Easter, City Manager DATE: January 4, 1994 SUBJECT: Metal Surge Tank Purchase RECOMMENDATION: Approve purchase of (1) metal surge tank from the Quality Tank Company in the amount of $12,990.00. FISCAL IMPACT: This surge tank is part of the Bath Welisite Treatment Plant, and will be funded by monies from the sale of the Water Bonds issued earlier this year. BACKGROUND: The Bath Wellsite Treatment Plant has been in service since November 30th. As this project nears completion, a surge tank needs to be installed on the site. This surge tank will relieve pressure surges in the water system, thus protecting our mains and treatment plant. The Hungerford & Terry Water Treatment Company has already gone out to bid for the most economical tank manufacturer. They chose the Quality Tank Company of Sandy, Oregon because of their being the lowest qualified bidder. We wish to have Quality Tank make a duplicate of the tank we have already purchased through the Hungerford & Terry contract. CITY OF SAN JACINTO STAFF REPORT TO: Honorable May FROM: John Townsel, via Pamela S. or and Members of the .City Council Water Superintendent Easter, City Manager DAME: January 4, 1994 SUBJECT: Grand Well Pump Replacement RECOMMENDATION: Approve purchase and installation of a new well -pump and column pipe at the Grand Street Wellsite. Project to be completed by Foothill Engineering of Corona for an amount not to exceed $18221.61. FISCAL IMPACT: This project will be paid for with existing monies from the water fund. Southern California Edison has set aside $5684.00 in rebate money for this project. An appropriation of $12,537.61 of water funds will be required to accomplish this project. Energy savings from the project will offset the costs within 8 months. BACKGROUND: The Grand Street Well has been recently tested for efficiency, and rated at 55%. This efficiency can be raised to 70% with a new well pump. An estimated power bill savings of $17051.85 will be achieved during the next year of operation. Water production will also be increased to approximately 2000 gpm, up from the current 1473 gpm. BIDDING RESULTS: Foothill Engineerin Heylik Drilling Layne -Western - $18,221.61 - $23,844.75 - $31,339.00 CITY OF SAN JACINTO STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: John Townsel, Water Superintendent via Pamela S. Easter, City Manager DATE: January 4, 1994 SUBJECT:-- Grand. Well Video and Cleaning RECOMMENDATION: Approve purchase of service from the Water Well Redevelopers Company for the Grand Street Wellsite. Project cost is not to exceed $3,820.00. FISCAL IMPACT: This project will be paid for from water monies. An appropriation of $3,820.00 will be required to accomplish this project. Estimated energy savings from the project will offset the costs within 12 months. BACKGROUND: The Grand Street Well has not been inspected or cleaned since July of 1984. This video inspection is vital to the lifespan of the well. The proper time for this maintenance is during periods of well repair such as that scheduled for next month. The normal bidding process could not be used for this portion of the project. There is only one qualified company in the Southern California Region which provides this service. This company has been used exclusively on all City Wells for the past 15 years. All competitors are franchises from this original contractor, and would be infringing on their service area. STAFF REPORT TO: Honorable. Mayor and Councilmembers FROM. Les Evans, Director of Public Works via Pamela S. Easter, City Manager DATE: January 4, 1994. SUBJECT: ESPLANADE AVENUE WIDENING ACROSS THE RAILROAD TRACKS RECOMMENDATION: Receive and file. BACKGROUND: Since 1991 the City of San Jacinto has been working with the owner of the railroad tracks on Esplanade Avenue to arrange for the widening of the street and repair of the pavement. The owner during the negotiations was the Atchison, Topeka and Santa Fe Railway (ATSF) Company who assured the City that plans and agreements for the widening project were being finalized. On April 1, 1993, the City received a letter from the ATSF advising that they had sold the railroad line to the Riverside County Transportation Commission (ROTC) and any future action on our project should be directed to the RCTC. In October, 1993, RCTC acknowledged that they were the owners of the railroad line crossing Esplanade Avenue and would pursue our request to widen and improve the street within railroad right of way. In November, 1993, City staff was informed that the purchase agreement between ATSF and RCTC identified the Esplanade Avenue grade crossing as an on -going project for which the ATSF would take the lead. ATSF has responded that they may have archived the files on the San Jacinto line after the sale and record retrieval may take some time. Contact with RCTC last week indicated that the ATSF had not yet retrieved their San Jacinto file and could offer no time schedule for doing so. Staff will continue to monitor the situation. City of San Jacinto STAFF REPORT A.:a --- --5 TO: Honorable Mayor and Members of the City Council via Pamela S. Easter, City Manager FROM: Ross Chadwick, Fire Chief/Building Official i00/g3 DATE: SUBJECT: January 4, 1994 WEED ABATEMENT PROGRAM PROPOSAL - 1994 RECOMMENDATION: Endorse the proposed Weed Abatement Program for 1994. BACKGROUND: As a follow-up to the City Council Workshop of September 28, 1993, on our Code Enforcement Program, Staff presents the following overview of the proposed Weed. Abatement Program for 1994 for Council consideration and comment. 