MEMO
TO: Honorable Mayor and Council Members
FROM: Henry T. Garcia, Asst. City Manager
SUBJ: Executive Session - 2 -6 -90
DATE: 02-01-90
Chief Kozma has requested to speak to Council in closed
session concerning direction from the City Manager's Office.
Please note that Government Code Section 54957 specifically
states, with regard to personnel matters, "that the Council
may discuss appointments, employment evaluations or perfor-
mance or dismissal of an employee or to hear complaints
or charges brought against such an employee by another
person or employee unless such employee requests a Public
Hearing."
It is important to note that the Council must adhere to
the aforementioned Government Code or face the possibility
of violating Section 54957. To ensure Council fulfills
it's legal obligation, I have asked City Attorney, Jim Cox,
to be available should the Council determine it appropriate
to grant Chief Kozma's request for an Executive Session.
By way of background, the Council should be aware that Staff
has already placed an Executive Session on the agenda for
February 6, 1990, by action taken on January 16, 1990.
If you should have any questions, or need further clarifi-
cation on the information herein, please do not hesitate
to contact me.
Respectfully submitted,
Henry T. Garcia

SUBJ: Police and Fire Department Negotiations
DATE: 01-31-90
On January 25, 1990, Steve Filarsky and I met with the
Police Association negotiating team consisting of John
Dugan (Chief Spokesperson), Steve Villeneuve, Jim Worthy
and John Napolitano (Association officers).
A list of proposals has been given the City and the items
will be costed out and given to you, prior to the next
City Council meeting.
On January 30, 1990, Jim Cox and I met with the Fire Depart-
ment Association negotiating team consisting of John
Dugan (Chief Spokesperson), Dave Herterich and Steve Overton.
A verbal update was given to the City with regards to the
previously submitted MOU proposal for 1989-90. Both the
Association and City agreed to negotiating for the Fiscal
Year 1990-91. A cost breakdown on these items will also
be provided to you prior to next City Council meeting.
I believe the attempt to negotiate early is being received
as a positive action by both Associations. You will be
apprised of any further communication or changes in
scheduling of next meeting(s).

Hill. A proposal to develop 558 lots on approximately 365 acres located
on the westerly three-fourths of Park Hill proper.
At 9:55 p.m. Councilman Boykin left the room due to a possible
conflict of interest.
Community Development Director McNabb explained this is to consider the
Draft EIR and Supplemental EIR for the Park Hill Specific Plan 1-89 and
a pre-annexation request to amend the General Plan land use element and
establish City zoning within proposed Annexation No. 60, and establish
a 558 lot specific plan on 365+ acres on the westerly three-fourths of
Park Hill. Staff's recommendations are to accept the County EIR 225

II Public Hearings - continued
regarding slope setbacks on the specific plan; Tom Tekavec, 1335 Park
Avenue, asked if the developer already has approval of the County; the
answer was yes; Greg Fowler, 1373 Park Avenue, says that he contacted
105 people in the area and 100 signed a petition asking that the houses
face Park Avenue; Diane Higgins, 40681 Terrace Drive, objected to the
lot sizes and was also concerned about the developer fees since the
area is in the Hemet Unified School District; Richard Franke, 41940
Park Avenue, objected to the smaller lot sizes; Tom Taylor, 24955
Meridian, was concerned about the annexation; however, he is not in
the annexation area; Gary Cook, 41284 Park Avenue, voiced his concern
about open space and spoke in favor of the larger lot sizes; Barbara
Reed, 24620 Hewitt Street (house on a triangle at the intersection of
Hewitt and Park) wants the planned cul de sac to remain, also wants
a condition put on the project that streets and drainage be improved
prior to development, Chief Kozma answered Mrs. Reed's request to
prohibit truck traffic on Hewitt; this is not possible. Dale W. Reaser
1039 Park Avenue, says he is not opposed to annexation of Park Hill.
He spoke in favor of the 10,000 square foot lots. Also, spoke in
favor of the houses facing Park Avenue; A.J. Frick, 40941 Washington,
says he "can't wait to be annexed." Stephen Braun spoke again regard-
ing some of the objections; he says the firm has taken out 35 lots in
the steepest areas. He asked about the possibility of the area being
turned over to the San Jacinto Unified School District, a question that
cannot be answered at present. No one else spoke. The hearing was closed.

