City Manager Easter stated that the City will continue to make every effort to get 2,3 or 4 bids. 2 May 21, 1991 Minutes Page 3 Motion by Councilman Rose to approve consent calendar items A through M with the inclusion on Item I-L of "non-exclusive" and adopt Resolution No. 1959 and introduce Ordinance No. 933 to second reading and waive the readings in full. Seconded by Councilman Ford. Motion carried: 5-0. 11. PUBLIC HEARINGS (continued from May 7, 1991) A. Adoption of fees for processing of various development applications. (Continued from 4-2 and 4-16 and 5-7-91). Ordinance for Introduction - Ordinance No. 934 -- An Ordinance of the City Council of the City of San Jacinto establishing fees for processing planning related matters and repealing Ordinance No. 622. Staff recommends introduction of Ordinance No. 934 to second reading and waive the reading in full. Presentation by Brian McNabb, Community Development Director, stating that the Council's adoption of Ordinance No. 934 would put the City on a "pay as you go" basis for the next Fiscal Year. Councilman Ford inquired what the feeling of the BIA and Partner's groups were. Mr. McNabb advised that the groups understand what the City is trying to accomplish and their one concern, in terms of how these fees might impact some of these developments that are ongoing, is the lack of opportunity to budget in these fees to their overall costs. The builders are saying they may have to take this out of their pocket from their profits. We spent quite a bit of time discussing this and came up with two comments that were relative to this issue: Comment No. 1 was you have to draw the line somewhere and Comment No. 2 was if we said certain projects were exempt from this ordinance because they are too far down the line, then we would have to raise some of these other fees to compensate for the loss of this revenue. May 21, 1991 Minutes Page 4 Councilwoman Leahy asked when this fee ordinance would take effect, if adopted. Community Development Director McNabb advised 30 days from adoption of ordinance. Ms. Leahy further requested a chart be available to developers listing the new fees and the times they are payable. Mr. McNabb advised that the City can notify the developers of the scheduled fee increases relative to their current status. Councilwoman Leahy further inquired if there was an overall % of increase assessed with these fees. Mr. McNabb advised that was not evaluated, but the methodology was different for different fees. City Attorney Cox advised that fees reflect actual cost to provide service by the City. Mayor Boykin opened the Public Hearing. The City Clerk stated that the affidavit of publication for notice of public hearing was on file and no written or verbal communications had been received. As no one wished to be heard, the Mayor closed the public hearing. Motion by Councilman Rose to introduce Ordinance No. 934, establishing fees for processing planning related matters and repealing Ordinance No. 622 to second reading and waive the reading in full. Seconded by Councilwoman Leahy. Motion carried: 5-0. B. Tract Map of Specific Plan 2-88 (Continued from 5- 7-91). Applicant: PR Equities Location: Tentative Tracts 24050, 24051, 24052, 24053, 24054, 24055, 24056, 24057, 26426, 26427 Proposal for 10 Subdivisions within Specific Plan 2-88. Community Development Director, Brian McNabb, advised that Staff is requesting continuance of this matter to June 4, 1991, to administratively address how we are going to address the issues of fire mitigation fees and school impact. 4 May 21, 1991 Minutes Page 5 Motion by Councilman Ford to accept Staff's recommendation and continue to June 4, 1991. Seconded by Councilwoman Leahy. Motion carried: 5-0. Councilman Hafliger asked if the City was working with the School District in attempting to develop an overall Riverside County plan, a state-wide plan, for funding for school mitigation. Mr. McNabb advised we were not working on a state wide plan, but only a local plan. City Manager Easter concurred that this would be very appropriate as many cities in our County are dealing with these same issues. Mayor Boykin suggested bringing this topic up at the WRCOG meetings, which includes the cities of Riverside County. 111. ORAL COMMUNICATIONS None. IV. CITY DEPARTMENTS A. Vosburg Hotel Update - Brian McNabb Mr. McNabb met with Mr. Lehmeir and advised them he would be meeting with the economic and redevelopment subcommittee prior to the June 4 meeting, and will be able to bring this topic back at the June 4 meeting. Mr. McNabb further advised that the newspaper is reporting the Vosburg Hotel is in escrow and this subject may be moot. City Manager Easter stated that under a related issue, the homeless, she is of the understanding that some officials from the City of Hemet with the Valley Restart Homeless Shelter, currently located within the City of Hemet. She further understood that they are going to try to get a Valley Task Force put together to address the issue of the homeless and a representative from San Jacinto's Council will asked to participate. 