AGENDA ITEM 1.1 May 3, 2001 TO: The Honorable City Council FROM: Tim Hults, Planning Director SUBJECT: Public Hearing - Conditional Use Permit 1-97, Amendment 1 Competition Park RFCOMMFNDATION• By motion, approve Temporary Conditional Use Permit 1-97 Amendment No. 1, subject to the Conditions of Approval to follow. BACKGROUND: On April 5, 2001, the Council opted not to ratify the Planning Commission approval of this project and instead set the matter for public hearing. On April 20, 2001 and again on April 26, 2001 a public hearing notice was mailed to surrounding property owners and on April 21, 2001 a similar notice was published in the Press Enterprise, as required by law. The project involves the modification and expansion of a moto-cross style off -road riding and racing track on a 40.68-acre parcel. The property location is south of Ramona Boulevard and east of the Sanderson Avenue. The applicant is requesting to operate on a regular basis from 9:00 am until 10:00 pm daily (Current Hours of Operation 7:00 AM to 7:00 PM). In addition to increasing the hours of operation, the applicant is seeking to expand the operation to include a flat oval track, a BMX track, a skate park, and an extension of time for an additional 5-year period (Current operation includes a veteran's track, the open track, a night-time track with an expiration date of March 4, 2002). Parking for racers and spectators of regular events will be provided on -site on existing concrete pads and unpaved areas throughout the entire project area. The unpaved parking areas will provide 400 regular parking spaces and an additional 49 RV/Trailer size parking spaces, which should be more than adequate to accommodate both the regular daily activity of the use as well as the occasional sanctioned activities. In addition, the majority of vehicular maneuvering areas will be unpaved. The parking and vehicle access areas are proposed to be compacted and maintained Class II roadway base material. The General Plan designation for the property is Medium Density Residential. Within this land use designation, residential uses at up to 14 units per acre are permitted. The Zoning of the site is R-2 (Two Family Residential). The use is not identified in the Zone as a permitted or conditionally permitted use. Therefore, the original application was approved as an interim CUP pursuant to Section 17.12 of the Zoning Ordinance. Said provision allows the Planning Commission to approve interim uses for up to five years. The original application was approved on March 4, 1997 and expires on March 4, 2002. The subject site is currently developed with three residences and several other buildings. The residences and their related out buildings are located some 600 feet from the proposed riding tracks and will not be a part the proposal. The primary area of the site proposed for race activities includes the current activities such as the veteran's track, the open track, a night-time track, and the proposed uses including a flat oval track, a BMX track and a skate park. The surrounding uses consist fallow fields, a dairy with its associated residence and out buildings, an industrial building and a single family home. Among the issues of importance related to this request include the following: NOISE The current activity generates some noise from the existing motocross activity. With the additional activity and the nature of the use, additional noise will be created. However, we have received only one written complaint regarding the noise associated with the current track activities. Golden Era Productions indicated that noise from the motorcycles impacts their ability to film outdoors. In addition, the operator is asking that the use be allowed to operate until 10:00 pm daily. The City's noise ordinance allows for noise generating activities from recreational activities up to 11:00 pm. DUST Access to the track from the adjacent roadway is via an existing unpaved driveway. Additionally, the operator is using earthen parking areas to provide parking for racers and spectator vehicles. This will lead to the generation of additional particulate matter entering the air. In order to reduce fugitive dust, parking and vehicle access areas are proposed to be compacted and maintained Class II roadway base material. Regular watering of the track and the vehicular maneuvering areas is an existing condition of approval. LAND USE COMPATIBILITY The site is located in the general vicinity of the City's identified entry point. The motocross operation is generally not thought of as an ideal use for the entry of the City. In addition, future development in the area of the site will include a combination of residential, commercial and industrial users. These users will be making a substantial investment in the form of infrastructure and buildings. Clearly, these will be permanent improvements, whereas the motocross operation is an interim use. Due to the potential for future land use conflicts, the use should be granted not more than a two-year extension, with a new expiration of March 4, 2004. In addition, the permit should be reviewed annually to ensure the use is consistent with approved future uses on adjacent parcels. ATTACHMENTS: 1 — Site Plan 1 - Public Hearing Notices CONDITIONS OF APPROVAL TEMPORARY CUP 1-97, AMD. NO. 1 