Ken Leahy, Treasurer CITY OF SAN JACINTO S A N [JACINTO TO: FROM: Rod Butler, Assistant to the City Manager Via: Pamela Easter, City Manager Staff Report Honorable Mayor and Members of the City Council DATE: August 15, 1995 RE: FISCAL YEAR 1995-96 SENIOR NUTRITION PROGRAM LEASE AGREEMENT FOR SAN JACINTO COMMUNITY CENTER Recommendation Approve the Fiscal Year 1995-96 Senior Nutrition Program lease agreement as presented and authorize the Mayor to execute it. Background The Riverside County Office on Aging leases a portion (approximately 1700 square feet) of the San Jacinto Community Center each year for use in its federally -funded Senior Nutrition Program. The community center dining room is used to serve approximately 40 seniors daily. Additionally, the kitchen is used to prepare 80 meals for home delivery each day. The proposed agreement for Fiscal Year 1995-96 contains the same basic components as last year's agreement. They are as follows: 1. Area of Building Covered --The agreement is limited to the kitchen and dining areas. 2. Approved Uses --The agreement specifically states that the leased premises shall be used only "to prepare and serve nutritionally sound meals to the elderly and to provide social and rehabilitative services on a daily basis...." 3. Hours --The agreement gives the County exclusive use of the kitchen and dining area from the hours of 10:00 a.m. to 2:00 p.m., Monday through Friday. 4. Term --The new lease will be retroactive to July 1, 1995 and will run through June 30, 1996. 1 41. 1I 5. Rent --The County will continue to pay the City of San Jacinto $250 monthly ($3,000 annually) for the use of the kitchen and dining area. This rental fee is deposited in the General Fund and partially offsets the costs of operating the community center. In the early part of 1996, staff will be reviewing the amount of the monthly rental charge with the goal of increasing it for the new lease that will begin on July 1, 1996. Increased utility costs, the City's upcoming investment of CDBG funds to upgrade the kitchen, and the need to cover "wear and tear" costs adequately are all justifications for a rent increase. Submitting a proposal to the Office on Aging in March of 1996 will provide plenty of time for its staff to respond before the County's FY 1996-97 budget is completed. 6. Utilities --As with the old agreement, the County will be responsible for paying for its own telephone services. The City pays for all other utilities. 7. Maintenance --The City retains the primary responsibility for maintenance of the facility, but the County is responsible for keeping the leased premises in a neat and sanitary condition. 8. Improvements --The proposed agreement requires the County to receive prior written approval from the City for any alterations, improvements, or installation of fixtures in this leased area. 9. Equipment and Supplies —The County is given the right to store necessary equipment and supplies within the leased premises. These items remain the property of the County. 10. Insurance --Obtaining property insurance coverage is the sole responsibility of the City of San Jacinto. 11. Option to Terminate --Either party may terminate the lease by giving 30 days notice, in writing, to the other party. 12. Responsibility for Damage or Negligence --The County "holds harmless" the City of San Jacinto for bodily injury or property damage resulting from the County's use of the building and agrees to repair, replace, or compensate the City for any damage to the property occasioned by the negligence of the County. Conclusion The Senior Nutrition Program at the community center has proven to be an important part of San Jacinto's overall outreach to the community's seniors. The lease agreement with the County protects the interests of both parties and has been an adequate document to handle any operational issues that have arisen in past few years. Staff recommends that it be approved as presented. 2 LEASE (Office on Aging - Nutrition Program) CITY OF SAN JACINTO , herein called Lessor, leases to the COUNTY OF RIVERSIDE, herein called County, the property described below upon the following terms and conditions: 1. Background The Riverside County Office on Aging administers federal grant money (Title IIIB) for local agencies who provide information and assistance programs to their senior citizens. The City of San Jacinto has participated in this grant program for a number of years in conjunction with its senior outreach program at the community center. The money that the City receives ($7,009 for Fiscal Year 1995-96) pays for half of the community center coordinator's salary and covers a corresponding portion of the time that she spends on various senior referral, information, and assistance activities. Each year the City is asked to sign a participation contract that enables San Jacinto to receive the grant money, which is paid out in twelve monthly installments. This year's agreement, which is similar in format and content to the agreement approved by the City Council for the FY 1994-95 grant, spells out the rights and responsibilities of each party. The reporting requirements contained in the contract are fulfilled through routine reports completed by the community center coordinator under the direction of the Assistant to the City Manager. The outreach, information, and referral services funded by the Title IIIB monies are essential components of the overall senior program in San Jacinto. Staff recommends that the Council approve the 1995-96 funding contract and the attached resolution which authorizes the City Manager to execute the agreement. i RESOLUTION NO. 95- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, DESIGNATING THE PERSON AUTHORIZED TO SIGN THE FISCAL YEAR 1995-96 INFORMATION AND ASSISTANCE CONTRACT WITH THE RIVERSIDE COUNTY OFFICE ON AGING. A notice of action pending has been recorded against each of the properties involved. I have requested