5 May 21, 1991 Minutes Page 6 E. Update on request of Ed Meyerson for water service at 22741 Alessandro Ave. - Brian McNabb (moved out of order by request of Staff - no objection from Council) Mr. McNabb gave an overview of the City's existing policy which basically says it will not provide any new water services to the unincorporated areas. The second issue in Mr. Meyerson's request is from a service standpoint whether the City would grant permission to put a water meter on Alessandro and allow water service to run back several hundred feet to an essentially landlocked piece of property. Mr. McNabb allowed that the policies have been on the books a number of years and during that time only one exception has been granted and that was in the - fall of 1990. Staff feels it would be appropriate for the Council to consider the review of that current policy. Motion by Councilman Rose to deny request of Ed Meyerson and direct Staff to return with recommendations at the first meeting in July. Seconded by Councilman Ford. Motion carried: 5-0. Staff requested Mayor move Item V-D to this portion of the agenda. V. D. Update on Civic Center project by City Council Sub Committee and authorization for Staff to receive proposals to plan, finance and construct this facility. The Civic Center Council Subcommittee (represented by Councilwoman Leahy) requested approval of a plan to approve the building of a Civic Center for the 90's, which would be contained in an office building, serving as a source of revenue for the City and provide the space to meet the growing needs. The Committee further requests Council authorize Staff to pursue this avenue by seeking out developers who are interested in helping the City with their needs. Councilman Hafliger added that the Committee has been working for several months and arrived at the following conclusions and recommendations: The Sub Committee recommends that in place of a Civic Center, the City build, or have 6 May 21, 1991 Minutes Page 7 private enterprise build, or a combination of the two, build an office building that would provide adequate, for conducting the business of the City through the 90's. The building should have an approximate area of 70-80,000 sq. ft. and be flexible enough to attract and accommodate other businesses as lessors, and/or co -occupants. As the City develops and the need for additional space occurs, the City could occupy more of the building. The building should have the aesthetic values that it will enhance the image of the City of San Jacinto. It should be located in an area of the City to encourage the development of the surrounding area and it should be built at a cost that is within the current economic ability of our City's financial position. It is also the opinion of the Subcommittee that as the City grows it will become clearer to the City Council which direction the growth is unfolding and as this growth develops the City will be in a better position financially and better able to determine the appropriate location for a permanent civic center. The investor - developers we have talked to have suggested several different locations for the proposed office building. Because the City Council has not yet finalized this or the City Council is not even aware of these locations we would refrain from naming those locations at this time. The Subcommittee recommends a motion that the City Council give the City Manager the authorization to enter into a dialogue with interested parties and that the City Manager be authorized to accept proposals from interested parties, using . the above stated recommendations as a guideline. Motion by Councilman Hafliger to endorse the concept of the Civic Center of the 90's by authorizing Staff to solicit proposals from the private sector for the planning, financing and construction of this Civic Center concept. Seconded by Councilwoman Leahy. Councilman Ford inquired how many different possibilities has the subcommittee and the joint committee looked at? Councilman Hafliger answered about 200. Councilman Ford asked if there were any possibility of any presently built facilities that might be a possibility for a Civic Center for the 90's? Councilman Hafliger advised that a number of 7 May 21, 1991 Minutes Page 8 existing facilities have been discussed and the Subcommittee in conjunction with the ad hoc committee that was established have pretty much ruled out any existing facilities, as a matter of cost, location and aesthetic values. Councilwoman Leahy allowed that Staff currently needs more space and that an interim facility is being addressed. Motion carried: 5-0. B. Paramedic Committee - Ross Chadwick Chief Chadwick requested the Paramedic Committee be continued to the meeting of June 18, 1991, until the meetings with