Clarke, Deputy City Clerk of the City of San Jacinto, do hereby certify that I caused to be posted the foregoing agenda this 12th day of November, 1999, as required by law. Nov-12-99 12:49pm From-RUTAN & TUCKER LLP, + T-739 P.04/Ue F-3®I CONFIDENTIAL This Memorandum is protected by the attorney -client and attorney work product privileges. It is not a public record and is not subject to disclosure under the California Public Records Act. MEMORANDUM TO: Honorable Mayor and Members of the San Jacinto City Council FROM David J. Aleshire, City Attorney Jeffrey Wertheimer, Rutan & Tucker Alison Tsao, Rutan & Tucker DATE: November 12, 1999 RE: Park Manor Corp. et al_ v. City of San Jacinto. et a1_; United States District Court, Central District, Case No. CV 98-7100LGB(MANx) Status of Litigation A. WFRODUCTION This Confidential Memorandum concerns existing litigation which has been initiated against the City of San Jacinto. Thus, this Memorandum is privileged and confidential and should be protected from disclosure as a public record. (Government Code Section 54956.9(a).) Since this Memorandum pertains to actually pending litigation matters, this Memorandum is protected from disclosure by Government Code Section 54956.9(c) as well as the attorney -client privilege- A copy of this Memorandum should be kept in the office of the City Attorney. This Memorandum will be reviewed with the City Council at a closed session to be held at the regular Council meeting on September 2, 1999. This memorandum is a supplemental litigation report on the above -referenced case. Our summary of the status of this matter is as follows: 1. To date our attorneys fees and costs in this matter have been approximately $60,520.00. This represents about 446 hours of attorney time. Since the matter was filed a year ago we have done the following: Respond to 237,018275-00 3287368 atan21o9 1 Nov-12-99 12:49pm From-RUTAN & TUCKER LLP, + T-T39 P U5/09 F-391 each separate allegation in Plaintiffs Complaint and draft the answer, draft and serve on plaintiff interrogatories and document production requests, respond to Plaintiff's interrogatories and document production requests, review documents produced by Plaintiff and evaluate Plaintiffs damage claims, interview many of the residents who testified at the relevant beatings, interview current and ex -City employees, defend the deposition of Tim Hults, made Court appearances, and conduct extensive legal research relating to the claims made by Plaintiff. 2. The Plaintiffs counsel is aggressively pursuing the claim and has probably spent well over $100,000 in fees. If he prevails in this matter all of tits attorneys fees are potentially recoverable. 3. It is difficult to estimate ow overall chances of success in this case but they may be only 50-50. Plaintiff is trying to show that the City's actions were based on prejudice. Difficulties in our position arise because Plaintiff will argue that the Staff supported the proposal and felt it was appropriate for the neighborhood, yet the Planning Commission and the City Council arguably "caved in" to the fears of the neighbors_ There were relatively few problems with the neighbors prior to the incident involving alcohol bottles being strewn about the neighborhood. Some of the neighbors will not make good witnesses because they may come across as prejudice against the mentally i11_ 4. On the positive side, we did bend over backwards and permit Plaintiff to operate for years without the necessary CUP. We sought to give Plaintiff a price break on the application for the CUP and we made a great deal of effort to work him in order to assist him in fitting into the community. Mr. Hults will testify that he sought Plaintiffs assistance in certain matters in order to appease the neighbors and Plaintiff was uncooperative and refused to take any steps to fit in. Additionally, we will be able to show that Plaintiff did a poor job of running Park Manor. There was a rape at Park Manor at or about the same time as this dispute was going on, and even one of the more open minded neighbors is prepared to testify that he had problems with the residents, and some of them were his friends. We have a history of being tolerant and cooperative, and this will weigh in our favor. 5_ We will have an opportunity to resolve the case soon through a motion for summary judgment. Prior to filing the motion we will have to wait for Plaintiff to file his amended complaint, then we wiU review it to determine what new allegations are being raised. At that point we will commence the remaining legal research and drafting of the motion. Depending on how the amended complaint is written, we may file a motion to dismiss that complaint, or merely answer and then file our summary judgment motion. Assuming we answer and then file the summary judgment motion, we estimate the cost of 237/018275-001 /32873b8 a11112199 2 Nov-12-99 12:50pm From-RUTAN 8 TUCKER LLP, + T-T39 P.06/09 F-391 those projects to be approximately $12-$15,000. Depending on when Plaintiff files this amended complaint, we hope to file the summary judgment motion sometime in January. b. 1f the summary judgment motion fails we will likely have to go to trial which is currently scheduled to occur in July, and will probably cost another $50-$70,000. In all likelihood, the opposition will have incurred well over $200,000 in attorneys' fees by that time. 7. A settlement conference is going to be conducted sometime in January. We will attempt to solicit a settlement offer from Plaintiffs prior to the conference and review it with you, so that we will know what settlement authority you wish to authorize at the conference. B. BACKGROUND Plaintiffs filed this action on August 31, 1998, and served the City with a Summons and Complaint on October 1, 1998. Our office filed an Answer to the Complaint on October 30, 1998. Trial is now set for July 11, 2000. The Plaintiffs are Park Manor Corporation and Glenn Vodhanel, the sole shareholder of Park Manor Corp_ Mr. Vodhanel ran the community care facility for the mentally disabled that is the subject matter of this Complaint. The Complaint named the City, the Mayor of San Jacinto, and the State Department of Social Services ("DSS") as Defendants The action arises out of the City's denial of a Conditional Use Permit (hereafter "CUP") for Park Manor, which operates a home for a maximum of 32 mentally disabled adults at 135 South Estudillo. Since the initial report, several events have occurred which we believe should be brought to your attention. First, the deposition of Community Services Director Tim Hulls has been completed and it both helped and hurt us. Mr. Hults will be a very good witness, he is both honest and believable. However, he testified that prior to making his recommendation to the Planning Commission concerning the fate of Park Manor, be made no effort to inspect the interior of the residence. He did, however, take many steps in an effon to assist Park Manor in securing its CUP. Also on the positive side, if he committed any oversights they did not harm Park Manor because Mr. Hults recommended that Park Manor be granted its CUP. He made certain recommendations which he felt were necessary in order for Park Manor to fit into the neighborhood, but they were done with the intent of assisting Park Manor get past the complaints of the neighbors To the extent Hulls took any controversial actions he did so in his belief that they would assist Park Manor and his written reports completely support this 2371018275-00206287168 a1U12/99 Nov-12-99 I2:50pm From—RUTAN It TUCKER LLP, + T-139 P.U(fUtl -d l claim. Neither he, nor anyone else on staff, ever took any actions with the intent to discriminate against the mentally ill. On the negative side, since the staff recommended granting the CUP, their report will be used to prove the impropriety of the Planning Commission's actions. This will also focus the lawsuit squarely at the action taken by the Planning Commission and the comments that the neighbors made during the course of the hearing. Since Staff recommended the granting of the CUP, it will be the Planing Commission and the Council that come under most of the scrutiny. The Staff Report will be used to undercut the findings made by the Board. As stated in the prior report, this case remains a very fact intensive case and it remains very difficult to predict the outcome. The other recent development concerns Plaintiffs' production of their profit and loss statements. Our initial review of the documents indicates that Vodhanel never made a great deal of money from Park Manor, so that will keep his damage claim to a minimum. The other interesting fact is that he has spent over $100,000 in attorneys' fees and he appears to have both the desire and the financial ability to see this case through to its conclusion. The financial commitment lie is making to this case also indicates that he probably is not willing to settle for a nominal sum. His financial commitmenI also leads this office to believe that the cost of defending this action will be considerable, probably well over $100,000 just for defense costs. If we lose, then obviously the liability could be a great deal more. C. EVALUATION Based on our review of the Planning Commission Minutes and our meetings with neighboring residents who had testified during the hearings, we believe that the City has not acted improperly in its denial of Park Manor's CUP application. However, our interviews indicate that some of the neighbors will not make good wimesses and they may actually create a negative impression of local prejudice. The biggest danger at this trial is that Plaintiffs will create the impression that the Planning Commission denied the permit merely because of the prejudice voiced by some of the neighbors. Such action is not proper, and thus the denial of the CUP could lead to liability. Furthermore, a recent federal civil rights disability discrimination case may adversely impact the City's position in this litigation and provide Plaintiff with additional ammunition in presenting his claims of discrimination. In 13ay Area Addiction Research and Treatment, Inc_ v_ Ciry of Antioch, 1999 Daily Journal D.A.R. 5381 (9th Cir. June 4, 1999), the Ninth Circuit coup determined that a city's zoning ordinance which prevented the approval of a drug treatment facility violated the American with Disabilities Act (ADA) and the Rehabilitation Act. While Plaintiff has not pled a cause of action under the ADA or the Rehabilitation Act, he indicated that he will be amending