AGENDA ITEM 4.1 March 15, 2001 TO: The Honorable City Council FROM: Habib Motlagh, City Engi er SUBJECT: Millennium Bridge at Soboba — Construction Management Change Order No. 1 RECOMMENDATION By motion, approve Change Order No. 1, for the sum of not to exceed $78,189.00. BACKGROUND Parsons Brinckerhoff Construction Services (PB) contract was approved by City Council on February 3, 2000. Over the past fourteen months, PB has and continues to provide the construction management and inspection services for this bridge. As the Council is aware, the bridge was opened to traffic in December 2000, well ahead of the anticipated scheduled, and the construction change orders have been kept to minimal. Mr. Barnett in his attached letter dated February 26, 2001, has provided his firm's justification for the requested change order. Page 3 of Mr. Barnett's letter summarizes the breakdown of cost by task and sub - consultants. Based on the remaining work, which includes preparation of "as built," drawings, negotiations with contractor to finalize the contractor's work, coordination with Army Corp of Engineers, and LSA (City's environmental consultant), preparation and processing of final report to Caltrans, EMWD, Flood Control, and Army Corp of Engineers, an estimated 150 hours of Mr. Faqih (resident engineer) would have to be allocated to complete these tasks. The cost of Mr. Faqih's time is included in the $78,189.00. Although, the construction is complete, PB and MCM (contractor) have to continue their work until the City receives final approval by all agencies. One obstacle to finalizing this project is the fact that the contractor without City's knowledge, excavated the riverbed beyond locations approved by the Army Corp of Engineers. The original permit requires the City maintain the disturbed area for three years. Since the contractor excavated beyond these limits, City staff is negotiating a mitigation agreement with Army Corp. of Engineers. The contractor should be responsible for expenses related to this work including the maintenance period. Enclosed for the Council's review is a breakdown of expenditures and expected revenues as of March 1, 2001. As shown on page 3 of this report, staff has allocated $145,000 for three year monitoring of the disturbed area included in the original permit, and $75,000 for the cost of the bridge monument sign and landscaping. It should be noted that some of the numbers shown on this report are best estimates and are subject to change. The Council is also aware of the recent negotiations and discussions with BIA for an additional $350,000 in grant funds. This figure is not included in the revenue summary shown on sheet 3 since the City has not received the final confirmation from BIA as of the date of this report. JUSTIFICATION Please refer to attached letter from PB dated February 26, 2001. BUDGETARY IMPACT See attached breakdown dated March 01, 2001. ATTACHMENTS 1. PB letter dated February 26, 2001 2. Contract Change Order Summary dated March 1, 2001 MRR.11.1995 2:12AM NO.155 P.2/4 "-WO KAROO Mr. Habib Motlagh City Engineer City of San Jacinto 201 East Main Street San Jacinto, CA 92583 Parsons Brinckerhoff 505 South M81n Street Suite 900 Orange, CA 92868-4529 714-973-4880 Fax: 714.973-4918 February 26, 2001 Main Street Bridge Project Subject: Request for Contract Amendment for the Millenium Bridge at Soboba Project Dear Mr. Motlagh, Parsons Brinckerhoff Construction Services, Inc. (PB) has been pleased to work with the City of San Jacinto on this challenging and fulfilling project over the last year. We have managed to keep the project on schedule in spite of a number of issues that have come up, and were very pleased to be able to attend the opening festivities as scheduled on December 2, 2000. As we discussed with yourself and Mr. Wager on February 23, 2001, the project costs have increased due to an extension of project time, and the costs for material testing and surveying have increased to cover the impacts resulting from changes in construction methodology not foreseent at the beginning of the project, Each of these situations is discussed in detail below, Construction Changes The following issues, not anticipated in the original scope of work, include: • Surveying a new route for relocation of power poles, and verification of the Right of Way limits for these same power poles, • The failed piles at Bent 7N and 8S required the re -staking of abutments and bent footings, surveying for footing and H-pile locations, and additional material testing of both concrete and backfill compaction. • The Osborn project waterline extension require additional surveying in two stages. • The staged construction of approach embankments, which essentially split the project in half to complete the abutment fills while maintaining traffic along Lake Park Drive, required additional surveying and doubled the number of compaction tests required in the embankments. • Detour and staged construction for the eastern approach to the bridge were not included In the project plans, and the strategy to complete this work without additional project costs was not acceptable to the Soboba Indian Reservation. • We also provided additional material testing to accommodate the Osborn connection and the EMWD water line tie-in (while under traffic control) at the east end of the project Over a Century of Engineering Excellence MRR.11.1995 2:12RM NO.155 P.3/4 kgM 00 ,vnas.