III PUBLIC HEARINGS A. Tract 21900 Applicant: Crown Pacific Realty Request to amend Conditions of Approval for Village IV of Specific Plan 1-85. Brian McNabb, Community Development Director, gave a review of the five (5) conditions recommended by Planning Commission: 1. Developer post bonds to cover any shortfall in Mello -Roos funding. 2. Developer shall dedicate land for debris basin within Village VI and construct a fully improved debris basin along Soboba Road between Village IV and the golf course. 3. Defer fire station until future development occurs 4. Developer shall post bonds to cover any shortfall in Mello -Roos bond funding, and 5. Deny request to amend utility condition #3 (undergrounding utilities adjacent or within a tract and payment of a fee.) The Mayor opened the Public Hearing. The Clerk stated notice of the public hearing has been advertised (continued from 9/27/90); affidavit of publication is on file. All property owners of record within 300 feet have been notified by mail; declaration of mailing is on file. The Clerk has not received oral or written comments. 10-2-90 Minutes Page 5 Harry Bigham, applicant (Crown Pacific Realty), expressed that the master developer will have to pick-up overruns and additionally stated that fees should apply only from tract boundary to tract boundary. Mr. Bigham stated that completion of second half of Village #4 would relieve a bad situation for existing owners of completed half. Brian McNabb, Community Development Director stated bonds can be sold on projected cost or bids received and then bolds sold. Councilman Divine stated he feels the existing owners are owed assistance in completing the Village. Mayor Ford expressed objection to deferring the Fire Department. Mr. Bigham stated that the homeowners in the village (approx. 70) did not feel the existing liability would be increased with completion of the Village and that the Fire Department could be deferred. James Broadeur, 1830 Carrera Drive, requested speedy consideration of existing problems in Village #4. Mr. Brass, 828 Verona, stated there had been a significant fire in the area lately and the response time from the Fire Department was satisfactory. He further stated that Soboba Road's condition was o.k. for now and requested City action to help complete the Village. Mr. Reents, 1806 Carrera Drive, requested commitment from Crown Pacific to complete golf cart paths and stairways leading nowhere, listing the following_priorities: 1. completion of unfinished items in existing phase, 2. landscaping inside tract, 3. flood control, and concluded saying that completion will attract future developers. As no one else wished to be heard, the Mayor closed the Public Hearing. Councilman Boykin suggested road improvements to entrance of development be completed and postpone the 12" water line. Councilman Boykin further asked what city did wrong in initial assessment of project? Mr. McNabb stated that the flood control requirements were unknown at the beginning of project and not sufficiently budgeted, developer quoted price of 1% maximum allowable cap set at $650 (homes sold for much more, but assessment set at $650.), and no bonds for Soboba Road were required for because it had been the intention to complete the improvements through CFD financing. Mr. McNabb recommended not enforcing the large debris (Village #6) through Village #4 at this time. Mr. McNabb further stated that options 1 and 2 can be omitted, reduce the costs to a $37,000 shortfall from bond sales. 10-2-90 Minutes Page 6 Mr. Bigham stated that a $50,000 bond can be posted, but cannot include any overruns. Mr. McNabb stated a maximum $75,000 bond could be posted. Mr. Bigham asked Council to address underground utilities. Councilman Boykin stated that Staff can address this concern at a later time. Councilman Divine stated that the applicant's requests were reasonable regarding the identification of tract boundaries. Councilman Boykin told the audience this was a difficult project and requested citizen support on behalf of completion. Mr. McNabb told Council that a Letter of Credit to guarantee property tax payment must be posted by applicant in order to secure bond sale. Motion by Councilman Divine to amend the conditions of approval for Tract 21900 as follows road conditions lA & 1B and utility conditions are amended to read as follows: The developer shall secure and contribute a maximum of $75,000 to pay for any shortfalls or cost overruns for public and utility improvements within Soboba Rd. Condition #2 shall be amended to read, comply with requirements of Riverside County Flood Control, except that developer shall dedicate land for debris basin within Village VI and construct a fully improved debris basin along Soboba Road between Village IV and the golf course. Public safety condition shall be deleted as it relates to Tract 21900. You then informed me that you had prepared for presentation, a Government tort claim on behalf of officer Worthy. You indicated your intent to serve the claim upon the City. Z have since reviewed the claim and it is scheduled for the City Council meeting of October 16/ 1990. Z have recommended that the claim be denied. As we previously discussed, Labor Code Section 3601 provides that worker's compensation benefits are the exclusive remedy avail- able to Officer Worthy, as against the Citl, (his employer). If Officer Worthy files an action naming the City, it would be subject to dismissal on demurrer as a matter of law. The City remains willing to cooperate with you in providing full information as to the compensation benefits provided to officer Worthy. We further wish to remind you that the City does intend to assert its lien rights pursuant to Labor Code Section 3858. Ibaobs a lot and feel free to give me a call should you need any information. It further recognizes that compen- sation and conditions of employment must be sufficiently attrac- tive to draw and retain qualified employees. Therefore, the City will compensate its management employees with wages and benefits commensurate with performance of the management employee. This philosophy is based in part upon socio-economic level of the community and those standards, values and characteristics as reflected to the City Council by the community. Each job classification in the management