his complaint to include an ADA cause of action. If he chooses to do so, the City stands a much larger chance of being held 237/018275-0O20/3281368 .,11/12/99 4 Nov-12-09 12:51pm From—RUTAN & TUCKER LLP, + T-739 P 08/08 F-391 liable for its actions in denying Plaintiffs CUP and not providing Plaintiff with "reasonable accommodations." In the near future Plaintiff will be tiling a Second Amended Complaint and will be able to more accurately estimate both the cost of defense and the cost of bringing a summary judgment motion. However, based on conversations with him, it is our estimate that the summary judgment motion will cost between $10-15,000 to prepare for and argue. Without seeing the Second Amended Complaint it is difficult to accurately estimate, but we believe we have a 60% chance of prevailing on summary judgment. It is our best and only chance of prevailing before trial. If the motion fails, we estimate it will cost an additional $50- 70,000 to bring the case through trial. Settlement remains an option, however at this point we do not have any estimate on the value Plaintiff puts on his case_ The Court is in the process of scheduling a mandatory settlement conference that will most likely be held in early December. Prior to that he will be sending Plaintiff a letter inquiring into senlemenr possibilities. We hope to have some sort of offer from Plaintiff that we can bring to Council prior to the mandatory settlement conference. At the very least it will enable us to understand Plaintiffs damage claims a little better and possibly explore settlement opportunities, although we anticipate his initial offer will be extremely high. Jeff Wertheimer who is handling this matter will be present to discuss your questions concerning this matter. 2371018275411120/3287362 a11112/99 Respectfully submitted, RU AN & TUCKER David leshire City Attorney 5 AGENDA REGULAR MEETING SAN JACINTO CITY COUNCIL November 18, 1999 - 7:00 P.M. BACKGROUND The City Council at their meeting of September 16, 1999, authorized the advertisement of bids for this project. The City Clerk received three bids from contractors. The bids ranged from $61,800.00 to $64,4000.00 (see attached bid summary.) The 1997 Bonds are being used to finance this project. BACKGROUND: The City Clerk on October 26, 1999 received 6 bids from contractors for rehabilitation of Cottonwood and 7"' Street between State and Kirby Streets. We have previously reported to you that due to the budget limitations, we are not able to complete both streets. For this reason, we requested alternative bids, which includes 3" of asphalt overlay for portions of both streets in lieu of removal and replacement. As you know, the life expectancy of overlay job is less than complete removal and replacement. The cost of removal is far beyond the $300,000 budgeted amount. If you recall, when MWD completed the improvements to Warren Road and Esplanade Avenue, City of Hemet elected to overlay their side of both streets with 3" of asphalt overlay. These roads were also in bad shape. Other option available is to award the contract to Lowest bidder for either Schedule I or II. The Soil's Engineer in his attached letter dated November 2, 1999 is recommending minor modification to the proposed alternative bids. I have recently worked with CDE on a project in City of Perris and found their work satisfactory and acceptable. The Measure "A" Loan and regular Measure "A" funds will be utilized to offset the construction cost. S STAFF REPORT TO: Honorable Mayor and City Council Members FROM: Habib Motlagil' City Engineer DATE: November 18, 1999 SUBJECT: SAN JACINTO VALLEY ACADEMY - STREET DEDICATION 480 N. San Jacinto Avenue San Jacinto, CA 92583 RECOMMENDATION 1. Accept the San Jacinto Avenue road dedication as presented. 2. Authorize the City Clerk to record the street dedication with the County Clerk and Recorder. 3. Direct staff to work with school officials to locate a suitable drainage easement. BACKGROUND As a condition of approval for the San Jacinto Valley Academy School, eight feet of right- of-way along San Jacinto Avenue will be needed to comply with the City's Circulation Element. The enclosed legal description and plat offers such dedication. Also, as a condition of approval, a drainage easement is required pursuant to the Northwest Plan. This item was previously presented to the Council for approval. Councilman Conner requested additional information to insure the easement would be sufficient for future northerly extension along the back side of the school's property. Upon further discussion with Mr. Duistermars, he was recently advised by EMWD that they currently maintain a waterline within twenty-five foot easement along the southerly property line where the proposed drainage easement had previously been identified. It is apparent that the drainage channel and existing waterline cannot be located within the same easement. Based on this information, we respectfully request that you give staff and the school officials additional time to find a more suitable location for future drainage improvements. Mayor Williams questioned payment to Sierra Computer Systems. Interim Finance Director Kaenel indicated it was for 5 hours of services for the new building permit program. Planning Director Hults clarified Sierra was providing the building permit program to automate permits. Sierra needed to review the existing system and provide expertise for implementation. Mayor Williams questioned checks to Tony's Seafood to which Planning Director responded to his satisfaction. 