Grisham, Housing Advisor via Brian McNabb,Community Development Director DATE: June 21, 1994 SUBJECT: Sub -Recipient Agreement For HOME Funds NEIGHBORHOOD: Heritage SOURCE OF FINANCING: Low/Moderate Housing Redevelopment Funds and Federal HOME Funds RECOMMENDATION City staff recommends that the City execute the attached Sub -Recipient Agreement with the County of Riverside for a grant of HOME Program funds in an amount of $150,000 to the City of San Jacinto for assistance in the construction of 3 homes on Brown Street on property currently owned by the Redevelopment Agency. BACKGROUND In February of this year, the City Council authorized staff to submit an application for HOME Grant Funds from the County of Riverside's Economic Development Agency. One of the potential projects submitted was for assistance in the construction of three homes on the 20,000 square foot lot previously purchased by the Agency. The Agency proposed to build three entry level detached homes for low income buyers. In return for receiving the $150,000 grant from the county, the agency would have acquired the site, prepared plans, secured the necessary approvals and permits and completed initial site improvements for the three homes. The initial off -site improvements along Brown Street have been completed. The construction drawings for the three homes have been finalized and approved by the City and permits are ready to be issued. The basic utilities, gas, electric, and telephone have been installed behind the sidewalk on the site. The City staff are currently determining the cost for the next stage of construction, the grading of the site, construction of on -site improvements, construction of the retaining walls and perimeter fencing, and construction of the home and garage slabs with utility sweeps. This next stage of activity will be done using the HOME Grant Funds and should be initiated by August of this year. The County of Riverside has provided a Sub -Recipient Agreement For The Use Of HOME Funds for approval by the City Council. This grant will allow the city to proceed with the construction of three homes for owner -occupied housing for low-income families. Low-income families are those households with an annual income equal to 80% of the median family income of the county. Once this agreement is approved by the City Council it would be returned for final approval by the County Board of Supervisors. Staff would expect this final approval to be at the July 19th Board of Supervisors Meeting. Construction of the first home would have to be initiated by September 15, 1994. The final home would have to be under construction by October 1, 1995. This allows for a phased housing project. Homes sold under this program would be limited to a maximum sales price of $79,500. We will be submitting a revised schedule for agency actions relating to the construction of the three homes. The revised schedule is attached for your review. Activity Start Date Completion 1. Box 2216 Riverside, California 92516-2216 Project Title: Brown Street Prolect-3 Homes Project Type: New Construction Location: Jacinto. Brown and 2nd Street located in the City of San Description: The City of San Jacinto in cooperation with its redevelopment agency proposes to construct three units for first- time homebuyers. This project is located in the first demonstration neighborhood selected by the Redevelopment Agency for revitalization efforts. As part of this, the RDA purchased a 20,000 square foot lot on Brown Street for the construction of single-family housing. The design consists of two three -bedroom homes of approximately 1,160 square feet each, and one four -bedroom home of 1,398 square feet. The estimated land acquisition/processing fees/construction costs for three homes on this site are $279,000 or $93,000 each. With this HOME grant, the RDA is able to reduce the cost to approximately $148,800; thus, making the sales price of approximately $59,500 for the three -bedroom and $79,500 for the four -bedroom. The project will be 100% affordable to the very low and low-income community. Total Costs To Be Paid With Home Partnership Agreement Funds: Total Sum: $150,000.00 AGENDA 9-3 TO: FROM: CITY OF SAN JACINTO REDEVELOPMENT AGENCY STAFF REPORT San Jacinto Redevelopment Agency Board Marc Grisham, Housing Advisor via Brian McNabb, Director of Community Development r-, DATE: June 21, 1993 SUBJECT: Joint Park Improvement Project - San Jacinto Elementary NEIGHBORHOOD Heritage RECOMMENDATION Agency staff recommends that the Redevelopment Agency Board approve the expenditure of a not -to -exceed amount of $20,300 for playground improvements to the San Jacinto Elementary School. FUNDING SOURCE The recommended funding would be from the Redevelopment Housing Fund (Fund 99) and is included in the Redevelopment