BACKGROUND: The City Council and Planning Commission have recently identified the need for additional funding sources for police protection and fire protection and suppression services, especially those services that are created by new development within the City. In response to the need for additional funding for such services, the City Council formed Community Facilities District 2003-1 (the "District') and the levy of special taxes therein. On November 6, 2003, the City Council called an election of the landowners affected by the formation of the District and the levy of special taxes. The landowners approved the formation of the District and levy of special taxes with over a two-thirds majority vote of the voters voting. Willow Creek LLP is developing certain real property (APN 439-110-002) that will be developed into a multi -family housing project near the boundaries of the District. As a condition to receiving the building permits from the City, Willow Creek LLP must annex its territory into the District. Willow Creek LLP now desires to obtain building permits and annex such real property into the District. JUSTIFICATION: The adoption of the resolution is required to begin the annexation process into the District. BUDGETARY IMPACT: The annexation of the Willow Creek LLP property into the District will have a beneficial impact to the City's budget in that, upon implementation of the proposed financing district, it would assist in the funding of police and fire services that would otherwise come from the City's general fund. 1 City Manager: Finance Director: STATE OF CALIFORNIA ) COUNTY OF RIVERSIDE) ss CITY OF SAN JACINTO ) RESOLUTION NO. RESOLUTION OF THE CITY COUNCIL OF THE SAN JACINTO CALIFORNIA, MAKING CERTAIN DETERMINATIONS AND AUTHORIZING SUBMITTAL OF THE LEVY OF SPECIAL TAXES TO THE QUALIFIED ELECTORS OF CERTAIN TERRITORY PROPOSED TO BE ANNEXED TO COMMUNITY FACILITIES DISTRICT NO. 2003-1 WHEREAS, the CITY COUNCIL of the CITY OF SAN JACINTO, CALIFORNIA (the "City Council"), has previously declared its intention and held and conducted proceedings relating to the annexation of territory (the "Annexation Area") to an existing community facilities district and an improvement area thereto pursuant to the terms and provisions of the "Mello - Roos Community Facilities Act of 1982", being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California, and specifically Article 3.5 thereof (the "Act") and the City of San Jacinto Ordinance Conditioning the Issuance of Building Permits on Annexation into Police, Fire and Road Maintenance Financing Districts enacted pursuant to the powers reserved by the City of San Jacinto under Sections 7 of Article XI of the Constitution of the State of California (the "Ordinance") (the Act and the Ordinance may be referred to collectively as the "Community Facilities District Law"). The existing Community Facilities District has been designated as COMMUNITY FACILITIES DISTRICT NO. 2003-1 (the "District"); and, WHEREAS, notice of a public hearing relating to the annexation of such territory to the District, the extent of such territory, the financing of Authorized Services (as defined in Section 4 below) and all other related matters has been given; and, WHEREAS, it has now been determined that written protests have not been received by fifty percent (50%) or more of the registered voters residing either within the Annexation Area or the District and/or property owners representing more than one-half (1/2) or more of the area of land within the Annexed Area or within the District; and, WHEREAS, inasmuch as there have been less than twelve (12) persons registered to vote within the Annexation Area for each of the ninety (90) preceding days, this legislative body desires to submit the levy of the required special tax to the landowners of the Annexation Area, said landowners being the qualified electors as authorized by law. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. RECITALS The above recitals are all true and correct. SECTION 2. DETERMINATIONS It is determined by this City Council that: A. all proceedings to consider the annexation of the Annexation Area to the District prior hereto were valid and taken in conformity with the requirements of law, and specifically the provisions of the Community Facilities District Law; B. the annexation of the Annexation Area to the District as proposed conforms with the policies of City of San Jacinto; C. less than twelve (12) registered voters have resided within the Annexation Area for each of the ninety (90) days preceding the close of the public hearing and, consequently, the qualified electors shall be the landowners of the Annexation Area and each landowner who is the owner of record as of the close of the public hearing, or the authorized representative thereof, shall have one vote for each acre or portion of an acre of land that she or he owns within the Annexation Area; D. the time limit specified by the Community Facilities District Law for conducting an election to submit the levy of the special taxes to the qualified electors of the Annexation Area and the requirements for impartial analysis and ballot arguments have been waived with the unanimous consent of the qualified electors of the Annexation Area; E. the City Clerk, acting as the election official, has consented to conducting any required election on a date which is less than one hundred twenty-five (125) days following the adoption of any resolution annexing the Annexation Area to the District; and F. the Authorized Services proposed to be financed from the proceeds of special taxes to be levied within the Annexation Area are in addition to maintenance provided to the Annexation Area before the annexation thereof to the District. SECTION 3. BOUNDARIES OF ANNEXED AREA. The boundaries and parcels of land in the Annexation Area and on which special taxes are proposed to be levied in order to pay the costs and expenses of the Authorized Services are generally described as follows: All that property and territory proposed to be annexed to the District, as said property is shown on a map as previously approved by this legislative body, said map designated as Annexation Map No. 2 of Community Facilities District No. 2003-1, a copy of which is on file in the Office of the City Clerk and shall remain open for public inspection. SECTION 4. DESCRIPTION OF AUTHORIZED SERVICES. The services that are authorized to be financed by the District from the proceeds of special taxes levied within the District (the "Authorized Services") are generally described as (a) additional police protection services, including but not limited to, criminal justice services and (b) additional fire protection and suppression services throughout the District. The District shall finance all direct, administrative and incidental annual costs and expenses necessary to provide the Authorized Services. The Authorized Services authorized to be financed by the District from the proceeds of special taxes levied within the District are also the Authorized Services to be provided in the Annexation Area. If and to the extent possible the Authorized Services shall be provided in common within the District and the Annexation Area. SECTION 5. SPECIAL TAXES. Except where funds are otherwise available a special tax, secured by recordation of a continuing lien against all non-exempt real property in the Annexation Area, is hereby authorized, subject to voter approval, to be levied within the boundaries of the Annexation Area. For particulars as to the rate and method of apportionment of the special tax proposed to be levied within the Annexation Area, reference is made to the attached and incorporated Exhibit A (the "Rate and Method of Apportionment"), which sets forth in sufficient detail the method of apportionment of the special tax to allow each landowner or resident within the Annexation Area to estimate the maximum amount that such person will have to pay. Such special tax shall be utilized to fund the Special Tax Requirement as such term is defined in the Rate and Method of Apportionment. The special taxes herein authorized, to the extent possible, shall be collected in the same manner as ad valorem property taxes and shall be subject to the same penalties, procedure, sale and lien priority in any case of delinquency as applicable for ad valorem taxes; provided, however, the District may utilize a direct billing procedure for any special taxes that cannot be collected on the County tax roll or may, by resolution, elect to collect the special taxes at a different time or in a different manner if necessary to meet its financial obligations. Under no circumstances will the special tax to be levied against any parcel within the Annexation Area used for private residential purposes be increased as a consequence of delinquency or default by the owner of any other parcel or parcels within the District by more than ten percent (10%). Upon recordation of a Notice of Special Tax Lien pursuant to Section 3114.5 of the Streets and Highways Code of the State of California against the property within the Annexation Area, a continuing lien to secure each levy of the special tax shall attach to all non-exempt real property in the Annexation Area and this lien shall continue in force and effect until the special tax obligation is prepaid and permanently satisfied and the lien canceled in accordance with law or until collection of