reading in full, grant a Negative Declaration and authorize Notice of
Determination to be sent to the County Clerk. (Pre-zoning for Annexation 60)

II Public Hearings - continued
C. Planned Unit Development 5-89. Applicant: Palm Avenue Estates. Loca-
tion: Northwest corner of Palm Avenue at 7th Street. A proposal to
establish a Planned Unit Development overlay on Tract 24922 which is a
proposal to divide 17.5 acres into 82 lots. Community Development Di-
rector McNabb stated the Planning Commission has recommended adoption
of Ordinance No. 896 creating a Planned Unit Development Overlay on
the subject property pursuant to the approved development plan. The
PUD request is for lots less than 7,200 square feet. It is in "A" flood
zone so the developer would have to comply with the City's flood damage
ordinance, and special studies are required because the property is in
a seismic zone. The Mayor opened the public hearing. The clerk stated
notice of the public hearing has been advertised; affidavit of publica-
tion is on file. Property owners of record within 300 feet have been
notified by mail; declaration of mailing is on file. No written or oral
comments have been received by the clerk. The Mayor asked if anyone in
the audience wished to speak. Kevin Cozad, 151 S. Girard, Hemet, (Tract
22347) was concerned about his development in the area being affected by
up-stream storm flows from Tract 24922. J. C. Burton, 23246 Lori Ann,
would like the recreation park area of PUB 5-89 relocated; it abuts
his back yard, and he is concerned about the noise. Brian O'Donnell,
4603 Mission Boulevard, #200, San Diego, spoke about the recreation
area; they are trying to keep it adjacent to the drainage channel.
Councilman Redding opposed the 6,000 square foot lots. The public hear-
ing was closed.
Councilman Rose moved to introduce Ordinance No. 896 to second reading and
waive reading in full.
Seconded by Councilman Boykin
Motion carried 4-1. Councilman Redding voted no
III ORAL COMMUNICATIONS
A. Barbara Reed, 24620 Hewitt, again brought up the subject of trucks using
Hewitt Street, Chief Kozma stated even if you restrict the street you
cannot limit trucks going to development sites to get to the next ingress
or egress.

SUBJ: ACCEPTANCE OF ROAD DEED FROM AGRI -EMPIRE
This item was continued from January 16th to allow staff time to
clarify the exact boundaries of the dedication. Agri-Empire has
acquired property from Santa Fe - Southern Pacific Railroad, but
retained a 50' wide strip. This is reflected on the revised map
and legal description. The road dedication is on either side of
this railway right-of-way.
Staff recommends the acceptance of the road deed from Agri-Empire.

Joint Financing and Construction Agreement Among CFD #2,
EMWD, and Peacock Radaker
CFD #2 has nearly finished the first phase of water and sewer
improvements. Phase two will probably commence in the next 9-12
months. The water system within CFD #2, when complete, will belong
to EMWD.
The purpose of the proposed agreement is to provide the framework
by which: The lines will be inspected and turned over to EMWD;
the CFD will receive credit for installation of facilities; and,
EMWD is committed to financially participate in the construction
of facilities.
Staff and CFD counsel have participated in the preparation of the
agreement and now find it satisfactory.
Staff recommends the Mayor be authorized to execute the agreement
after the EMWD Board has taken similar action. The matter is
tentatively scheduled for the next EMWD Board Meeting.
Respectfully Submitted,

to be known as the San Jacinto Valley Project (comprised of Tracts
Nos. 23671 and 23963) located in the City of San Jacinto, as shown
and depicted on the map which is attached hereto and incorporated herein
as Exhibit A.
B. Property Owner plans to develop the Project in phases for residen-
tial and commercial uses. The development plan includes, among other
things, the construction of the water facilities to be owned and operated
by EMWD (the "EMWD Facilities"), which are generally shown and described
on the map which is attached hereto and incorporated herein as Exhibit
C. Property Owner initiated by written petition and thereafter the