quotes from Chicago Title for litigation guarantees on the above parcels. I will inform you of the costs prior to ordering the litigation guarantees. We have not yet filed an action against PR Equities pending investigation of the letter regarding the Radaeker bankruptcy. I understand from GFG that Mr. Radaeker was or is in partnership with Steve Peacock, who is somehow associated with PR Equities. I will keep you posted. Finally, we have requested that GFG prepare a summary of all delinquencies for the 94- 95 tax year that have not had prior foreclosure actions ordered. Considering the high delinquency rate in CFD No. 2, once the City has the list, we recommend you pass a resolution as quickly as possible to get the foreclosure actions started. Warren will be out of town from July 24 through August 9. If you have any questions during his absence, please feel free to contact me. Very Truly Yours, CELIA A. BREWER cc: Larry Weaver Jim Cox TO: STAFF REPORT Honorable Mayor and City Council Members FROM: Brian McNabb, Director of Community Development via Pamela S. Easter, City Manager DATE: August 15, 1995 SUBJECT: REPLACEMENT OF THE SUBDIVISION AGREEMENT FOR TRACT 23789 - SOUTHWEST CORNER OF EVANS STREET AND LAS ROSAS Applicant: Linway Development 3133 Goldsmith San Diego, CA 92106 NEIGHBORHOOD Rose Ranch RECOMMENDATION Upon the close of escrow between Gentra Capital (seller) and Linway Development (buyer) regarding the above referenced development, Staff recommends that the City Council: 1. Authorize Staff to prepare a replacement Subdivision Agreement for Tract 23789, for execution by the potential property owners and the City 2. Accept replacement bonds in the amount of $297,143, as follows: Performance/Labor and Materials of Street Improvements - $232,336 Monuments - $12,000 Water - $32,846 Sewer - $32,961 3. Release existing bonds in the amount of $479,843, as follows: Performance/Labor and Materials of Street Improvements - $232,336 Monuments - $12,000 Water - $32,846 Sewer - $32,961 Grading - $182,700 City Council Staff Report August 15, 1995 Page No. 2 DISCUSSION The subject site, a 113-lot recorded subdivision, is in escrow. The City is party to an executed (but expired) Subdivision Agreement with the seller for the infrastructure improvements related to the development of the site. Additionally, bonds in favor of the City in the amount of the needed improvements were posted initially by the original developer and are still in full force and effect. As a condition of escrow, the seller is requiring that their obligation for the bonds be removed. The developer that is in escrow for the purchase of the land is agreeable to replacing the existing bonds and executing a replacement Subdivision Agreement. However, the buyer is reluctant assume the obligation for the improvements until such time as escrow closes. Therefore, the buyer is requesting that the City Council allow for the execution of the Subdivision Agreement and the posting of replacement bonds at the close of escrow. At that time, the existing bonds would be released and the obligation of the bank to guarantee the improvements would be removed. In the event that escrow does not close, this action would be nullified and the existing bonds and improvement obligations would remain in effect. However, Staff would recommend that Gentra Capital be required to extend the Subdivision Agreement. CCRPT-95\23789AGM.AMD 106 C CR PT-95 \CUP 2-95. However, development of the site will increase the amount of impervious surfaces and incremental run-off from the site. Drainage improvements will be adequately constructed to accommodate the increased off -site flow. Additionally, the project will be subject to payment of the City of San Jacinto Regional Flood Control Mitigation Fees. 3. Main access to the project areas is available from several major arterial routes. The major arterial routes and the ultimate proposed rights of way are indicated below: San Jacinto Street Esplanade Avenue Commonwealth Avenue Hewitt Street Urban Arterial - 134 feet of ROW Major Arterial - 100 feet of ROW Secondary Street - 88 feet of ROW Secondary Street - 88 feet of ROW 4. The proposed Conditional Use Permit implements the goals of the General Plan and 2010 Strategy by providing additional opportunity for further commercial development to enhance the sales tax base, provides additional employment opportunities for City and Valley residents, and provides additional recreational activities. 5. The area uses consist of primarily of agricultural, commercial and residential related uses interspersed throughout the area. 6. The skate rink, combined the movie theater, will generate less than 200 peak hour vehicle trips per day. Therefore, it is not necessary to prepare and submit a Traffic Impact Analysis (TIA) to the Riverside County Transportation Commission (RCTC) for this project at the end of the year, as required by the previously adopted Negative Declaration for this site. 7. The proposed project will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. The site is appropriately designated and classified for the use, and includes improvements and access facilities designed and constructed to accommodate such activities. City Council Staff Report August 15, 1995 Page No. 3 8. The conditionally permitted use is commercial/recreational in nature and consistent with the General Plan and Zoning Ordinance. The facilities, when constructed, will implement the requirements of the City's General Plan, Zoning Ordinance, and federal and State Building and Access Codes. FIRE DEPARTMENT INCORPORATE HEREIN THE FIRE DEPARTMENTS CHECKLIST AGENDA AC STAFF REPORT TO: Chairman and Members of the Planning Commission FROM: Brian McNabb, Director of Community Development DATE: August 9, 1995 SUBJECT: PROJECT NO. 95-09 CONDITIONAL USE PERMIT 2-95 APPLICANT: FUN PROPERTIES, L.L.C. 12356 CENTRAL AVENUE CHINO, CA 91710 DESCRIPTION A proposal to construct