+ .Extension of Project Time The original contract signed on February 3, 2000 allowed for up to twelve months of service, and the original PB cost proposal covered the period from December 13, 1999 to January 24, 2001. As you are aware, we utilized the unforeseen utility relocation period at the beginning of the project to perform submittal review and preparation work which allowed our team to respond rapidly and resolve issues as they come up when the project began in earnest, thereby leveraging the contract time for the heaviest construction periods. The project is now complete with the exception of execution of the Final Progress Pay Estimate, environmental issues, and resolution of outstanding issues with the Construction Contractor, We have included enough hours for our Resident Engineer in our request for contract amendment to cover the resolution of these issues through approximately the end of March on a part-time as -needed basis. If you require any additional clarification, please do not hesitate to contact me at (714) 973-4880. Sincerely. PARSONS RRINCKERHOFF CONSTRUCTION SERVICES, INC. BACKGROUND The grading of Phase I of this project has been completed for several months. The applicant has diligently worked with adjacent property owners (Golf Course) to resolve the drainage issues. Currently the plans are ready for our approval subject to payment of inspection fees, posting of adequate bonds, and receipt of a grading and drainage easement from Mr. Pirelli who owns the property on the east side of Soboba Road. According to the attached letter from Mr. Osborne, the developer is requesting deferral of offsite improvements along Soboba Road until completion of units 1-69 of Phase I or 18 months after recordation of Tract 28998-1, whichever occurs first. A separate bond on forms acceptable to City Attorney will have to be posted to insure completion of Soboba Road improvements. The bond shall include the cost of all required improvements such as curb, gutter, sidewalk, new paving, striping, streetlights, and the remainder of landscaping. It should be noted that in Phase I, some of the drainage facilities must be installed under Soboba Road to accept and properly convey the offsite runoff contributed from Mr. Pirelli's property. Also, there are several existing poles along Lake Park Drive both on the north and south sides of the street. Our current undergrounding ordinance requires developers to underground the poles fronting their project. Based on my meetings with Mr. Torres of SCE, the cost to relocate four poles fronting this project is much higher than normal, due to the fact that SCE currently has special facilities on one of these poles, which makes it more expensive to relocate. If the four poles fronting Mr. Osborne's property are relocated to the north side, the City at some future date could use the City's undergrounding funds to eventually remove and underground all poles on Lake Park Drive. JUSTIFICATION To facilitate the timely development of this project, and the developer is proposing to complete the improvements on Lake Park Drive beyond Phase I boundary. BUDGETARY IMPACT Future impact to the City's Underground Facilities Account (Fund 38), to underground the existing and proposed poles along Lake Park Drive. ATTACHMENTS 1. Exhibit gagew BUILDERS • DEVELOPERS Fax Letter — 2 Pages Fax No. 909/654-9896 February 20, 2001 Habib Motlagh City Engineer City of San Jacinto 201 East Main Street San Jacinto, CA 92583 Subject: SOBOBA TR. 28998-1 Dear Habib: In accordance with our recent discussions and the City's desire to complete all improvements on Lakepark Drive, I would like to again propose that Osborne Development Corp. in conjunction with the improvements of Lakepark Drive fronting Tr. 28998-1 that we also improve the balance of Lakepark Drive in front of Tr. 28998. As you are aware, we will not be building Tr. 28998 until a later date so we will have no construction funds available for that section of street, nor will we have a map recorded for Tr. 28998. However, what I am proposing is that instead of completing the improvements on Soboba Road at this time that we go forward with the construction of the perimeter wall along Soboba Road and the planting of irrigated vines down to the end of our first phase of 69 lots. Then, with the construction of Phase II, we would complete the wall along the entire length of Soboba Road along with the required improvements i.e. curb, gutter, paving, landscaping etc. I feel this will result in a win -win situation for both the City and Osborne Development Corp. as I agree the look along Lakepark Dr. is important. Furthermore, a bond could be posted by Osborne Development Corp. and conditioned for the improvements along Soboba Road to be installed either upon the completion of Phase I — 69 Units, or 18 months, whichever comes first. I would also like to confirm our desire to relocate the power poles that currently exist on the eastside of Lakepark Drive to the westside of Lakepark Drive and pay all Edison costs involved with same. As you are aware, because of Edison's relay boxes, the cost to underground those poles and relocate their relays could exceed $300,000. 30001 Comercio • Rancho Santa Margarita, California 92688 • (949) 888-3822 • FAX (949) 888-3820 £00/z00d SZ8'ON 968E 17S9 606 F IN3Wd013f1312 3N2108SO bE:LS L0/S0/£0 Habib Motlagh Fax Letter February 20, 2001 Page 2 of 2 As it is, the cost to relocate the poles is somewhere near $50,000. This will result in the poles that were just relocated by the City in conjunction with the bridge construction all being located on the westside of Lakepark Drive. This will result in a well -manicured look on the eastside of Lakepark Dr. and at a reasonable cost to do satne. i hope these items can be addressed and resolved quickly as we are most anxious to move forward with the project. BACKGROUND: This project was added to Fiscal Year 2000-2001 budget via a reprogramming action on November 16, 2000. The work includes the installation of 1,980 linear feet of 6.5 foot high wrought iron fencing and eight 20 x 6.5 foot high swing gates, also of wrought iron. This project would provide needed security fencing and enhance the appearance of the facility. For your information, the item is being bid as a design/build project. A design/build project requires each bidder to submit a design for the project as part of their bid. One or more Council members have expressed the desire to include block or brick pilasters as part of the design either flanking the main entry gates or regularly spaced throughout the fence design. If the Council would like to see block or brick pilasters included, a modification to the bid schedule or an alternate bid schedule