and confidential series shall have a defined salary range as defined in Attachments "A" and "B", effective the 1st day of September, 1990, and thereafter, as approved by the City Council in the annual operating budget. NOW, THEREFORE, upon adoption of Resolution No. 1913, Resolution No. 1785 adopted on the 22nd day of November, 1988, will remain in force with the exception of Attachments "A" and "B", being respectively rescinded and replaced by Attachments A&B. CITY OF SAN JACINIO WWIER DEPARDENE 905 Industrual Way San Jacinto, CA 92383 TO: MAYOR TRAMMEL FORD and CITY COUNCIL MEMEEFS FROM: John Townsel Water Superintendent DATE: October 9, 1990 SOBJ: "The Villas" Development This memo is being generated to provide canplete and up to date information for the City Council regarding water quality problems in the City; and, in particular, "The Villas" development. As you know, the City water supply contains an excessive amount of iron and manganese, as well as, hydrogen sulfide. The iron and manganese causes discoloration, and the hydrogen sulfide causes a "rotten egg" odor. Customers living in "The Villas" are experiencing these symptoms more frequently than most. I believe their problems can be taken care of in the following manner. 1. Short Term Solution: a. Flush deadend water mains frequently. b. Customers should flush water heaters monthly. c. City to install flusher on main line in alley South of Encanto. 2. Medium Term Solution: a. Install remaining loops of main line on Palm Ave., Encanto St. and Sambra Way. This will allow good circulation of fresh water. Developer should be starting on this final section soon, thus eliminating deadends where problems intensify. 3. Long Term Solution: a. Install water treatment systems at each well site to filter out stain and odor problem elements. b. Flush mains throughout the City to expell remaining iron and manganese still in system, after treatment plant installation. With the continued cooperation of the public, I believe we can Systematically increase our water quality, and virtually eliminate the staining and odor problems we are now experiencing. In talking with Rod Tibbitts of California Ranch Homes, he stated that he will be installing continuations on Encanto St. and Palm Ave. in the near future. We are also hoping to continue the main from Sanbra Way north to Encanto Dr. This is an especially delicate installation because of the close proximity of an E.M.W.D. water main. However, I am optimistic that a solution will be resolved with. the developer. Kx\ SENIOR DAY CARE CENTER of HEMET-SAN JACIN ' 0 625 SOUTH PICO AVENUE SAN JACINTO, CA. 92383 ALZHEIMER'S RESOURCE CENTER (714) 654-1477 October 1, 1990 Mayor Trammel Ford Vice Mayor Francis Boykin Councilman Cliff Rose Councilman Les Redding Councilman Marc Devine San Jacinto City Hall 201 East Main Street San Jacinto, CA. 92383 Honorable Councilmen, Per our conversation on September 28, 1990, I would like to confirm our agenda appointment of October 16, 1990. The Senior Day Care Center is most appreciative of our comple- mentary and cooperative relationship with the City of San Jacinto over the past four years. We believe that the housing of our program for the frail elderly and their family caregivers, within the City's Community Center complex is a stategic step in successfully servicing our senior community. Together we are providing a wide range of. alternatives for this growing segment of our population. As San Jacinto is one of only three communities in Riverside County associated with a senior day care center, this has added to the attractiveness of living in San Jacinto. It's a feature some developers have used in their marketing compaigns. At this time, as the City plans for the future and as we assess our services, we request an extension of our present agreement with you to remain in the Community Center complex an additional five years beyond the original five-year term, bringing us to 1996. We are now serving 26 clients and their families weekly and have increased our hours of operation from 7 AM to 6 PM in order to better service our working families. We have served over 800 families in the past four years. Two years ago we changed our name from the David Kahn/Alzheimer's Senior Day Care Center in an effort to better serve the full range of needs of our senior community. Our bi-monthly Support Group Program, offering informative speakers as well as intergroup discussions, continues to be the only Alzheimer's support group in the entire valley and draws sizeable numbers of participants at each session. A NON-PROFIT CENTER PROVIDING SERVICES FOR SENIORS While our financial status has stabilized due to funding from United Way in the past two years, we continue to rely heavily upon donations and fund-raising because any further increases in our service fees of approximently $3.00 per hour would be prohibitive for the families we serve. We are looking forward to discussing this request with you at the October 16th meeting. Sincerely, Carole Donahoe President of the Board cc: County Supervisor Kay Ceniceros City Manager Pamela Easter CD/jra MEMORANDUM TO: Honorable Mayor and Council Members via Pamela S. Easter, City Manager FROM: Nancy Randolph, Deputy City Clerk DATE: 10-12-90 SUBJECT: Planning Commission Appointments Pursuant to the City's Ordinance No. 747, the City's Planning Commission shall consist of five members who shall be appointed by the Mayor, with the approval of the City Council. Three members must be (and remain) residents of the City, and two members may be residents of the City's approved and adopted sphere of influence. Two Planning Commissioners' terms are expiring on October 31. These vacancies have been published in the local papers. Six (6) applicants have submitted resumes indicating their interest in being considered. The resumes have been attached for your review and consideration. All six (6) reside within the approved City limit as do the remaining three (3) Commissioners. The Council may wish to consider interviewing the candidates to have a better understanding of their background, related experience, etc. These interviews could be held on a Saturday or in the evening in the next several weeks so that a selection could be made at the October 30 adjourned Council meeting or the November 6 meeting.