a 24,000 square foot building to accommodate a skate rink and entertainment center with an additional 14,000 square foot outdoor skate rink on a 2.5 acre parcel. The site is located within the San Jacinto Valley Faire development, approximately 600 feet south of Esplanade Avenue, and 700 feet east of San Jacinto Avenue. The actual pad location is approximately 300 feet southwest of the Metro 12 theater building. EXHIBIT "A" EXISTING ZONING EXISTING SURROUNDING USES EXHIBIT "B" EXISTING CIRCULATION ELEMENT EXHIBIT "C" EXISTING GENERAL PLAN EXHIBIT "D" SITE PLAN EXHIBIT "E" FLOOR PLAN EXHIBIT "F" BUILDING ELEVATIONS BACKGROUND The property in question is included within the City's commercial Superblock/San Jacinto Valley Faire area. The Superblock/San Jacinto Valley Faire is identified as the best and most marketable area of the City for commercial development at this time. Existing development on the Superblock site includes the Stater Bros. market, Burger King Restaurant, and the newly opened Metro 12 Theater complex. Ultimately, the Superblock/San Jacinto Valley Faire site may have in excess of 250,000 square feet of commercial/entertainment use floor space. The construction of the skate rink/entertainment center is an additional component implementing the Superblock/San Jacinto Valley Faire master plan. Surrounding the Superblock/San Jacinto Valley Faire site are commercial, residential, agricultural and vacant land uses zoned commercial and residential. To the south is a combination of vacant land zoned for commercial and residential uses and 3 residences zoned R-2. To the west of the site is a small office complex, mobile home park and a used car sales facility. North of the site is land zoned for commercial, office and residential uses developed as follows: the Alpha Beta Center, Post Office, and the American Village residential community. East of the site is vacant land zoned for residential and/or professional office uses. ENVIRONMENTAL ANALYSIS A Negative Declaration was prepared and adopted in May, 1994, for the General Plan Amendment and Change of Zone action related to this parcel. The proposed development was considered by that environmental action. Therefore, pursuant to Section 15162 of the State California Environmental Quality Act (CEQA) Guidelines, no additional environmental action is necessary. The environmental review considered the following impacts, of which mitigation measures were established and have been included as conditions of approval for this project. Local and Regional Drainage The entire property is located in Zone "X" (unshaded), which is an area determined to be outside the 500-year flood plain. However, the project will generate site run-off, which is considered to be local drainage flows. Facilities that convey local drainage to the to a regional system include local streets, ditches, open channels, and storm drains. Customarily, the entire cost of local drainage improvements is borne by the developer. On the other hand, regional drainage is the cumulative impact of local storm run-off. Therefore, all local run-off must be conveyed in a manner consistent with the Regional Master Drainage Plan for the San Jacinto Area. This project will contribute site generated nuisance water to the regional system. The impact on regional drainage will be mitigated through payment of storm drain fees prior to issuance of a building permit (Environmental Condition No. 3). Air Quality All new development that induces motor vehicle usage will have a detrimental effect to air quality levels. Individually, a user of the will not have a significant impact on air quality, but the cumulative effects from the development of the shopping center site will contribute to an overall air quality problem. Emissions generated from this project include those emitted from power generating equipment. Methods to mitigate these additional emissions include the following: PLANNING COMMISSION AUGUST 9, 1995 PAGE NO. 2 (1) Require all building to be constructed consistent with the energy conservation building standards (Title 24) and require the use of energy efficient appliances. This will reduce the need for power generation, thereby reducing the amount of pollutants released into the atmosphere. Circulation The development of the site has the potential to cause an increase in traffic, impacting both local roadways and regional transportation facilities. According to a trip generation report prepared by the Institute of Transportation Engineers, this type of entertainment use will generate less than 200 peak hour trips. Nonetheless, this additional traffic combined with that of the new theater and the future additional development of the Superbiock/San Jacinto Valley Faire, will eventually create a need for more signal controlled intersections, especially at those intersections in closest proximity to the proposed development. Currently, the traffic signal mitigation fee is $2700 per acre. These fees will be exacted from the project proponent prior to issuance of a building permit, or as prescribed by Ordinance No. 1009. Future traffic signals will be installed at local and downtown intersections when warranted by increases in traffic volume. Additionally, all new development impacts regional transportation corridors, and an equitable cost sharing system has been established. The two regional corridors which traverse San Jacinto include the Ramona Expressway and Sanderson Avenue, as both roadways serve destinations outside the San Jacinto Valley area. Presently, neither roadway is constructed to the ultimate Right of Way and existing pavement sections are in need of repair. Therefore, to mitigate the impact of the project on the roadway network, at the issuance of building permits or as prescribed by Ordinance No. 1009, the developer will be assessed both the regional ($820/acre) and the local ($500/acre) road improvements and maintenance fee. Schools According