Agency Budget. BACKGROUND The Redevelopment Agency, through its contractor, is now in the process of completing the asphalt concrete pavement for the expanded school playground at San Jacinto Elementary School. This redevelopment activity was previously approved when the contract was signed for the public infrastructure improvements for Brown and 2nd Streets. The actual bid for the playground was $34,700, which was $9,050 below the original estimate of $43,750. In the Agency's original discussions with the school district, approximately $110,928 in improvements were identified to upgrade the school grounds so that they could be used on a joint use basis for community park purposes. The School District has agreed to pay half of this amount, $55,000, from the existing school district funds currently being held by the Redevelopment Agency. This will create a 50/50 partnership between the redevelopment agency and the school district. With the $34,700 already committed for the paving of the playground, the Agency will need to commit the remaining balance of $20,300 to equal the $55,000 commitment of the District. As you are aware, there were four primary goals set by the Redevelopment Agency in working to establish this partnership process with the school. These goals were as follows: • One, to improve the school grounds for recreational purposes during off - school hours. • Two, to increase access to school grounds from the Brown and 2nd Street neighborhood for school children during school hours, and the general public after school and on weekends. • Three, to create an attractive appearance along 2nd Street. • Four, to set a model for future school district/agency partnerships. We believe that the following improvements will allow these goals to be met: ASPHALT HARD COURT DEMOLITION OF BLDG. Easter, City Manager DATE: June 21, 1994 RE: Minutes of Special Meeting of May 24, 1994 RECOMMENDATION: Approve the Minutes of the Special Meeting of May 24, 1994, as presented. MINUTES SPECIAL MEETING SAN JACINTO CITY COUNCIL AND THE CITY COUNCIL SITTING AS THE REDEVELOPMENT AGENCY AND INDUSTRIAL DEVELOPMENT AUTHORITY AND THE SAN JACINTO FINANCING AUTHORITY MAY 24, 1994 1 0 CALL TO ORDER The Special Meeting of the San Jacinto City Council was called to order at 8:10 P.M. by Mayor Hafliger at the Community Center, 625 South Pico, San Jacinto, California. Present: Absent: Councilmember Leahy, Solorio, Williams and Mayor Hafliger Council Seat Vacant A Moment of Silence was Observed for Reflection Pledge of Allegiance was led by Mayor Hafliger 2.0 SPECIAL PRESENTATIONS None 3.0 PUBLIC COMMENTS Wesley Morrett spoke regarding the intersection at Ramona Expressway and Chase, voiced concern regarding the near misses at that location and urged some type of traffic control. Stated that he felt the Planning Commission had originally called for a signal as a condition of approval. Further, felt the fencing requirement had not been met, and identified the dumping problems on the vacant portion adjacent to the project. Mayor Hafliger requested that staff follow up with a report within 30 days. A MOTION was made by Councilmember Leahy, seconded by Councilmember Solorio, to move to item 7.1 of the agenda. Motion carried on a 4-0 vote with one Council seat vacant. 7.0 CITY DEPARTMENTS 7.1 AB939 Implementation Program - City of Hemet/CR & R-Citv of Perris 1 May 24, 1994 City Manager Easter advised that the matter had been previously discussed with the City of Hemet in an earlier meeting and it was not resolved. Council postponed a decision for 30 days. Outlined for Council various options for follow up and requested direction from the Council. Comments from Council: 1. More public involvement, suggested some type of public hearing and explain the cost factors and the service the citizens would be receiving. 2. Would like to hear the citizen committee response rather than staff interpretation. 3. Request that Councilmember Solorio or Williams replace Mayor Hafliger on the subcommittee. 4. Inquired if the committee would need to comply with the Brown Act (City Attorney Cox advised they would if formed by formal action of the Council). Artis Lowenberg read a prepared statement, which was in anticipation of Council action. Identified the following points: 1. Felt the CR & R proposal would result in a cost savings. 2. Felt the citizens of San Jacinto would be subsidizing the Hemet's system. 3. The Hemet proposal would require special containers and inconvenience to citizens. 4. CR & R would guarantee meeting the reduction and absorb the liabilities of not doing so. 5. Supported contracting with CR & R and continuing with OK Associates. 