2 October21, 1999 A MOTION was made by Mayor Williams, seconded by Council Member Ayres to approve the warrant register warrants number 52433 through 52545, dated October 15, 1999, and payroll checks number 12130 through 12183, dated October 15, 1999. 5.7 Ordinance No. 1059 City Manager Mocalis indicated Council Member Ayres had asked this item be placed on agenda. City Attomey Aleshire told members the ordinance went beyond co -occupancy of City Manager / Chief of Police and he cited examples of other possible co - occupancies. In the future if the council decided to combine two offices keeping the ordinance would protect council from claim of incompatibility. He said in smaller cities it was not uncommon and with this ordinance the council would be more defensible. There were a number of protections set forth and he said he was not speaking on the merits of City Manager / Chief of Police position but he said the ordinance went beyond that to allow City Council to combine positions. Without the ordinance they would be subject to challenge. City Manager Mocalis concurred with City Attorney Aleshire. Council Member Ayres said he had looked at the ordinance and back when it was crafted they left out a lot of items. He went on to say the smaller cites had populations of 3,000 - under 5,000 but San Jacinto had more than 25,000 people. He stated cost savings was not found and he did not see it fitting for San Jacinto and he wanted motion to rescind it entirely. Council Member Conner concurred with Council Member Ayres and said the ordinance came about 6 months after the positions were combined. He stated he would like a rebate of cost for the attorney to construct the ordinance. Council Member Ayres again stressed he felt the numbers did not parallel San Jacinto in population. Council Member Good stated they wanted to be sure the snake did not rise again and she said she hoped the dates on page 4 were to be corrected; the dates should be corrected. Council Member Carlson-Buydos said the ordinance went beyond the current situation and it was important to point out the personnel rules for acting positions. She said she did not think they wanted to circumvent the situation. City Manager Mocalis said page 4 of the Ordinance was referring to when ordinance was originally enacted. City Attorney Aleshire said the ordinance was a matter of litigation and asked if Mayor Williams and Council Member Conner had a conflict of interest due to the litigation? He said the ordinance went beyond that litigation but if the ordinance was not in effect the City was in a less defensible position. Council Member Conner said to look on pages 3 - Conner and Williams voted no. He said two cities called him because of their problems and the whole thing was City Attorney Aleshire's attempt to make an end run. He said City Attorney Aleshire was wrong to speak on the item. City Attorney Aleshire said it was listed as an item to take action. A MOTION was made by Council Member Ayres, seconded by Council Member Conner, that Ordinance 1059, adding section 2.56.035 to Title 2 of the San Jacinto Municipal Code, be repealed. 3 October21, 1999 City Attorney Aleshire told Council they needed an ordinance to repeal Ordinance 1059 and they should direct staff to bring back an ordinance. Council Member Ayres amended the motion. A MOTION was made by Council Member Ayres, seconded by Council Member Conner, to direct staff to draft an ordinance to repeal Ordinance 1059. Motion carried on a 4-1 voice vote with Vice -Mayor Good dissenting. Council Member Good said she did not believe there had been report of closed session. City Attorney Aleshire reported the following: 9.1 - Recall litigation. Status report, no action. 9.2 - Thomas White - Council directed legal Counsel to settle, undertaking settlement negotiation. 9.3 - Napolitano - Not discussed. 9.4 - Elliot - No action. 9.5 - Hemet - Settlement agreement to be on next council agenda. 6.0 PUBLIC HEARING: NONE 7.0 CITY DEPARTMENTS 7.1 Estudillo Mansion Seismic Retrofit Planning Director Hults gave a presentation as contained in the staff report on file with the City Clerk. He stated all references on the low bidder indicated the firm did a good job. In response to Council's question, Director Hults said it was recommended additional funding be secured through reprogramming of the current cycle not from the next funding cycle. He stated it was possible the 39% difference noted by Council Member Good could have been attributed to the engineer not including prevailing wage rates in the estimate but was also due rising costs overall. When questioned as to whether the Estudillo Committee was comfortable with the project, he told members the committee had not met that day. Regarding replacement cost, Director Hults said that cost was unknown to him. Mayor Williams asked if the Director had talked to the bidder about lowering the price? Director Hults responded the price was set mostly by number of cores. Council Member Conner asked what American's estimate would be if they did a standard retrofit? Planning Director Hults stated he did not think that was the direction Council had given him. Council Member Carlson-Buydos said she did not think staff was asked to check out another type of retrofit process. That, she said would require new documents. Mayor Williams asked if, because of the recent earthquake, there was a need to reevaluate. He had heard there were reports of new cracks in the foundation. Planning Director Hults told members he and two City building inspectors walked structure after the quake and no new cracks were noticed. 