ceedings for the formation of CFD No. 2 pursuant to the Mello-Roos
Community Facilities Act of 1982, as amended, Section 53311 et seq.
of the California Government Code (hereinafter the "Act"), to provide

ties (the "Facilities"), which include the EMWD Facilities. As shown
on Exhibit A, the boundaries of CFD No. 2 include the parcel of land
which is shown and depicted as Property of Others on Exhibit A that

within CFD No. 2 to fund debt service on the Bonds.
E. In contemplation of the issuance and sale of the Bonds, Property

or are to be reimbursed to Property Owner by CFD No. 2 from the proceeds
of heretofore sold CFD No. 2 Bonds.

of the EMWD Facilities, except for certain fixed amount EMWD financial parti-
cipations for the purpose of financing the "oversizing" of and/or increasing
the capacity of certain specified facilities for EMWD purposes. For the
purposes of this Agreement, EMWD's fixed financial participation for such
"oversizing" and/or increasing capacity has been based on the estimated
difference in the cost of the size/capacity facility needed for the antici-
pated Project development and the size/capacity facility needed for EMWD
purposes as computed in Exhibits E, E-1, E-2 and E-3 which are attached
hereto and incorporated herein.
As shown on said Exhibits E, E-1, E-2 and E-3, the amounts of EMWD's fixed
financial participation for "oversizing" and/or increasing the capacity

EMWD Facilities, including all costs associated with change orders necessi-
tated by site conditions, except as provided in Paragraph 7 hereinbelow.
7. Shortfall and Facility Betterment Related Change Orders
A. Shortfall
In the event CFD No. 2 for any reason has insufficient funds to finance
the planning, furnishing and construction of all of the planned EMWD Facili-
ties as contemplated and provided for herein, Property Owner shall be solely
responsible for nonreimbursably financing the planning, furnishing and con-
struction (including all related engineering, rights of way and site acquisi-
tion costs and EMWD's incurred expenses) of the involved portions of the
EMWD Facilities.
Such financing by Property Owner, if necessary, shall not affect the amount
of fixed EMWD financial participation provided for in Paragraph 6 hereinabove
or the amounts of potential credits to Property Owner provided for in Para-
graph 10. hereinbelow.
B. Facility Betterment Related Change Orders

following completion of appropriate competitive bidding procedures, employ
duly qualified and licensed contractors to furnish and construct all such
Future Phase EMWD Facilities, in accordance with EMWD approved plans and
specifications therefore, under EMWD inspection as provided for in Paragraph
16 hereinbelow.
CFD No. 2 shall be under no obligation to approve the award of a contract
and shall not allow a contract for construction of any of the EMWD Facilities
to be awarded until it has determined that sufficient uncommitted funds
to cover the contract award, including a contingency amount equal to at
least ten percent (10%) of the total contract price, and EMWD's and CFD
No. 2 costs of inspecting and administering said contract, are in the Con-
struction Account and/or the Common Facilities Account of the Acquisition
and Construction Fund created by the Indenture (collectively the "Construction
Account").
CFD No. 2 shall prepare and forward to EMWD the Payment Request Form (as
defined in the Indenture) for progress or other payments required under
the contracts awarded for the EMWD Facilities. EMWD shall review and approve
any properly prepared and executed Payment Request Forms submitted to it
by CFD No. 2 within fifteen (15) days after submission to EMWD's General