the tax by the legislative body ceases. SECTION 6. SPECIAL TAX ACCOUNTABILITY MEASURES. Pursuant to and in compliance with the provisions of Government Code Section 50075.1, this City Council hereby establishes the following accountability measures pertaining to the levy by the District of the special taxes within the Annexation Area as described in Section 5 above: A. Each such special tax shall be levied for the specific purposes set forth in Section 5 above. B. The proceeds of the levy of each such special tax shall be applied only to the specific applicable purposes set forth in Section 5 above. C. The District shall establish a separate account into which the proceeds of the special taxes levied within the District shall be deposited. D. The City Manager or his or her designee, acting for and on behalf of the District, shall annually file a report with the City Council as required pursuant to Government Code Section 50075.3. SECTION 7. ELECTION. The proposition related to the levy of the special tax shall be submitted to the qualified electors of the Annexation Area, said electors being the landowners, with each landowner having one (1) vote for each acre or portion thereof of land which he or she owns within the Annexation Area. The election shall be held on March 4, 2004, and such election shall be a special election to be conducted by the City Clerk (hereinafter "Election Official"). If the proposition for the levy of the special tax receives the approval of more than two- thirds (2/3) of the votes cast on the proposition, the special tax may be levied as provided for in this Resolution. SECTION 8. BALLOT The ballot proposal to be submitted to the qualified voters at the election shall generally be as follows: PROPOSITION A CITY OF SAN JACINTO COMMUNITY FACILITIES DISTRICT NO. 2003-1 ANNEXATION MAP NO. 2 AUTHORIZATION FOR SPECIAL TAX LEVY Shall Community Facilities District No. 2003-1 of the City of San Jacinto be authorized to levy special taxes, subject to the accountability measures set forth in Resolution No. within the territory identified in Annexation Map No. 2 to such district therein pursuant to the rate and method of apportionment of special taxes (the "Rate and Method") set forth in such resolution for the purpose of funding the Special Tax Requirement as such term is defined in the Rate and Method? SECTION 9. VOTE The appropriate mark placed in the line before the word "YES" shall be counted in favor of the adoption of the proposition, and the appropriate mark placed in the line before the word "NO" in the manner as authorized, shall be counted against the adoption of said proposition. SECTION 10. ELECTION PROCEDURE This City Council hereby authorizes the Election Official to take any and all steps necessary for the holding of said election and ratifies any such steps previously taken by such Election Official which were necessary for the holding of such election. Said Election Official shall perform and render all services and proceedings incidental to and connected with the conduct of said election, and said services shall include, but not be limited to the following: A. Prepare and furnish to the election officers necessary election supplies for the conduct of the election. B. Cause to be printed the requisite sheets and other necessary forms. C. Furnish and address official ballots Annexation Area. number of official ballots, tally for the qualified electors of the D. Cause the official ballots to be mailed and/or delivered, as required by law. E. Receive the returns of the election. F. Sort and assemble the election material and supplies in preparation for the canvassing of the returns. G. Canvass the returns of the election. H. Make all arrangements and take the necessary steps to pay all costs of the election incurred as a result of services performed by the District and pay costs and expenses of all election officials. J. Fee County Recorder of Riverside County EXHIBIT B CITY OF SAN JACINTO COMMUNITY FACILITES DISTRICT NO. 2003-1 RATE AND METHOD OF APPORTIONMENT A-1 RATE AND METHOD OF APPORTIONMENT FOR COMMUNITY FACILITIES DISTRICT NO. 2003-1 OF THE CITY OF SAN JACINTO A Special Tax as hereinafter defined shall be levied on all Assessor's Parcels in Community Facilities District No. 2003-1 of the City of San Jacinto ("CFD No. 2003-1") and collected each Fiscal Year commencing in Fiscal Year 2003-2004, in an amount determined by the Council through the application of the appropriate Special Tax for "Developed Property" as described below. All of the real property in CFD No. 2003-1, unless exempted by law or by the provisions hereof, shall be taxed for the purposes, to the extent and in the manner herein provided. A. DEFINITIONS The terms hereinafter set forth have the following meanings: "Acre or Acreage" means the land area of an Assessor's Parcel as shown on an Assessor's Parcel Map, or if the land area is not shown on an Assessor's Parcel Map, the land area shown on the applicable final map, parcel map, condominium plan, or other recorded County parcel map. "Act" means the Mello -Roos Community Facilities Act of 1982, as amended, being Chapter 2.5, Division 2 of Title 5 of the Government Code of the State of California. "Administrative Expenses" means the following actual or reasonably estimated costs directly related to the administration of CFD No. 2003-1: the costs of computing the Special Taxes and preparing the annual Special Tax collection schedules (whether by the City or designee thereof or both); the costs of collecting the Special Taxes (whether by the County or otherwise); the costs to the City, CFD No. 2003-1 or any designee thereof of complying with City or CFD No. 2003-1 disclosure requirements; the costs associated with responding to public inquiries regarding the Special Taxes; the costs of the City, CFD No. 2003-1 or any designee thereof related to an appeal of the Special Tax; and the City's annual administration fees and third party expenses. Administrative Expenses shall also include amounts estimated or advanced by the City or CFD No. 2003-1 for any other administrative purposes of CFD No. 2003-1, including attorney's fees and other costs related to commencing and pursuing to completion any foreclosure of delinquent Special Taxes. "Apartment Property" means any Assessor's Parcel of Residential Property that consists of a building or buildings comprised of attached residential units available for rental, but not purchase, by the general public and under common management. "Assessor's Parcel Map" means an official map of the Assessor of the County designating parcels by Assessor's Parcel number. City of San Jacinto Community Facilities District No. 2003-1 October 30, 2003 Page 1 "CFD Administrator" means an official of the City, or designee thereof, responsible for calculating the Special Tax Requirement and providing for the levy and collection of the Special Taxes. "CFD No. 2003-1" means Community Facilities District No. 2003-1 of the City. "City" means the City of San Jacinto. "Consumer Price Index" means the Consumer Price Index published by the U.S. Bureau of Labor Statistics for "All Urban Consumers" in the Los Angeles - Anaheim - Riverside Area, measured as of the month of December in the calendar year which ends in the previous Fiscal Year. In the event this index ceases to be published, the Consumer Price Index shall be another index as determined by the CFD Administrator that is reasonably comparable to the Consumer Price Index for the City of Los Angeles. "Council" means the City Council of the City, acting as the legislative body of CFD No. 2003-1. "County" means the County of Riverside. "Developed Property" means, for each Fiscal Year, all Taxable Property for which a building permit for new construction was issued after March 1, 2003 and as of March 1 of the previous Fiscal Year. "Fiscal Year" means the period starting July 1 and ending on the following June 30. "Floor Area" for any Non -Residential Property means the total square footage of the building(s) located on such property, measured from outside wall to outside wall, exclusive of overhangs, porches, patios, carports, or similar spaces attached to the building but generally open on at least two sides. The determination of Floor Area shall be made by reference to the building permit(s) issued for such Assessor's Parcel. "Land Use Class" means any of the classes listed in Table 1 and Table 2. "Maximum Special Tax" means the Maximum Special Tax A and/or Maximum Special Tax B, as applicable. "Maximum Special Tax A" means the Maximum Special Tax A, determined in accordance with Section C.1 below, that can be levied in any Fiscal Year on any Assessor's Parcel. "Maximum Special Tax B" means the Maximum Special Tax B, determined in accordance with Section C.2 below, that can be levied on any Assessor's Parcel of Taxable Property on a one-time basis, at the time a building permit for new construction is issued for such Assessor's Parcel. "Non -Residential Property" means all Assessor's Parcels for which a building permit(s) was issued for a non-residential use. City of San Jacinto Community Facilities District No. 2003-1 October 30, 2003 Page 2 "Non -Retail Commercial/Industrial Property" means all Assessor's Parcels of Developed Property that are considered Non -Residential Property and that are not Retail Commercial Property. "Property Owner Association Property" means, for each Fiscal Year, any Assessor's