MEMO
TO: Honorable Mayor and Council Members
FROM: Ross S. Nammar, City Manager
SUBJ: Disability Retirement - Lt. Holmes
DATE: 03-02-90
As you recall, Lt. Holmes sustained injury the day of
the dedication of the Gromov Monument, while repelling
from the fire hose tower at the Police Department parking
lot.
You will further recall that as a result of the injury,
Council adopted Resolution No. 1843 retiring Mr. Holmes,
effective September 1, 1989. Please be advised now that
we were able to close Mr. Holme's worker's compensation
disability claim payment in the amount of $38,640.00 cash,
with the future medical expenses to be born by the City.
A rather interesting situation was brought to our attention
that Mr. Holme's withdrew from PERS safety retirement
in 1984. Therefore, the disability retirement now falls
under a different section of the Code, thereby the City
realizing a substantial savings in its financial liability
for Mr. Holme's life retirement.
At the regular meeting of March 20, 1990, a Resolution
will appear on the Agenda for adoption, informing PERS
that the disability was not a result of a direct violent
act perpetrated upon the member and that the incident
occurred during the performance of those portions of the
member's duties which are not hazardous or dangerous.
If you have any questions, or need further information,
please contact me since you are aware the subject matter
is confidential and should not be discussed in public.

Dear Henry: March 9, 1990
Subject: Placed on Agenda of March 20, 1990
Our Association would like to thank the City of San
Jacinto for the faithful, timely manner in which they have
supported us through the vouchers this fiscal year.
We would like to be placed on the agenda of March 20,
regarding a CINCO de MAYO FIESTA celebration that we are
planning.
If we can have a banner made, we would like to have the
city hang it for us over Main Street or San Jacinto St.. We
would request that the city have all trash containers emptied
on and around Main Street the day before our celebration.
Our request is to have Main Street blocked off from San
Jacinto Ave. to Alessandro. We are in need of Police patrol,
barricades to block the -streets off, 6 toilets and 1 sink.
Unlike the Potato FestiVal, we will not have the sponsorship
support in great volume to offset our expenses. So we are
asking the city to take care of these items.
As always, we will supply the city with a $1,000,000.00
insurance liability rider.
Sincerely,
Linda Scott

SUBJ: STORM DRAIN FINANCING DISTRICT/DEVELOPER FEES
At the study session on March 13, the Council directed staff to
develop the necessary ordinances, for Council review, to set the
necessary fees needed to cover the construction of flood control
facilities and to potentially implement a construction moratorium.
In order to implement the fees on a permanent basis, the City must
adopt an ordinance which would not be effective for a period of
sixty days after adoption. An urgency ordinance may be adopted
immediately implementing fees.
The presentation of the study session showed there are cases where
payment of fees will satisfy the impacts caused by development and
cases where payment of fees will not be effective because actual
facilities need to be constructed. Policies should be developed
differentiating between these two cases.
The presentation additionally demonstrated there were various ways
to spread the cost of construction which needed to be evaluated
further.
Staff and its consultants met after the study session and
determined it was impossible to accurately finalize an urgency
ordinance dealing with fees in the space of three days. However,
it was possible to prepare an urgency moratorium ordinance for
Council consideration.
Staff, in presenting this ordinance to the Council, is not making
a specific recommendation. We do note, however, the consultants
plainly stated every permit issued with an inadequate fee compounds
the problem.
If the Council chooses to adopt the ordinance, staff estimates the
following timetable to lift the moratorium.
April 3rd - Draft policy for issuance of building permits and
recording final maps submitted for Council
consideration.
April 17th - Final policy approved by Council. Urgency fee
ordinance adopted. Public hearings set for adoption
of fee schedule.
May 8th - Public hearing and introduction of fee ordinance.
May 22nd - Adoption of fee ordinance.
July 22nd - New fees effective. Repeal of moratorium.
If the Council choose to adopt this ordinance, the action should
be taken in two steps:
1. Motion to introduce the ordinance.
2. Motion to adopt the ordinance.
Approval of an urgency ordinance requires a 4/5's vote of the City
Council.
Respe tfully submitted,