tion by EMWD. EMWD personnel shall inspect the furnishing, construction
and installation of the EMWD Facilities to assure compliance with EMWD's
approved construction plans and specifications. Inspection shall be the
-12-
responsibility of EMWD and shall be done in a timely manner consistent with
the approved schedule established at the Preconstruction Meeting. EMWD's
inspection personnel shall have the authority to enforce the EMWD approved
construction plans and specifications for the EMWD Facilities, which authority
shall include the authority to require that any and all unacceptable mate-
rials, workmanship and/or installation be replaced, repaired or corrected.
In addition, the Contractor(s) shall be required under the approved construc-
tion specifications to repair any and all installed facilities which have
been damaged by any party prior to EMWD's final acceptance of the EMWD Facili-
ties for ownership, operation and maintenance which final acceptance shall
follow final inspection and testing of the EMWD Facilities after completion
thereof. Contractor(s) will be required to: (i) make the corrections and/or
repairs determined by EMWD inspection personnel to be necessary and consis-
tent with the approved construction specifications and (ii) provide a one
(1) year materials and workmanship guarantee, the precise nature of which
will be agreed upon by CFD No. 2 and EMWD, providing that such Contractor(s)

SUBJ: 16th Year CDBG Grant
DATE: 01-31-90
Attached for your review are the survey results from the
Public Hearing held on Thursday, January 25, 1990, reference
the 16th Year of the Community Development Block Grant
Program.
By way of background, Federal CDBG regulations require
the City to provide for and encourage citizen participation.
It is imperative, therefore, that a public hearing be
provided to obtain citizen input.
The results of the first Public Hearing indicate the following
project(s) are viewed as important.
1. Replace rusting water lines
2. Install sewer mains.
3. Provide affordable housing.
The purpose of the February 6th Public Hearing is to gather
additional and/or supplemental public input, as to how
the City should utilize CDBG Funds. Staff, upon the comple-
tion of the second Public Hearing will take the combined
input of both Public Hearings under review prior to completing
the Block Grant Application Form.
Staff will bring the completed application before Council
on February 20, 1990, for final review prior to submission
to the County.,

Wall permits - Permit fee is based
on value. Value calculated at
adopted cost per sq. ft. of wall 3.50/sq. ft. 5.00/sq. ft.
This increase was based on our conversations with masonry
contractors as to the actual cost to construct a block wall.
The impacts of this increase vary depending on length of wall.
Three examples are as follows:
Current Fee Proposed Fee Increase
60 ft. of 6 ft. wall
47.50 57.50 21%
150 ft. of 6 ft. wall 79.50 88.50 11.3%

Pools and Spas - A permit
fee is based on value.
Value is derived on adopted
rate per gallon. $.75/gal
$1.00/gal
Again this increase is based on input from developers as to the
actual cost to construct a pool.
The impact again will very by pool size. Examples are as follows:
300 gallon spa 15.00* 15.00* 0%
500 gallon spa 15.00* 15.00* 0%
10,000 gallon pool 99.00* 117.00* 18.2%
15,000 gallon pool 125.00* 162.00* 29.6%
Additional fees may be charged for plan check, plumbing,
and mechanical
Exhibit C - No. 13 - Subdivisions
The plan check fee was increased for subdivisions only from 2% of
engineers estimate to 2-1/2% of the engineers estimate. This
increase is necessary to cover the plan check costs when the City
uses outside consultants.
Exhibit C
The minimum inspection fee which has been $10.00 for more than 10
years was increased to $15.00.
The Staff recommends the adoption of Ordinance 893.

ORDINANCE NO. 893
REGULATING CONSTRUCTION ON PRIVATE PROPERTY AND THE
PUBLIC RIGHT OF WAY AND THE ABATEMENT OF DANGEROUS
BUILDINGS
State law requires the city, from time to time, to adopt revised
editions of the uniform construction codes. Ordinance 893 is the
document which repeals the previous codes and adopts the new codes.
This is advertised as a public hearing, because state law requires
any increase in permit fees to be considered at a public hearing.
In summary the fee revisions are as follows:
1 The fees for after hour inspection and special plan check
were increased to more accurately reflect the city
incurred costs.
2 The valuation rate for walls and pools and spas was
increased to more accurately reflect the actual
construction costs.
3 The public works plan check fee for subdivisions was
increased to cover the cost of plan check the minimum
inspection fee for public works inspection was increased.

