Isidro and Connie Guzman were on the Planning Commission Agenda last month at the March 10, 1993 meeting. At that time Mr. Guzman was in attendance prior to the onset of the meeting. Through a misunderstanding Mr. Guzman was told that his presence would not be necessary and he left the meeting before his case was heard. Because of this misunderstanding the appellant was deprived of his opportunity to present and defend his case to the Planning Commission. At this time staff has put the appeal of Isidro and Connie Guzman back on the agenda in order to permit them the opportunity to present their case and answer any questions that the Commission might have. L ) STAFF REPORT TO: Chairman Rutledge and Members of the Planning Commission FROM: Jeff Cherry, Planner I via Brian McNabb, Director of Community Development DATE: February 10, 1993 SUBJECT: Appeal of Staff denial of application requesting placement of a fence in a prohibited location. ORDINANCE 877 (FENCE REGULATIONS) APPLICANT: Isidro and Connie Guzman 369 N. Wateka Street San Jacinto DESCRIPTION The applicant is appealing the staff denial of a 42" chain link fence proposal in the front setback on Wateka Street. Staffs denial is based upon Ordinance 877 Section 4.1.3 which prohibits fencing between the front setback line and the street. Section 4.1.3 also provides for an appeal process which includes appealing a denial to the Planning Commission. However if the Planning Commission finds that extenuating circumstances do exist, it can grant the applicant permission to construct a fence of no more than 42" in height within the front setback. Staff can only approve front yard fencing subject to the following: "Normally, an exemption shall only be granted for fencing along side lot lines. However where fencing on more than 50% of the lots on the same side of the street in a block containing fencing in a prohibited location, the Community Development Director shall allow conformance with existing fencing." As noted in the applicants letter, the property is not on the corner, but instead next to a vacant lot which is on a corner. The problem is the result of a large amount of pedestrian traffic, to schools and parks etc. in the area cutting a pathway through the lot and disturbing the property and privacy of the applicants. BACKGROUND Applicants Isidro and Connie Guzman originally submitted an application to construct a fence on the front property line which was denied by staff in accordance with Ordinance 877. The applicant is now appealing staffs' denial to the Planning Commission. The property owner feels that extenuating circumstances do exist which warrant the placement of a fence in a prohibited location. In a letter which is attached the applicant cites numerous instances of theft and vandalism and at this point is concerned about their own personnel safety and privacy. ‹..&t r / %=i - - Adz E -710 Le- ____LZuLa-dgi-oc-1 LL,A2LL Zu<< 6idranthz 4/1 jt/Ei1&riee_ 4.34 - / 4 rc.A. too/ a 0 ar 00 0 601 0 FOR. Jeff Cherry Planner I STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: Brian McNabb, Director of Community Development DATE: May 18, 1993 SUBJECT: Agenda Item No. 7.2; Appeal of Planning Commission denial APPLICANT: Isidro and Connie Guzman 369 N. Wateka Street San Jacinto DESCRIPTION The attached letter was inadvertently omitted from your Staff Report on this item. The letter is the formal appeal request and delineates the reasons which the property owner feels warrant the placement of the fence in a prohibited location. Isidro & Connie Guzman 369 N. Wateka St. San Jacinto, Ca 92581 (909)654-7106 San Jacinto City Council c/o Laurie Mora 312 E. Main Street San Jacinto, Ca 92583 April 29, 1993 SUBJECT: CITY COUNCIL APPEAL TO PLANNING COMMISSION DENIAL FOR FENCE CONSTRUCTION AT 369 N. WATEKA STREET Dear City Council: We are the property owners/residents of 369 N. Wateka Street. On January, 1993 we decided to install a chain link fence in front of our house, so our children could have more area to play outside the house and still be safe from the dangers of the street. We applied for our fence permit and it was denied by staff, because under the current City Ordinance #877, the City does not allow construction of residential fences unless 50% of the neighboring residences on the same side of the street have the same type of fence. We appealed this decision to the Planning Commission on February 10, 1993, a copy of our appeal letter is enclosed for your reference and consideration. We were unaware that we needed to be present at the Planning Commission meeting and we did not attend. At this meeting the Planning Commission continued this item to March 10, 1993, to allow us to be present. On March 10, 1993, the Planning Commission and City Council had a joint meeting. Our appeal was in the agenda as Item No. 5.1, I was attending mandatory classes for my girl's first communion and I was unable to attend, my husband who was sick that day was present at the meeting. David Solorio who was also present at the meeting, talked to my husband and told him to go home and that he would notify him of the Council's action on his case. Therefore, my husband left the meeting and he was unable to expose our case to the Commissioners and Council Members. After this misunderstanding, Tim Hults contacted me by telephone to tell me the City was going to allow us to take our appeal to the Council. We had already planned our spring vacation to Rosarito, and had made all the arrangements for the same, I told Tim "never mind" as we couldn't be at this meeting because of our plans. We went ahead and erected our chain link fence after talking to our neighbors. They felt the City was being unfair to us, they see how good we keep our place and how proud we are of it too. After this chain link fence our neighbors came over and complimented us on its looks, and none of them object it. Our children enjoy playing in the front yard, before they wore only allowed to play in the back yard. When we are away from home, we feel more confident about leaving our house alone, and we do not have people stepping in our lawn any more. We might have done the wrong thing by installing the fence without your permission, but after all the frustrations and misunderstandings we had we decided to do it. We are requesting your consideration of our case and asking you to allow us to keep our front fence for the safety of our children and security of our belongings and peace of mind. Sincerely, v µ_me -„- -ter. As you might have heard from the city officials, two years ago, have presented a plan tb the city to"build 34 units on the above mentioned parcel. Although.: we -:had -the support of the.,city on that project, but :later on it was defeated at the public hearing. We also had a ulternative.plan to build 16 houses, but:we were waiting for the right dime. Last week we presented a copy of the preliminary lay -out to Mr McNabb. For us it is not just We have invested lots of time, money, and effort on that parcel We understand the past is gone. That is why after a long discussion I convinced my partners to accept the idea of selling the. land to the city. We belive the city officials were very cooperative and fair with us on this and other projects we had. We are looking. forward to working with the city at the future time on the other projects. So with all this in mind we would like to be realistic. We agreed on the asking price of $160,000.00. Ofcourse we are ready to sit down and negotiate, a piece of land. It is the expectation we had.