can be prepared prior to bid advertisement. The alternate bid schedule would allow for the bid to include costs for the fence either with or without pilasters. A copy of the bid documents and specifications is available at the City Clerk's office for Council's review and comment. On February 21, 2001 the Riverside County EDA authorized bid advertisement and on February 27, 2001 the City Attorney indicated legal sufficiency. In the event the Council authorizes bid advertisement, bid opening will occur on April 16, 2001. JUSTIFICATION: This activity is identified as a Council priority in the Implementation Plan regarding the continued improvements to the Estudillo Mansion. In addition, the improvements will provide the necessary security fencing for the facility. BUDGETARY IMPACT: On November 16, 2000 the Council reprogrammed $106,392.45 in CDBG funds to the Estudillo Mansion. MEMORANDUM March 1, 2001 TO: Tim Hults, Planning Director FROM: Grace Alvarez, Administrative Assistant to the City Manager SUBJECT: ESTUDILLO MANSION SECURITY FENCING — BID SPECIFICATIONS Enclosed, please find a complete set of the approved bid specifications for Estudillo Mansion Security Fencing. Also enclosed is Riverside County Economic Development Agency approval of the document and authorization to proceed with bid advertisement, as well as Best, Best, and Krieger letter of legal sufficiency. This item is now ready for Council approval, and we should be ready to agendize this item for March 15, 2001. Based on this Council action date, I have chosen April 16, 2001 as the bid opening and a mandatory pre -bid meeting at the Mansion for April 2, 2001. Looking forward to assist you with this project. Should you have any questions please feel free to call. Very truly yours, Malathy Subramanian for Best Best & Krieger LLP City Attorney City of San Jacinto cc. John F. Wager, Jr,, City Manager RVPUB\MXS 608062 March 6, 2001 AGENDA ITEM 4.4 TO: The Honorable City Council FROM: Bernie SimoiY, Finance Director SUBJECT: Review of Assessment Lighting, Landscaping, Park District No.1 (LLPD) Options RECOMMENDATION: By motion: 1) Continue General Fund subsidy and Gas Tax Fund subsidy of San Jacinto Lighting, Landscaping Park District No. 1 through fiscal year the FY 2001-2002 Property Tax Roll. 2) Create an Ad Hoc Committee to study and make a recommendation for the separation of the Rancho San Jacinto area subdivisions from LLPD #1 and create a new Rancho San Jacinto Prop 218 Assessment District. BACKGROUND: The Assessment District is divided among six zones with assessments involving over 8,500 individual parcels. Zone A-1 Zone A-2 Zone A-3 Zone B Zone C Zone D City Wide Landscaping Soboba Springs Landscaping Rancho San Jacinto Landscaping Street Lighting No Street Lights Park Zone LLMD Park District #1 is a pre -proposition 218 assessment district, under which assessment districts cannot raise the amount of the assessment to the property owners without a vote of the property owners. Under position 218, passed by the voters in 1996, an assessment that is charged to all property owners would require a 50% + affirmative ballots, of all ballots cast, based on the dollar amount of assessments. Costs charged to the individual zones with combined costs allocated based on best use estimate. Revenue has historically not been identified by Zone. It is reported by percentage assessed. Therefore, we are unable to identify actual receipts from each zone. Page 2 This coming year Staff will request the County to separate each Zone into a fund for assessment revenue reporting purposes. LLMD Park District #1 currently has approximately a $212,000 deficit that is being made up with General Fund and Gas Tax Fund subsidy. Staff is aware of the City Council's concern regarding the General Fund and Gas Tax Fund Subsidy. Additional Gas Tax Fund subsidy could be taken for right of way maintenance. However, this would only leave less money available for the maintenance and refurbishments of city streets. Options that Staff has looked at are: A. Continue LLMD Park Assessment District subsidy; Budget a continuing subsidy from the General Fund on the theory that it benefits the entire City. Some Cities budget all of their citywide landscape, lighting and median area maintenance from the General Fund or in a combination with the Gas Tax Fund. B. Decrease costs everywhere to match assessment revenues; Reduce landscaping maintenance district wide and lighting costs within the district to match the available revenues generated by the zones within the district. Staff would have to come up with a reduction plan to advise Council of what would be reduced or eliminated. C. Increase all Assessments within the district; Eventually, newly developed properties will increase the revenue base within the district. However, this will also increase the demand for services within the district. The only way assessments can be raised is by an affirmative assessment ballot tabulation of 50% +, by dollar amount. An assessment ballot would be done by mail. If we raise assessments for just one of the zones, we would have to create a new Prop 218 assessment district for only that zone. D. Carve out Rancho San Jacinto into its own Prop 218 assessment district; Because Rancho San Jacinto is a unique area within the City, the landscaped medians, landscaped right of way areas, lighted walkways, drainage areas and park areas are in the greatest need of resources within the district and the City of San Jacinto. If the theory is that those living in Rancho San Jacinto are receiving the greatest benefit of the maintenance areas of Rancho San Jacinto; then it follows that the property owners of Rancho San Jacinto should pay for the costs of the majority or all of the maintenance in Rancho San Jacinto. The new district should have a limited annual CPI cost escalator. Page 3 E. Create a whole new Prop 218 assessment district that adds a CPI escalator; Create a new Prop 218 assessment district that has a limited annual CPI escalator. This would solve part of the problem of increasing costs. This would