Parcel within the boundaries of CFD No. 2003-1 that was owned by or irrevocably offered for dedication to a property owner association, including any master or sub -association, as of January 1 of the previous Fiscal Year. "Proportionately" means that the ratio of the actual Special Tax A levy to the Maximum Special Tax A is equal for all Assessor's Parcels of Developed Property. "Public Property" means, for each Fiscal Year, (i) any property within the boundaries of CFD No. 2003-1 that was owned by or irrevocably offered for dedication to the federal government, the State, the City or any other public agency as of January 1 of the previous Fiscal Year; provided however that any property leased by a public agency to a private entity and subject to taxation under Section 53340.1 of the Act shall be taxed and classified in accordance with its use; or (ii) any property within the boundaries of CFD No. 2003-1 that was encumbered, as of January 1 of the previous Fiscal Year, by an unmanned utility easement making impractical its utilization for other than the purpose set forth in the easement. "Residential Property" means all Assessor's Parcels of Developed Property for which a building permit has been issued for purposes of constructing one or more residential dwelling units. "Retail Commercial Property" means all Assessor's Parcels of Non -Residential Property for which the building permit was issued for a retail sales tax generating use or which is being used primarily for a retail sales tax generating use, as determined by the CFD Administrator. However, if the land use of an Assessor's Parcel changes, and such Assessor's Parcel no longer generates retail sales tax, such Assessor's Parcel shall no longer be considered Retail Commercial Property and shall be classified and taxed according to its use, as determined by the CFD Administrator. "Single Family Property" means all Assessor's Parcels of Residential Property for which building permits have been issued for detached residential units, excluding Apartment Property. "Special Tax" means the Special Tax A and/or Special Tax B, as applicable. "Special Tax A" means the annual special tax to be levied in each Fiscal Year on each Assessor's Parcel of Developed Property to fund the Special Tax Requirement. "Special Tax B" means the one-time Special Tax which is paid directly to the City at the time a building permit for new construction is issued for an Assessor's Parcel of Taxable Property. City of San Jacinto Community Facilities District No. 2003-1 October 30, 2003 Page 3 "Special Tax Requirement" means that amount required in any Fiscal Year to meet the needs of CFD No. 2003-1 to: (i) pay for fire protection and suppression services (ii) pay for police protection services (iii) pay Administrative Expenses; less (iv) a credit for any funds available to reduce the annual Special Tax levy, as determined by the CFD Administrator. "State" means the State of California. "Taxable Property" means all of the Assessor's Parcels within the boundaries of CFD No. 2003-1 which are not exempt from the Special Tax pursuant to law or Section E below. "Undeveloped Property" means, for each Fiscal Year, all Taxable Property not classified as Developed Property. B. ASSIGNMENT TO LAND USE CATEGORIES Each Fiscal Year, all Taxable Property within CFD No. 2003-1 shall be classified as Developed Property or Undeveloped Property and shall be subject to Special Taxes in accordance with the rate and method of apportionment determined pursuant to Section C. Residential Property shall be assigned to Land Use Classes 1 and 2 based on the type of structure located on the Assessor's Parcel. Non -Retail Commercial/Industrial Property shall be assigned to Land Use Class 3. C. MAXIMUM SPECIAL TAX RATE 1. Special Tax A The Special Tax A is an annual Special Tax that shall be levied on Developed Property to fund the Special Tax Requirement. a. The Council shall levy the Special Tax A until the amount of Special Taxes equals the Special Tax Requirement. The Special Tax A shall be levied Proportionately on each Assessor's Parcel of Developed Property at up to 100% of the applicable Maximum Special Tax A as needed to satisfy the Special Tax Requirement. Special Tax B Commencing with Fiscal Year 2003-04 and for each following Fiscal Year, the Council shall levy the Special Tax B on each Assessor's Parcel that is subject to the Special Tax B at 100% of the applicable Maximum Special Tax B. The Special Tax B shall be collected by the City at the time a building permit for new construction is issued for an Assessor's Parcel of Taxable Property. E. EXEMPTIONS No Special Tax shall be levied on Retail Commercial Property, Property Owner Association Property or Public Property. However, should an Assessor's Parcel no longer be classified as Retail Commercial Property, Property Owner Association Property or Public Property, its tax-exempt status will be revoked. F. APPEALS AND INTERPRETATIONS Any landowner or resident may file a written appeal of the Special Tax on his/her property with the CFD Administrator, provided that the appellant is current in his/her payments of Special Taxes. During the pendency of an appeal, all Special Taxes previously levied must be paid on or before the payment date established when the levy was made. The appeal must specify the reasons why the appellant claims the Special Tax is in error. The CFD Administrator shall review the appeal, meet with the appellant if the CFD Administrator deems necessary, and advise the appellant of its determination. If the CFD Administrator agrees with the appellant, the CFD Administrator shall eliminate or reduce the Special Tax on the appellant's property and/or provide a refund to the appellant. If the CFD Administrator disagrees with the appellant and the appellant is dissatisfied with the determination, the appellant then has 30 days in which to appeal to the Council by filing a written notice of appeal with the City Clerk, provided that the appellant is current in his/her payments of Special Taxes. The second appeal must specify the reasons for its disagreement with the CFD Administrator's determination. Interpretations may be made by the Council by ordinance or resolution for purposes of clarifying any vagueness or ambiguity in this Rate and Method of Apportionment. MANNER OF COLLECTION The Special Tax A shall be collected in the same manner and at the same time as ordinary ad valorem property taxes; provided, however, that in Fiscal Year 2004-05 and each Fiscal Year thereafter, CFD No. 2003-1 may directly bill the Special Tax A, may collect Special Taxes at a different time or in a different manner if necessary to meet its financial obligations, and may covenant to foreclose and may actually foreclose on delinquent Assessor's Parcels as permitted by the Act. Commencing in Fiscal Year 2003-04, the Special Tax B shall be paid directly to the City. H. On January 12, 2004, the Council Sub -Committee reviewed the speed hump requests and standards previously reviewed by Council and made the following recommendations: o Speed humps and other traffic calming improvements may be considered by City Council and implemented subject to compliance with all the following criteria: A. 51% of residents along the proposed street must sign and submit a petition requesting installation of traffic calming improvements B. Traffic calming improvement shall be considered only within existing residential developments (with speed limits of 25 MPH) with curb to curb improvements not to exceed 40' (one lane in each direction C. An additional recommendation as to staffing needs for each fire station is also provided for Council consideration. Direct staff to bring back a detailed zone map with assessor's parcel numbers (APNs) and a recommended site for a new fire station in the vicinity of Sanderson Avenue and Cottonwood Avenue. BACKGROUND: The City Manager directed the Fire Department to prepare a Plan to identify our City's future fire stations and staffing needs to stay abreast of development of development in the City. Council reviewed an initial Plan presented at its December 18, 2003 meeting; however, requested that additional information be taken into consideration. In particular, Council wished to have the Plan illustrate future major roadways and the impacts of the Highway 79 realignment. During our Growth Workshop held in February, 2003, Council was briefed by staff as to our inability to provide adequate emergency response times to the west end of the City where extensive subdivision development is in the current planning stages. The Fire Department identified five (5) minutes as the desired maximum response time. This is particularly critical in life-saving rescues/medical-aids and extinguishment of structure fires prior to the flashover stage. The above recommendations were prepared taking into consideration National Fire Protection Association (NFPA) Standards and the Riverside County Fire Department's Goals and Objectives for Emergency Services Delivery for Unincorporated Areas. JUSTIFICATION: This Plan allows the City to better prepare for future fire station and staffing needs, as well as the associated costs. Identifying these potential expenses now will help to structure our newly created Public Safety CFD. In addition to these reports, staff also requested update of speed surveys and review of speed and stop sign warrants along Chase Street north of Ramona