1. We will continue to use our Community Beautification Ordinance, City Ordinance No. 978 to enforce the abatement of weeds in San Jacinto. The City is beginning to make some significant progress in our current weed abatement program using this ordinance. Several of our "bad" properties are beginning to get the message. 2: The City has purchased a computer program called "Dataquick" to keep current on property owners in the City. This program, which is used by title insurance companies and real estate companies, will help us notify and bill (when necessary) current owners. Our program will be updated monthly. In the past, notifying the current owner presented a problem due to the non -current information we received from the County and other sources. This in turn caused problems collecting money for City -initiated abatement. 3. Beginning in January 1994, Code Enforcement staff will begin surveying all parcels in the City. In addition to weeds, they will also be looking for other violations of the Community Beautification Ordinance. We will use volunteers where possible for this survey to assist Staff. 4. In February and March, notices will be sent out for all non -conforming parcels. The first notice will allow 10 days to clear lot. If compliance is not achieved, a 2nd notice will be mailed giving a final notice (this notice costs a $78.00 administrative fee even if the property owner clears the parcel). If the owner does not clear the lot after this 2nd notice, the City will contract out the abatement which will cost the property owner the contractor's fee plus $156.00 or 25% of the contractor's fee, whichever is higher, for administrative costs. Page 1 Weed Abatement Program Proposal - 1994 5. A lien is then placed on the property if the property owner does not pay the costs within thirty (30) days. Due to the law, we can only place liens on property once a year in August. 6. The Community Preservation Committee will continue having the responsibility to. review all weed abatement costs and any appeals from property owners. This year, the Community Preservation. Committee will do this on a monthly basis to facilitate a quicker response to property owners. In addition, we are exploring the possibility of placing a "Notice of Withdrawal of Pendency of Administrative Proceedings" with the County Recorder to "red flag" properties with unpaid weed abatement fees. This can be done on a monthly basis. Although this is not a lien, it does give us the chance to keep property from selling before the abatement costs are paid. One of the problems we have had in the past is property changing owners before the lien is placed in August. 7. Staff is currently working on all of our notification letters so they are computer generated using the Dataquick program and more customer "friendly." Copies of the new letters will be given to the Council once developed. These letters will be finalized within the next thirty days. Staff is developing an educational campaign for the newly annexed areas of the City explaining the Community Beautification Ordinance and specifically our weed abatement requirements. The City's requirements are different than the County's. We want to take a proactive approach to gain voluntary compliance rather than a heavy- handed code enforcement attitude. This will be accomplished within the next thirty days. A copy of our communication with these new residents will also be provided to City Council members. 9. As part of examining the way the City does business, we are exploring the cost effectiveness of a "Code Enforcement Abatement Officer" who would do weed abatement and also graffiti abatement. Staff is in the process of developing a proposal for the City Manager dealing with this issue. Based on the cost/benefit, the City could use this as a revenue enhancement program. This proposal will be sent to the City Manager within the next thirty days for her review. Page 2 STAFF REPORT TO: Honorable Mayor and City Councilmembers FROM: Pamela S. Easter, City Manager DATE: January 4, 1994 SUBJECT: ANNEXATION TO THE VALLEY HEALTH SYSTEM As your December 21st Council Meeting, Boardmember "Vic" Tate and. Chief Executive Officer Geoff Lang made an informational presentation to the City Council on the potential annexation of San Jacinto to the Hospital District. The attached "issues with respect to annexation and Board MakeupNalley Health System" that was distributed at the December 21st meeting reviews the various issues and questions related to. annexation. At that meeting, the City Council asked that this item be scheduled for discussion at your January 4th meeting. C: "Vic" Tate Geoff Lang ISSUES WITH RESPECT TO ANNEXATION AND BOARD MAKEUP VALLEY HEALTH SYSTEM WHAT ARE THE APPROXIMATE BOUNDARIES NOW? EAST - San Jacinto mountain ridge SOUTH - San Diego County line WEST - just west of Winchester NORTH - San Jacinto/Hemet city line WHY CHANGE? Valley Health System provides services at three hospitals to patients from an area much wider than the current District boundaries. Two of those hospitals are actually outside of the District boundaries. Even for Hemet Valley Medical Center a significant proportion of patients come from the city of San Jacinto and the unincorporated areas north of the northern boundary of the District. Populations served by District facilities should have the ability to participate in the policy making process by having the ability to vote for Directors. WHAT AREAS ARE BEING CONSIDERED