PLANNING DEPARTMENT 1. BACKGROUND: This issue was continued from the City Council meeting of April 19, 2001 to this meeting. There have been a number of meetings and telephone conversation between the developer, his representative, City staff and Mr. Pirelli. According to the comments made by Mr. Pirelli at the Council meeting of April 19, 2001, he is willing to provide a grading letter to developer for any work on Soboba Road on the condition that the ultimate drainage improvements are installed upfront. Mr. Pirelli is also asking the developer to make minor modifications to the location of the proposed asphalt berm and channel on Soboba Road. This item must be resolved between the developer and the property owner. The grading letter must include the proposed grading and drainage improvements within Mr. Pirelli's property and provide the City with the authority to maintain the drainage facilities once installed by developer and accepted by City. This letter shall also be reviewed by the City Attorney for legal sufficiency. JUSTIFICATION: To facilitate the development of this project and the developer will improve all the improvements on Lake Park Drive fronting Tr. 28998. BUDGETARY IMPACT: Future improvements to City's underground facilities account (Fund 38) to underground the poles. ATTACHMENTS: 1. Agenda submittal dated 3/15/2001 and 4/19/2001 2. (,/) 1 Pr BACKGROUND: This issue was last discussed at the Council meeting of March 15, 2001 at which time Mr. Pirelli, who owns the property on the hillside easterly of Soboba Road, appeared before the Council and presented the attached letter dated March 12, 2001. The following are a summary of Mr. Pirelli's concerns: 1. Detachment from City. 2. 40' access easement on south side of the proposed project. 3. 36" culvert previously removed from Soboba Road. 4. Unresolved flooding issues. Mr. Osborne and his Engineer, the City Manager, Council Members Buydos and Conner and the City Engineer, met with Mr. Pirelli on April 3, 2001 to discuss and respond to his concerns. Prior to this meeting, the proposed easement boundaries and the limits of cut and fill slopes along the Soboba Road were staked. Unfortunately, at this meeting we were unable to resolve any of the foregoing issues and the developer is requesting that the Council take the necessary actions to allow him to proceed with his development. As previously discussed in my staff report, the developer is asking the Council to defer the improvements on Soboba Road fronting the Phase I of Tr. 28998-1 until issuance of occupancy permit for the 70th unit for either tracts 28998-1 or Tr, 28998 or until 18 months after recordation of Tr. 28998-1, whichever occurs first. The required 6' high wall and minimum landscaping along the wall and minor drainage improvements will be installed prior to occupancy of any units. Also, the developer will be required to post separate bond to insure the timely completion of all of Soboba Road improvements. (ev I Road until the issuance of occupancy permit for the 70th units of this project or 18 . S' installation of smaller pipes under Soboba Road and less pavement improvements. This option, if approved, will require re -design of Soboba Road improvements. Agenda submittal dated 3/15/01 2. Main Street San Jacinto, CA 92583 Subject: Detachment of parcel 3 to annexation No. 55 40' road easement on east side of proposed development Missing 36" pipe culvert across Soboba Road Unresolved flooding issues Honorable Mayor and Honorable City Council: Back in December of 1987 the San Jacinto Mayor and Council Members made and passed a motion regarding annexation No. 55 that city staff prepare a resolution of detachment of my property from the city limits of San Jacinto, with staff doing the paperwork and the city paying for all costs. Please see attached letter from then Councilman Marc Divine. I have met with Supervisor Jim Venable and his staff regarding some concerns I have. Supervisor Venable has spoken with San Jacinto Mayor Patrick Williams, and also Elaine Johnson of Mr. Venable's office has spoken with Vice Mayor Jim Ayres and they have assured me that all agree after review and investigation that my subject property at 22770 and 22850 Soboba Road be detached from the City of San Jacinto. I personally spoke with Mr. Tim Hults, city of San Jacinto in November, 2000. In this regard I expressed my concern that this matter of deannexation had not been taken care of and made my request that detachment be taken care of by the city. He expressed he would do some research, which he did, after which in our subsequent meeting he said that he would get it going. He was very helpful in helping me with other matters at that time, which had prompted my first visit. In other matters that need immediate attention; I have recently received partial plans for review and requests for easements on my property regarding the newly proposed housing development on the south side of Soboba Road, and east of Lake Park Drive. These proposals are not acceptable to me. I feel the county, specifically Riverside Flood Control and Riverside Road Department (Department of Transportation,) can best address issues regarding improvements to Soboba Road, flooding issues from the mountainous terrain along the northeast side of Soboba Road, proper drainage, now