Expressway. (RK) is pleased to submit this review of the State Street (SR-79) at Idyllwild Drive intersection in the City of San Jacinto. The analysis location is shown in Exhibit A. Since State Street (SR-79) is a State Highway, the intersection is controlled to a substantial extent by the State. The purpose of this analysis is to develop recommendations to further improve current operations at this intersection. The analysis will determine existing conditions, and whether or not a traffic signal is warranted at the intersection of State Street (SR-79) at Idyllwild Drive based upon existing conditions. Also, a review of accidents has been conducted for this intersection and recommended improvements are suggested in the recommendations section of this report. This review will include potential access restrictions for Idyllwild Drive at its intersection with State Street (SR-79) and the warrants for a traffic signal. Existing Conditions Exhibit B illustrates the existing geometric condition at the intersection of State Street (SR-79) at Idyllwild Drive. State Street (SR-79) is a four -lane roadway with a striped median at its intersection with Idyllwild Drive. Idyllwild Drive is a two-lane undivided roadway, which intersects State Street (SR-79) at a significant angle. The intersection is stop controlled along Idyllwild Drive in the eastbound and westbound directions. The State Street (SR-79) approaches are not controlled at this time. However, a traffic signal exists at the intersection of State Street (SR-79) at Ramona Expressway located approximately 700 feet north of the 20201 s.w. birch street, suite 250 newport beach, california 92660 tel 949.474.0809 fax 949.474.0902 hip://www.rkengineer.com intersection. An advance -warning flasher is located at the northeast corner of the intersection of State Street (SR-79) at Idyllwild Drive. Photographs of the existing intersection are shown in Appendix A. This includes photographs from each of the four approaches at the intersection. Existing traffic volumes for the study area intersection are shown in Exhibit C. The traffic and pedestrian count sheets are included in Appendix B. Hourly approach traffic counts are tabulated in Table 1. Existing lane configurations at the intersection are shown in Exhibit B. The posted speed limit on State Street (SR-79) north of Idyllwild Drive is 50 mph and 40 mph south of the intersection. The posted speed limit on Idyllwild Drive is 25 mph. Based upon a recent speed survey, the 85th percentile speed on State Street north of Idyllwild Drive is 46 mph, and 50 mph south of Idyllwild Drive. The speed limit north of Idyllwild Drive is somewhat higher than what is indicated by the 85th percentile speed, and the speed limit south of Idyllwild Drive has lower than what is indicated by the 85th percentile speed. State Street is considered a rural street for the purposes of the traffic signal warrants and an all - way stop analysis, because the speeds are over 40 mph. The speed survey worksheets are included in Appendix C. Accident reports were provided by the San Jacinto Police Department (see Appendix D). These statistics are summarized and presented in Table 2, based upon the following formula: Accidents per No. of Accidents * 32,877 Million Vehicles = ADT * No. of Months According to the San Jacinto Police Department records, there have been five (5) accidents during Year 2003, three (3) accidents during Year 2002 and two (2) accidents during Year 2001. As shown in Table 2, the calculated accident rate for the study intersection is higher than the expected rate for similar types of intersections. Vehicles are currently exceeding the speed limit on the port of this roadway south of Idyllwild Drive and also making turning movements that are conflicting with through movement. The intersection of State Street (SR-79) and Idyllwild Drive has been evaluated for a traffic signal using Caltrans eleven (11) traffic signal warrants criteria. The following warrant criteria are applicable to the existing traffic conditions: Warrant No. Description 1 Minimum Vehicle Volume Interruption of Continuous Traffic 6 Minimum Pedestrian Volume School Crossings Accident Experience Systems 2 Warrant No. Description 8 Combination of Warrants 9 Four -Hour Volume 10 Peak Hour Delay 11 Peak Hour Volume Since the 85th percentile vehicle speed on State Street (SR-79) is over 40 miles per hour, the intersection of State Street (SR-79) at Idyllwild has been evaluated using rural area condition criteria. The intersection of State Street (SR-79) and Idyllwild Drive currently does meet four (4) of the warrants for a traffic signal based upon the Caltrans warrant analysis. In addition, the accident Warrant 6 is met, except that less restrictive changes have not been made yet at the intersection to improve the accident experience. The following warrants have been met at this time: Warrant 1, Minimum Vehicle Volume - No (80%) Warrant 2, interruption of Continuous Traffic - Yes Warrant 6, Accident Experience — Yes (except less restrictive measures than a traffic signal have not been taken) Warrant 8, Combination of Warrants - Yes Warrant 9, Four -Hour Volume - Yes Warrant 11, Peak Hour Volume - Yes Since there is a substantial difference in traffic volumes on State Street (SR-79), which has an 18,000 to 20,000 ADT in comparison to Idyllwild Drive which has a traffic volume of 1,000 to 2,600 ADT. All -way stop warrants would not be met at this intersection due to the substantial difference in volumes between the north/south and east/west approaches. Conclusions Based upon the analysis, the intersection of State Street (SR-79) at Idyllwild Drive does have a higher Accident Experience than what would be expected at similar intersections. This is probably caused by the substantial angle that Idyllwild Drive intersects State Street (SR-79). it is difficult for vehicles making eastbound or westbound left turns or going through the intersections to actually see the northbound and southbound vehicles on State Street (SR-79). Even though the traffic signal warrants have been met at this intersection, it is recommended due to the proximity of the intersection to Ramona Express Way, less restrictive measures be taken first to see if they can improve the safety at the intersection. This could include modifications to the signing/striping, turning movement and/or through movement restrictions in the east/west direction. Furthermore, the City may pursue with Caltrans lowering the speed limit north of Idyllwild Drive on State Street (SR-79). Recommendations The following recommendations are suggested for this intersection: 1. Install temporal channelization to restrict access at the intersection. There are two options that are available: Option A (Exhibit D) would include a "worm" median to prohibit east/west through and left turn movements on Idyllwild Drive at its intersection with State Street (SR-79). A conceptual layout of this recommendation is included in Exhibit D. Option B (Exhibit E) would limit the east/west approaches to right turns only by the use of raised channelization islands. Either of the two options would prevent the improvements, which are involved in the current accidents at the intersection. 2. Discuss with Caltrans installing a traffic signal at the intersection. 3. Request Caltrans to reduce the speed limit on State Street north of Idyllwild Drive based upon the recent speed survey. 4. Continue to provide additional police enforcement at the intersection to discourage illegal through or turning movements once the access restrictions are implemented. The purpose of this analysis is to review recommendations to evaluate the study area intersections for all -way stop traffic signals and to determine traffic calming measures, which could be implemented along Main Street east of Sheriff Avenue. The analysis will determine existing conditions, and whether or not all -way stop controls are warranted at the study area intersections. Speed surveys, traffic counts and a review of accidents have been conducted for these intersections and recommended improvements are suggested in the recommendation section of this report. The photographs at Sheriff Avenue and Main Street were taken during the reconstruction of Main Street, which has subsequently been paved and is currently open to traffic. Sketches of the existing study area intersections are included in Appendix B. Main Street is an east -west two-lane roadway between Sheriff Avenue and Ramona Expressway. It has a width varying from approximately 24 feet in the downtown area to approximately 50 feet in the area east of Jordan Avenue. The study area intersections are currently controlled by stop signs in a north -south direction. No stop signs or traffic signals control east -west movements along Main Street. As previously noted, photographs of the intersections are shown in Appendix A. These include photographs from each of the four (4) approaches at the intersection. The downtown area photographs depicts the roadway prior to the completion of improvements, which are now completed. Existing traffic volumes for the study area intersections are shown in Exhibit B. The traffic and pedestrian count sheets are included in Appendix C. Hourly approach traffic counts are tabulated in Tables 1 to 4. The existing lane configurations at the intersections are shown in Appendix B. The posted speed limit on Main Street is 40 miles per hour. Main