4 October21, 1999 Mr. Robert Otto of Estudillo Committee was called upon to speak. He said he wanted to give each Council member two tickets to Estudillo dinner. City Attorney Aleshire, in response to Council Member Ayres question, said it was O.K. for more than a quorum of the Council to attend if it was clearly a social event. It was not a violation of Brown act Mr. Otto said regarding the foundation; there was no foundation! He said part of the retrofit was to pour gelatin to be part of the retrofit. Council Member Ayres said he thought the Estudillo Mansion was a cornerstone in the community and he wanted to see it continue its restoration. He also acknowledged Supervisor Venables additional help. A MOTION was made by Council Member Ayres, seconded by Council Member Carlson-Buydos, to award the bid in the amount of $268,000, to American Restoration and Construction Company, and; Approve the reprogramming of the 1999-2000 CDBG funds (Fund 29) in the amount of $60,000 from the Line "E" (Roadway Crossing); Approve the use of $40,000.00 CDBG Funds contributed by the Riverside County EDA; Authorize the use of the unallocated Redevelopment funds (Fund 96) in the amount of $25,600. Motion carried on a 5-0 vote. 7.2 CDBG Fiscal Year 2000-2001 Calendar Planning Director Hults made a presentation as contained in the staff report on file with the City Clerk. He told members this was the first step for Fiscal Year 2000-2001. He asked they postpone selecting a theme until after the first public hearing and just approve calendar. A MOTION was made by Council Member Carlson-Buydos, seconded by Council Member Conner to approve the proposed calendar for the 2000-2001 Community Development Block Grants Program allocation process and defer selection of a theme until the first public hearing. The motion carried on a 5-0 vote. 7.3 O.K. & Associates Contract City Attorney Aleshire reported the City had received in August a draft of a proposed new franchise agreement. The City Attorney went through the agreement, and it was discussed at the September 28 h Council meeting. Notice of Termination was discussed at that time. He stated they could only terminate by giving a seven year notice. This, he said, was distinguished from default. He said they were not contending any default but informed members he had constructed a letter for a 7 year notice. City Attomey Aleshire made it clear to Mr. Wallis Council was willing to discuss agreement items. He thought staff would be able to handle it and recommended Council authorize them to dispatch the letter. Mr. Richard Swan, Swan, Carpenter, Wallis & McKenzie, said his partner, Mr. Wallis, was on vacation. Mr. Swan was not real familiar, but did not know if Mr. Wallis would have anything to say. He said Council may have wanted to, but did not need to state action. Further, he could not determine from correspondence when the seven (7) year clock would start. City Attorney Aleshire clarified the date would be from the date of letter after council action. Mr. Swan said his preference would be that Mr. Wallis be available and he would be back on Tuesday, October 261h. Council Member Good asked Mr. Swan about the evergreen clause and specifically how unusual was the clause given the fixed equipment, etc.? 5 October 21, 1999 Mr. Swan said he did not have an answer, Mr. Wallis could better address it. He said he simply came to state Mr. Wallis could not be there. He did not want to say anything that cast cloud on good faith discussions. Leverage, he said was a fact of life and it was common sense. Council Member Good asked if they were to cancel it tonight, where would one take the large equipment used to pick up recycle/trash to sell. Mr. Swan stated he did not know but there was a market for everything. Council Member Good said instead of discussing the termination / evergreen, would they not be talking about a contract for seven years for a $200,000 piece of equipment? Mr. Swan said it was a real fact of life and questioned if they would buy that expensive piece of equipment. Council Member Good asked Mr. Swan to tell the benefits to the City of San Jacinto as they had heard from one side why they should exercise the clause. Mr. Swan said he could not. He said it appeared representatives of the City were of a mind there were certain features of a contract were more in line with Signal Hill's contract. He said if Mr. Wallis were there he could probably address it better but he couldn't say for certain. Council Member Carlson-Buydos explained in the City's view it would be prudent for both parties. Council Member Good said to look in past minutes. O.K. and Associated asked that they be treated right