This lift station will be constructed in such a manner as to be able to serve up to 120 acres which would normally be without sewer for the next five to ten years. Staff has analyzed theiproposal and determined there is positive area benefit. It is our recommendation to purchase the lift station upon its completion and acceptance by the City. Staff is proposing the establishment of a benefit area related to this lift, station whereby as units connect to the sewer, a recapture fee is paid so the City will -ultimately recover its cost. Furthermore, the monthly billing to the residents connected to the sewer will reflect the cost of electricity and maintenance in addition to the normal monthly sewer charge. Respectfully Submitted, BRIAN MC NABB Director of Community Development BKM:lr /A. GE D MEMO TO: Honorable Mayor and Members of the City Council FROM: Brian McNabb, Director of Community Development DATE: December 27, 1989 SUBJ: ACCEPTANCE OF ROAD DEED FROM RECORD FARMS LTD. The City recently accepted road deeds for the future Ramona Expressway and the extension of Esplanade Avenue between Mountain Avenue and the Ramona Expressway. The zoning on each side of this section of Esplanade Avenue is commercial. A roadway is proposed from a recently approved single family tract located behind the commercial on the south side of Esplanade to Esplanade itself. This roadway extension is what the Council is considering. This roadway is necessary to provide two directions of egress from the proposed tract; to provide alternate access points to the commercial property; and, to provide drainage and utility access to both the residential and commercial pieces. Normally, this roadway would be dedicated at some time in the future. In this case, Premier Homes, who is in escrow on the proposed residential tract, has made the dedication of this section of roadway a condition of closing escrow. Staff has evaluated the request and found no reason not to accept the easement offered by Road Deed. Public liability does not normally start until public improvements are installed and accepted by the City. Nammar, City Manager SUBJ: Riverside County Ordinance No. 682 DATE: 12-27-89 In 1986, the Legislature amended Water Code Section 13801 to require the State Board to "adopt a model water well, a cathodic protection well and monitoring well drilling and abandonment ordinance, implementing standards for water well construction, maintenance and abandonment." Pursuant to this section, the State Water Resource Control Board on November 1, 1989, adopted the Model Ordinance. According to this ordinance, each County, City or Water Agency having permit over well -drilling must adopt a water well, cathodic protection well and monitoring well drilling and abandonment ordinance that meets or exceeds the standards developed, and adopted, by the State Depart- ment of Water Resources. Subsection 13801(d) states that if any City, County of Water Agency fails to adopt an ordinance by February 15, 1990, the State Model Ordinance shall take effect within their jurisdictions. We have been working closely with Riverside County Health Department in drafting an ordinance that meets the State requirements and will be uniform in its use and application throughout the County. Consequently, the Board of Super- visors adopted Ordinance No. 682, with an effective date of January 1, 1990. At this time I am respectfully recommending adopting, by reference, Ordinance No. 682 with an effective date of February 16, 1990, so that all construction and abandonment programs will be uniform throughout the County of Riverside. The applicant has submitted a revised development plan which allows 24 on street parking spaces for guest parking. 37 spaces are required by ordinance. The choices the developer has are to use the open space for the additional parking or to apply for a variance to recognize parking spaces in driveways 20' or greater in length. As the Council has expressed a desire to maximize the open area, staff's recommendation is to continue the second reading of Ordinance 884 until February 20th, 1990 to allow the applicant to process the variance application. Our problems consist of dealing with the event for seven (7) days, not the four (4) days that are scheduled. These types of events require 24 hour supervision from start to finish to protect the community investment in our facilities. Further, I feel it is important for the Chamber to note that the District incurs costs during these types of events that are sometimes overlooked. Typical costs and problems include: 1. Security - during these types of events we have a staff member sleep in the district offices for security. The district offices were broken into by carnival workers during the last two events. 2. Trash - Carnivals do not pick up after themselves. Ms. Judy Whitson San Jacinto Chamber of Commerce December 20, 1989 Page Two 3. Water - Hose hookups are needed by all of the mobile units. 