the County and private/public agencies are completed. Motion by Councilwoman Leahy to continue to the meeting of June 18, 1991. Seconded by Councilman Ford. Vote: 5-0. C. Assistant to the City Manager Classification - Pamela Easter City Manager Easter stated that with the resignation of Assistant City Manager Henry Garcia, it is appropriate to look at the type of Staff support needed in the City Manager's Office, and she recommended the position of Assistant to the City Manager be established and the Staff be authorized to recruit at the Assistant to the City Manager level and that replace the present authorization given as part of the Budget adoption for the Assistant City Manager position. Ms. Easter stated that the position will provide strong staff support and give the City Manager's office the strength and the level of experience we need at this point. The position will be responsible for personnel, grant administration, a new area of public information, a new area of legislative tracking and also special projects. The position will also offer support in labor relations training, budget and generally staff support to City Manager and her activities and work. The City Manager recommends the position be set at 8 May 21, 1991 Minutes Page 9 Range 61 ($3750/mo - $4570/mo) and recommends further the position be placed in Class B of Management Resolution No. 1785, relating to benefits. Ms. Easter further recommends the job classification be adopted at this time and incorporated into job classification manual. Councilwoman Leahy questioned the salary in comparison to the cities of Perris and Indio. Ms. Easter advised that in recommending this salary level for this position recognizes we are not going to have an Assistant City Manager position, but more importantly in recognition of the fact that we are looking towards a strong support person and that are requirements for the position are heavier than what some of the other agencies require of their Assistant to the City Manager. Motion by Councilman Rose to accept the City Manager's recommendation to adopt the classification of Assistant to the City Manager at Range 61 of the Management scale and authorize Staff to proceed with recruitment and selection to occur in Fall of 1991. Seconded by Councilman Ford. Motion carried: 5-0. D. Operation Proud Return request for street closure and waiver of permit fees - Joseph Kozma/Jan Leahy Chief Kozma requested the City Council approve the closure of streets for the Operation Proud Return Parade and waive the permit fees, being hosted by our City and Hemet to honor the men and women that served in Operation Desert Storm, as well as, those men and women in the Armed Forces that serve their Country. The parade starts at 11:00 at State St. and Devonshire and continues northerly on State to Esplanade, concluding at Valley Wide Park with a Memorial Service on May 25, 1991. Additionally requested is the permission to discharge weapons at the Memorial ceremony either by the VFW or another Armed Forces unit that will discharge the weapons in honor of the'service personnel. May 21, 1991 Minutes Page 10 Motion by Councilman Rose to approve the closure of streets and waiver of permit fees (including vendor fees), and grant permission of firing weapons at the Memorial ceremony. Seconded by Councilman Ford. Request by Councilwoman Leahy to use the City's 1941 Fire Engine as the City's entry in the parade. Above motion to include permission to use the City's 1941 Fire Engine. Councilmen Rose and Ford concurred. Motion carried: 5-0. F. Consideration of Action Steps and Timelines for Council's Nine Priorities - Pamela Easter City Manager Easter recapped the nine priorities the Council had established at their recent Retreat and advised that the Staff had met several times, at Council's request, to add and/or comment on the priorities. Staff is recommending these steps be put on a matrix so that as a Council and Staff we can track the progress of the projects. Councilman Ford requested an update on a report from the 2010 Committee. City Manager Easter advised that Clayton Record, Committee Chairman has met with Mayor Boykin on committee selection and a meeting is planned for the second week in June. Motion by Councilman Hafliger to endorse the presented action steps and timelines presented by Staff(developed from the Council's Retreat). Seconded by Mayor Boykin. Motion carried: 5-0. 