No. 95-6000780 MEMO TO: Honorable Mayor and Members of the City Council Via Pamela S. Easter, City Manager FROM: Henry Garcia, Assistant City Manager DATE: September 27, 1990 SUBJ: 1991-1993 URBAN COUNTY CDBG COOPERATING AGREEMENT REQUESTED AMENDMENT The City Council, at their regular meeting of July 3, 1990, agreed to participate in the County of Riverside's Community Development Block Grant Program for the upcoming 3 years (1991-93). In reviewing the County executed agreements with the various cooperating cities, the Department of Housing and Urban Development (HUD) has determined that the language of the original agreement is not specific enough regarding the promotion of fair housing activity by the City and County. Therefore, the language of the CPD Notice 90-24, paragraph 2(g) must be included in the cooperative agreement. Secondly, there is a typographical error in the cooperation agreement (paragraph 4(e), that shows an incorrect citation. Therefore, HUD is asking the County to amend their agreements with the cities to incorporate these changes. The attached amendment contains language requested and approved by HUD. A1.1 cooperative Cities are being asked to make these changes. Cities who do not execute the amendment will not be approved to participate in the Urban County CDBG Program. In addition, HUD did not approve the July 3, 1990 City Council meeting minutes, wherein, Councilman Boykin made the motion to notify the County that San Jacinto will participate with the County in the Urban County 1991-1993 CDBG Program. HUD is requesting the minute language be specific. Therefore, it is recommended that the City Council take two separate actions: 1. Approve the First Amendment to the Three Year Cooperation Agreement, and the minute order authorizing the execution of the agreement by the Mayor. 2. Affirm that the City of San Jacinto will participate in the three year (1991-1993) cooperative program and authorize the Mayor to execute said agreement. DATE: August 29, 1990 SUBJECT: City of Hemet's Surplus Striper During our discussion about the possibility of purchasing the used striper the City of Hemet has for sale, you instructed me to find out if it would meet our require- ments. I talked with Don Baca, the Traffic Control Technician with the City of Hemet, and he explained the stripers capabilities with me. He is very knowledgeable about the striper having operated it as one of his normal work tasks. The striper has the capability to paint the following patterns: 1. Solid double yellow lines w/a black center line 2. Single solid yellow line, broken yellow line w/ a black center line 3. Single broken yellow line 4. Single solid white line 5. Single broken white line It also allows glass beads to be sprayed out in con- junction with the paint to enhance night visibility of the painted lines. Richard Broos, Street Superintendent for the City of Hemet indicated that they would likely accept $3000.00 for the machine. He also indicated he would have his personnel train our employees in the machines operation. My suggestion if you decide we should purchase this equipment is that as part of the purchase price, all maintenance, parts and operation manuals be included. continued This machine wiii meet all of our needs to promote safer driving conditions on our streets. In addition, we would not have to pay large sums of money to a striping con- tractor to paint our streets on a regular basis or as we could afford it. It would allow my crews to paint our streets on an on -going basis and as needed. without the aforementioned expenditure associated with a contractor. FROM: THOMAS W. GIITINS, EXECUTIVE VICE PRESIDEN RE: U.S.-U.S.S.R. SISTER CITIES CONFERENCE SEPTEMBER 12-15, 1991 The U.S.-U.S.S.R. Sister Cities Conference in 1991 has been awarded to Cincinnati, Ohio. This is the reciprocal conference to the one held in Tashkent, Central Asia in May 1989. The dates for the Cincinnati meeting are September 12-15, 1991. This conference will be one of five major events during 1991 marking the 35th Anniversary of the Sister Cities Program in the United States. Cities in the Soviet Union that are working toward sister city affiliations in the United States will have an opportunity to send two or three (2-3) representatives to the conference in Cincinnati and to visit their American sister city once the conference ends. Each U.S. city that attended the Tashkent meeting has committed to provide conference hosting (room and board), domestic transportation (travel cost from point of entry to Cincinnati) and local community hosting for the 2-3 representatives from its sister city in the Soviet Union who will be attending the 1991 conference. This is part of a reciprocal arrangement agreed upon for participation in the Tashkent meeting in which all in-country hosting and transportation were provided for the American delegates by their Soviet sister cities. U.S. cities that did not attend the Tashkent meeting are asked to agree to those same bilateral hosting arrangements for the Cincinnati meeting. The reciprocal arrangement provided by the sister city in the Soviet Union will enable you to send 2-3 representatives to your future Soviet sister city with all in-country hosting and transportation provided. It is hoped that each American city working toward a sister city in the Soviet Union will participate in the Cincinnati meeting together with representatives from your sister city. Due to factors including logistics, management and costs and in order to maintain a relatively even level of American and Soviet participation, it will be necessary to limit the number of American representatives to no more than three (3) representatives per city. At least one (1) representative from each American city should be the mayor or a city council member. For the purposes of advance planning we would like to know how many representatives from your city you expect will attend the Cincinnati Conference. Additionally, we would like to know who will be designated to receive all information regarding the 1991 U.S.