to Government Code sections 65995-65997, all non-residential development is required to pay a fee based on square footage of conditioned floor space. These fees are currently payable prior to issuance of a building permit. Sewer/Water Sanitary sewer service will be provided by the EMWD and is currently available for the site. Domestic water service will also be provided by the EMWD and is currently available for the site. PLANNING COMMISSION AUGUST 9, 1995 PAGE NO. 3 Public Safety The proposed development will place additional demands on existing public safety facilities and staffing levels. The most appropriate measures of adequate public safety services include: (1) maintaining at least 1.3 sworn police officers per 1,000 persons; (2) responding to all emergency fire calls within 5 minutes or less. Traditional funding sources for public safety services have been property and sales taxes. However, the revenue demands of the police and fire departments' operating and capital budgets exceed these revenue sources. Further, the additional vehicle trips generated by the incremental development of the site increase the potential for automobile accidents or other emergency situations in the vicinity of the site further impacting public safety services. Therefore, it is recommended that the development join the City Public Safety Community Facilities District to mitigate impacts on public safety services and pay those additional mitigation fees in effect at the time of development, as prescribed by Ordinance No. 1009. ANALYSIS The subject site is located within General Plan Planning Area 5, and is designated Community Commercial. Planning Area 5 is identified in the General Plan as an area for significant development activity. Included in this Planning Area are Rancho San Jacinto, the Park Hill Collection, American Village, as well as other large tracts of vacant residentially and commercially zoned lands. The policies of the Community Commercial General Plan designation include providing a broad range of retail and service commercial activities to serve local residents. The skate rink/entertainment center is a use that adequately implements the policies indicated above, by providing a service oriented environment and expanding local employment opportunities. The zoning of the subject site is C-2, General Commercial. The use proposed is identified as a conditionally permitted use in this classification. The conditional use process includes Planning Commission review of the site infrastructure improvements, the construction design and details, and the operation of the use because of the uniqueness of the project. Infrastructure improvements to accommodate the skate rink/entertainment center include the completion of the southerly half of the Entrada, associated parkway landscaping, the development of a 167 space parking lot with the required tree wells and parking lot planting. Additionally, the improvements also include the completion of the traffic circle and the sidewalks that link the skate rink/entertainment center to the theater and the PLANNING COMMISSION AUGUST 9, 1995 PAGE NO. 4 future restaurant pad along Esplanade Avenue. A vehicle turn -out has been provided along the Entrada, west of the building entrance, to allow for parents and others to drop- off prospective customers. Though not included or identified on the plans, bicycle parking will be provided as required -by Condition of Approval No. 19. The project construction includes a 24,000 square foot building which will house the indoor skate rink and the entertainment center. The entertainment center includes party rooms and an area for electronic games. Also proposed is a 14,000 square foot out door rink proposed to be used for roller hockey. This outdoor rink includes lighting for use after dark. Staff has minor concerns with the design of the outdoor rink, and they may be related to the detail of the plans as opposed to the design of the rink. It appears from the plans that there will be very narrow walkways around the bleachers, which may not provide adequate handicap accessibility. Condition No. 11 has been included to ensure that the building and site meet all access requirements. Staff has also included Condition Nos. 18 and 19 to ensure that the finished products complements and is consistent with the architectural themes and elements established for the Superblock/San Jacinto Valley Faire development. The exterior facade treatment attempts to incorporate the features found on the theater building by providing the raised mansard elements and the tile bands between them. The raised roof features are more narrow and spaced closer together that those of the theater. Staff would recommend that the raised features would provide grater architectural enhancement if they were Tess numerous, larger, and spaced farther apart. Additionally, providing a more massive roof feature at the entry, similar to the marquee and tower on the theater building, would more greatly enhance the architecture and provide greater consistency with the theater building. RECOMMENDATION Staff recommends the Planning Commission adopt Resolution 95- approving Conditional Use Permit 2-95 subject to Findings of Fact and Conditions of Approval. Easter, City Manager DATE: August 15, 1995 SUBJECT: GRC-REDEVELOPMENT CONSULTANTS, I AMENDMENT TO THE REDEVELOPMENT RECOMMENDATION NC., CONTRACT FOR THE PLAN Staff recommends that the City Council/Redevelopment Agency award the contract to GRC-Redevelopment Consultants to perform the necessary services prescribed by the Health and Safety Code to amend the Redevelopment Plan, in an amount not to exceed $17,850, plus costs of approximately $1000. BACKGROUND GRC-Redevelopment is the consulting firm that participated in the preparation of the amended Redevelopment Plan for the 4000 acre expansion to the Redevelopment Project area. The expanded Redevelopment Plan was adopted in December 1993, and