also require an assessment ballot. It is too late to make changes for this coming property year tax roll (FY 2001-002). Therefore, we are only looking at changes beginning with the property year tax roll FY 2002-2003. Staff has included the last four years of actual costs for the assessment district and Budgeted costs for this year. BUDGETARY IMPACT: There is no budgetary impact. This is a discussion item only. ORGANIZATION Mayor Patrick Williams called the Regular Meeting of the City Council to order at 7:02 p.m. with the following members present: Ayres, Carlson-Buydos, Good, Williams Invocation by Pastor Donald Owens, 1st Presbyterian Church, Hemet The Pledge of Allegiance was led by Vice Mayor Jim Ayres. City Engineer Habib Motlagh introduced Brett Barnett, and Wael Faqih of Parsons -Brinkerhoff, Project Managers for the Construction of the Millennium Bridge at Soboba. Mayor Williams and Vice Mayor Ayres presented them with a framed photograph of the Millennium Bridge at Soboba, as well as individual Certificates of Appreciation for their outstanding job at managing the construction of the Bridge within budget and on schedule. A certificate was also presented to Steven Goldsmith, Assistant Resident Engineer, who was not able to be present. William D. Tibbitts of the Eastern Municipal Water District introduced Peter Odencrans of the EMWD and a resident of the City of San Jacinto, to present to the City a Certificate of Merit recognizing the efforts of staff and council in encouraging development of water resources for the benefit of the residents of San Jacinto. Mayor Williams accepted the Certificiate and recognized the work of Public Works Superintendent Bob Lavin and his crew for making this happen. City Attorney Marco Martinez announced the addition of two emergency items to the City Council Agenda as follows: Add Consent Calendar Item 5.7 — Approve Resolution Appointing City Manager Jake Wager and Finance Director Bernie Simon as Agency Negotiators for Property Identified as APN No. 437072011-5 Justification pursuant to 54954.2(b)(2) Minutes — City Council Regular Meeting March 1, 2001 Page 2 1) Need to take action immediate — Agency must begin negotiations with County of Riverside prior to the next Council meeting; 2) Need arose after posting of the agenda — City received correspondence yesterday from the County of Riverside, which is the other negotiating party, of the need to formally designate by City Council action the City's negotiators. M/S/C (Carlson-Buydos, Conner) to amend the agenda to add Item 5.7 as stated. Ayes: Ayres, Carlson-Buydos, Conner, Good, Williams Noes: None Add as Closed Session Item No. 7.3 — Conference with Legal Counsel — Existing Litigation, pursuant to Government Code Section 54956.9(a), Case Name: City of San Jacinto v. Ismael Ochoa (Case No. CSMCSARB 00-0236) Justification pursuant to 54954.2(b)(2) 1) Need to take action immediately — The window for negotiating a settlement without incurring additional costs and penalties occurs prior to the next City Council meeting on March 15, 2001 2) Need arose after posting of the agenda — The City's legal counsel received such notice from the Arbitrator and City staff put together a possible settlement package after the posting of the agenda for consideration. M/S/C (Carlson-Buydos, Ayres) to amend the agenda to add Item 7.3 as stated. Ayes: Ayres, Carlson-Buydos, Conner, Good, Williams Noes: None 2. PUBLIC COMMENTS — None. 3. PUBLIC HEARINGS At the request of Mayor Williams, and in consideration of the large number of individuals in the audience for this item, the Public Hearing on the Valley Transfer Station, Item 3.2, was consider before Item 3.1, Public Hearing on the Nextel Conditional Use Permit. 3.1 Public Hearing — Appeal of Denial of Conditional Use Permit for Valley Transfer Mayor Williams invited Planning Consultant John Freeman to present the staff report. Mr. Freeman reviewed the process of the application through Minutes — City Council Regular Meeting March 1, 2001 Page 3 the Planning Commission, which denied the Conditional Use Permit by a vote of 3-2 on March 2, 2001. Tonight's public hearing is to consider the appeal of the decision of the Planning Commission by the applicant. City Attorney Marco Martinez explained that tonight's hearing is a hearing de novo meaning it is brand new. The Council must consider the decision of the Planning Commission, but is not bound by its decision. The Council may act on a resolution affirming the Planning Commissions Denial, by adopting Resolution A, or may approve the project with suggested findings by adopting Resolution B, or it may continue the hearing for additional information. Mr. Freeman introduced Laurie Holk, County of Riverside Health Services Agency, Department of Environmental Health, that serves as the Local Solid Waste Management Agency (LEA) for the City of San Jacinto, acts as the permitting agency, and provides oversight of such facilities. She presented an overhead presentation regarding the permitting, regulatory and enforcement responsibilities of the LEA and responded to Council questions. In response to Council questioning, Ms. Hulk responded: • Regarding permitting, if and when local land use approval is obtained, approvals from the Water Quality Board, the Air Quality Board, Toxics Control, and other agencies will be processed concurrently. Any conditions placed on the facility will be combined and integrated with the final permit that is issued by the LEA. • Regarding enforcement of regulations, most similar facilities in the County are fairly well regulated; if a citation is issued for problems common to these types of facilities, such as litter or acceptance of unauthorized materials, compliance has occurred in a timely manner. In fact, the need for an enforcement letter has been rare and a permit has never been revoked. • If there were to be problems with enforcement, the City would be notified, particularly if a conditional use violation occurs as the City has jurisdiction over those issues. The Agency tries to be the eyes and ears for all