ORDINANCE
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO,
CALIFORNIA, DECLARING A TEMPORARY MORATORIUM ON ISSUANCE OF
BUILDING PERMITS FOR THE CONSTRUCTION OF NEW BUILDINGS AND
RECORDATION OF FINAL MAPS.
THE CITY COUNCIL OF THE CITY OF SAN JACINTO DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Recitals.
Whereas, the City of San Jacinto is experiencing a period of
tremendous growth in residential, commercial and industrial
building permits;
WHEREAS, this growth increases the amount of land coverage and
decreases the area for runoff percolation.
WHEREAS, this increased runoff potentially endangers the
health, safety and welfare of residents, property owners, and users
of public right-of-way.
WHEREAS, the increased runoff potentially exposes the City to
increased liability.
WHEREAS, the City Council Commissioned an analysis of the San
Jacinto Area Master Drainage Plan and appurtant structures for
purposes of determining costs and methods of implementing said
Master Drainage Plan.
WHEREAS, said analysis revealed the costs to construct the
facilities in the Master Drainage Plan and appurtenant facilities
to be approximately $85,000,000.00.
WHEREAS, cost of implementation exceed the financial capacity
of the City.
WHEREAS, new development must pay their fair share toward the
cost of these improvements.
WHEREAS, each building permit issued without its fair share
assessed creates additional liability questions as well as
increases the burden on the City and future development.
Section 2. Moratorium.
Except as noted below, the Council hereby declares no permits
shall be issued and no final maps shall be recorded based on the
public health, safety and welfare issues noted in Section 1, until
these issues can be adequately addressed.
Section 3. Exceptions.
The following permits and final maps are exempt from this
moratorium:
1. Encroachment permits.
2. Public works permits issued for projects that are exempt
from this moratorium.
3. Building permits or public works permits for additions
or alterations to existing structures or land totalling
less than 25% of the value of the existing structure or
land as determined by the Building Official.
4. Grading permits, provided the applicant and property
owner signs and agrees to the recordation of a document
acknowledging that the issuance of a grading permit does
not grant a vested right to a building permit and is at
the risk and expense of signator(s).
5. Final parcel maps of less than five lots.
Section 4. Effect date.
This ordinance shall be effective immediately.
Section 5. Term of Ordinance.
This ordinance shall remain in effect until such time as the
City Council adopts an ordinance repealing it.
Section 6. It is hereby declared to be the intention of the
City Council that sections, paragraphs, sentences, clauses and
phrases of the ordinance and the code and codes hereby adopted
severable, and if any phrase, clause, sentence, paragraph or
section of this ordinance of the code or codes hereby adopted shall
be declared unconstitutional or otherwise invalid by the valid
judgement or decree of a court of competent jurisdiction, such
unconstitutionality or invalidity shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, and sections of
this ordinance or the code hereby adopted.
Section 7. The City Clerk shall certify to the adoption of
this ordinance and cause the same to be published in a newspaper
of general circulation printed and published in the County of
Riverside, State of California.

Dear Mayor:
Per our telephone conversation last week--you asked again
for a letter listing all the things wrong with our home.
We sent two letters to the City of San Jacinto--return receipt
requested--wherein all the errors were listed.
One letter dated July 27, 1987 and the other February 13, 1989.
Also the Grand Juryletter that was sbnt to the City Manager and
Director of Community Development that you knew nothing about
the morning that Brian McNab, you and I met at City Hall. I
was very surprised to hear that you were not even informed that
the Grand Jury was investigating. Who runs the city the elected
officials or Brian McNab?
You know that the completion papers on our home was falsefied,
what are you doing about it?
I truly want to knof the code violations at the'time that I
bought this home, and the report that I received from Brian
McN8B did not list all the code violations.
The Los Angeles Times on September 5, 1989 states that a law
was passed in 1935 Calling for reinforced steelto be placed in
concrete. This house has no reinforced steel in the concrete
nor heavy mesh wire in the floors.
Is this your private domain where the Mayor, City Council and
Building Department can do as they please? You and the Building
Department are supposed to protect people buying in your city
but you are doing a poor job.
Please reply.
SMR:lr
I am sending this to your home since Bria n McNab is enclined
to withhold from you information derogatory to him or hid
department.