4. Recreation programs suffer due to the unsafe element as perceived by parents. 5. Picnics - noon lunches and weekend picnics are avoided by usual park users due to the types of individuals employed by carnivals. The general public avoids the park during their stay except for carnival rides. 6. Dates - The carnival runs for four (4) days, but we deal with the set up and break down which takes seven (7) days. 7. Nammar, City Manager SUBJ: Library Construction Bond Act DATE: 12-28-89 The California Library Construction and Renovation Act of 1988 was approved by voters in the November, 1988 General Election. The bond act authorizes $75 million to be issued for public library construction and reno- vation, including new building, additions and renovation for energy conservation, handicapped access, or to meet current health and safety codes. It is estimated that the Bond Act will fund between 60 and 80 projects to con- struct large and small new buildings and additions, and to remodel and renovate older buildings. The Act also provides that the funds be awarded on a 65% state/35% local matching basis by a five -person Board consisting of the State Librarian, the Director of Finance, the State Treasurer, a Senator and an Assembly Member. Senator Keene and Assembly Member Clute have been named to those latter posts. The Act provides that in considering applications, the Board shall consider the needs of urban and rural areas; projected population growth; changing concepts of library service; distance from existing and proposed library facilities; and age and condition of any existing facility. The current implementation schedule anticipates a two- phase application process. Phase I is a Notice of Intent at the beginning of 1990, and following any adoption of priorities and policies. Phase II is a Fiscal Commitment in mid-1990. The Phase I, Notice of Intent Application, is being completed by City and County Library personnel and must be postmarked no later than January 29, 1990. Based on previous Council commitments to the San Jacinto Branch Library expansion, I strongly encourage the City Council, by Minute Action, to authorize the City Manager to file a Notice of Intent for the State Library Construc- tion Bond with the California State Library Administrator of the Bond Act funds. Library Construction Bond Act Page 2 The reason Z am making this recommendation is the Notice of Intent is not binding and no subsequent applications are required at this time. NAMMAB ur MEMO TO: Honorable Mayor and Members of the City Council FROM: Brian McNabb, Director of Community Development DATE: December 28, 1989 SUBJ: LIFT STATION AT MISTLETOE AND ARTESIA STREET As you may recall, the City agreed to purchase the lift station at Mistletoe and Artesia from San Jacinto Partners, and create a lift station district involving approximately 120 acres. In order to create the district, an ordinance must be adopted setting the ultimate boundaries, the initial boundaries and the monthly maintenance charges. Staff has consulted with Lake Hemet Water District and Eastern Municipal Water District as to their experience with lift stations. In addition to the monthly sewer collection fee, a fee must be established within the district for regular maintenance, monthly electrical charges, depreciation of the pump, and depreciation of the lift station. Neither agency could provide us with a start up formula. However, based on their input staff has developed the initial charges. After one year staff will be able to assess the charges and make necessary adjustments. Staff recommends the adoption of Ordinance 892 creating Lift Station District No. 1. Field tests. literature reviews and discussions with waterfowl biologists indicated the color black produced the best frightening ef- fect. Larger or heavier plastic in- hibits movement in light winds and smaller or lighter colored pieces were not as visible. Optimum results were produced when plastic Hags were used in conjunction with propane exploders, Automatic Exploders. Automatic exploders, which generally operate on propane, make anoise louder than a shotgun blast. The blast in- tensity, timing, and period of operation can bemanually ad- justed. Exploders should be set to fire about every 10 to 20 minutes and should beelevated orplaced in a dear area tominimize any fire hazard. One exploder, depending on condidons, may protect5O acres. Location ofexploders should bechanged every two orthree days to prevent waterfowl from becoming conditioned to the blast. X =Uags Explosive Scare Devices. Twelve - gauge exploding shells (shell - crackers), vvNg|e bomb*, noise bombs, and rockets are manually used to scare waterfowl. The devices should befired toexplode in the air just above waterfowl to produce best results and to minimize fire hazard. BaNmmmo Helium -filled balloons staked in open fields o, on water with 50'to75'poundmoncfi|amen' line are very effective if properly maintained and frequently moved. Balloons should be inflated toa