria during the Relay For Life Luminaria Ceremony? Visit RelayForLife.org to learn more about this special part of Relay events. Why Relay? Everyone's reason to Relay is as unique as their own personal story. At Relay, you can find healing, comfort, and support from others who have faced cancer or who have lost a loved one to the disease. You have a chance to meet people in the community who are equally as passionate about finding an end to cancer in our lifetime. You can thank all the people who have done so much to support you through your personal cancer experience. And you can gather together with friends, family, and colleagues to laugh, cry, and create lasting memories. No matter why you take part in Relay, however, one thing is clear: with every step you take, you help the American Cancer Society save lives. With your help, we aren't just fighting one type of cancer — we're fighting for every birthday threatened by every cancer in every community. Each person who shares the Relay experience can take pride in knowing that they are working to create a world where this disease will no longer threaten the lives of our loved ones or steal another year of anyone's life.