6. Discouraged Council from entering into agreement with the City of Hemet for what she felt were purely political reasons. Judy Baitiger, City of Perris Mayor, stated they were still willing to work with the City and felt it was the best option for the citizens, and desired to remain a good neighbor. Heidi Ward supported the comments of Ms. Lowenberg. Voiced concerns regarding safety and the city's need for economic development (Councilmember Leahy advised that economic development was the reason behind the trip to the ICSC). May 24, 1994 David Fahrion urged that the Council review all the facts. Requested that staff include the once/twice a week business which was a 67% difference. Consented to extend their proposal for 30 days to allow the Council additional time for review. Advised they would be happy to assist with presentations to the public. Felt if the proposals were equally compared it would show less cost and more service with their proposal. Alice MacDonald was pleased with the idea of sharing information through public meetings. Stated she would be pleased to participate and felt others from Heritage Ranch would also. Concerned regarding the costs, not meeting the reduction mandate, and the quotes from Waste Management, and the guarantee by CR & R to meet the reduction mandate. Did not feel the figures from Hemet were viable and the commercial had not been fully addressed, and felt the additional trucks on the roads would add to the emission problems. Bob Zambon felt they did not have all the facts and the Hemet proposal would result in additional work for the elderly. Alan Oganesian questioned the commercial rates and the impact on small businesses with the Hemet proposal. Felt the CR & R proposal offered far more service with less cost. Further, CR & R was guaranteeing the diversion rate and if not met under the Hemet proposal would cost the citizens. Finally, felt the Hemet proposal would relinquish San Jacinto's authority. City Manager Easter clarified the Council direction as follows: Restructure the Focus Group to include members from each of the neighborhoods, take names of interested citizens and conduct 1 or 2 public meetings depending on what time would allow, to review. Present the staff report and comparison matrix for consideration. Interested citizens should contact Laurie Mora at the City Offices, 312 East Main Street. At the hour of 9:00 P.M. Council recessed. At the hour of 9:30 P.M. Council reconvened with all members present except one Council seat vacant. 4.0 REDEVELOPMENT AGENCY/FINANCING AUTHORITY None 3 May 24, 1994 5.0 CONSENT CALENDAR A MOTION was made by Councilmember Leahy, seconded by Councilmember Solorio, to approve the consent calendar as presented. Staff would report back every two weeks on the status and should have a schedule in June and by July things should be well under way. Advised that Mr. Elmore wished to address the models. 4 May 24, 1994 Mr. Greenwood stated he would hold his comments for later discussion. Wesley Morrett voiced concern that they were always waiting, noting the issue began in 1992 with calling bonds. Urged no more delays due to the models. Was not pleased with the recent weed cutting and some felt it was like the city dump. Stated that a prior weed burning was almost endless due to some toxic waste. Daniel Fontes agreed with the statements of Mr. Morrett. Further he was opposed to paying an assessment for landscaping and did not want anymore delays because of the models. Finally, stated he felt traffic control was needed at Chase and Ramona Expressway. Mayor Hafliger explained the need for traffic warrants and the possible liabilities. Ron Greenwood stated he felt the traffic control was a requirement for the developer to obtain permits. Stated there was limited ingress/egress to the tract and that further increased the need. Noted the hazards to children crossing at the location and suggested that Councilmembers were personally responsible if a child were hurt, for lack of action on the matter. Inquired what Mr. Elmore wished to address regarding the models and was advised by Council all would have to await Mr. Elmore's comments. Finally, stated he would be present at every meeting until the issues were addressed. Tony Salgado voiced concern regarding the Chase and Ramona area, as it was the gateway of the city. Concerned that it would take a tragedy to get some action. Mr. Hafliger reiterated the issues related to the need for traffic warrants and the inherit liabilities. Mr. Salgado stated the neighborhood was tired of waiting and wanted some action. Councilmember Leahy suggested that children be directed to the signal light and crosswalk up the street for crossing, and not at the uncontrolled intersection. May 24, 1994 Gil Torres noted there was a bus stop at the location and identified a previous accident which, if it had occurred while a bus was present, it would have been tragic. Richard Fiore