and for the future, for all property owners as well as for safety issues for travelers on Soboba Road and for new residents to come into this development. The Plans I recently received do not show or allow for my 40' recorded easement on the east side along the side of this new development property. There is still the January 22, 2001 To The City of San Jacinto LAFCO Committee and Others Concerned: I served as City Councilman from 1980 through 1990 for the City of San Jacinto. On December 8, 1987, a motion was presented before Mayor Stuart, Councilmen Ford, Stevens, Redding and myself. The motion was made and approved to prepare a resolution of detachment from the city of San Jacinto and directed staff to do the paperwork and Mr. Pirelli not to have to pay for it. Mayor Stuart at that time pointed out to council that Mr. Pirelli was "missed" in due process, of the proposed annexation, and Mr. Pirelli agreed to allow the annexation to proceed and be finalized, not to hold up the balance of remaining annexation land. Mayor Stuart pointed out that Mr. Pirelli could have possibly stopped or hindered the annexation process, but upon City's request to allow the process to it's completion, and then allow the detachment process to occur, Mr. Pirelli agreed. The costs for any of the detachment were to be borne by the City of San Jacinto, due to it's "error" in procedure and certainly in appreciation of Mr. Pirelli's willingness and cooperation in the matter. Councilman Ford agreed. I am totally surprised that this did not get handled in due time. Mr. Pirelli was let to believe the matter was taken care of. To date, Mr. Pirelli's address bears a county address number, namely 22770 & 22850 Soboba Road, as has the entire time to date. Hoping this matter to lap taken care of in an expedient way, I remain yours truly, Marc Divine 638 De Anza Dr, San Jacinto 654-7281 AGENDA ITEM 4.2 s''/\ March 15, 2001 TO: The Honorable City Council FROM: Habib Motlagh, City Engineer SUBJECT: Tract 28998-1 — Deferral of Soboba Road Offsite Improvements and Power Pole Relocations on Lake Park Drive RECOMMENDATION By motion, approve the deferral of offsite road improvements on Soboba Road and relocation of power poles along Lake Park Drive fronting his property pursuant to Osborne Development Corporation letter dated February 20, 2001. BACKGROUND The grading of Phase I of this project has been completed for several months. The applicant has diligently worked with adjacent property owners (Golf Course) to resolve the drainage issues. Currently the plans are ready for our approval subject to payment of inspection fees, posting of adequate bonds, and receipt of a grading and drainage easement from Mr. Pirelli who owns the property on the east side of Soboba Road. According to the attached letter from Mr. Osborne, the developer is requesting deferral of offsite improvements along Soboba Road until completion of units 1-69 of Phase I or 18 months after recordation of Tract 28998-1, whichever occurs first. A separate bond on forms acceptable to City Attorney will have to be posted to insure completion of Soboba Road improvements. The bond shall include the cost of all required improvements such as curb, gutter, sidewalk, new paving, striping, streetlights, and the remainder of landscaping. It should be noted that in Phase I, some of the drainage facilities must be installed under Soboba Road to accept and properly convey the offsite runoff contributed from Mr. Pirelli's property. Also, there are several existing poles along Lake Park Drive both on the north and south sides of the street. Our current undergrounding ordinance requires developers to underground the poles fronting their project. Based on my meetings with Mr. Torres of SCE, the cost to relocate four poles fronting this project is much higher than normal, due to the fact that SCE currently has special facilities on one of these poles, which makes it more expensive to relocate. AGENDA ITEM 4.2 May 3, 2001 TO: The Honorable City Council FROM: City Clerk Susan Matthe RE: Purchase of Laptop Computer For City Clerk's Office RECOMMENDATION By motion, approve the expenditure of up to $1,800 from the General Fund Unreserved Fund Balance for the purchase of a laptop computer designated for the City Clerk's office. BACKGROUND The City Clerk requires the use of a laptop computer for use during City Council meetings to record Council discussion for preparation of City Council meeting minutes. At present, the laptop used for this purpose is the one assigned to the City Manager. The City Manager's laptop is used by him exclusively while at the office and at home or when out-of-town. Consequently, the laptop must be returned and hooked up at City Hall immediately following the City Council meeting. Coordination of the use of this laptop is often awkward and inefficient. Also, It is not easily available for the City Clerk's use if she needs the laptop at home for the preparation of meeting minutes or other City -related assignments on evenings and weekends. An added benefit to having a dedicated laptop for this purpose will be to maintain on it previous Council meeting minutes, agendas, and staff reports to have the information available when necessary during City Council meetings. In addition, the Clerk's Office is undertaking a major