Street is considered an Urban Street for purposes of traffic signal warrants and all -way stop analysis at those locations where the speeds are less than 40 miles per hour. As shown in Table 5, the calculated accident rates for the study area intersections are lower than the expected rate for similar type of intersections, except for the Main Street intersection of Hewitt Avenue. Traffic signal warrants at the four (4) study area intersections were reviewed with respect to Caltrans average daily traffic and peak hour traffic signal warrants. At the present time the four (4) study area intersections do not meet the average daily traffic or peak hour warrants for traffic signals based upon Caltrans' criteria, although the intersection of Hewitt Avenue at Main Street is very close to meeting the peak hour warrant. The four (4) study area intersections have also been reviewed with respect to all -way stop control warrants. Based upon the MUTCD (Manual of Uniform Traffic Control Devices) criteria, the only intersection which meets all -way stop warrants is the intersection of Hewitt Avenue at Main Street. However, for purposes of controlling traffic in the vicinity of the 2 existing crosswalks, protecting pedestrian crossing, and because of the type of adjacent land uses, all -way stop control is recommended at the following intersections: North -South Street East-West Street Sheriff Avenue Main Street Mistletoe Avenue Main Street Hewitt Avenue Main Street Although it is not a study area intersection, an all -way stop control is also recommended for the intersection of Jordan Avenue at Main Street. The reason for this all -way stop is because of the potential for high pedestrian activity in the downtown area and the intersection is the transition point from the section of Main Street with the two-way left -turn median to the downtown area, which includes chokers and angle parking. Traffic Calming Opportunity A number of traffic calming techniques are available to control vehicle speeds and traffic volumes along the Main Street. A summary of the traffic calming opportunities are included in Exhibit C, and could include such items as follows: • Chokers • Speed humps • Chicanes • Diagonal diverters • Semi diverters • Roundabouts • Bulbouts • Pavement texture • Rumble strips • Striping As a long-term objective, it may be desirable to continue the angle chokers/parking, which have been implemented in the downtown area. This represents relatively high cost capital improvement that potentially could be extended to the east as funds become available. As a near -term solution, striping could be implemented to narrow the wider sections of Main Street east of Jordan Avenue. Main Street east of Jordan Avenue has a curb -to -curb width of approximately 50 feet. The area shown in Exhibit D indicates where the existing 50-foot curb -to -curb section of Main Street could be narrowed through striping to provide a two-way left turn striped median and one (1) travel lane in each direction. In addition, white 4" edge lines could be painted parallel to the curb where parallel parking could occur. The Main Street typical striping concept in this area is shown in Exhibit E. This shows a typical condition, which provides an 11-foot striped median two 12-foot travel lanes and a 7.5-foot curbside -parking lane. This striping concept would reduce the perceived width of the 3 roadway to drivers; therefore, potentially reducing traffic speeds from what currently occurs in the wider sections of Main Street. The striping traffic calming technique is a measure that could be implemented at a relative low cost without reconstructing the existing curb and gutter, rather than the textured pavement and other improvements, which have previously been implemented in downtown San Jacinto. The downtown San Jacinto concept of chokers and angle parking could be implemented to the east as funds become available. Conclusions Based upon this analysis, additional traffic control devices (i.e. all -way stop) are recommended at some of the study area intersections, as noted on Exhibit D. Even though two of these intersections do not warrant an all -way stop control from a volume standpoint, there are other factors which indicate they would be desirable in this particular area. In addition, the revised striping concept could be implemented along Main Street from Jordan Avenue to Camino Las Ramblas that would provide for a two-way striped left turn median and one (1) traffic lane in each direction with a white edge line within the parking area. Furthermore, in the future, the City of San Jacinto could pursue implementation of choker and angle parking as has been implemented in the Downtown area further to the east as capital funds become available. Recommendations The following recommendations are suggested for these intersections: 1. Install all -way stop signs, stop bars, stop legends, and advance warning signs on Main Street at the intersections of Sheriff Avenue and Main Street, Mistletoe Avenue and Main Street and Hewitt Avenue at Main Street. Also, install an all -way stop control at the intersection of Jordan Avenue at Main Street. All installations should follow Caltrans design requirements and advance warning signs should be posted in advance of each intersection along with appropriate pedestrian crossing warning signs. 2. Implement revised striping as conceptually shown in Exhibit E for Main Street east of Jordan Avenue which would include a striped two-way left turn median, one (1) 12-foot traffic lane in each direction, and white edge lines parallel to the existing curb at the edge of the parking lane. This would extend to the point where Main Street narrows to less than 50 feet east of Camino Los Banos Street. Transitions from the two-way left turn medians to a double yellow centerline stripe will need to be provided approaching Jordan Avenue and Camino Los Banos Street on Main Street. 3. Develop a long-term program to implement the choker and angle parking design that has been implemented in Downtown San Jacinto further to the east as funding becomes available. Ms, -' s i i►ex 1 4 4. (RK) is pleased to submit this review of the Chase Street at Cypress Drive and Sagecrest Drive intersections in the City of San Jacinto. The analysis locations are shown in Exhibit A. The purpose of this analysis is to develop recommendations to further improve current operations at these intersections. The analysis will determine existing conditions, and whether or not all -way stops are warranted at the intersections along Chase Street based upon existing conditions. Also, a review of accidents and a speed survey along Chase Street has been conducted for these intersections and recommended improvements are suggested in the recommendations section of this report. Existing Conditions The study intersections are located in a residential community in the City of San Jacinto. Chase Street is a north -south residential collector street that connects the neighborhood to Ramona Expressway to the south of the study intersections. Chase Street dead -ends approximately 500 feet north of Sagecrest Drive, which is also an outlet street connecting the neighborhood to State Street east of the study intersection. The location map can be seen in Exhibit A. Photographs taken for the study area are attached in Appendix A. These include photographs taken from each of the approaches at the intersections. The School District is constructing a new elementary school south of Sagecrest Drive and west of State Street. The intersection of Chase Street and Cypress Drive is stopped controlled along Cypress Drive in the eastbound and westbound directions, whereas, Chase Street and Sagecrest Drive is stopped controlled along Chase Street in the northbound and southbound directions. 20201 s.w. birch street, suite 250 newport beach, california 92660 tel 949.474.0809 fax 949.474.0902 http://www.rkengineer.com Newport Drive intersects Chase Street between the Cypress Drive and Sagecrest Drive intersections. This T-intersection is stopped controlled on Newport Drive in the westbound direction. Chase Street has a curb -to -curb width of approximately 44 feet allowing for parking on both sides of the street. Parking was observed on the streets, isolated, mainly, in front of the homes. The streets do not have any pavement markings, except for stop lines and stop markings at the stop -controlled locations. Exhibit B shows the existing traffic control and the number of travel lanes for the study area. There is roadway lighting on each of the streets but are not necessary located at the intersections. All of the roadways have sidewalks and are located on both sides of the streets. There were not any signs, within the study area, indicating the speed limit or indicating any parking restrictions. The overall condition of the pavement, striping, and sidewalks is good. It is also worth noting that a new school will be opening within a few blocks of the study area in the next year. This new school would mostly likely increase the number of vehicle and pedestrian volumes when opened. However, this review of the two intersections does not take into account the additional traffic from the school, but it is considered in the overall recommendations. All -Way Stop Review The study intersections were reviewed to see whether the intersections warrant an all -way stop control using two different methodologies: the Manual on Uniform