jurisdictions. If the City were to revoke the facility's Conditional Use Permit because of non-compliance, the Permit to operate would be null and void. • Citizen complaints are responded to with an inspection. Minutes — City Council Regular Meeting March 1, 2001 Page 4 • Ms. Holk will verify information on the Lamb Canyon Landfill, but estimated the landfill currently takes about 1200 tons a day and there are plans for expansion of the facility in the near future. Councilmembers Good and Conner reported on their tour of three transfer stations. Councilmember Good noticed excessive noise and that trucks going in and out of the facilities were very messy. Councilmember Conner questioned whether the sewer waste coming out of Orange County could end up in San Jacinto and was assured that the proposed facility would take no human waste nor would there be any sludge applications permitted. Mayor Williams opened the Public Hearing at 7:45 p.m. Applicant John Petty was invited to describe his project and respond to questions raised during the staff report. Mr. Petty assured the Council that the proposed material recovery and transfer station will only accept municipal solid waste, green waste, and co -mingled recyclables. He stressed no animal waste nor sludge processing would be part of the facility's operation. Although the facility would be permitted to process up to 600 tons per day, he expected no more than 200 tons per day for many years. In response to concerns about noise from the facility, Mr. Petty noted that the conditions of approval set decibels levels both at the property line and at the property of the nearest residents. Mr. Petty proceeded with a power point presentation describing the proposed facility, its location and a description of adjoining sites, the typical operation of a transfer station, and the zoning. Mr. Petty's presentation included photographs illustrating the intensive industrial use of adjoining properties Mr. Petty described the current truck traffic through the city to the Lamb Canyon Landfill. With the Transfer Station, the annual miles traveled through the city will be reduced by approximately two-thirds. In addition, Mr. Petty committed to working with the City on a preferred route. He added that by using Esplanade, transfer trucks would be traveling 50% of the time on City of Hemet Streets. Mr. Petty addressed concerns expressed regarding odor mitigation. The facility has been oriented on the site so that the prevailing winds go against the solid side of the building. Conditions imposed require moving Minutes — City Council Regular Meeting March 1, 2001 Page 5 trash out within 48 hours, the transfer of green waste daily, and daily cleaning of the grounds. In summary, Mr. Petty asked for the Council's approval of his Conditional Use Permit to site a regional facility of benefit to the entire San Jacinto valley. There will be opportunity for potential cost savings to San Jacinto ratepayers, recycling to better comply with 8939 guidelines, and a deposit site for household hazardous waste, thereby discouraging illegal dumping and harm to the environment. Mr. Petty responded to Council questions relating to noise, tonnage, benefits to the local industry, future expansion possibilities, and proposed routes and number of trips by trucks in and out of the facility. Mr. Petty again assured the Council he would work with the City to select the most desirable routing of trucks, including Warren Road if appropriate. Mr. Petty further spoke to benefits of the facility at this location including a substantial reduction in truck traffic through the city and air quality improvements by a reduction in diesel emissions. Mr. Petty also agreed to proceed with good faith negotiation and committed to paying his fair share of any identified impact to the city's infrastructure. City Attorney Martinez explained the difference between a mitigation fee and a host fee which cannot be imposed unless the applicant agrees to it. Mr. Petty indicated that the facility would bring approximately 10 full-time jobs to the City and would generate approximately $15,000 annually in tax revenue to the City. Mayor Williams opened the Public Hearing for Project Proponents Thomas Palmiere, 385 W. Esplanade, spoke in support of the Transfer Station, a multi -million dollar facility that will bring jobs and economic growth to the City. He noted the applicant has agreed to meet all conditions imposed by the City. He stated his belief that this is a pro - business and pro -progress project. Scott Neely, 1122 S. State Street, San Jacinto, reported on the number of trucks that already travel down that street. He supported having a green waste facility in the city. He added that the transfer station will provide jobs and help the city grow and will actually add to the beautification of the street. He noted that he currently resides 1/2 block from the proposed facility at Best Lumber Materials and has been to other Transfer Stations. Minutes — City Council Regular Meeting March 1, 2001 Page 6 David Brown, 5001 West Florida, Hemet, stated that he is an employee of one of the principals involved in the proposed project. He shared his background working with community groups on solid waste issues and his opinion that transfer stations are the best way to efficiently and cleanly deal with these issues — they don't smell, are not dirty, do not generate trash, are not a breeding ground for rats, and will reduce the volume of truck traffic the city now experiences. Mayor Williams opened the Public Hearing for Project Opponents Lupe Florez, 229 N. Wateka, stated she was also pro -growth and believes in recycling, but was opposed to the proposed location for this facility. The $15,000 estimated revenue will not be enough to compensate for damage to our streets from these trucks. She also did not believe that trucks would be able to safely negotiate turns onto the streets they will be entering. She suggested this facility be sited on the outskirts of the San Jacinto area. William Havens, 1481 Drummer Circle, spoke representing American