Resource Criteria: The older person needs: a. are multiple, more than two distinct services are needed. b. are not being met because of a problem the elder encounters in accessing service, excauples would be language barriers, eligibility requirements, etc. c, require further assessment before referral. IF ON THE INITIAL OUTREACH VISIT THE OLDER PERSON MEETS AT LEAST ONE CRITERIA EACH OF THESE AREAS THEY SHOULD BF REFERRED TO RIVERSIDE ACCESS. CALIFORNIA 18 19 20 21 22 23 24 25 26 12 MEMO TO: Honorable Mayor and Members of the City Council FROM: Brian McNabb, Director of Community Development DATE: September 14, 1990 SUBJ: Conditional Use Permit 6-90 This item was heard before the City Council on September 4, 1990. The City Council at that meeting requested further investigation whether the project complies with the R-3 Multifamily Ordinance and whether the Ordinance specifies a requirement for amenities based upon number of residents. Staff has reviewed the project since the last City Council meeting and found that the project does comply with all provisions of the R-3 section of Zoning Ordinance 340. Recreational amenities are based upon a percentage of the gross area rather than an occupancy basis. Ordinance 897 does not require recreational amenities be provided except to increase allowable densities. Section 708.2.h reads as follows: H. A density increase of up to 25% maximum shall be given if active recreational facilities are available, such as the following: Recreational building(s) 5% Tennis courts 10% Children's Play Area 5% Basketball courts 5% Volleyball courts 5% Swimming pools 10% Badminton courts 5% Handball courts 5% Any active recreational facility approved by the Planning Commission or City Council. The sizing and/or number of recreational facilities shall be as approved by the Staff, Planning Commission, and/or City Council as applicable. As illustrated in Section 708.2.h, the recreational amenities are only provided as a result of incentives to increased densities. The Staff, Planning Commission, and City Council may however require minimum recreational amenities as needed or applicable. Staff reviewed the proposal and determined the swimming pool is approximately 20' X 35'. Open space excluding the emergency access road exceeds the minimum required 11,835 sq. ft. requirement. The tot lot area shown is approximately 900 sq. ft. The applicant has submitted calculations on the site plan showing density, parking, open space etc. This document was submitted on an 8 1/2" x 11" paper and may have been difficult to read. The calculations as submitted are shown below. Total lot area 2.72 acres (118,357 sq.ft.) Density: Basic allowed 14.5 du/acre *25% increase for 50% or more of the units are affordable *15% increase for swimming pool, tot lot, and barbecue Total allowed 20.5 du/acre Total provided 20.5 du/acre Total units allowed 56 units Total units provided 56 units 32 - 2BR/1BA 24 - 3BR/2BA Total parking required 115 spaces Total parking provided 115 spaces 36 - garages 40 - carport 39 - open Common open space required 11,936 sq. ft. (10% of net) Common open space provided 21,721 sq. ft. Please note density bonuses were granted on the condition 50% or more of the units were made affordable and the swimming pool, tot lot, and barbecue area are provided. The City Council may condition the project to provide additional recreational amenities as necessary or applicable to the project. Respectfully Submitted, BRIAN MC NABB Director of Community Development MEMO TO: Honorable Mayor and Members of the City Council FROM: Brian McNabb, Director of Community Development DATE: August 30, 1990 SUBJ: Conditional Use Permit 6-90 This item was heard before the Planning Commission on August 15, 1990. The Planning Commission reviewed the project and found it to be consistent with Zoning Ordinance 340. The Planning Commission approved the conditional use subject to City Council ratification. Attached for your review is a copy of the staff report and exhibits. Respectfully Submitted, -72;61 BRIAN MC NABB Director of Community Development STAFF REPORT TO: FROM: DATE: SUBJ: Chairman Hixson and Members of the Planning Commission Brian McNabb, Director of Community Development July 19, 1990 ENVIRONMENTAL ASSESSMENT AND CONDITIONAL USE PERMIT 6-90 APPLICANT: ENGINEER: USA/FAIRFIELD REALTY FUND, LTD 3179 Temple Avenue, Suite 170 Pomona, CA 91768 (714) 594-1889 MAINIERO, SMITH & ASSOCIATES 2225 Faraday Avenue, Suite F Carlsbad, CA 92008-0163 (714) 438-1605 DESCRIPTION A proposal to develop a 56 unit apartment complex on approximately 2.76 acres located south of the extension of Oakwood Avenue east of Santa Fe Avenue. EXHIBIT "A" EXISTING GENERAL PLAN EXHIBIT "B" EXISTING ZONING EXHIBIT "C" CURRENT USES EXHIBIT "D" EXISTING CIRCULATION ENVIRONMENTAL ANALYSIS The subject property is not in an "A" floodzone. The subject property is not in a seismic study area, however a seismic zone does exist within 200' to the southwest. Utilities are available to serve the site. Traffic volumes to and from the site will increase above current levels. An average of seven trips per unit indicates an increase in traffic volumes near 392 average daily trips. PLANNING COMMISSION AUGUST 15, 1990 PAGE NO. 1 Noise levels will most likely increase due to both children playing as well as increased traffic. Noise levels should not increase to a severe level but will probably be at a noticeable level. DISCUSSION The subject property is zoned R-3, Multifamily and the General Plan for the property is High Density Residential. The subject property currently is vacant. Surrounding land uses consist of vacant properties with the exception of a senior apartment complex to the northwest. Article 7 of Zoning Ordinance 320 requires a Conditional Use Permit for areas of multiple dwellings with 5 or more dwelling units. The applicant proposes 56 units which is subject to the Conditional Use Permit requirement. Once a C.U.P. is granted, it would remain with the property regardless of ownership. The proposed development has been reviewed for conformance to the R-3 zone requirements. Staff has found the proposed development to be in compliance with Article 7. The purposes of the R-3 zone is to provide locations for multiple family residential projects at densities designated in the City's General Plan for Medium and High Density Residential. It may also provide protection for existing housing stock and allow housing for all socio-economic sectors of the community. Properties assigned this designation should be shopping centers, transit systems, sewers and other required infrastructure. The Planning Commission should consider whether the proposed use would create an atmosphere which would create or potentially create negative impacts. The proposed site for the conditional use is within an area planned for reasonably dense residential uses. Special considerations should be made to ensure the proposal is not detrimental to adjoining properties. Approval of a C.U.P. application involves the Planning Commission find the following. 1. The proposed location of the conditional use is in accord with the objectives of this ordinance (Ordinance 340) and the purposes of the zone in which the site is located. 2. That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to PLANNING COMMISSION AUGUST 15, 1990 PAGE NO. 2 properties or improvements in the vicinity. 3. That the proposed conditional use will comply with each of the applicable provisions of this ordinance. To ensure no negative impacts will result from this proposal or mitigation of adverse impacts occurs the Planning Commission should condition the use permit as necessary. RECOMMENDATION If the Planning Commission wishes it would be appropriate to adopt Resolution 90-59 approving Conditional Use Permit 6-90 subject to the findings of fact, conditions of approval, and ratification by the City Council. Brian McNabb Director of Community Development PLANNING COMMISSION AUGUST 15, 1990 PAGE NO. 3 FINDINGS OF FACT 1.