FOR ANNEXATION? The northwestern annexation will include the City of San Jacinto and surrounding unincorporated areas. The western annexation will include the unincorporated areas which lie between Winchester and Sun City, and the Sun City, Menifee Lakes, and Canyon Lakes regions. HOW DO RESIDENTS IN THOSE AREAS PARTICIPATE NOW? There has long been San Jacinto area participation on the Board of the Hemet Hospital Foundation. Other ad hoc activities have generally included San Jacinto residents. There has also been active participation by San Jacinto residents in the Hemet Valley Medical Center Auxiliary and volunteer programs. There is similarly active participation by Sun City area residents on the Board of the Menifee Valley Medical Center Foundation, the Menifee Valley Medical Center Auxiliary and volunteer programs, and a formal Citizen's Advisory Council for the Menifee Valley Medical Center. While important, these activities fall short of assuring the level of representation and participation which should be offered to patients and supporters of District programs. WHAT OTHER ACTIVITIES HAVE TAKEN PLACE TO FACILITATE ANNEXATION? Recognizing that the name Hemet Valley Hospital District was exclusionary and obsolete after the District opened facilities in Sun City and Moreno Valley, the District Board changed the name of the District to Valley Health System in 1992. This was more than a symbolic gesture; it communicated a major broadening of focus and priority. WHAT IS THE PROCESS FOR ANNEXATION? The annexation process falls under the procedures set forth by the Local Agency Formation Commission (LAFCO). The process can start by petition (signatures of 5% of the voters in the affected area) or by District Board resolution. The LAFCO hearing and review process begins with either of these initiatives. The hearing and review process can take upwards of 180 days depending on the outcomes of each step of the hearing process. If there are organized protests representing over 50% of the voters the process terminates; if between 25 - 50% of voters protest, the process requires that the measure be placed on a ballot; if less that 25% of the voters protest, the annexation must be approved by LAFCO. ARE THERE ANY TAX IMPLICATIONS FOR THE AFFECTED AREAS? The District imposes no taxes for the operation of District activities and has no plans to levy such taxes. The constraints against levying such taxes make it virtually impossible for any such taxes to levied in the future. There is a small general obligation bond issue which will be retired within the next two years by the District. Even if the annexation is completed before that bond issue is retired, only the residents within the old boundaries are responsible for its retirement. WHAT ABOUT THE SIZE OF THE BOARD? The current Board of Directors is comprised of 5 members, elected at large. Hospital District law allows for the establishment of a 7 member Board. That law requires that the question of enlarging the Board be placed on the ballot for determination by District voters. WHAT ABOUT REGIONAL REPRESENTATION OR ESTABLISHMENT OF ZONES The Hospital District law allows for the zoning of the hospital district wherein the electors of each zone select one Director to represent their zone. Such zoning must accommodate demographic and geographic factors. It is expected that the newly annexed areas would have their own, discrete zones for representation. The Board of Directors, by resolution, can establish the zones unless there is a petition to overturn the zoning in which case the zoning issue must be placed on the ballot. 12/21/1993 STAFF REPORT TO: Mayor and Members of the City Council FROM: Laurie Mora, Deputy City Clerk Via: Pamela S. Easter, City Manager DATE: January 4, 1994 SUBJECT: Acceptance of City Councilmember Resignation RECOMMENDATION: Accept the resignation of Trammell Ford, City Councilmember effective January 10, 1994. December 28, 1993 City Council Henry Hafliger, Mayor City of San Jacinto 312 E. Main St. San Jacinto, CA 92583 Dear Henry, I am sorry that I am writing this letter on our Council meeting day, but it is a very necessary communication that has been weighing heavily on my mind during recent months. Over the last several months, family business has necessitated my absence from San Jacinto. During October, November and the first six days of December I was in the state of. New Mexico with my wife, Teri, my eldest daughter, Candace, and my sister, Juanita and her husband in Albuquerque. During the past two weeks I have also had to be away from San Jacinto. At the present time, I am planning additional visitations away from the City. I feel that I am being unfair to the City of San Jacinto, Council, staff and our citizens when I need to be away from the City. I have proudly served as a member of the City Council for nearly ten years. During those years, it was my privilege to also be Mayor and Mayor Pro -Tern. My wife, Teri, and family members have reminded me of how much time and energy is necessary to serve in this capacity. Therefore, I have come to the difficult decision that I cannot be absent from the City as often as required by my family and still do what is necessary to ably serve the citizens of San Jacinto. Teri and I have come to the decision that I shall resign from the Council effective January 10, 1994. We were married on January 10, 1947, and this will serve as a sentimental reminder of my years as a Councilmember as well as a recommitment to my wife and family. Kindly add my letter of resignation effective January 10, 1994 meeting agenda for action. Sincerely, Trammell B.