stated the Council was elected to help them and requested they do so with regard to the landscaping and safety for the children. Mayor Hafliger requested that staff put together a letter in response and report back to the Council the second meeting in June. Public Works Director Evans reported that the warrants did not exist for a traffic control. Advised he would provide a report to those who spoke. Lengthy discussion on the warrants from previous counts. Mr. Morrett questioned how they compared to Warren Road? Mr. Evans explained the CALTRANS requirements, identified the locations which did meet warrants and the lack of funding, and simply it was not a logical place for a signal. Karry Kent suggested that staff look for some alternative ingress/egress, possibly a gravel road in the back. Dennis Elmore advised he had a landscaping contractor, met with Todd Bagley and agreed on specifications on landscaping and could begin the job in 10 days. Proposed a 10 day delay on the bonding stating they could be working on the matter in 30 days. Stated he wanted the models for the cost of landscaping, they would need to get a map and performance bond, an approval on septic tanks, could begin work in 10 days and be complete in 30 days. Community Development Director McNabb explained the existing need for improvements along State and need for a deferment but Mr. Elmore had not had a chance to analyze the cost impact. Lengthy discussion on traffic warrants, mitigation measures and requirements, funding, fencing, tumble weeds and dumping. Staff reiterated their concerns, and noted the City could not install a fence on private property. May 24, 1994 City Manager Easter advised that staff would discuss alternatives for the intersection at a staff meeting and bring back any suggestions in June. Suggested residents contact Laurie Mora for the date. George Dryer suggested as an interim measure that the speed on Ramona Expressway be reduced to 25 mph. At the hour of 10:30 P.M. Council recessed. At the hour of 10:45 P.M. Council reconvened with all members present except Councilmember Williams and one Council seat vacant. 7.3 Initial Presentation of 1994/95 Budget City Manager Easter recommended the issue be postponed until May 31, 1994, at 6:00 P.M. 8.0 MAYOR/ COUNCILMEMBER REPORTS/DISCUSSIONS Obtained a consensus of Council for personnel hearings July 6, 13 and 27, 1994. Councilmember Leahy related a meeting with County Board of Supervisor on senior housing and suggested the Mayor send a letter to the Secretary of Housing and Urban Development to clarify the issues of housing standards, enforcement and to encourage public hearings in Riverside County. At the hour of 10:55 P.M. Councilmember Williams returned to Council Chambers. Councilmember Leahy recently met with Perris and Hemet regarding traffic flow and suggested a possible coalition for input on the decision making process. Councilmember Leahy urged everyone to stop by the new Teen Center on Florida Avenue. 9.0 CLOSED SESSION At the hour of 11:00 P.M. convened in closed session with all members present except one Council seat vacant, pursuant to the following: 7 May 24, 1994 9.1 Conference with Real Property Negotiator 54956.8 Property: Superblock, Area East of San Jacinto St. bounded by Esplanade & Commonwealth Negotiating Parties: Delgado Under Negotiation: Price and terms 9,2 Pending Litigation pursuant to Government Code Section 54956.9(a) Marshall vs. City of San Jacinto 9.3 Conference with Labor Negotiators pursuant to Government Code Section 54957.6 Agency Negotiator: Cox, Kreisler Employee Organization: San Jacinto Police Officer's Association, San Jacinto Firefighters Association, Public Employees of Riverside County (PERC) At the hour of 12:17 A.M. reconvened in open session with all members present, except one Council seat vacant, and announced no reportable action being taken. 10.0 ADJOURNMENT There being no further business to conduct, the meeting was adjourned. Easter, City Manager DATE: June 13, 1994 RE: Africanized Bee Ordinance RECOMMENDATION: Waive the reading in full and read by title only, and introduce (First Reading) Ordinance No. thereby establishing regulations to control beekeep'ng practices. FISCAL IMPACT: The cost of public education, training, and safety equipment is estimated to be $2,000. BACKGROUND: Riverside County has had an ordinance regulating beekeeping practices since 1975 for all county areas. With the anticipated arrival of the Africanized Honey Bees into southern California, it has been recommended that cities adopt regulations regulating beekeeping practices. The proposed ordinance was recently adopted by the City of Hemet and has been reviewed by personnel from the local office of the Riverside County Agricultural Commissioner. It will provide guidelines for the beekeeping hobbyist as well as commercial beekeepers. It is intended to provide safeguards in residential areas. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA ESTABLISHING GUIDELINES FOR BEEKEEPING The City of San Jacinto does hereby ordain as follows: Section 1. PREAMBLE WHEREAS, honey bees are of benefit to mankind by providing agriculture, fruit and garden pollination services and by furnishing honey, wax, and other useful products and WHEREAS, domestic strains of honey bees have been selectively bred for desirable traits, including gentleness, honey production, and tendency not to swarm; and WHEREAS, gentle strains of honey bees can usually be maintained within populated areas within reasonable densities without causing a nuisance if the bees are properly located and carefully managed; Section 2. DEFINITIONS As used in this ordinance, the following words and terms shall have the meanings ascribed in this section unless the context of their usage clearly indicates another meaning: Apiary means a place where bee colonies are kept. Bee means any stage of the common domestic honey bee, Apis mellifera species. Colony means a hive and its equipment and appurtenances including bees, comb, pollen, and brood. Hive means a structure intended for the housing of a bee colony. Tract means a contiguous parcel of land under common ownership. 1 Underdeveloped property means any idle land that is not improved or actually in the process of being improved with residential, commercial, industrial, church, park, school, or governmental facilities or other structures or improvements intended for human use occupancy and the grounds maintained in association therewith. The term shall be deemed to include property developed exclusively as a street or highway or property used for commercial agricultural purposes. Section 3. Purpose The purpose of this ordinance is to establish certain requirements of sound beekeeping practices, which are intended to avoid problems that may otherwise be associated with the keeping of bees in populated areas. All beekeepers are expected to be certified and registered with the State of California as required by State law and abide by any other State or Federal laws governing beekeeping activity. Section 4. Hives All bee colonies shall be kept in Langstroth type hives with removable frames, which shall be kept in sound and usable condition. Section 5. Water Each beekeeper shall ensure that a convenient and adequate source of water is available at all times to the bees so that the bees will not congregate at swimming pools, bibcocks, pet watering bowls, bird baths, or other water sources where they may cause human, bird, livestock, or domestic pet contact. If no natural or convenient water source is available, then the operator of the apiary shall maintain a plentiful supply of fresh water within 300 feet of such apiary. Section 6. General maintenance Each beekeeper shall ensure that no bee comb or other materials that might encourage robbing are left upon the grounds of the apiary site. Upon their removal from the hive all such materials shall promptly be disposed in a sealed container or placed within a building or other bee proof enclosure. Section 7. Queens In any instance in which a colony exhibits unusually aggressive characteristics by stinging or attempting to sting without due provocation or exhibits an unusual disposition towards swarming, it shall be the duty of the beekeeper to promptly re - queen the colony. Queens shall be selected from stock bred for gentleness and non - swarming characteristics. 2 Section 8. Colony densities (a) It shall be unlawful to keep more than the following number of colonies on any tract within the City, based upon the size of configuration of the tract on which the apiary is situated: 1. one -quarter acre or less tract size -- 2 colonies, 2. more than one -quarter acre but less than one-half acre tract size -- 4 colonies, 3. more than one-half acre but less than one acre tract size -- 6 colonies, 4. one acre or larger tract size -- 8 colonies, 5. regardless of tract size, where all hives are situated at least two hundred feet in any direction from all property lines of the tract on which the apiary is situated, there shall be no limit to the number of colonies, 6. regardless of tract size, so long as all property, other than the tract upon which the hives are situated, that is within a radius of at least two hundred feet from any hive remains undeveloped property, there shall be no limit to the number of colonies. (b) For each two colonies authorized under Colony densities, subsection (a), there may be maintained upon the same tract one nucleus colony in a hive structure not exceeding one standard 9 5/8 inch depth ten frame hive body with no supers attached as required from