and she did not want them terminated Mayor Williams questioned City Attorney Alesire on no default and asked if the current contract includes compliance with laws including local ordinances? City Attorney Aleshire stated the contract required O.K. and Associates to comply with laws; federal, state and local. At the time he wrote letter, he said it was his understanding that there was no problem with service. He questioned why the evergreen clause would be there and stated it was competition that gets the best deal; you get the best bid in the competitive process. He said he had been involved in the process a number of times in his over 20 years. Once you entered into an evergreen he said you could go 50 years with no competition. In that seven years before the contract was up they could try to convince new councils to rescind the notice. He said near the end of the notice period the firm may be more motivated. And, the City was better off to be in a situation where there was a fixed term; long enough for O.K. & Associates to recoup their investment, but he said it was in the City's interest to have potential to have competitive bid. He concluded just because they sent the seven (7) year notice did not mean we can't continue with the firm. Mayor Williams brought up campaign signs being placed by OK and Associates employees. He asked if that was a violation of local laws and was that a default situation? City Attorney Aleshire said he did not know if it was a default if it was not in violation of their contract but some other City ordinance. He told members he could check. Council Member Conner asked if O.K. and Associates was required to file if they contribute to campaigns? City Attorney Aleshire said there were State filing requirements but he did not October21, 1999 know what kind of filings had been done. He clarified his letter stated if they found cause, action that evening t would not preclude it. If they found default at a later date in time, they could exercise the default process. A MOTION was made by Mayor Williams, seconded by Council Member Ayres, to approve termination notice and authorize City Attorney to dispatch the letter with one amendment regarding default. Motion carried on a 4-1 vote with Council Member Good dissenting. 7.4 Resolving Tie Votes at Municipal Election City Manager Mocalis informed Council the default in State law for ties is to draw lots. The Resolution would remove from speculation any questions. Council Member Good asked if a historical study had been done and why this was brought forward at that time? City Manager Mocalis responded. He said the consultant City Clerk believed it was good practice. City Attorney Aleshire said it was an abundance of caution but he had been in a community where it happened. Council Member Ayres stated it could keep the city out of an embarrassing situation. Council Member Conner said the Deputy City Clerk had information from the Registrar of Voters a special election would be $26,000 in fees. He said in past years they had had Council members come within 1 vote of each other. A MOTION was made by Mayor Williams, seconded by Council Member Carlson- Buydos, to adopt Resolution 99-53,option two - drawing by lots. Motion carried on a 4- 1 vote with Vice -Mayor Good dissenting. 7.5 Subordination Agreement - Talley & Ochoa / Valley Merchants Bank City Manager Mocalis reported the item had been added out of necessity due to the deadline date of October 29, 1999 for Talley & Ochoa to submit the document to Valley Merchants Bank. A MOTION was made by Mayor Williams, seconded by Council Member Carlson- Buydos, to add item 7.5 Subordination Agreement - Talley & Ochoa / Valley Merchants Bank as an emergency item. Council Member Conner asked City Attomey Aleshire if there was a conflict of interest for him due to his stock holding. City Attorney Aleshire could not determine without further information. Council Member Conner withdrew and four votes were then required. The motion carried on a 4-0 vote. City Manager Mocalis indicated the total debt vs. appraisal and said at risk was $25,000 which they believed was reasonable for the agency to subordinate. City Attorney Aleshire responded to Council Member Ayres' question regarding the time frame for the item. Mr. Aleshire said he had looked at it when he was last at City Hall last and had questions about it. He said the staff report addressed those questions. Vice -Mayor Good initiated discussion regarding the appraisal. She felt there was not sufficient information to subordinate. Mr. Joe Talley stated the appraisal had been done within the last 6 months but did not know the name of appraiser. 