never became effective as a lawsuit attempting to overturn the plan was filed. Staff and the City's Redevelopment counsel have been negotiating with both the California Farm Bureau and the State of California Resources Agency (the plaintiffs) since February 1994, and settlement agreements with both agencies are imminent. One of the main points for the settlement of the lawsuits by both agencies is the removal of territory that is subject to Agricultural Preserve contracts. The removal of territory for the adopted plan will modify the boundaries of the project area, therefore, necessitating an additional amendment to the Plan. The proposed contract includes a scope of work, schedule of activities, and the table of fixed fees. The scope of work includes the preparation of revised legal description, the preparation of the environmental documents, preparation of a revised Redevelopment Plan, and the miscellaneous services necessary to complete the amendment to the Redevelopment Plan. The Agency should note that although GRC will be preparing the necessary documentation, Staff will be responsible for reproduction and conducting the required mailings. Attachments: 1. Proposal dated July 24, 1995 C C RPT-95\ G RCAM E N D. R DA Revised: July 24, 1995 SAN JACINTO REDEVELOPMENT PROJECT AMENDMENT NO. 2 SCOPE OF WORK Task 1 Prepare Work Schedule Beginning immediately after authorization to proceed, GRC Redevelopment Consultants will prepare a detailed program schedule that spells out deadlines by specific date, including due dates for all draft and final material, meetings and hearings. Task 2 Prepare and Circulate Resolution of Intent to Amend the Project Area Prepare for Agency Board approval a resolution stating the Agency's intent to amend the existing Plan to remove territory, reaffirming the base year, and authorizing Agency staff to make all appropriate notifications. This resolution along with appropriate cover letters and a revised legal description will be distributed to the State Board of Equalization and affected taxing entities pursuant to CRL Section 33327. Task 3 Prepare Revised Legal Description CRL Section 33328.3 requires that a legal description be prepared and distributed to the State Board of Equalization and all affected taxing entities. According the State Board of Equalization, the legal description they need must be of the area to be removed, while the legal description in the amended plan will be of the remaining area. The legal description and map are best prepared by a qualified civil engineer. For these services, GRC Redevelopment Consultants subcontracts with Kenneth Wilch & Associates, which has an excellent track record in preparing these legal documents. Task 4 Prepare Initial Study and Circulate Notice of Availability An initial study will be prepared, and if the Final EIR for Plan Amendment No. 1 is found to be adequate, then a notice of availability will be posted pursuant to CEQA Guidelines Section 15153. The entire public review period can be completed during the time it will take to prepare the Auditor/Controller's Report. Alternatively, environmental review could be accomplished using a negative declaration. While the negative declaration approach has the advantage of having a shorter -1- Revised: July 24, 1995 review period, it may require more work in preparing the initial study, and thus a slightly larger budget. In any event, environmental review is not the critical path in this project, because it can be substantially completed by the time the Auditor/Controller's report is due. Task 5 Review Auditor Controller's Report (Section 33328 Report) Between 60 and 75 days after circulating the Task 2 notices, the Riverside County Auditor/Controller will issue an Auditor Controller's report estimating the assessed value of the land to be removed from the Project Area. GRC Redevelopment Consultants will evaluate this report, and will prepare tax increment impact assessments for the Agency's use based on existing pass through arrangements. Task 6 Consult With Affected Taxing Agencies CRL Section 33328 also requires consultation with affected taxing agencies prior to the joint public hearing on the project. Due to the relatively non -controversial nature of this amendment, GRC Redevelopment Consultants recommends a series of telephone conversations with taxing agency representatives, and possibly one consultation meeting. This task can be accomplished by GRC Redevelopment Consultants staff. Task 7 Prepare Redevelopment Plan Revisions Under this task, a revised plan will be prepared to include necessary text changes, revised maps, and a revised legal description. Significant text changes are not expected at this juncture. Task 8 Prepare Abbreviated Report to Council The CRL requires that minor amendments include an abbreviated Section 33352 report to council. This report will contain: • A description of the project, its history, and why land is being removed. • A brief resume of remaining blighting conditions drawn from the December, 1993 report to council. • Revised financial projections. • Revised public improvements list. • Report and Recommendation of the Planning Commission (final version only). • Project Area Committee meeting summary (final version only). -2- Revised: July 24, 1995 • Reference to the Amendment No. 1 Final EIR and why it is being used for this amendment. • Analysis of the Auditor/Controller's Report. • Summary of taxing agency consultations. • Other matters as may become necessary. Two versions of this document will be prepared. The first version will be a draft that could be circulated to the Project Area Committee and the Planning Commission. The second version will be the version that goes to the Agency/City Council at their joint public hearing. Task 9 Hold Project Area Committee Meeting A meeting will be held with the existing Project Area Committee to review the amendment, its implications, and to get their