Traffic Control Devices' (MUTCD) warrant method and an alternative method published in the ITE WesterniTE commonly used in the San Francisco Bay Area for neighborhood streets. Both of these warrant analyses worksheets can be found in Appendix D. Both of the methodologies are used as guidelines to determine if an intersection warrants an all -way stop. The procedure quantifies the recommendation using a list of criteria in which one or more of the criteria must be met. RK gathered information of the existing conditions including: traffic volumes, a speed survey, and field observations to fulfill the requirements of the analyses. Both methods require recent accident data for the intersections. However, RK attempted to obtain accident data from the City but was unable to acquire the information during the time of the study. RK obtained a 24-hour traffic count, taken on August 6, 2003. The 24-hour traffic count was taken for each approach of the two study intersections. The count showed the traffic volume on Chase Street to have a 472 ADT (Average Daily Traffic) between the Cypress Drive and Newport Drive and a 336 ADT between Newport Drive and Sagecrest Drive. Pedestrian volumes were not tabulated during the 24-hour vehicle count. Tables 1 and 2 show the traffic volumes collected for each approach at the two study intersections. For this study, RK assumed the pedestrian volume to be low and calculated the pedestrian volumes to be approximately 10 percent of the vehicle volume for the given time period. 2 Field observations confirmed that this assumption would be adequate. The existing traffic volumes worksheets for the study intersections are shown in Exhibit C. RK also obtained a speed survey performed on November 6, 2003. The 85th percentile speed (the speed that 85 percent of the vehicles are traveling or less) for Chase Street is 32 miles per hour and the 10-mile per hour pace speed (10-mile per hour group of speeds that is most frequent) is 23 to 32 miles per hour. The 85th percentile speed and the 10-mile per hour pace speed is shown on Exhibit C, and the entire sample speed data worksheets can be found in Appendix C. The intersections of Chase Street at Cypress Drive and Chase Street at Sagecrest Drive have been evaluated for an all -way stop control using the Manual on Uniform Traffic Control Devices' all -way stop warrants criteria. The following warrant criteria are used for existing conditions: MUTCD All-Wav Stop Warrants Warrant No. Description Results 1 Minimum Vehicle Volume Does Not Satisfy 2 Traffic Signal Warranted Does Not Satisfy 3 Accidents Does Not Satisfy Warrant 1 Both intersections could not meet the minimum traffic volume requirements of 300 vehicles over 8 hours. Even with the addition of pedestrian volumes, the total volumes of the intersections could not meet the second requirement for Warrant 1. Since the 85th percentile vehicle speed on Chase Avenue is below 40 miles per hour, the vehicle and pedestrian volumes at the intersections could not be reduced. Therefore, both intersections are unable to satisfy Warrant 1. Warrant 2 Warrant 2 states that a four-way stop could be implemented as an interim measure when traffic signals are warranted. Since traffic signals are not warranted, both intersections are unable to satisfy Warrant 2. Warrant 3 To satisfy this warrant, there must be five or more accidents that are correctable by an all -way stop. Accident data from the San Jacinto Police Department indicate that this warrant is not satisfied. Result Neither of the two intersections were able to satisfy MUTCD's warrant requirements for an all -way stop at this time. RK also evaluated Chase Street at Cypress Drive and Chase Street at Sagecrest Drive using an alternative method published in the ITE WesternlTE. This method is an all -way stop installation evaluation for residential streets commonly used in the San Francisco Bay Area for neighborhood streets. RK has used this criteria for residential, local, and collector streets in other areas of Riverside County. The following installation criteria are used for the existing conditions: ITE WesternlTE Article: All-Wav Stop Installation Criteria Criterion No. Description Results 1 Volume Does Not Satisfy 2 Accidents Does Not Satisfy 3 Visibility Satisfied 4 Speed Satisfied 5 Crossing Residential Collector Streets Satisfied Criterion 1 RK evaluated both intersections with respect to the volume criterion. Both of the intersections were unable to satisfy the requirements of 300 vehicles per hour for at least eight hours during the day. Although, the side streets did account for at least 1/3 of the intersection volume, both parameters must be met to satisfy the criterion. Criterion 2 To satisfy this criterion, there must be at least three accidents that are correctable by an all -way stop. Accident data from the San Jacinto Police Department indicate that this warrant is not satisfied. Criterion 3 RK performed a sight distance review of both intersections and found the sight distance on several approaches to be approximately 150 feet, the minimum required sight distance for this criterion. The southbound approach at the intersection of Chase Street and Sagecrest Drive and the westbound approach of Chase Street at Cypress Drive had sight distances that were obstructed by existing walls. Parked vehicles near the intersection would compound this problem. RK feels that this criterion has been met. Criterion 4 A speed survey showed the 85th percentile speed on Chase Street to be 31 miles per hour. Therefore, both intersections meet the requirements stipulated in Criterion 4 specifying the 85th percentile speed must be equal to or greater than 30 miles per hour. Criterion 5 Since both of the intersecting streets are considered collector streets to the neighborhood and since both of the street's volumes are relatively equal, both intersections satisfy Criterion 5: Crossing Residential Collectors. 4 Result Both intersections have met at least two of the required criterion, therefore satisfying WesternlTE article for multi -way stop installation criteria for neighborhood streets. Findings Based upon the analysis, both of the study intersections do not meet the MUTCD warrant criteria, but do meet the WesternlTE article, Multi -Way Stop Installation Criteria for Neighborhood Streets requirements. The criteria in which the study intersections do meet the requirements of the ITE method should be noted. At several of the approaches, visibility for the stopped traffic was poor and was measured in the field equaling the minimum sight distance requirement. RK considered this visibility criterion to be satisfied. The speed criterion was satisfied when the 85th percentile maximum speed of 30 mph was exceeded. The 85th percentile of 32 mph is above the 30 mph criterion. The third criterion met was Criterion 5, where both intersecting streets are considered collectors for the neighborhood. Since both connect the neighborhood to major streets for the community and the volumes were relatively equal, the criterion was considered satisfied. Conclusions Even though the intersections did not meet the MUTCD warrants, the ITE WesternlTE article methodology surfaced several safety issues that would advocate for the placement of all -way stops. Considering this, RK agrees that all -way stops would improve safety at the intersections and therefore be recommended. However, RK recommends the City first obtain the School District's "safe route to school plan" before installing the all -way stops. With a review of the plan, the City would be better informed on the location and placement of the stop signs, stop bars, and stop markings in relation to any new school crosswalks for the new school. Recommendations A summary of project recommendations is included in Appendix D. As well, the following recommendations are suggested for these intersections: 1. Install all -way stops at the intersections of Chase Street and Cypress Drive and Chase Street and Sagecrest Drive after review of the new school's "safe route to school" plan. 2. The City should install stop sign ahead warning signs (W17) in advance of the intersection at the time of the installation of stop signs. 3. Install "STOP" pavement markings 8 feet prior to the stop bars or limit lines. 5 RK is pleased to provide this intersection review for the intersections at Chase Street and Cypress Drive and Chase Street and Sagecrest Drive. BACKGROUND: During a Council discussion at a previous Council meeting, staff was directed to look at different alternatives to handle weed control in the City's right-of-way. Staff has concluded that the best method available would be to utilize wood chips or wood mulch given to the City from local tree companies (at no cost to the City). This type of material usually deters weed growth and maintains moisture around landscaped areas. Locations for wood chip use would be specified by both the Park Supervisor and Street Supervisor to control specific problems or areas of high visibility and utilize the use of Community Service Workers to spread and place wood chips or wood mulch. Two other alternatives are: 1. Weed abatement through a contractor @ $320 per day 2-man crew, or; 2. The use of herbicide through a contractor @ approx. $300 per acre. Retention of weed abatement practices in-house will continue utilizing the Street Division Mower Unit and one (1) operator to concentrate on rural area shoulders and right-of-ways within the City (west -side) and City -owned properties of facilities. JUSTIFICATION: Improve the atheistic of the City's parkways and major roadways and to control weed abatement. BUDGETARY IMPACT: Utilizing the wood chips or wood mulch would have no budgetary impact. Funding for alternatives numbers 1 and 2 would have to be allocated as this was not budgeted. ATTACHMENTS: None. ORGANIZATION 1.1 Call to Order Mayor Jim Ayres called the Regular Meeting of the San Jacinto City Council to order at 7:07 p.m. Prior to opening the meeting Mayor Ayres noted that public comments regarding 1.5.3 would be heard under 2.0 Public Comments section. 