7 October21, 1999 City Manager Mocalis said the bank commissioned the appraisal. Mr. Talley said he remembered the appraisal was by McIntire in Hemet. Vice -Mayor Good thought they needed more information. Mayor Williams responded. He said if Valley Merchants Bank was prepared to lend $400,000 on the property, securing deed of trust, he was comfortable the city would not be left holding the bag. He agreed, under typical situations, with Vice -Mayor Good that information needed to come before Council sooner. City Attorney Aleshire told members the form of document was fine. He said he had asked staff to give him information but he did not review the appraisal. Vice -Mayor Good asked if council would cause an undue hardship if item was continued until the next meeting? Mr. Talley said the creditors were getting demanding but they had not begun any collection efforts. Council Member Ayres said the business was a job creator and a revenue creator. He felt Mr. Talley only gave staff a day and a half to get the item on the agenda but was in favor of approving the agreement as he did not think it was a risk. Vice -Mayor Good said they were moving the advance from 62% to 66% and asked if Mr. Talley was guaranteeing the loan? Mr. Talley said he was guaranteeing it. Vice -Mayor Good said she wanted a current appraisal and credit rating. A MOTION was made by Mayor Williams, seconded by Council Member Ayres, to approve the Subordination Agreement in favor of Valley Merchants Bank. Discussion led by Vice -Mayor Good who said it was the city who was asked to subordinate. The motion carried on a 3-1-1 vote with Vice -Mayor Good dissenting and Council Member Conner abstaining. MOTION AMENDED by Mayor Williams and seconded by Council Member Ayres to approve the Subordination Agreement in favor of Valley Merchants Bank upon review by staff of appraisal to check the timeliness and amount. The motion carried on a 3-1-1 vote with Vice -Mayor Good dissenting and Council Member Conner abstaining. Vice -Mayor Good said for the record, the point was to express financial positions in other instances. 8.0 MAYOR/COUNCIL MEMBER REPORTS/DISCUSSIONS 8.1 Interim City Clerk Services - Contract Approval City Manager Mocalis reported a contract of the type presented required City Council approval and was to be at a rate of $50 per hour and 30-40 hours per week, but not that many hours initially. He said it was prudent for the City to keep Mrs. Sumich on retainer as well due to Electoral situation and review of the City Clerk position. Vice -Mayor Good asked why they had an incomplete, unsigned contract?! City Manager Mocalis said the Council had not approved the agreement but the City Attorney had reviewed and approved the contract. The form, he said, emanated from the City Attomey's law firm. City Manager Mocalis did not 8 October21, 1999 believe it was appropriate for the City Manager to sign an agreement prior to Council approval. He said he accepted the criticism. Mayor Williams said the level of training had not occurred as Council had been led to believe and said Ms. Sumich was not in a position to do more than her contract stated. He told City Manager Mocalis he wanted to see Ms. Hynes hours down to 24 hours. City Manager Mocalis said he had encouraged Ms. Hynes to make herself available 30 or more hours. He also believed that as soon as the electoral process was completed Ms. Sumich would reduce or end her hours with no ill will. Council Member Ayres said there was a need for a very experienced person, the City Manager saw a void and acted on it. He said the city could be held liable. A MOTION was made by Council Member Ayres, seconded by Council Member Conner, to ion to accept and approve the Agreement providing for Interim City Clerk Services. Vice -Mayor Good stated she thought it was a sloppy method to accept the word of an interim employee and she made mention the contract was unsigned. The motion carried on a vote of 4-1 with Vice -Mayor Good dissenting. Council Member Conner commented about the Main Street program in downtown Los Angeles and said he attended the League of California Cities conference in San Jose. He was in Desert Hot springs last week. He reported on the Riverside County Flood Control, San Jacinto Levee with a reach of about a 15 mile stretch to be completed in about 6 months. Council Member Ayres reported on a meeting with EMWD, Supervisor Venable and RDA regarding west end. He said it was a very good meeting for City. Council Member Carlson-Buydos encouraged staff to keep on EMWD. Mayor Williams reported United Way expressed interest in a top ten list of community needs. City Manager Mocalis informed the Mayor staff had responded to the request and it had been forwarded to United Way. At the hour of 8:08 PM, Vice -Mayor Good left Council Chambers. Mayor Williams read a letter from Valley -Wide Recreation and Park District complimenting the San Jacinto Police officers regarding the "Battle of the Badges". Mayor Williams said he received a letter from IEAP that the City had not paid membership as of the publication date. Council Member Conner said the City was a member through the County and questioned whether the City had funds to become a full member. Council Member Carlson-Buydos concurred. Mayor Williams brought up the issue regarding prior contract with then -City manager At the Hour of 8:12 PM, Vice -Mayor Good returned to chambers. Mayor Williams asked staff to look at the appropriateness of two raises. He ask 9 October21, 1999 that it be on the agenda the first meeting in November. City Attorney Aleshire suggested it be a closed session item as it was a personnel item. Mayor Williams said his focus was not on the City Manager but the action of the former mayor. Vice -Mayor Good asked why look at only the Mayor as the forms were signed by three others as well? Mayor Williams announced no closed session items were to be heard that night. City Attomey Aleshire asked if Council Members needed to have Napalitano heard? No members objected to it not being heard at closed session that evening. 