patterns may be varied upon the recommendation
of a landscape architect or a slope control
specialist with approval of the Building
Director. If a species other than those from
the recommended list of plants is selected, a
written statement shall be submitted by a
landscape architect or slope control specialist
certifying the plants suitable for erosion
control and slope stability. This statement
must accompany the grading plan at the time of
submittal.
b. Landscape and Irrigation Plan Requirements
1. Landscape Plan Requirements.
Landscape Plans shall be submitted for all
slopes required to be planted. The
landscape plan may be incorporated as part
of the grading plan unless, in the opinion
of the Building Director the plan becomes
too obscured to be effective. A landscape
plan shall include:
(a) A slope planting schedule that
provides common and scientific names
and specifications of all plants,
number and size of each tree and
scrub and the spacing of plants.
(b) The location of the planting.
(c) Details of the irrigation system.
Landscape plans involving more than
four structures shall be prepared and
signed by a landscape architect.
This plan shall include the details
necessary to complete the project
including scope of work, materials
ORD. 893 JANUARY 16, 1990 PAGE NO. 7
to be used (seed mixtures, plant
species listed by size quantity,
fertilizer used and rate of
application), construction methods,
maintenance and time table for
project completion.
2. Irrigation Plan Requirements.
Except where approved by the Building
Director slopes required to be planted
shall be provided with an approved system
of irrigation designed to cover all
portions of the slopes and shall be of
sufficient clarity to indicate the extent
of work proposed. Specifications for
devices, size and type of pipe, flow rates
and precipitation rates are to be shown
on the landscape plan. An approved
backf low prevention device shall be
installed in each irrigation system which
conforms to Chapter 10 of the Uniform
Plumbing Code. If the planting require-
ments specified in the subsection above
are waived by the Building Director, the
requirements specified in this subsection
may be waived.
C, Planting Method.
Planting shall commence as soon as slopes are
completed on any portion of the site and shall
provide for rapid short term coverage of the
slope as well as long term permanent coverage.
Minimum requirements shall include:
1. Planting Holes. Planting holes shall be
excavated twice as wide as the diameter
and 2 inches less than the depth of the
root ball of the plant. The planting
holes shall be backfilled with a mixture
of native soil, slowly decomposing organic
matter and an appropriate fertilizer.
2. Staking. Each tree shall be staked in
order to anchor the root system and to
ORD. 893 JANUARY 16, 1990 PAGE NO. 8
support the trunk in an upright position.
Stake material shall be of adequate
dimension and length to support the tree.
Ties used for typing the tree to the stake
shall have a broad surface to minimize
rubbing or girdling and have some
elasticity. In lieu of stakes a three
wire tie-down system may be used.
3. Ground Cover Spacing. Ground covers are
to be spaced in such a manner that 100%
coverage of the planted slope will be
achieved in as short a time as possible.
Spacing of ground cover shall not exceed
12 inches O.C. unless acceptable
supporting horticultural evidence
recommending greater spacing is furnished
to the Building Director.
d. Waiver of Planting Requirements.
Waiver of the Planting and irrigation
requirements may be approved by the Building
Director if found to be unreasonable or
unnecessary for one of the following reasons:
1. The erosion resistant character of
material composing the slopes make
planting unnecessary.
2. The unavailability of water making
irrigation either impossible or
impractical.
3. Slope heights are less than those
requiring planting by Section 3, paragraph
(H) 1.a.
e. Planting Maintenance. All vegetation planted
for erosion control shall be maintained in a
healthy, vigorous condition. Maintenance of
planted slopes shall include watering, weeding
and restoration of any plant material that may
die. Slopes that are affected by the future
installation of walls, fences, swimming pools
or any other building must be properly

more than four structures shall be filed with
the City by the developer at the time that the
landscaping plan is approved.
g
Final Planting Inspection. A final planting
inspection shall be required for all building
sites requiring planting. For building sites
not requiring a performance bond, the final
planting inspection shall be approved prior to
the building permit final inspection. Any
required irrigation system and all planting
shall be installed at the time of the final
planting inspection. A functional test of the
irrigation system may be required. For

subsection shall be approved prior to the
building permit final inspection. The final
planting inspection shall be performed at the
end of the one year bond period.
h. Slope Verification. A site inspections shall
be performed by the responsible landscape
architect to assure compliance with the
approved plans and to perform a functional test
of the sprinkler system. Said landscape
architect shall verify in writing to the
Building Director that the soils, additives,
and amendments, weed control, planting of the
slopes and the installation of the irrigation
system comply to the approved plans and to all
the provisions of this section. Verification
to contain a Statement as to the grow stock
vitality.