10 May 21, 1991 Minutes Page 11 V. MAYOR AND COUNCIL MEMBER REPORTS/DISCUSSIONS A. Letter of Resignation from Councilman Clifford Rose, effective June 1, 1991. (Mayor recommends acceptance, with regret.) Motion by Mayor Boykin to accept, with regret, the resignation of Councilman Clifford Rose, effective June 1, 1991. Seconded by Councilwoman Leahy. Motion carried: 4-0 (Rose abstained). B. Establishment of Sister City with Zhukovsky (Moscow Region, USSR) - Mayor Boykin Mayor Boykin advised Council that five delegates from San Jacinto went to Zhukovsky, arriving in Moscow on April 24 and Zhukovsky on April 27, leaving on May 5, 1991. The group toured the City and a number of the flight test facilities, as this is what the City was built for back in 1947. Mr. Gromov, the pilot who landed in the field in San Jacinto, was the first Chief of the Flight Test Center. Mayor Boykin requested the Council accept the cooperative items suggested by Zhukovsky as a possibility for future activities between the two cities. The Agreement before Council is not the final agreement, but if approved by Council tonight, the agreement will be signed in Cincinnati in September at the USSR -USA Conference. This will be at no cost to the City of San Jacinto, except if the official City participant is authorized an expenditure by the City Council. Agreement signed by Mayor of Zhukovsky and Mayor Boykin on his recent visit to Zhukovsky. Motion by Councilman Rose to accept items of cooperation for future activities (tentative). Seconded by Councilman Ford. Motion carried: 5-0. 11 May 21, 1991 Minutes Page 12 C. Vacant Council Seat - Mayor Boykin Mayor Boykin inquired of City Attorney if it was appropriate to set a date prior to the date of the resignation and additionally asked that he spell out alternatives for selection of Council member. City Attorney Cox advised that Govt. Code 36512.1 allows that a Council shall, within 30 days, either fill the vacancy or call for a special election. The month of June being available to fill the vacancy or using the second meeting in June to call for a special election. Mayor Boykin inquired if it would be appropriate for the Council to advertise if the appointment is the method the Council chooses to use. City Attorney - Cox advised that the method of selection is entirely up to the Council as long as the Brown Act is not violated. City Manager Easter advised that if the Council chooses to select by appointment, there are a variety of different ways to choose from, such as advertise and submit resumes and then Council conduct interviews. The Staff could hold an orientation, similar to what was done for all the Council candidates during the last November election. City Attorney Cox advised that a two - person Council Subcommittee could also be appointed. Councilman Ford inquired if there was a form established to set up the resume. City Attorney Cox was not familiar with any City document. Councilman Hafliger advised that the School District had been through this process several times in the last several years and have such a form. City Manager Easter advised that she was not aware of any city having such a form, but we can check with the School District and League of California Cities. Councilman Hafliger suggested that the Mayor and City Manager work together to come up with an appropriate form. At this point Mayor Boykin recognized Art Shephard, 396 Angela Way, who requested to speak on this subject. Mayor Boykin stated that Mr. Shephard's statement would not be appropriate at this time as he stated he was to be a candidate and this was not 12 May 21, 1991 Minutes Page 13 the proper forum. Mayor Boykin allowed Mr. Shephard to read the portion of is statement dealing with the subject - the process of filling the vacancy of a Council seat (Cliff Rose) to be vacant June 1, 1991. Mr. Shepherd read his statement, addressing the difficult task of selecting another City Councilman. He continued on with a campaign statement advising that he had run last November at the number of votes he received and the confidence factor he had received. At this time Mayor Boykin requested he terminate his statement as it was out of context of the subject matter of the item and not in order. Mayor Boykin requested Mr. Shepherd be seated and the Council continue discussion of the process to be selected to fill the upcoming vacant Council seat. Mayor Boykin advised Council that they did have an alternate choice of calling an election. Councilman Hafliger inquired what an election might cost the City. The City Clerk's Office responded that the County advised between $10,000 and $15,000. Councilman Hafliger inquired if there was a 30-day delay in appointment after the appointment where it can be protested. City Attorney Cox advised that the Govt. Code contained no such provision. Councilwoman Leahy stated that she would like to see the Council work together towards saving the City the $10,000 to $15,000 for a special election and set up an interview process at a special meeting. Motion by Councilman Ford to move that Mayor and City Manager set- up a resume form to pass out to interested parties from the City Office, let then fill it out, turn it in, and have a press release submitted to the papers and set Special Council Meeting on June 11, 1991 for an open meeting of consideration of all candidates. Councilwoman Leahy received verification from the City Attorney that the vote must be informed to the public in open format. 