Village and the over 200 residents who signed a petition opposing this project. He questioned the economic viability of the facility, with only one contract with the City of Hemet. Gene Hutcheson, 829 Horizon Court, speaking in opposition, discussed proposed routing, the damage to our streets by trucks that weight 27 tons, the potential cost to our City in maintaining these streets, and concluded there will be no financial benefit to the City from this facility. Pepper Renshaw, 600 W. Esplanade, supported establishing a transfer facility in the San Jacinto Valley, but not at the proposed location. She also questioned the amount of truck traffic this will generate, proposed routing, potential damage to streets, and questioned the traffic study submitted. She also questioned the impact on her business, which has a payroll of 100 employees, when a dump is located across the street. Chad Spates, 1280 S. Buena Vista, representing Hawaiian Popcom, stated his strong opposition to the current proposed location for this type of business. He petitioned the Council to carefully consider the impact this will have on our industrial neighborhood and noted that the majority of the existing businesses do not want a trash transfer station next to their facilities. Peter Demyan, Superintendent of the San Jacinto Unified School District, read a prepared statement in opposition to the project, which was submitted for the record. His statement concluded that the location is a Minutes — City Council Regular Meeting March 1, 2001 Page 7 bad idea based on future use, and there would be better access through the City of Hemet. Roger Van Doren,1690 Juanita, who operates a business directly across the street from the proposed facility, stated his opposition because of traffic and possibly the decline in property values. He also questioned the impact on the health of residents, with odors and breeding of rodents. David Bowman, 1350 S. State Street, owner of the Valley Industrial Park, expressed concerns about the impact of a transfer station in this area on future rentals of his industrial park. As a trucker and the owner of 22 trucks, he questioned the ability of a 53-foot trailer to make a left-hand turn onto Esplanade off of Juanita. There being no additional public comment, Mayor Williams invited rebuttal from the project applicant. Mr. Petty introduced Susan O'Rourke, of O'Rourke Engineering in Carlsbad, who responded to concerns raised relating to traffic and number of trips during peak hours. She noted that the roads on which these trucks will travel are designed for industrial use. Ms. O'Rourke responded to questions of Councilmember Conner related to the estimated truck loads during peak periods. Councilmember Carlson-Buydos requested more information regarding the roadway plan, roadway design to assure they will accommodate the added weight, and an analysis of turning radius required. In closing, Mr. Petty assured Council that this Council would not be detrimental to the City and all issues raised will be addressed and mitigated. In response to a question by Mayor Williams, Mr. Petty indicated he would be willing to submit appropriate bonds to protect the City; in addition his company will patrol adjacent streets for litter clean-up. Mayor Williams closed the Public Hearing at 9:42 p.m. Mayor Williams commented on the additional information requested by Councilmember Carlson-Buydos, the issues raised relating to mitigation, including the imposition of fees and bonding, if appropriate, and questions unanswered relating to the estimated life of the landfill and future needs for expansion. He asked for a motion to continue deliberation to the next Council meeting so that the additional information can be provided. Councilmember Carlson-Buydos asked for further dialogue regarding possible additional conditions that could be imposed to further mitigate citizen concerns. These included oversight, bonding, the possibility of Minutes — City Council Regular Meeting March 1, 2001 Page 8 establishing a host fee, and further review of the traffic issues raised. With proper mitigation, this project is an example of responsible development in an industrial area. Vice Mayor Ayres expressed his thanks to staff for the time and effort put into review of this proposed project. He expressed concerns relating the future probable expansion of the facility. He objected to the proposed location, noting the unanimous opposition to the project by residents of nearby Rancho San Jacinto. He cited the potential for road damage on Esplanade and Sanderson and the need to protect the investments made by the City in street, sewer and water line installations. He concluded that he supports the use of transfer stations as good facilities that help cities and the environment, but he does not support the location of the project proposed at Juanita Street. Councilmember Good concurred with the comments of Vice Mayor Ayers, particularly relating to proposed routes and future growth of the facility. She also noted that there is no way to measure the potential business we could lose because of the location of this facility. Councilmember Conner stressed that both he and Vice Mayor Ayers have worked hard to promote economic development in this valley. He acknowledged that the information presented and his tour of similar facilities in southern California, seems to support the contention that odor and rodents is not a problem at these types of facilities. However, in looking at the overall planning and benefit to this community, he did not support the proposed site and will not vote for the conditional use permit. Mayor Williams complimented Mr. Petty on his professionalism and willingness to work with the City to mitigate all concerns expressed. He added that, although this community may not support locating a transfer station at the proposed location, landfill and resource recovery are issues that must be dealt with, and material recovery facilities are the future. He suggested there will be objections by adjacent properties owners no mater where these facilities