`Ford Councilmember 0 he January 4th Council Ciry of San Jacinto • 201 East Main Street • San Jacinto, California 92583 714/654-7337 • FAX 7141054-3723 'r! ¢Lsd 011 Pecvcle9 Paper STAFF REPORT TO: Honorable Mayor and City Council FROM: Pamela S. Easter, City Manager DATE: January 4, 1994 SUBJECT: SELECTION PROCESS FOR COUNCILMEMBER Recommendation: Give staff direction on how the Councilmember vacancy will be filled. Background: The City Council needs to determine the procedure to be used for filling the vacancy brought about by the resignation of Trammell Ford. As discussed by the attached memo by City Attorney Cox, Government Code Section 36512 requires that, within 30 days from the commencement of the vacancy, the Council must fill the vacancy by appointment or make a call for an election to fill the vacancy. If an election is called, it is to be held at the next regularly scheduled election date. In talking with the County Registrar of Voters, that election would most likely be the June 1994 primary. The earlier April 1994 election might be difficult to meet due to publication and nomination deadlines in early January that are required for setting an election. The cost to the City of San Jacinto for participating in these elections would be $16,000 - $17,000 for April and $10,000 - $12,000 for the June Primary. -OVER The second option for the Council to consider is to fill the vacancy by appointment. The appointment would need to be made by February 9, 1994 to fall within the 30 day period. If this option was chosen, the following time schedule would be necessary: January 8-9, 1994 Advertise vacancy January 10-19 Accept applications January 25 First round of candidate interviews January 27 Councilmembers submit names of candidates for second round of interviews February 1 Second round of candidate interviews February 8 Special Council meeting for purpose of making appointment Attachment THOMAS M. TELEPHONE AREA CODE 909 6 SE - 1400 FAX (909) 652-3900 To: Mayor and Members of the City Council via Pamela Easter From: Jim Cox Re: Council/Clerk Vacancies I have been asked to provide information relative to the statutory requirements toward filling the vacancies of elected positions. Government Code Section 36512 requires that, within 30 days from the commencement of the vacancy, the Council must fill the vacancy by appointment, or make a call for an election to fill the vacancy. If an election is called, it is to be held at the next regularly scheduled election date, but no sooner than 90 days from the call for the election. The 30 day time limit for the Council's action commences upon the effective date of the vacancy. With regard to the City Clerk vacancy, I am informed that Mr. Brewer's letter of resignation was filed with the City clerk on December 27, 1993. By the terms of his resignation, it was effective immediately. There is no requirement that the resigna- tion be actually accepted by the Council to give it effect. For these reasons, the Council must act on or before Wednesday, January 26th, to appoint or call for election of this office. With regard to the intended resignation of Councilman Ford, effective January 10, 1994, the 30 day period will end on Wednesday, February 9, 1994. Action must be taken by that date. Easter, City Manager DATE: January 4, 1994 SUBJECT: SELECTION PROCESS FOR CITY CLERK VACANCY Recommendation: Give staff direction on how the City Clerk vacancy will be filled. Background: The City Council needs to determine the procedure to be used for filling the vacancy brought about by the resignation of Richard Brewer. As discussed in the attached memo by City Attorney Cox, Government Code Section 36512 requires that within 30 days from the commencement of the vacancy, the City Council must fill the vacancy by appointment or call for an election to fill the vacancy. Similar to the Councilmember vacancy, the next regularly scheduled election would most likely be the June 1994 primary election. The earlier April election might be difficult to meet due to publication and nomination deadlines in early January that are required for setting an election in April. It is estimated by the County Registrar of Voters that the cost to the City of San Jacinto for participating in these elections would be $16,000-$17,000 for the April election and $10,000-$12,000 for the June primary election. If an election for City Clerk was combined with one for a City Councilmember, several thousand dollars would need to be added to the above mentioned dollar amounts. The decision to call an election would need to be made by Wednesday, January 26. The second option for the Council is to fill the vacancy by appointment. The appointee must be a citizen of San Jacinto. A staff person who is also a citizen of San Jacinto may also be appointed. The appointment would also need to be made by Wednesday, January 26th. If the appointment option is chosen, a time schedule similar to the schedule outlined in the Council vacancy memo would need to be followed. However, because of the earlier January 26 deadline, a tightened schedule would be required. Most likely a second round of interviews would not be possible. Attachment THOMAS M. COX JAMES A. Government Code Section 36512 requires that, within 30 days from the commencement of the vacancy, the Council must fill the vacancy by appointment, or make a call for an election t+b fill the vacancy.