13 May 21, Page 14 991 Minutes Mayor Boykin recognized Art Shephard at this time, wherein Mr. Shephard stated he felt the results of the November election should be considered. Mayor Boykin stated he felt that many would be eliminated if only those people were considered. Councilman Hafliger stated that he feels that this is completely a new process and additional people have interest. Seconded by Councilman Hafliger. Motion carried: 5-0. E. Special Presentation and Invitation to a Reception - Mayor Boykin Mayor Boykin presented Councilman Rose with a Clock for his years of service to San Jacinto (1980-1985 and 1988-1991). San Jacinto #1 San Jacinto, CA 92383 Re: Claim against City of San Jacinto Receiver, May 17, 1991 Dear Ms. Johnson: TELEPHONE AEA CODE 74 652-i400 FAx (714) 6S2-.39g0 This office represents the City of San Jacinto. I have received the claim you presented to the City on May 17, 1991. The documents you presented are unclear as to whether you intended to make a monetary claim against the City, or whether you intended to request public records, or both. I am treating your documents as both a government claim and a request for records. With regard to your claim against the City, I am informed that your arrest was made as a citizen's arrest effected by the victim, and also as the result of an outstanding misdemeanor warrant. Accordingly I believe that the City has no liability for any damage you may have suffered. I will, therefore, be recommending that the City Council reject your claim at the Council meeting scheduled to be heard on June 4, 1991. You will thereafter receive formal notice of the action taken by the City Council. With regard to your request for documents in the possession of the City or its Police Department, the California Public Records Act does not provide for the disclosure of investigative files to suspects in an incident. 1 am, however, enclosing a copy of the booking record, which I believe, contains most of the information you requested. This document reflects that San Jacinto Police Officer Rodriguez took you into custody on the night in question. RECEIVED MAY 2 8 1991 CITY OF SAN JACINTO Audrey A. Johnson May 24, 1991 Page Two If you believe that you were treated improperly while at the police station, I would recommend that you contact the San Jacinto Police Chief's office and request a citizen's complaint form. All such complaints are investigated and, if found to be warranted, proper discipline is imposed. I hope this letter answers all of your questions. Sincerely, AMES A. DATE PREPARED ccc.i MEMO TO: Honorable Mayor and Members of the City Council FROM: Brian McNabb, Director of Community Development DAI':: May 31, 1991. SUBJ: CO-OPERATIVE AGREEMENT WITH RIVERSIDE COUNTY FLOOD CONTROL Attached is the Co-operative agreement with Riverside County Flood Control related to the construction, inspection, and financing of Master Plan flood control lines in Esplanade Avenue between San Jacinto Avenue and the railroad tracks, as well as two lines draining northerly. Included in this document is an agreement for San Jacinto to contribute $350,000 as its share of Line C, which runs from Esplanade Avenue into the Buena Vista Retention Basin. Without this influx of money, Line C could not be built until fiscal year 92-93. As a result, we would lose our construction grant for the street improvements on Esplanade Avenue, which are dependent on Line C. The City Attorney has reviewed the document and found it satisfactory, Staff therefore, requests the council authorize the execution of the agreement and the allocation of the $350,000 in construction funds as well as any inspection charges from the flood control fund (Fund 39). Respectfully, ?%-r611 BRIAN MC NABB Director of Community Development BKM:lr 1I! EXHIBIT "A" EXISTING GENERAL PLAN EXHIBIT "B" EXISTING ZONING EXHIBIT "C" EXISTING CIRCULATION EXHIBIT "D" FLOODZONE ENVIRONMENTAL ANALYSIS Seismic Safety The subject property is not located on any potentially active fault or PLANNING COMMISSION MAY 15, 1991 PAGE NO.1. within the boundaries of any special seismic study area. The nearest seismic study zone is over one mile to the southwest. Hydrology The subject site is not subject to flood inundation since it is outside the boundaries of the 100-year floodplain represented on the Flood Insurance •Rate Map. However, storm runoff will contribute to the regional drainage problem and the project proponent must provide assurances that runoff will not adversely affect adjoining properties. Circulation The proposed project will create additional traffic demands at the intersection of San Jacinto Avenue and Seventh Street. According to a March 25, 1991 traffic study prepared by Kurtzman and Associates of Irvine CA. concludes that the project will generate approximately 1866 daily vehicle trips and 103 of those trips will occur during peak evening hours. Currently, the