SUBJ: 2010 COMMITTEE REPORT
The initial organization meeting of the 2010 committee was held on
Wednesday, January 31st. A total of 9 of the possible 19 committee
members attended the meeting. Two had asked to be excused for the
evening.
After discussion, the attendees determined there was a need for 40-
50 members to serve on the committee in order to have enough
members to serve on subcommittees. In order to develop this
number, staff must readvertise in the newspaper. In addition to
this, the committee felt invitations to participate should be sent
to the schools, business associations, utility companies, the
Soboba Indians, social service groups and private industry.
With Council concurrence, staff will advertise and issue
invitations with the goal of having a list of potential members to
appoint on February 20th, 1990.

CONCEPT TO REALITY
A Creative Process
Time is an ongoing journey. Managing it creatively is what the
City of Duarte has in mind.
Join the City-sponsored strategic planning effort "Duarte Resurgence:
Concept to Reality" as both City leaders and officials lead Duarte to
its golden anniversary in the year 2007.
Strategic planning
Today, cities like businesses are cognizant of the need to plan for
tomorrow. Strategic planning offers us this opportunity.
The strategic planning process traces its roots to the military.
However, it wasn't until the concept was used by private sector
corporations that it gained widespread recognition.
The process can be broken down into two phases: analysis and im-
plementation. Maximizing opportunities, neutralizing difficulties
and accounting for regional trends summarizes the critical analysis
phase. These findings combined with citizen input create the
framework for the plan. Once completed, the plan is presented to the
City Council for its final stage of approval. Day to day implemen-
tation is handled by the City staff. Typically, the process takes
one year to complete.
Getting Involved
Duarte residents, members of the business community and local
organizations are invited to participate in the year-long process in
one of two ways: task force membership or town hall meeting
attendance.
To determine our goals, six task forces comprised of eight to
twelve community members are being formed. Task force topics include
Economic Development; Education, Culture and Research; Health and
Medical Services: Public Safety; City Finance and Municipal Services;
Environment and Aesthetics. Coordination of the overall effort will
be handled by a steering committee composed of representatives
from each task force. To participate in the strategic planning
process, simply fill out the attached application and submit it to
the City Manager's office by Wednesday, October 21, 1987.
During the process, there will also be two town hall meetings held
at the Community Center. At this time, those in attendance are
invited to comment about the issues at hand as well as share their
own ideas about Duarte's future. Town hall meetings are scheduled
for Tuesday, November 17, 1987 from 7:00 p.m. to 10:00 p.m. and
again during the third week of February, 1988. Date and time to
be announced.
Duarte Benefits
Upon completion of our strategic planning, Duarte can look forward
to gaining new insights into ongoing areas of change and concern.
Whether dealing with growing economic pressures or encouraging the
cultivation of the arts, staying one step ahead will prove to be
much to the community's advantage. "Duarte Resurgence" is our
chance to form today's concepts into tomorrow's reality.

SUBJ: PETITION FOR SPEED CONTROL ON QUANDT RANCH ROAD
Residents on Quandt Ranch Road have submitted a petition requesting
speed control. Quandt Ranch Road is a wide residential street,
one-half mile or more in length. The speed limit is 25 MPH, but
vehicles tend to travel much quicker.
As a result of several phone calls from residents in this
development over the last six months, staff requested the new City
Engineer to perform a traffic study to determine what might be done
to slow traffic down on the street. We anticipate the results of
this study in approximately a month.

events held in the city.
There will be no charge to the public for attending the event.
We are asking a small donation from the artists who are compe-