recommendation to the City Council as to whether the amendment should be approved or not. Follow on meetings could be scheduled, but they are not anticipated at this point. GRC Redevelopment Consultants will prepare agenda materials including a brief staff report; Agency staff will attend the meeting and make the appropriate recommendations. Task 10 Hold Planning Commission Meeting CRL Sections 33453 and 33458 require that the Planning Commission review the amendment as to conformity with the General Plan, and submit their comments and recommendations to the Agency prior to the joint public hearing. GRC Redevelopment Consultants will prepare agenda materials including a brief staff report and a resolution; Agency staff will attend the meeting and make the appropriate recommendations. Typically, this step is taken at least 30 days prior to the joint public hearing. Task 11 Public Notices Public notification will be done according to CRL Section 33452. This includes publication in the paper once a week for three successive weeks, first class mailings to each known property owner, resident, and business in the entire project area, and certified mailings to the affected taxing agencies. GRC Redevelopment Consultants will prepare all material to be mailed or published, and will deliver camera ready copy to the City for mailing and publication. -3- Revised: July 24, 1995 Task 12 Prepare Ordinance and Other Resolutions Resolutions certifying the EIR for the pm -poses of this amendment, making necessary CEQA findings, approving and transmitting the report to council, and other matters as appropriate will be prepared and delivered. The ordinance adopting the amendment also will be prepared and delivered. Task 13 Hold Joint Public Hearing A joint Redevelopment Agency/City Council public hearing will be held to review the amendment. It is anticipated that only one meeting will be required in this regard. GRC Redevelopment Consultants will prepare agenda materials including a brief staff report and a resolution; Agency staff will attend the meeting and make the appropriate recommendations. Task 14 Final Transmittals Upon adoption of the ordinance amending the Redevelopment Plan, a statement of proceedings must be recorded with the County of Riverside along with a copy of the legal description. GRC Redevelopment Consultants will prepare transmittals to various taxing agencies, the County Assessor, the County Auditor/Controller and the State Board of Equalization. -4- Revised: July 24, 1995 SCHEDULE GRC Redevelopment Consultants proposes to complete the above Scope of Work in five months, given the following preliminary schedule. Easter, City Manager DATE: August 15, 1995 SUBJECT: Traffic Speed Ordinance RECOMMENDATION Waive reading in full and read by title only and introduce (First Reading) Ordinance No. , establishing speed limits on various City streets. FISCAL IMPACT None BACKGROUND On March 21, 1995 the City Council directed that speed surveys be conducted to determine the proper speeds to be posted on city streets. In accordance with California Vehicle code Sections 22357 and 22358 an engineering and traffic survey was conducted by the City Traffic Engineer. The study evaluates existing speeds, accidents, and speed conditions on roadway sections. Based on the results of the traffic engineering studies the streets outlined in the attached ordinance are those that the speeds need to be reduced in accordance with the authority granted by the California Vehicle Code Section 22358 (Attachment A) and posted as indicated in the ordinance. The Traffic Engineer, Chief of Police , and Director of Public Works concur in these recommendations. Other streets were surveyed which did not justify reduction in speed limits. They are currently posted as listed in Attachment B, based upon the traffic volume, accidents, and speed conditions it was not felt that there is sufficient justification to adjust the posted limits on those streets. Increase of Local Limits 22357. Whenever a local authority determines upon the basis of an engineering and traffic survey that a speed greater than 25 miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon any street other than a state highway otherwise subject to a prima facie limit of 25 miles per hour, the local authority may by ordinance determine and declare a prima facie speed limit of 30, 35, 40, 45, or 50 miles per hour or a maximum speed limit of 55 miles per hour, whichever is found most appropriate to facilitate the 1 orderly movement of traffic and is reasonable and safe. The declared 1 prima facie or maximum speed limit shall be effective when appropriate 1 signs giving notice thereof are erected upon the street and shall not thereafter be revised except upon the basis of an engineering g and traffic survey. The provisions of this section ( )' does not apply () to any 25- mile-per-hour prima facie limit which is applicable when passing a school building or the grounds thereof or when passing a senior center or other facility primiarily used by senior citizens. Decrease of Local Limits 22358. Whenever a local authority determines upon the basis of an engineering and traffic survey that the limit of 55 miles per hour is more than is reasonable or safe upon any portion of any street other than a state highway where the limit of 55 miles per hour is applicable, the local authority may by ordinance determine and declare a prima facie speed limit of 50, 45, 40, 35, 30, or 25 miles per hour, whichever is found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe, which declared prima facie limit shall be effective when appropriate signs giving notice thereof are erected upon the street. Amended Ch. 11, Stats. 1959. Effective September 18, 1959. Amended Ch. 25, Stats. 198f. Effective May 28. 1987, by terms of an urgency clause. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, ESTABLISHING A SPEED LIMIT ZONE ON THE BELOW STATED STREETS WITHIN THE CITY OF SAN JACINTO. THE CITY COUNCIL OF THE CITY OF SAN JACINTO DOES HEREBY ORDAIN AS FOLLOWS: Section 1. This Council, having caused a speed zone survey to be conducted by the City Traffic engineer in 1995 and being aware of the volume of use on said streets in the City of San Jacinto and the number of accidents that have taken place in the vicinity and having been advised that the City Traffic Engineer has recommended the establishment of the indicated speed limit zones on these streets listed in Section 2, in the City of San Jacinto, does hereby determine that the speed limit of 55 MPH on said streets is not reasonable and safe speeds on said streets and that said lower speed limit will be most appropriate to facilitate the orderly movement of traffic. Section 2. That it is hereby established under the authority of Section 22357 and Section 22358 of the Vehicle Code, State of California, a prima facie speed limit as indicated on; Commonwealth Avenue between Sanderson and Arroyo Viejo 45 MPH Commonwealth Avenue between Arroyo Viejo and Esplanade 25 MPH Cottonwood Avenue between Sanderson and State 50 MPH De Anza Drive between Potter and 1000 Feet NW of Young 40 MPH Esplanade Avenue between State and Mountain 40 MPH Hewitt Avenue between Main and Evans 30 MPH Hewitt Avenue between Evans and Washington 45 MPH Idyllwild Drive between State and San Jacinto Avenue 30 MPH Kirby Street between Cottonwood and Seventh 40 MPH Lyon Avenue between De Anza and Seventh 50 MPH Main Street between Alessandro and Ramona Expressway 40 MPH Potter Road between Ramona Expressway and De Anza 40 MPH Ramona Boulevard between Sanderson and State 45 MPH Sanderson Avenue between Ramona Expressway and South City Limits 50 MPH Seventh Street between Lyon and Main 35 MPH Seventh Street between Hewitt and Mountain 45 MPH State Street between Ramona Boulevard and South City Limits 40 MPH Section 3. The Traffic Engineer, as defined in Ordinance No. 358, of this City is instructed and empowered to cause the appropriate signs giving notice of the new speed limit to be erected on the above streets in the City of San Jacinto as may be required by law. Section 4. The City Clerk shall certify the adoption of this Ordinance and cause said Ordinance to be published in a newspaper of general circulation, printed and published in the City of San Jacinto. Section 5. The City Clerk shall forward certified copies of this ordinance to the Traffic Engineer of the City of San Jacinto and the Road Department, County of Riverside. c. INTRODUCED at a regular meeting of said City Council on the 15th day of August, 1995. MOVED, PASSED, AND ADOPTED, at a regular meeting of the said City Council on the day of , 1995 by the following vote: AYES: NOES: ABSTAIN: AB SENT: ATTEST: Mayor City Clerk 0 Staff Report Iritormigra F i IF TO: Honorable Mayor and Members of the City Council FROM: Gene Price, Interim Fire Chief Via: Pamela S. Easter, City Manager DATE: August 15, 1995 RE: Residential Sprinklers RECOMMENDATION: That the City Council discuss this report and give direction to Staff for follow up. FISCAL IMPACT: The following is the fiscal impact of the current ordinance to a San Jacinto resident and what the impact would be to the City if the ordinance was rescinded. Cost to a San Jacinto resident who purchases a sprinklered residence: Monthly Cost of installation on 30 year loan $17.54 Savings on Fire Insurance policy $ 3.75 Total Monthly Cost to Resident $13.79 Cost to City of San Jacinto Rescinding the Residential Sprinkler Ordinance: Increased future City costs associated with additional suppression activities and the cost of fire station construction and manpower because no other fire protection systems are in place during the time development is occurring. INFORMATION: At the City Council meeting on June 20, 1995, the City Council directed staff to meet with Mr. Steven Peacock to discuss issues related to residential sprinklers. Staff met with Mr. Peacock and Mr. Jim Didion on July 25, 1995. I have attached a letter from Mr. Peacock for your consideration that recommends you adopt alternative number 3 in my report as a compromise. Mr. Peacock will attend the City Council meeting to discuss the issue. Residential Sprinklers Page Two BACKGROUND: Prior to November of 1990, the City of San Jacinto had a Sprinkler Ordinance that required all new Commercial and Industrial buildings over 5,000 square feet to be sprinklered. There was no requirement to provide sprinklers in any residential dwellings at that time. In November of 1990, the City Council adopted Ordinance 917 that adopted the 1988 Building related Codes. At that time, an amendment was added to require sprinklers in all buildings, including residential, constructed after that date. In January of 1993, the Council approved Ordinance 975, that adopted the 1991 Building related Codes. The amendment requiring all buildings to be sprinklered was also included in that Ordinance. The only exception is a garage constructed less than 500 square feet, located a minimum of 10 feet from adjacent buildings, and five feet from property lines. The ordinance also included a requirement that any building that was increased in size by more than 1000 feet be sprinklered. Since the adoption of the residential sprinkler requirement, more than 250 homes constructed have been sprinklered. The residential sprinkler systems include an audible and visual alarm that is located on the street side of the residence, 160 degree heads, a back -flow valve, an inspectors test valve, a main drain valve, and a pressure gauge. The alarm is activated with any flow of water in the sprinkler system. The sprinkler heads are activated individually and flow approximately 15 gallons per minute. Loss records of Factory Mutual Research show that the probability of a sprinkler discharging accidentally due to a manufacturing defect is only 1 in 16 million sprinklers per year. ANALYSIS: The