- U.S.S.R. Conference. Please return the enclosed commitment form by October 1, 1990. Dialogue between Sister Cities International and the Association of Sister Cities of the USSR (new title for the Association in Moscow) and between Cincinnati and Kharkov about the conference is well underway. SCI and the Association are discussipg a broad range of issues ranging from conference fee to workshop topics. We expect to conclude those discussions in October 1990 in Moscow. SCI will begin sending detailed information on all aspects of the conference in November 1990. U.S.-U.S.S.R. DIRECTORY Sister Cities International is proud to announce that it will be producing a Directory of U.S. Chairpersons for sister city committees with or working toward a sister city in the U.S.S.R. The Directory is in response to increasing requests by local committees to network with other U.S. cities that have Soviet sister cities. SCI would like to know if you would like to have your address and/or telephone listed in this Directory. The Directory will be for the exclusive use of U.S. city committees that have sister cities in the U.S.S.R. and have paid dues. This will be a member service at no cost. The Hayden Initiative tries to address too many important environmental concerns with a single stroke. Proposition 128 covers subjects such as global warming, ozone depletion, water treatment and supply, air conditioning, food production, timber l offshore oil drilling and many others. This 39 page and more than 16,000 word document is simply too complex and costs too much. We need to vote on all these issues separately. Unfortunately, we are not gin/en that choice. We have to vote to accept the entire package—ME GOOD, THE BAD AND THE UGLY. THE 1,.)AL Prop. 128 costs to itiuch! According to the initial estimate by the non-partisan state Legislative Analyst, Prop. 128 would cost taxpayers nearly $3 billion with "additional unknown costs" to state and local taxpayers. Other independent economic experts estimate the costs could be as high as $12 billion every year! Would Increase "razes! Californians can't afford that pricetagl With our state's ongoing fiscal problems, the last thing we need to do is put more lawyers, consultants, regulators and bureaucrats on the taxpayer payroll in Sacramento. If enacted, Californians would either experience severe cuts in essential services or higher taxes. Business would be put at a competitive disadvanta g e! California's business community, having to comply with hundreds of new govemm -ent regulations, would be placed at a competitive disadvantage with companies from other states and foreign countries. Proposition 128, the Hayden Initiative, would require such extreme regulations that it would give foreign countries major advantages over California business. That's just not FAIRI $4i) miliion bureaucracy! The Hayden initiative also creates an elected position of Environmental Advocate which would have a $40 million budget. The Environmental Advocate would have broad enforcement authority over all environmental and public health issues—independent from and more powerful than the Governor, Legislature and local governments. THE UGLY • Gasoline prices would increase up to 60 cents a gallon! • Electricity rates would Increase at lest 20%! • Reduced water supply with a doubling of water bills! • Tom Hayden, an author and carripElel co-chairman Is widely reported to be raeld73 the office of Envrronmental Advocate! • Up to a 30% Increase in food prices with up to a 40% reduction in the supply of fresh fruits and vegetables! Prop. 128 would cost nearly $3 billion, with "additional unknown costs" which could run into the billions for local government Other independent economic experts estimate the costs could be as high as $12 billion. Since there is NO FUNDING MECHANISM to cover these costs, local and state government would either have to RAISE TAXES or SEVERELY CUT ESSENTIAL SERVICES. CO- a UP! awsm.o.asm...n=masseasselt" • The Hayden initiative would significantly increase local government costs for energy and transportation. Based on California Energy Commission economic models, electricity rates would increase at least 20%. The initiative would increase gasoline prices up to 60 cents per gallon. Higher energy costs would add to:nancial and budgetary problems already faced by many cities, counties, hospital, water and school districts. • Mandatory storm water run-off control syitei would cost countici billions of dollars. Stringent water quality requirements would force all municipalities Into seco ndary sewage treatment, costing billions of local taxpayer dollars. • The elected Environmental Advocatc would have the power to sue local government agencies for noncompliance, regardless if funding Is available. • Local governing autherity woule to usurped as the elactec nvironmental Advocate could have final say over Industrial and residential development on the basis.of water quality. • Up to a 30% increase In food prices. Higher food costs would mean cities and counties which now provide nutritional program~ for seniors, the homeless and many mora l would have their costs greatly increased. • For those communities dependent on agriculture and timber, more than 100, Jobs may be lost, causing reductions