are sited. Regarding the proposed location of this project, Mayor Williams declared that the location is not in the middle of the City, but on its southernmost boundary. The location is in compliance with the City's General Plan that envisions most growth to the northwest quarter of the City. Mayor Williams also outlined the many plusses this project would bring including additional jobs and tax revenue. Mr. Freeman reviewed the Next request to install a 102-foot pole located at the sewer treatment facility on Sanderson Avenue which was originally approved by the Planning Commission. The City Council declined to ratify the Planning Commission approval requesting additional mitigation on height and stealthing. In response, Nextel has proposed locating the pole to the southern property line among a small stand off Eucalyptus trees, and to paint the pole brown to blend with the background. In addition, pole height could be limited to 80 feet if not planned for co -location in the future. There was considerable Council discussion regarding the stealthing proposed and other options that were available. There was general consensus that the proposal was not adequate. Preference was expressed for a pole disguised to look like a palm tree, and other amenities. Brian Viarra of Nextel was present to respond to Council questions and was uncertain of the economic viability of the pole if required to mitigate to the extent requested. Amendments include a provision for controlled outdoor fires by special permit only; the requirement for an on -duty City of San Jacinto Police Officer at events where alcohol is served; and clarification that a Special Event Permit is required, along with a detailed site and use plan for certain category users. Mayor Williams questioned the $75/hour charge for police presence and the regulations will be amended to time -and -a -half plus 25%. Mayor Williams invited public comment. Larry Shirts, 32643 Hwy 74, owner of Hearts Home Farm, testified regarding the proposed regulations. He supported the restoration of Estudillo Mansion and did not object to its use for civic and non-profit events. However, on behalf of his own business, and owners of other similar facilities in the area including Soboba, Crystal Cove, and Minutes — City Council Regular Meeting March 1, 2001 Page 11 Georgianne Farms, he objected to its use for private parties at a rate considerably under market, subsidized by public funds, undercutting private enterprise. Mr. Shirts informed the Council that his fee for private parties is $275.00 and hour compared to the proposed fee of $150 for three hours plus $40.00 for each hour thereafter. He also questioned the hours of operation, number of people allowed, zoning issues, and whether staff had conducted due diligence to notify property owners adjacent to the Mansion of this anticipated use. Based on his experience in the business, he listed potential issues that may arise including noise, non -approved use of alcohol, and potential liability. City Manager Wager noted that each application will be evaluated on a case -by -case basis as to hours of operation, staffing which may be required, and other controls that may be necessary. Staff will insure that the facility is properly regulated and supervised and will be sensitive to impacts on the neighborhood MIS/C (Carlson-Buydos, Good) to adopt Resolution No. 2279, Setting a Policy and Procedure for the Use of the Estudillo Mansion and Establishing Fees, amended to set the fee for police officers at time - and -a -half plus 25%, and a provision for private security for non- alcoholic events paid for by the applicant. Fact: That 60 feet into San Jacinto is nearly 3,560 into the area of Park Hill Elementary School in the San Jacinto Unified School District. If magnanimously moved by proposer (as "suggested") in planning hearing 120 feet south (into Hemet), TTS will still be 3,440 feet into school zone. If it could go 60 feet into Hemet, why is THAT not the proposal to Hemet? Even if granted by City of Hemet and moved 60 feet into Hemet, TTS would STILL be in the Park Hill ES attendance area. Assertion: TTS location can lighten traffic through San Jacinto and route it along Esplanade to Sanderson to RC Dump. Fact: Trash can now go up Acacia, Stetson or Johnston to Warren; down Warren to Ramona Expressway to Riverside County Dump. Assertion: Must be three miles beyond Hemet City Hall. Fact Part A. Three-mile limit was suggested by TTS's speculator/owner, not city of Hemet. Fact Part B. The "three mile" no TTS zone, takes the TTS just out of airport area east of Sanderson where access to Warren is very direct. From there it is an easy (with roads made for heavy traffic) turning and hauling to the RC Dump via Lambs Canyon Road. If it is so good for future economic development, why would Hemet pass on this opportunity to locate TTS there? Assertion: Travel of trucks along Esplanade to Sanderson to RC Dump not impacting on residences. Fact: This can only be true if you accept no growth. Area of traverse down Sanderson possible site of state approved elementary school #1 or a future elementary school in San Jacinto Unified SD. Double -long trucks are not safe for areas with children. Assertion: TTS only takes a small land area. Fact: When build -out complete in 20 years, San Jacinto (open land) will again be more populated (est. 110,000) than Hemet (land bound) is (est. at 85,000). The San Jacinto Valley population will near 200,000 (triple today's) and the TTS will also have to ti "in San Jacinto," if proposal accepted. Assertion: TTS fees will give San Jacinto about $15,000 yearly to repair roads that may be damaged by the trucks. Fact: A four -lane road costs about that amount to build per FOOT -- not at all adequate in trade for TTS location. "Fools gold," it's called up north. Bonus Fact: At a recent San Jacinto Rotary Club meeting, the code enforcer for Hemet City proudly touted Hemet's low income housing nearing completion at State and Menlo. He was totally "unaware" that development is in the San Jacinto USD. By the State's test