intersection of San Jacinto Ave and Seventh Street operates at Level of Service A. (favorable progression) ; upon completion, the intersection will continue to operate at Level of Service "B" (good progression). However, future development, population growth, and intensification of downtown land uses may warrant left turn phasing at that intersection. This project will be required to pay Traffic Signal Mitigation Fees of $2025 ($2700/acre x .75 acres to be developed) prior to issuance of any building permits. Also, San Jacinto Avenue and Seventh Street have been designated by the Circulation Element of the General Plan as Secondary Highways. A Secondary Highway will have an 88' ultimate right of way with a 64' pavement section. The project proponent will be required to dedicate and improve those ultimate half width sections which directly adjoin the site. Finally, circulation to the project is enhanced by locating the drive approaches at the furthest point from the intersection apex of San Jacinto Avenue and Seventh Street. Air Quality This project will have an impact on air quality based on the following factors : (1) escape of fumes from individual pump hoses; (2) spillage of gasoline after removal of pump hoses or from overfilling; (3) vehicle idling while waiting for available pumps or during egress from the site ; and (4) increased energy demands imposed by the operation of the use. PLANNING COMMISSION MAY 15, 1991 PAGE NO.2 In order to mitigate the impacts pertaining to items 1 and 2, the service station must comply with those standards imposed by the South Coast Air Quality Management District and the State of California. Vehicle idling time may be reduced by limiting left turn access onto both San Jacinto Avenue and Seventh Street. Left turn access may be eliminated completely or perhaps during peak traffic hours. The applicant may also reduce vehicle idling time by having signage displayed which instructs motorists to use the most forward pump. Finally, those standards imposed by Title 24 will significantly enhance energy efficiency of the project, thereby reducing demands on Southern California Edison generating capabilities and delay construction of additional facilities. Hazardous Materials This project will involve transportation of hazardous materials along transportation corridors, thereby exposing vehicle and pedestrian traffic to risk of fire . Also, underground fuel storage tanks will be placed on site. Underground fuel. storage tanks are subject to corrosion, thereby allowing hazardous materials into the ground water. The project will be required to comply with specifications set forth by the Environmental Protection Agency for underground fuel tank construction. Public Facilities/Services Water, sewer, and other franchise utilities are currently available to the site and are capable of providing adequate service levels. The project will create additional demands for public safety services. Additional police services will be required since the service station/convenience store operates on a 24 hour basis. However, both police and fire services are located approximately 500 feet from the project, therefore anticipated response times would be approximately 1-2 minutes. DISCUSSION The current General Plan Land Use designation for the subject property is Downtown Commercial. All development within this designation should promote the City's ideal to establish a central, downtown commercial district which reflect San Jacinto's present small town character. Appropriate methods which implement this goal include providing visual amenities and promoting a pedestrian orientation with unified streetscapes. Presently, the site is zoned C-2 "General Commercial" and is being used as a chiropractic office with accessory detached storage. Surrounding zoning and adjacent land uses include the following: PLANNING COMMISSION MAY 15, 1991 PAGE N0.3 NORTH - C2/ Existing Single family dwelling adjacent to occupant's business EAST - R3/ Nonconforming Recreational Vehicle Storage and single-family dwelling SOUTH- C2/ Union 76 Service Station WEST- C2/ Fastrip 24-hour Market and Delicatessen & Hoffman Park The proposed automobile service station and convenience store are conditionally permitted uses within the C2 zone, per Article 10.02(2). If a C.U.P. is hereby granted and subsequently established, this approval would be vested with the property , regardless of any future change in ownership. The applicant is proposing that the use in question be constructed on a building site that will ultimately measure 180' by 181.50'. However, no recorded legal building site exists to accommodate this proposal. To achieve the legal building site as proposed, the applicant must accomplish the following: (1.) acquire a 31.50' by 80' parcel at the northeast corner of the project (2) convey a 14' by 100' parcel at the southeast corner of the project ; and (3) eliminate the bisecting lot line that runs east to west through the site. Items 1 and 2 can be accomplished through separate lot line adjustments and Item 3 will require a parcel merger. RECOMMENDATION - If the Planning Commission wishes it would be appropriate to adopt Resolution 91-18 approving Conditional Use Permit 4-91 subject to the findings of fact, conditions of approval, and ratification by the City Council and grant a negative declaration with mitigating measures. PLANNING COMMISSION RECOMMENDATION TO CITY COUNCIL: The Planning Commission recommends the City Council ratify the Planning Commission approval of Zoning Ordinance Amendment 1-91. STAFF COMMENTS: None Respectfully Submitted, 171-:54.