9.0 CLOSED SESSION None. 10.0 ADJOURNMENT: A MOTION was made by Council Member Ayres, seconded by Council Member Carlson-Buydos, to adjourn. The motion carried on a vote of 5-0. There being no business to conduct, the meeting was adjourned. The hour of adjournment was 8:15 PM. Submitted by Cynthia A. EXHIBITS EXHIBIT "A" EXHIBIT "B" DISCUSSION Planning Commission Staff Report Draft Planning Commission Minutes On October 13, 1999, the Planning Commission approved Resolution 99-14, recommending the City Council approve Change of Zone 2-99. The project involves the consideration for a Change of Zone for 26 parcels located primarily around the intersection of State Street and Seventh Street. The Current zoning is inconsistent with the General Plan. Government Code 65860 states, "The Zoning Ordinance must be consistent with the General Plan." The government also states "...any resident or property owner within the City may bring an action in Superior Court to enforce compliance, such actions or proceedings are governed by Civ. Proc. Code 1084-1097. In order to prevent this from ever happening, Staff has identified and brought forward 26 parcels that have zoning that is inconsistent with the current General Plan. On November 4, 1999, the City Council opened the public hearing on of the Change of Zone 2-99, and directed Staff to bring back the Ordinance that reflects Councils changes. BACKGROUND: Several search firms were contacted and asked to submit informal quotes for the total cost of the recruitment effort for the four subject positions, in order to give the City Council an approximation of the cost of the recruitment. The quotes ranged in price from $60,000 to $81,000, which includes all four positions. The City of Palm Springs estimates that the complete process of hiring their new City Manager through the use of a search firm will be approximately 28 weeks. Staff believes that the cost and time involved in using a search firm for these four positions may be unwarranted, and that City staff can adequately handle the recruitment effort. The City Council had previously expressed its desire to allow the new City Manager the opportunity of selecting the three department heads, in order to create a cohesive management team of his own choosing. The Interim City Manager proposes a phased process that will result in the appointment of the new City Manager, followed by his immediate review of a selected "short list" of candidates for the three department head positions. The deadline for submitting advertisements in Western City magazine is November 22 for the January issue. If the City Council approves the staff recommendation, appropriate advertisements will be placed in Western City magazine prior to November 22. JUSTIFICATION: Both time and expense will be reduced by the use of City staff for the recruitment effort. BUDGETARY IMPACT: No funds were budgeted for this action. San Jacinto Avenue San Jacinto, CA 92583 RECOMMENDATION 1. Credit the Flood Control fees in the amount of $12,579.00, pending dedication of adequate right-of-way for future flood control improvements; and 2. Authorize the deferral of development fees in the amount of $13,947.12; and 3. Establish an amortization schedule and interest rate not to exceed five years at seven percent. BACKGROUND On June 3, 1999, the City Council approved Conditional Use Permit 3-99, authorizing the establishment of a charter school, for up to 500 children, on the west side of San Jacinto Avenue, north of Idyllwild Drive. The first phase of the project, which has been commenced, includes a K-8 school, with an approximate enrollment of 180 students. After Council approval, the applicant initiated plan check and permit issuance. To date, only plan check and inspection fees in the amount of $2,065.15 have been paid. Pursuant to the City's fee deferral ordinance, development impact fees for Phase I are due and payable at occupancy. At this time, a balance of $26,526.12 remains to be paid. Of this amount, $12,579 is for Flood Control Improvement fees. However, San Jacinto Valley Academy will be dedicating land to the City for this purpose. Upon the dedication, flood control fees should be credited. The Academy is requesting that the remaining balance of $13,947.12 be waived or deferred for an extended period. Inasmuch as the fees are set by Ordinance, they cannot be waived without modifying or repealing the ordinance. However, the Council has the discretion to allow the fees to be paid over time. The existing fee deferral program allows for development fees to be paid prior to final occupancy. At this time, the academy is operating under the terms of a temporary occupancy inspection. City Council Staff Report November 18, 1999 In the event the Council authorizes the fee deferral, a loan agreement with a promissory note will be prepared and presented for Council approval. Past agreements for sewer connection fees and entitlement application fees, provide for five year amortization schedules at an interest rate of 7 percent. Based upon these terms, the Academy would make monthly payments in the amount of $277.