results and 35 plus years of research, we KNOW children and parents/guardians living in poverty demand higher levels of resources to meet today's learning proficiency goal. The San Jacinto Unified School District was not consulted about the facility. We, in SJUSD, welcome all students, but need resources to allow each to attain high levels of success. Conclusion: Bad idea based on future use, better access through Hemet and TTS location in center of metropolitan San Jacinto Valley in about 20 years. Hemet can point out its Diamond Valley Lake to visitors. We in San Jacinto won't even have to point out our attraction. People will "smell" where to visit the Trash Transfer Station (AKA Da Dump). Recommendation: Dump the TTS. Protest the TTS until it is out of San Jacinto City AND out of the San Jacinto Unified School District. Tell Hemet, "no thank you." We had to discontinue garbage pick up service at the industrial park due to liquid garbage and hydraulic oil being Leaked all over the areas of the park , this will be the same smell and oil problems that will a be leaked around our streets that these trucks drive on. I traveled to Anaheim to look at the transfer station there, they have the same problems on their streets. The driver's of the garage and transfer trucks do not sweep off the back of their trucks after dumping each load leaving residue to be left on the streets around our area and from the dumps. Tommy Taylor Welding has welded and repaired these trucks in the past and can provide information that large amounts of residue are left to run out of these vehicles such as maggots and other stinking odors that would be offensive to every one any where close to the sewage disposal plant not in a area designed for businesses who employ as many people as in the Juanita and Esplanade area. Also this will be detrimental to industrial development in these areas. TIES INJURY COLLISIONS HAZARDOUS CITATIONS January 22, 2001 To The City of San Jacinto LAFCO Committee and Others Concerned: I served as City Councilman from 1980 through 1990 for the City of San Jacinto. On December 8, 1987, a motion was presented before Mayor Stuart, Councilmen Ford, Stevens, Redding and myself. The motion was made and approved to prepare a resolution of detachment from the city of San Jacinto and directed staff to do the paperwork and Mr. Pirelli not to have to pay for it. Mayor Stuart at that time pointed out to council that Mr. Pirelli was "missed" in due process, of the proposed annexation, and Mr. Pirelli agreed to allow the annexation to proceed and be finalized, not to hold up the balance or remaining annexation land. Mayor Stuart pointed out that Mr. Pirelli could have possibly slopped or hindered the annexation process, but upon City's request to allow the process to it's completion, and then allow the detachment process to occur, Mr. Pirelli agreed. The costs for any of the detachment were to be borne by the City of San Jacinto, due to it's "error" in procedure and certainly in appreciation of Mr. Pirelli's willingness and cooperation in the matter. Councilman Ford agreed. I am totally surprised that this did not get handled in due time. Mr. Pirelli was let to believe the matter was taken care of. To date, Mr. Pirelli's address bears a county address number, namely 22770 & 22850 Soboba Road, as has the entire time to date. Main Street San Jacinto, CA 92583 Subject: Detachment of parcel 3 to annexation No. 55 40' road easement on east side of proposed development Missing 36" pipe culvert across Soboba Road Unresolved flooding issues Honorable Mayor and Honorable City Council: Back in December of 1987 the San Jacinto Mayor and Council Members made and passed a motion regarding annexation No. 55 that city staff prepare a resolution of detachment of my property from the city limits of San Jacinto, with staff doing the paperwork and the city paying for all costs. Please see attached letter from then Councilman Marc Divine. I have met with Supervisor Jim Venable and his staff regarding some concerns I have. Supervisor Venable has spoken with San Jacinto Mayor Patrick Williams, and also Elaine Johnson of Mr. Venable's office has spoken with Vice Mayor Jim Ayres and they have assured me that all agree after review and investigation that my subject property at 22770 and 22850 Soboba Road be detached from the City of San Jacinto. I personally spoke with Mr. Tim Hults, city of San Jacinto in November, 2000. In this regard I expressed my concern that this matter of deannexation had not been taken care of and made my request that detachment be taken care of by the city. He expressed he would do some research, which he did, after which in our subsequent meeting he said that he would get it going. He was very helpful in helping me with other matters at that time, which had prompted my first visit. In other matters that need immediate attention; I have recently received partial plans for review and requests for easements on my property regarding the newly proposed housing development on the south side of Soboba Road, and east of Lake Park Drive. These proposals are not acceptable to me. I feel the county, specifically Riverside Flood Control and Riverside Road Department (Department of Transportation,) can best address issues regarding improvements to Soboba Road, flooding issues from the mountainous terrain along the northeast side of Soboba Road, proper drainage, now and for the future, for all property owners as well as for safety issues for travelers on Soboba Road and for new residents to come into this development. The Plans I recently received do not show or allow for my 40' recorded easement on the east side along the side of this new development property. There is still the removal (3 years ago) of a 36" culvert across Soboba Road by the city, which has still not been addressed. In summary, specific issues are: detachment, flood hazard protection and adequate development flow from upstream properties, and road easement provisions identified on plans. I would appreciate these matters resolved as soon as possible. Thank you.