`/V1 BRIAN MC NABB Director of Community Development TO: FROM: DATE: SUBJECT: STAFF REPORT Chairman Ver Plank and Members of the Planning Commission Brian McNabb, Director of Community Development May 10, 1991 ZONING ORDINANCE AMENDMENT 1-91 APPLICANT: City Initiated DESCRIPTION A proposal to amend Article 15, Section 15.03, Sub -section 30 (a), of Ordinance 340 the zoning ordinance of San Jacinto pertaining to parking regulations for single-family development. As Staff has previously outlined at the Planning Commission retreat, the goal the City should seek to attempt with its Zoning Ordinance is a document that is practical to use but not a burden. In other words, it should address issues the City determines important while at the same time not hindering the goals of new and existing development. One area of the Zoning Ordinance which has been reviewed and modified a number of times over the past several years has been the parking regulations. Particular attention has been focused on the single family parking regulations. The issues previously identified related to parking have been: 1. The houses were becoming larger, creating potential for more household members and therefore vehicles. 2. The City was transitioning away from a senior citizen predominated community. 3. Many residents are not able to park the maximum number of vehicles for which a garage has been designed due to storage in parking spaces. 4. If cars are able to park inside a garage, the streetscape and aesthetics of the neighborhoods would be more attractive. Taking these factors into account, the existing regulations were adopted to read as follows: PLANNING COMMISSION MAY 15, 1991 PAGE NO. 1 Single Family Homes As you can see, these regulations are very specific. The problems this creates are a limit to the flexibility of a builder or homeowner. Additionally, the regulations may lead to an architectural disaster in attempting to add a third parking space to a very rigid design. This question was brought before the "Partners In Progress" advisory group. This group is an informal forum created to enhance the interaction and communication between the City, developers, school district, and Chamber of Commerce. After extensive discussion, an idea was developed which attempts to address the City's goal without creating an undue development burden. The attached Exhibit "A" is a suggestion proposed to the "Partners". This proposal retains the existing regulations but allows an option of built in storage, in -lieu of the third garage space. The drawings with Exhibit "A" reflects 30 c.f. of storage on one side of the garage and 42 c.f. of storage at the end of the garage. - An analysis of this proposal is as follows: 1. The 72 c.f. of storage is similar to the 70 c.f. of storage required for each apartment unit which does not have a garage. 2. A typical garage space is approximate 200 sq. ft. If one garage space is totally used for storage 3 ft. high, there would be 600 c.f. of storage. 3. The reason the shelves are 4 ft. 6 in. high is to allow a vehicle and its doors to fit under the shelves. 4. It is not practical to make the shelves lower unless the garages are wider. 5. In many cases, the area above the ceiling joists may be used for storage if there is not a second story above and if the spacing of the joists is adequate. 6. There appears to be room for additional shelves on the other side of the garage as well, which would total approximately 30 c.f. 7. The approximate distance between the side of the vehicle and the side of the garage is 2 ft. 8 in. RECOMMENDATION Staff recommends that Article 15, Section 15.03, Sub -section 30 (a), of Ordinance 340 the zoning ordinance of San Jacinto reads as follows: PLANNING COMMISSION MAY 15, 1991 PAGE NO. 2 Two (2) enclosed spaces for up to five (5) sleeping rooms and three (3) enclosed spaces for more than five (5) sleeping rooms. A sleeping room shall be defined as any habitable room 70 square feet or larger and not used for the preparation of food or dining. As an alternate, homes containing more than (5) sleeping rooms may provide 100 cubic feet of built-in permanent storage space within the garage in lieu of the 3rd parking space. 6)- Brian McIb Director of Community Development PLANNING COMMISSION MAY 15, 1991 PAGE NO. 3 0RflI1.ANCENO. 