cost of installation in new construction is estimated to be $1.00 to $1.50 a square foot. Our redevelopment area project budgets show sprinkler system costs to be at the lower to mid -range of the estimate, therefore, the cost of installation of the sprinkler system in a 1500 square foot house could vary from $1500 to $2250. An installation cost of $2250 would increase the owners' monthly payment on a 30 year loan by approximately $17.50. A variation of fire insurance discounts are offered on residences with sprinkler systems. Some quoted discounts are: SAFCO 0 Fireman's Fund 10% Aetna 15% Allstate 15% Residential Sprinklers Page Three An example of insurance savings on a 1500 square foot house with a $300 a year premium would vary from 0 to $45 a year. This could result in a reduction of the monthly cost of insurance of $3.75. Benefits of sprinklered residences include: Studies have shown property losses are 85% less in residences with fire sprinklers compared to those without sprinklers. Although fire insurance replaces contents lost in the fire, there is always personal contents that cannot be replaced and have sentimental value rather than monetary value. In addition to early warning provided by smoke detectors, sprinklers reduce smoke and heat to provide a safer and Tess obscure means of escape for • building occupants. The amount of Fire Department resources required for suppression activities and the time spent on scene by department personnel is greatly reduced. Reduction of the amount of water required for suppression activities in residential structure fires. Fire sprinklers are only one component of the City's overall fire defense system. This overall system includes early warning fire alarm systems, Fire Department responses, public education programs, building construction requirements, and code enforcement activities. Early containment of fires is important to reduce fire loss and prevent injury. This requires rapid response by fire agencies. Fire stations are located to provide this rapid response. A 1.5 mile radius from the Fire Station provides this (see attached map). The Fire Department will normally arrive at a residence 1.5 miles from the fire station in approximately five minutes from the time of dispatch. As you are aware, the Fire Department only has one Fire Engine to respond to a structure fire without mutual aid assistance from an adjoining agency. With our emergency response activity level, it is becoming more likely that our unit will be unavailable on another call, and the first arriving unit will be from an adjoining agency, which may extend the response time considerably. Even with a rapid response, residential sprinklers provide additional safety and reduced fire Toss. As development occurs, fire mitigation fees are collected to build fire facilities. Approximately 1000 residential units are required to provide the funding to build a fire station and provide a fire engine. There is a considerable amount of time between the beginning of construction and the completion of enough homes to fund the construction of a station and purchase of an engine and equipment. Residential Sprinklers Page Four As strictly a financial consideration, based solely on installation costs versus reduction in fire insurance premiums, residential sprinkler systems do not appear to be a good investment for the individual homeowner. However, it is a good investment for the City based on potential additional costs outlined above. The building code now requires all buildings over 5,000 square feet to be sprinklered. Our ordinance amended the building code, by requiring sprinklers in buildings less than 5,000 square feet. FACTS: Fires in sprinklered buildings produce lower losses than fires in unsprinklered buildings. Sprinklers provide a high level of life safety. Temperature and toxic by-products are controlled by sprinklers at levels that do not threaten occupants of industrial, commercial, or residential occupancies. A significant percentage of the new housing areas in San Jacinto are outside the 1.5 mile radius. Elimination of the residential sprinkler requirement will not necessarily reduce the price of housing in San Jacinto. Some possible alternatives to consider are: 1. Elimination of the requirement for single family residential and leave in place the requirement for all multi -family residences. 2. Eliminate the requirement in all residential construction, including multi -family. 3. Modify the existing requirements and only require sprinklers in residences constructed outside the 1-1/2 mile radius from a City fire station. Based upon input from the Council, staff will follow up with any requests for more information or implement direction given by the Council. PEACOCK FINANCIAL CORPORATION Real Estate Development and Investment August 9, 1995 San Jacinto City Council 312 E. Main Street San Jacinto, CA 92583 Dear Mr. Mayor and Members of City Council: PEACOCK Prior to meeting with Gene Price and Bob Wilson of the Fire Department on July 25, 1995, we had taken the position of the Building Industry Association that residential fire sprinlders were unproven over the long term, added cost and no value to the house and a legal issue as to the ability of a governmental agency to require such was currently being tested in the courts. After the meeting, we believe that a compromise approach as suggested in Mr. Price's staff report as alternative #3 is both prudent and economically viable. By amending the resolution accordingly, you would be allowing a more level playing field with competition in core development areas such as Rancho San Jacinto, but still provide the Fire Department with the added protection in more outlying, harder to reach areas within the City. As always, I know that both sides of this issue will be reviewed equally and I will be present at the August 15, 1995, Council meeting to answer any questions. Respectfully submitted,, Steven R.