1.2 Roll Call Present: Jim Ayres, Chris Carlson-Buydos, Ken Shaw, Dale Stubblefield Absent: Jim Conner 1.3 Invocation — Rev. Randy Leeper, Faith Tabernacle, San Jacinto Rev. Leeper gave the invocation. 1.4 Pledge of Allegiance Council Member Stubblefield led the Pledge of Allegiance. 1.5 Special Presentations Because of the travel time Mayor Ayres noted Terri Neuswander, representing the Riverside County Fair and National Date Festival, would be taken out of order. Following introductions by Ms Neuswander, Queen Scheherazade and her court invited the City Council and those present to the event February 13-22, 2004. 1.5.4 Business Spotlight of the Month / L.O. Lynch, Inc. accepting Emil Worm and Ken Swarthout / Economic Development Specialist Randy Williams, Economic Development Specialist, commented the first spotlight of 2004 was L.O. Lynch, Inc., originally known as L.L. Lynch. It is the largest pump company in the valley with 20 employees. Following many interesting facts about the company, City Council Minutes January 22, 2004 Page 2 of 13 Emil Worm and Ken Swarthout accepted the plaque from Mayor Ayres. 1.5.1 American Cancer Society "Relay for Life" presentation / Anna Martin, Volunteer Chairperson Anna Martin informed the Council the "Relay for Life's" goal is to raise $100,000 this year for the American Cancer Society. Ms Martin then introduced three of the young women of the 19 participants in the youth team. Ms. Martin noted it is a 24 hour event. Mayor Ayres commented that he would be organizing a team from the City. 1.5.2 Q-Star Technology / Public Safety Sub Committee Mayor Ayres noted that the Public Safety Sub Committee had reviewed a similar presentation and thought it would be beneficial for the Council to also see it. Carlita Mead explained that the camera is a vandalism deterrent mechanism. It is operated with a remote on the ground, including battery and film check. The camera is able to pick a license plate number at 100 ft. in the dark with no lights. Ms Meade further noted that it runs on five batteries, it tends to be bullet proof, is typically mounted on a 16' foot pole, and nationally used for catching illegal dumpers. She noted the cities using it to assist in the prosecution of law breakers. Ms Meade offered to loan a couple of units for the City to test at no risk. Mayor Ayres advised Ms Meade that the City Manager would be in touch to make the necessary arrangements. 1.5.3 Overview Sheriff's Department Services / Sheriff Bob Doyle and staff's presentation Assistant Sheriff Gayle Janes explained he is responsible for field operations and was present to explain how contract services work. The Sheriff's department is preparing a proposal to provide local law enforcement within San Jacinto City limits. Said proposal will be delivered to the City Manager on February 3, 2004. Sheriff Janis then introduced the officers present from the Sheriff's Department. He noted some of the career development for officers that had left city departments to begin working with the Sheriff's office when their cities no longer provided local (city) police protection. City Council Minutes January 22, 2004 Page 3 of 13 Sheriff Janes than gave a PowerPoint presentation, which included, the present organizational chart, the history of the contract law enforcement, the 12 cities contracted with the Sheriffs Department: Moreno Valley, Norco, Pal Desert, Coachella, Calimesa, Lake Elsinore, La Quinta, Perris, Canyon Lake, Temecula, Indian Wells, and Rancho Mirage; noting that is exactly half the cities in Riverside County. The City can determine the level of service and the cost is determined by the service level provided. More highlights the Sheriff's Department handles: all the human resource services, including employee training, labor negotiations, benefits, discipline, grievances personal injury, wrongful death, and employee lawsuits. The logistics of other items covered include radio and dispatch, equipment, and fleet services. They have specialized services including SWAT, hazardous materials, forensic science, canine program, aviation, special investigation, and central homicide units. The City would only pay for overtime to utilize these special teams. Other communities retained their community involvement in partnership with the Sheriffs Department: the local department could keep their patch but would have to switch to the green and tan uniform; citizen supported volunteer programs, reserve deputies, search and rescue, chaplin, citizens on patrol, etc. Sheriff Janes noted that to keep their cost down, they would be offering a standard five year contract with an automatic renewal provision. There is a 12 month termination provision for either party. The cost of the contract is based on full cost recovery: the City only pays what it costs. The cost recovery is analyzed annually and is based on personnel, mileage, and facility. When deputy cost is reviewed it includes salary, benefits, compensation, supervision cost, station clerical support, administrative investigative, administration and media information and other supports. Support costs include dispatch, finance, accounting, informational technology, etc. Community based programs can be as much or as little as the City wants. Mayor Ayres noted that specific questions could be answered under public comments, as the Sheriff's Department staff had offered to answer questions. The City Council will take public testimony for 30 days. He noted that response time is a frequently asked question. Sheriff Janes noted that it depends on how many officers the City pays for. It could be better or worse than it is currently. If the same number of cars is kept, then it will remain the same. 2. PUBLIC COMMENTS: City Council Minutes January 22, 2004 Page 4 of 13 Beverly Griggs, 298 S Jordan, San Jacinto, commented her family has been in San Jacinto since 1915. According to Ms Griggs, there has always been a dispute between the City and the Police Department. She expressed concern about the response time if the switch was made to the Sheriff's Department. She noted that her friends in Perris and Val Vista have had slow response from the Sheriffs Department. She encouraged the Council to keep the police coverage local and the police department should be appreciated and acknowledged for what they do. Moreen Williamson, 401 West Main Street, San Jacinto, presented a petition of a consensus of those that would like to keep the police department local. There were initially 804 signatures; approximately 100 of the signatures were stolen from on of the locations gathering signatures. Dr. Janice Hickerson, 1151 Reinhart, San Jacinto, commented she has lived in San Jacinto for the past nine years. She heard the contract with the Sheriff's Department was a "done deal" and that it was going to be identical to Temecula's contract. Dr. Hickerson requested to know if there was a written or verbal contract. The Sheriffs office employee was confident the contract does exist. Mayor Ayres responded there is no contract, verbal or written. There will not be one until there is a public vote. Sheriff Janis responded, and confirmed the Mayor's comment — there is no contract. If she wants to give him the name, he will follow up. 3. PUBLIC HEARING None 4. CITY DEPARTMENTS 4.1 Joint Exercise of Powers Agreement (JPA) creating the Western Riverside County Regional Conservation Authority (FCA) for the Western Riverside County Multiple Species Habitat Conservation Plan (MSHCP) Approve / Community Development Director Community Development Director Tim Hults reviewed the formation of the JPA for the MSHCP: This is the final step to begin implementation of the MSHCP. The two items of concerns for the Council were how the leadership would be selected and the indemnification for the City. The WRCOG executive committee approved the JPA, noting the JPA will select their own executive director and the indemnification provision is included. Staff recommends approval and selection of JPA representative. City Council Minutes January 22, 2004 Page 5 of 13 Vice Mayor Carlson-Buydos questioned if the County was taking the lead for the first three years. Director Hults responded that is in place, as they are the only ones with sufficient technical staff to do the job at this time. Council Member Stubblefield commented he is on the FCA Board, as it is the same as the WRCOG. Ayes: Carlson-Buydos, Shaw, Stubblefield, Ayres Nays: None Absent: Conner Abstain: None 4.2 Request to Initiate Zoning Ordinance Amendment (Burn Policy) / Discuss and direct staff / Community Development Director Director Hults reviewed the current Burn Policy and why it was adopted: Non -conforming uses, i.e. a house in a commercial zone may stay unless it suffers more than a 50% burn; then it can't be