task to inventory, categorize, and store the inactive records of the City which are currently stored in an off -site 40' x 8' metal ocean cargo storage container. This task will be conducted at a site to be determined — either at City Hall behind the new conference room, or at the Public Works Shop break room. As the work is in process, an inventory log will be created to identify the records contained in each box, the inclusive dates, the destruction date, and the exact location of each box of records within the storage tank. This log will be created on an Excel Spreadsheet. A laptop is necessary to allow this task to proceed in the most efficient way possible and as quickly as possible before the hottest summer weather will make it impossible to work in the storage container. BUDGETARY IMPACT Unreserved General Fund: $1,800.00 AGENDA ITEM 143 TO: The Honorable City Council FROM: Tim Hults, Planning Director%' DATE: May 3, 2001 SUBJECT: Estudillo Mansion Security Fencing — Bid Award RECOMMENDATION: By motion, award the bid to Himco Security Products of Los Angeles in the amount of $85,985.80 for the Estudillo Mansion Security Fencing, and authorize the Mayor to sign the contract, upon the review and subsequent approval of the County of Riverside Economic Development Agency. BACKGROUND: This project was added to the Fiscal Year 2000-2001 budget via a reprogramming action on November 16, 2000. The work includes the installation of 1,980 linear feet of 6.5 foot high wrought iron fencing, eight 20 x 6.5 foot high wrought iron swing gates, and 34 brick pilasters to match the Estudillo Mansion. This project will provide needed security fencing and enhance the appearance of the facility. On April 16, 2001, the City Clerk's office received five bids ranging from $76,738 to $145,116. The low bid was rejected due to an incomplete bid package submittal. The low bidder failed to submit the bid form, the anti-trust claim form, the labor code certification, the certification of non-discrimination, and the experience statement with a list of references. Therefore, it recommended that the Council award the proposal to the next lowest bidder, Himco Security. The bidders and their proposed construction amounts are noted below: Company Bid Amount Complete Bid Talley and Ochoa $76,738.00 No Himco Security $85,985.80 Yes Landmark Fence Company, Inc. $89,611.00 Yes Econo Fence Company $108,611.80 Yes Quality Fence $145,116.00 Yes Staff has checked some of the references provided by the contractor and the overall results are excellent. The agencies contacted were the University of Southern California (USC) and the Inglewood Unified School District. USC contracts with Himco for all their fencing and security needs. The most recent project was a combination of wrought iron and chain link fencing at a cost of $500,000. This project was completed on time, within budget and the agency was extremely satisfied with their work. Inglewood Unified School District also contracted with Himco for the construction of a combination wrought iron and chain link fence. The amount of the contract was for $250,000. Once again, the representative indicated that Himco did excellent work, completed the project on time and under budget. Also, because this project is funded by CDBG funds Riverside County EDA will also check references and will only authorize the City to award the contract upon their approval of the proposal. JUSTIFICATION: This activity is identified as a Council priority in the Implementation Plan regarding the continued improvements to the Estudillo Mansion. In addition, the improvements will provide the necessary security fencing for the facility. BUDGETARY IMPACT: On November 16, 2000 the Council reprogrammed $106,392.45 in CDBG funds to the Estudillo Mansion. AGENDA ITEM ` '/ TO: The Honorable City Council FROM: Tim Hults, Planning Director" DATE: May 3, 2001 SUBJECT: Conditional Use Permit 1-01 - Nextel of California RFCOMMFNDATION- By motion, ratify the Planning Commission decision to approve Conditional Use Permit 1-01 to establish an unmanned telecommunications facility consisting of an 80 foot steel pole and related equipment building. BACKGROUND: On April 11, 2001 the Planning Commission considered and approved this item. The project involves the collocation of a cellular antenna and ball field lights on an 80-foot pole. The 80-foot pole would be installed in place of an existing 70'6" light standard at one of the ball fields at the 36-acre Valley -Wide Park on Esplanade Avenue. The antenna array would be attached to the pole above the lighting equipment. The light standard to be collocated with the antenna array is between the two westerly ball fields at the park. The collocated antenna/light standard will be located approximately 775 feet from Esplanade Avenue and is immediately adjacent to the westerly driveway at the park. The applicant has provided an exhibit that shows the existing ball field, and photos showing the light standard that will be replaced by the collocated antenna/light standard (See attachment) and the area where the equipment will be placed. The equipment will be housed in a 200 square foot building located in a fenced area north of the antenna. Landscaping will be used to help screen the proposed equipment building. In any case, the equipment