935 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, AMENDING ORDINANCE 340, THE ZONING ORDINANCE, RELATED TO PARKING REGULATIONS FOR SINGLE- FAMILY DEVELOPMENT. 4 THE CITY COUNCIL OF THE CITY OF SAN JACINTO DOES HEREBY ORDAIN AS FOLLOWS: 6 7 8 9 10 11 12 13 14 Section 1. Witness my hand and official seal of the City of San Jacinto this day of , 1991 Deputy City Clerk •W MEMO TO: Honorable Mayor and Members of the City Council FROM: Brian McNabb, Director of Community Development DATE: May 31, 1991 SUBJ: PEACOCK-RADAKER TRACTS As you know, the tentative tracts of Phase II of Rancho San Jacinto have been continued because of two issues: 1. The applicability of the Fire Mitigation Fee 2. School mitigation Staff has consulted with the City attorney and the developer regarding the fire mitigation fee. The recorded development agreement outlines certain fee exemptions. Because the fire mitigation fee is a new fee applied to all development, it does apply to Rancho San Jacinto. However, Community Facilities District No. 2 paid for fire equipment which the fire mitigation fee also is allocated to pay for. To avoid charging a duplicate fee, the development agreement with Peacock-Radaker must be amended to specify the amount of credit that will be granted. This will be forthcoming at a subsequent hearing. The school fee discussions have been complex. All new developments are typically conditioned by the City to pay fees and to join a financing district as determined by the City. We are exploring other avenues of financing with the school district. The school district is in the process of hiring consultants to develop a financing strategy According to staff discussions with Bill Marshall, one of the financing priorities will be the establishment of a Mello -Roos District similar to the City's Community Facilities District No. 3. This approach would normally be applied to Phase II of the Rancho San Jacinto. However, this cannot be, because of the underlying Community Facilities District No. 2 debt. The general rule of thumb for bond underwriting is that the maximum amount of extra tax a property can bear is 1%. Community Facilities District No. 2 approaches, but will probably not fill, the extra 1% tax. We have proposed, Peacock Radaker has accepted, and the school district has confirmed a plan in which the school district will create a Mello -Roos District which will fund Phase II's fair share of school impacts with a a three phase approach. I. The developer will pay school fees. 2. An initial tax will be checked at a rate which will be added to the CFD #2 rate with the maximum additional tax to be 1%. 3. Upon the payoff of the CFD #2 tax, the school's Mello -Roos will increase to an amount not to exceed 1% of additional tax. Staff therefore, recommends the approval of the tracts of Phase II of the Rancho San Jacinto Specific Plan subject to the findings of fact and conditions of approval with the Environmental Condition No. 3 for each tract amended as follows. Pay school fees and create school district Mello -Roos with a maximum additional tax, when totalled with other special assessments, of 1%. FEE MEMORANDUM TO: Honorable Mayor and Council Members via Pam Easter, City Manager FROM: Rick Vryheid, Public Works Supt. DATE: 5-30-91 SUBJ: Aerial Lift Truck In the 1990-91 Fiscal Year the Public Works Department has $60,000 budgeted in the L&LMD account for the purchase of an Aerial Lift Truck. After several discussions with Ms. Easter and Ms. Vega about various options regarding this equipment purchase I re- spectfully request purchasing a aerial lift truck from Baker Equipment Leasing Company_ The truck consists of a 1986 GMC chassis and a Versalift Model SHV-36-PI aerial lift device. Baker Equipment does not offer any warranty with this unit. The aerial lift portion of the unit will be Cal-Osha certified before any purchase would take place. The chassis will be inspected by Pedro Castillo, our mechanic, to determine if any repairs are needed that Baker Equipment will have to accomplish before the sale. In recommending the purchase of a used piece of equipment, instead of new equipment, is that the Department needs additional machinery which will replace broken/unrepairable equipment. This includes a 1963 Asplundh Chipper that is broken and not worth investing the time, money and effort to repair and maintain. We also require a small tree and root stumper to alleviate tree root damage in our parkways and tc remove tree stumps. By purchasing this used equipment we can purchase the additional equipment and stay within the approved budget. For a background comparison, a new aerial lift truck in 1991 dollars, is approximately S70,000 whereas this unit is $24,850.00. RECOMMENDATION: Council approve the purchase of the aerial lift truck from Baker Equipment Leasing Company in the amount of $24,850 plus tax and license from LLMD funds.