diameter of about Z feet so that they rise without causing undue stress from wind resbtence. They should not be used where projec- ting objects could cause punctures (Atlantic Flyway Council 1976). Dogs. Some landowners have used dogs with success to keep water- fowl out of hay and grain crops. A free -ranging dog, trained tochase birds as soon as they |and, is most effective. Slip -wires have also been used to maintain control of the dog while permitting extensive movement. Even tethered dogs that move and bark and are periodical- ly relocated have merit (Atlantic Flyway Council 1976). Objects other ti,,,mcurecrows' especially if they ' will move in the wind or create un- natural sound, can be used effec- tively. They must, however, be moved frequently tomaintain their usefulness. These include old cars' farm machinery' pinwheels, streamers' fluorescent traffic cones, and dangling aluminum pie plates (Atlantic Flyway Council 1976). Economics of Damage and Control Waterfowl are an important na- tional resource, and as such, are protected by federal law, As land use becomes more complex and in- tense competition for available agricultural resources increases' crop depredation by waterfowl becomes of greater concern. Although on a national basis water- fowl depredation is small, damage can besevere in localized areas. The severity of depredation is often weather -dependent, and in years of delayed harvest' depreda- tions can become locally extreme. The minimization of crop damage by waterfowl is of common con' Acknowledgments Figure 1 by Emily Oseas Routman, Univer- sity of Nebraska -Lincoln. Sprouting crops are damaged by grazing, and muddy fields can be compacted by trampling. Contamination by defecation decreases the quality and value cdcrops. ` General Biology Waterfowl are generally migratory and gregarious in nature. Reproduction occurs annually in the spring; waterfowl are generally monogamous. Damage and Damage Identification Damage generally involves crops within a few miles of or within waterfowl roosts. Within this general area, birds will fan out and feed in selected sites. During the summer moulting period, water- fowl are flightless and damage oc- curs wbhinvva|kingdistance of the roost. |fthe birds are undisturbed, they will likely feed there repeatedly. Once waterfowl have established afeeding pattern, they become increasingly difficult to move. Damage generally occurs during daylight, especially during morning and evening hours. Some feeding may occur during moonlit nights, and increased feeding often occurs during inclement weather conditions. Legal Status Waterfowl are protected by the Migratory Bird Treaty Act of 1918. it is unlawful to hunt, kU|' sell, pur- chase or possess migratory birds except as permitted byregulations adopted by the Secretary ofthe in- terior. No federal permit is re- quired toscare o,harass depreciating waterfowl. In extreme 'situations, usually involving human health or safety, akiU permit may be issued. . uDamage Prevention and Control Methods Damage prevention or correction requires alertness, immediate ac- tion and persistence. Regardless of theioo|s chosen, immediate action is the most important part of suc- cessful control. Do not let the birds establish afeeding pattern. , Cultural Methods Landowners are encouraged to use early -ripening grain and plant varieties which are the most resis- tant to damage. Effort should be made to plant crops so that harvest can be completed early to reduce the vulnerability of crops during the damage season. Harvested fields can provide an alternate food source and should not be plowed. Grain dryers and straight combining, rather than windrowing, should be used whenever possible. Hunting, during open season, should beencouraged in areas of unharvested crops. Frightening Devices When waterfowl are scared, they should be discouraged from land- ing in other unharvested crops since they trample as much or more than they eat. Fields must be watched closely, especially during the morning and evening hours when waterfowl usually feed, and during periods of inclement weather when there is an increased depredation potential. Scare equip- ment should be ready before the damage begins. A combination of several control tools produces best results. A com- bination of plastic f|aQs, exploders and shooting bythe landowner to scare the birds is hiQh|yrecom' . mended. Better results can beob- tained bymoving orchanging scare tools and methods to prevent the waterfowl from becoming con- ditioned tothem. Devices are: Scarecrows. Scarecrows can be made with |umber, gunny sacks or old clothing. They should be of / 3mil thick black plastic *ft. lath 2ft. ,1sin. cardboard zb F/ourez Design and construction of plastic flags used in waterfowl depredation control. simple construction and have movement in the wind. Firearms should beused only aoascare device in conjunction with flags or scarecrows, Caution should be used in the vicinity of people or buildings.