building will not be visible from Esplanade Avenue. While the collocated antenna/light standard will be visible, it is located amidst other light standards and about 775 feet from Esplanade Avenue. All told, there are four lighted ball fields and one lighted soccer field at the park. There are 24 light standards at the park ranging in height from 60 feet to 80 feet. JUSTIFICATION: The telecommunication facility is in accordance with the objectives of Zoning Ordinance, and the purposes of the zone in which the site is located. The overall height of the collocated antenna/light standard is 80 feet, consistent in overall height with the existing Tight standards at the park. In addition, there are 24 light standards at the park ranging in height from 60 feet to 80 feet, which will help the collocated antenna/light standard blend into the facility. Furthermore, the particular collocated antenna/light standard is located approximately 775 feet from Esplanade Avenue. BUDGFTARY IMPACT. None Anticipated. PC 01-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JACINTO, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW FOR A TELECOMMUNICATION FACILITY CONSISTING OF A COLLOCATED ANTENNA/LIGHT STANDARD AND RELATED EQUIPMENT FOR PROPERTY LOCATED AT 901 W. ESPLANADE AVENUE: CUP NO. 1-01 WHEREAS, Nextel of California, Inc. filed an application on February 15, 2001, for a conditional use permit to allow a telecommunication facility consisting of a collocated antenna/light standard and related equipment ("Application") on approximately 36 acres of land, APN 435-190-041, located 901 W. Esplanade Avenue, San Jacinto ("Subject Site"); WHEREAS, the property affected by the Application is within the M-1, Light Industrial zoning district; WHEREAS, the Application was reviewed, studied, and found exempt from the California Environmental Quality Act ("CEQA") as more fully described below; WHEREAS, on April 11, 2001, the Planning Commission of the City of San Jacinto ("Commission") conducted a duly noticed public hearing on the Application at which time all persons wishing to testify in connection with the Application were heard and the Application was comprehensively reviewed; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF SAN JACINTO RESOLVES AS FOLLOWS: SECTION 1. Based on the entire record before the Commission, all written and oral evidence presented to the Commission, and the findings set forth in this Resolution, the Commission grants Conditional Use Permit No. 1-01 to allow for a telecommunication facility consisting of a collocated antenna/light standard and related equipment on the subject site, subject to the conditions of approval in Exhibit "A" ("CUP"). SECTION 2. Based on the entire record before the Commission and all written and oral evidence presented to the Commission, including the staff report, the Commission finds as follows: A. The Subject Site for which the CUP is granted is in accordance with the objectives of the City of San Jacinto Development Code and the purposes of the M-1, Light Industrial zoning district because the zoning district explicitly authorized (use allowed under CUP) as a Conditional Use; 1. The telecommunication facility is in accordance with the objectives of Zoning Ordinance, and the purposes of the zone in which the site is located. The overall height of the collocated cellular antenna/light standard is 80 feet, ten feet higher than the existing ball field light located at the park. In addition, collocating the antenna on the ball field light standard maintains the visual character of the area, as there are four lighted ball fields and a lighted soccer field at the facility. As such, there are 24 light standards at the park ranging in height from 60 feet to 80 feet. Furthermore, the particular collocated cellular antenna/ball filed light standard is located approximately 775 feet from Esplanade Avenue. B. The CUP is consistent with the general plan of the City of San Jacinto ("General Plan"), will not be detrimental to the public health, safety, or welfare, and will not be materially injurious to properties or improvements in the vicinity because: 1. The CUP provides for land uses compatible with the Public Institution land use designation for the Subject Site in the General Plan Land Use Element. The use encourages the development of a collocated antenna/light standard, which implements the provision of the general plan, encouraging more efficient utilization of public utilities. In addition, the telecommunications facility implements the provision of the General Plan, which seeks to insure there is adequate capacity to meet future and existing communication needs of the community. 2. The proposed location of the telecommunication facility and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity because the facility will be collocated with ball field light standard at a public park that already has a large number of similar light standards (24). SECTION 3. Based on the entire record before the Planning Commission and all written and oral evidence presented, the Planning Commission finds the CUP complies with CEQA for the following reasons: A. The item has been determined to be a Class 11 Categorical Exemption (Accessory Structures), pursuant to Section 15311 of the California Environmental Quality Act (CEQA).