in local tax revenues. WATER • 'Local elected officials, already reeling from years of drought conditions and water rationing could be faced with an even smaller water supply since the Hayden Initiative gives water priority to fish and wildlife over people and agriculture. • According to water experts, our water supply could be reduced by 2,000,000 acre feet per year--that's enough Inter for 8„.000 people annually! Secondary ewage treatment would become man&ory. Los Angeles, Orange and San Diego Counties as well as the cities of Morro Bay, Goleta and Watsonville would be forced into secondary sewage treatment. Los Angeles County alone would spend more then $350 million to comply. Local governments would no longer be allowed • to develop local plans and able to apply for federal waivers or exemptions. • Mandates expensive stormwater run off control systems. Santa Barbara water officials estimate this section alone would cost its taxpayers over $10 million to implement. o rtirigent wIcr quality control standards. Proposition 128 sets such stringent water quality standards that reclaimed water for irrigation purposes may no longer be allowed to be used. • Local r7 .:Ar boards would be granted power superseding city councils, county boards of supervisors and regional ,IcrAlng agencies. The slowing effect the Hayden initiative would have on the California economy would mean that city and county revenues could be reduced by as much as $4 to $5 billion annually. • Estimates indicate California a g ricultural counties, such as: Fresno, Tulare, Kern, Riversict", Montere y , San Joa q uin, Imperial, Stanislaus, Ventura, Kin g s and ;Vlerced, would lose 100,000 farm-related j obs alone. In the first year alone, Humboldt County officials estimate Proposition 128 would cause a tax revenue loss of more than $1.2 million. THE ENVIRONMENTAL CZAR • Enforcement authorit y over all laws related to public health and the environment would be g iven to a sin g le Environmental Advocate, with power supersedin g the Governor, Le g islature and local g overnments. • Prop.12 8 would create a new state bureaucrac y with a $40 million bud g et, addin g more law y ers, re g ulators, consultants and bureaucrats to cile state pa yroll. It would strip taxpa yers of local control and g ive it to the Environmental Czar. • rower to sue local governments The environmental advocate would be empowered to sue local governments that do not meet the initiative's criteria, regardless of whether funding is available to meet the initiative's mandates. Resulting in more lawsuits at the taxpayers' expense. What the former U.S. Surgeon General says about Prop. 128. • Or. C. The initial estimate by California's independent Legislative Analyst has said Proposition 128 would cost state and local governments nearly $3 billion with "additional unknown costs" to taxpayers -- estimated to be $12 billion a year by independent economic experts. (IP Proposition 128 would Increase Utility Rates 20%, By restricting current energy-generating sources, the initiative would force utility companies to invest in expensive alternative sources of energy such as nuclear power and natural gas. The estimated $4 billion cost to meet the standards of Proposition 128 would be borne by consumers. • The Cost of Gasoline could IncreLsc 60 Cents a Gallon. Gasoline prices could rise 60 cents a gallon within 10 years under the Hayden initiative -- based on economic models by the California Energy Commission. Diesel fuel would be hit even harder because of strict emissions standards, leading to possible rationing. This would drastically raise the price of everyday truck deliveries and subsequently consumer costs. • Proposition 128 Would Force the State to Create a New $40 Million Bureaucracy. The initiative would create a new state bureaucracy with a $40 million budget. Tom Hayden, the initiative's principal author, is widely reported to be seeking the position of Environmental Advocate, which the initiative would create. This post requires no scientific or medical background, yet would supervise the hundreds of new lawyers, regulators and bureaucrats added to the state payroll. • Proposition 12f,, :could Increalc. ooL Prices up t 30%. The initiative would ban a number of crop-protecting chemicals which could reduce the supply of California-grown fresh fruits and vegetables by 40%. The result would be felt in our supermarkets in up to 30% higher food prices and substantial increases in food costs for school lunch and senior nutrition programs. • Proposition 128 Could Result in Thousands of Lawsuits Against the State. The initiative would encourage thousands of lawsuits against state and local governments because of the measure's unrealistic and unattainable Standards. The "bounty" provision of the Hayden initiative would also allow members of groups like Earth First to share in any awards from successful lawsuits -- awards which would be paid with taxpayer dollars. • over 100,000 Jobs Could be Lost Due to Proposition 128. Staggering increases in unemployment in rural communities could occur due to the Hayden initiative's moratorium on redwood harvesting and reductions in the use of agricultural chemicals. The initiative would require the state to give first priority to fish and wildlife over people and agriculture. The result could be a worsening of water shortages and increases in water prices for consumers and farmers. I Proposition 128 Attempts Too Much. The Hayden initiative attempts to address important issues like air, water, food, wildlife and our coastline. In fact, the measure tries to regulate everything from auto air conditioners to wildlife habitats.