rebuilt. There are specific limitations on non -conforming structures if damaged to re-establish the house. Because lenders are aware of this rule they won't finance or allow a mortgage on the property. It has caused a hardship on one family and their real estate agent continues to bring this item before the Planning Commission and Council. Planning Commission opted to not initiate the change as they believe the regulation to be valuable and should stay as it is. Joan Berggren, 272 Grand Army Avenue, San Jacinto, noted that she was not speaking specifically for Mr. Alexandru (Adrian Alexandru) but in general. The policy was adopted 20 years ago without sufficient notice or public input (the applicable rules were followed at the time of adoption). Ms Berggren suggested a policy like Long Beach, as they rescinded a similar policy. What she was able to find out was that the policy hadn't been helpful. Ms Berggren then read a section of Government Code as it applies to duplexes, as she believes the City's regulation takes away an individual's rights. Vice Mayor Carlson-Buydos questioned how many situations were there that would or could be caught in these transitional land uses (houses in City Council Minutes January 22, 2004 Page 6 of 13 commercial or industrial areas). Director Hults guessed about 12, commenting that most are on Seventh Street, Eighth Street, and State Street. Vice Mayor Carlson-Buydos commented that she believes it is an important tool. She questioned what Hemet's tool is for similar situations; what predicament would it place the City in if they changed to allow replacement only — no expansion; and if it would be highly detrimental to redevelopment. Director Hults noted that the language in this particular regulation is exactly the same as it is in Hemet. He was informed that a Hemet staff person created a policy that was in conflict with their City Ordinance. That person is no longer there. Attorney Ballinger concurred that was correct. Attorney Ballinger than reviewed the City's regulation. Mayor Ayres questioned how to get to a place where this owner could sell his house. Attorney Ballinger commented that would be a Council policy decision. Vice Mayor Carlson-Buydos questioned what other cities besides Hemet do in these situations. Attorney Ballinger remarked that it is a good tool but how often it is used is unknown. He believes the City should not relinquish the tool. Vice Mayor Carlson-Buydos noted that she would be willing to look at single family but not multifamily and would like to know the areas that would be relinquished. City Council consensus was to bring it back in 30 days and propose a hybrid, if that is possible. 5. Ms Cope address the Council briefly on: 1) Operation Clean Sweep — a ticket equivalent to a traffic citation can be issued to students for things like graffiti. It is to make students accountable for their actions. Council consensus is needed to implement 2) Each needs to review the other's General Plan. Discussion of where schools are being designated would be helpful. 3) The community is involved in the schools. It shows, including test scores are up. The press has had several articles on the homeless condition. Social Services is going to do another survey. He noted the problem is delicate and not sure everyone is going to be happy with the outcome. Council Member Stubblefield noted WRCOG was dark and the next meeting on February 2nd will be followed by the first JPA. The water committee met and the water subcommittee will be meeting shortly to bring back recommendations. Vice Mayor Carlson-Buydos commented VEDC met on 1/21/04. The draft strategic plan has been received and she believes VEDC is moving towards what it needs to be doing. On 2/11/04 is VEDC's General Membership meeting at the Hemet Library. Dinner is served at 5:30. She would like to see the full council there. Mayor Ayres noted the passing of the oldest San Jacinto resident. Roy Waters missed his 100th birthday by a few months: He was one of the Grand Marshals at the 2003 4th of July Parade. Also, the president of the American Legion Post 848 and long time resident, Bob Moffat, passed away this past week. Services will be at the McWayne Funeral Home on Saturday. BACKGROUND: Stetson Engineering is under contract to design the plans and specifications for construction of Lake Park Drive Well proposed at the northeast corner of Ramona Expressway and Lake Park Drive within the City's property immediately adjacent to the road. This property is the result of right-of-way exchange between EMWD and the City of San Jacinto due to construction of Lake Park Drive Bridge. EMWD will have to record the necessary documents to transfer the property to the City; their staff has been in communication with City Manager and myself indicating their concurrence with the well location. The extension of waterline along Main Street from Camino Los Banos to the well was anticipated to be included in the Main Street Pavement Rehabilitation project. However, recently staff was directed to include the waterline with the well project. To merge the waterline and the well project, we respectfully request that the Council authorize bid advertisement after completion of final design and specifications expected within two to three weeks. Appro City Manager: Finance Director: Page 1 of 2 According to the attached memorandum from Finance Director dated January 13, 2004, $1,871,485.00 is currently available in combined water funds. On January 22, 2004, City Council authorized construction of Sixth Street and Mistletoe Avenue Waterline Replacement and Upgrades at an estimated cost of $430,000.00, leaving a balance of approximately $1,330,000.00. Stetson Engineer's estimate for the well was $920,000.00, the estimated cost for Main Street Waterline is $400,000.00. JUSTIFICATION: Ensure availability of reliable source of water to the residents within the City's Water Service Area at a reasonable cost. BUDGETARY IMPACT: Adequate funds are available from 1997 San Jacinto Water Improvement Bonds and 2002 Water Revenue Refunding Bonds, as well as water capital improvement fund (Project No. 02-022). RECOMMENDATION: By motion, 1) Approve Final Tract Maps 30462 and 30462-1; 2) and authorize the City Manager to execute the subdivision agreement. BACKGROUND: Tentative Tract Map 30462 is a 212 single family lot subdivision on 60.15 acres, located at the southeast corner for Sanderson Avenue and Seventh Street. This subdivision is being recorded in two final tract maps; Final Tract Map 30462 encompasses 109-lots, and Final Tract Map 30462-1 encompasses 103-lots. The improvement plans associated with this subdivision have been approved and construction of infrastructure is under way. Adequate bonds, including landscaping improvements, have been provided to ensure installation of the required improvements. Additionally, on October 2, 2003, the entire area of Tract 30462 was annexed to the City's Landscaping, Lighting, and Park District No. 2, and on November 6, 2003, this project was annexed to the City's Community Facilities District 2003-01 for Police and Fire Protection. JUSTIFICATION Final Tract Maps 30462 and 30462-1 have substantially complied with the requirements of the Subdivision Map Act and the City of San Jacinto Subdivision Ordinance. Appropriate securities to complete the offsite improvements have been posted with the City and are part of the subdivision agreement. BACKGROUND: On November 20, 2003, Council authorized staff to advertise for construction of Ramona Boulevard/Sanderson Avenue Waterline Installation. Bids opened on January 26, 2004, with six bids received ranging from $385,450.00 to $908,020.00. (staffs estimate is $700,000.00). This project is Phase II of De Anza Lift Station, Gravity Sewer, Force Main, and Water Main, which includes installation of approximately 11,800 L.F. of 12" waterline along Sanderson Avenue and Ramona Boulevard. As you may be aware, partial installation of waterline was done in conjunction with Phase I of this project. With the installation of this waterline, the system will be operational and property owners will be able to connect to this new system. Due to the considerable difference in bid costs received, staff and EMWD have contacted Utah Pacific Construction Company to confirm their bid. We are also memorializing our conversation with both EMWD and the contractor as to minimize future misunderstandings. Council Members Shaw has suggested using development agreement fee moneys to paint City Hall. Certainly, these funds can be used in any way the Council sees fit. They are considered general fund unrestricted moneys. I have recommended to Council to use these funds for our deficit situation. However, the Council has declined the recommendation and has asked for a report back on how to use these moneys in relation to the specific traffic and road issues surrounding the developments that generated the money. It is estimated that this staff report shall come before the City Council at the second meeting in February along with the mid -year budget report. This is the current time frame goal. I would not recommend to the Council that we use these funds for the painting of City Hall, due to our financial position. JUSTIFICATION: Enhance the aesthetics of our newly renovated Downtown area. BUDGETARY IMPACT: The estimated cost of painting City Hall is between $4,000 and $5,000.00. This includes some stucco work.