time to time for managements of swarms. Each such nucleus colony shall be disposed of or combined with an authorized colony within thirty (30) days after the date is acquired. Section 9. Location of Apiaries (a) All apiaries owned or kept within the City of San Jacinto shall be kept and located at a place at least 300 feet from any and all public roads. (b) All apiaries owned or kept within the City of San Jacinto shall be kept and located at a place at least 500 feet distant from the nearest structure used as a dwelling or a business, unless permission from the owner or occupant of said dwelling or business has been authorized. Upon request, satisfactory evidence of such permission shall be furnished to the city inspector. 3 (c) No apiary shall be kept within any location, of the City of San Jacinto whenever the bees from such apiary which are entering lands or property of others, in sufficient amounts such as to endanger the public health or safety, or to create an unreasonable nuisance. Section 10. Fencing of flyways As allowed by this ordinance, any colony which is situated near a dwelling or business structure, school yards, or where people congregate shall maintain a flyway barrier at least six feet in height consisting of a solid wall, fence, dense vegetation, or combination thereof and extends ten feet beyond the colony in each direction so that all bees are forced to fly at an elevation of at least six feet above ground level in vicinity of the apiary. Section 11. Marking hives, presumption of beekeeping (a) In apiaries, the name, address, and telephone numbers of the beekeeper, shall be branded, painted, or otherwise clearly marked upon the structure of at least two hives and placed at opposite ends of the apiary. Instead of marking the hives, the beekeeper may conspicuously post a sign setting forth the name, address, and telephone number of the beekeeper. (b) Unless marked in accordance with subsection (a) it shall be presumed for purposes of this ordinance that the beekeeper is the person or persons who own or otherwise have the present right of possession and control of the tract upon which a hive or hives are situated. The presumption may be rebutted by a written agreement authorizing another person to maintain the colony or colonies upon the tract setting forth the name, address, and telephone number of the other person who is acting as the beekeeper. Section 12. Inspection The city inspector, or other city employees, shall have the right to inspect any apiary between the hours of 8:00 am. and 5:00 p.m. Where practicable, prior notice shall be given to the beekeeper if he resides at the apiary of if his name is marked on the hives. The city inspector or other city employees has the right, to ensure the public safety, to enter a tract anytime to investigate and if necessary abate, any feral colonies, swarms, or hazardous bees. Section 13. Compliance 4 (a) Upon receipt of information that any colony situated within the City is not being kept in compliance with this ordinance, the administrator shall cause an investigation to be conducted. If he finds that grounds exist to believe that one or more violations have occurred he shall cause a written notice of hearing to be issued to the beekeeper. (b) The notice of hearing shall set forth: 1. the date, time, and place at which the hearing will be conducted, 2. the violation(s) alleged, 3. that the beekeeper may appear in person or through counsel or other representative, and 4. that the bees may be ordered destroyed or removed from the City, at the owners expense if the hearing officer finds that they have been kept in violation of this ordinance. Notices shall be given by certified United States mail or personal delivery. However, if the City is unable to locate the beekeeper, then the notice may be given by posting the notice in a conspicuous place on or near the apiary where the condition exists. (c) The hearing shall be conducted by the Safety Manager (Hearing Officer) that will be designated by the Fire Chief. The burden shall be on the city to demonstrate by a preponderance of credible evidence that the colony or colonies have in fact been kept in violation of this article. If the hearing officer finds that the colony or colonies have been kept in violation of this ordinance, then he may order that the bees be destroyed or removed from the City, not to exceed twenty days, and that the bees not thereafter be kept upon the tract for a period of two years. In instances where the hearing officer finds that the violations were not intentional and that the beekeeper has employed corrective actions that will probably be effective to cure the violations alleged, then he may issue a warning in lieu of ordering the bees be removed or destroyed. Upon failure of the beekeeper to comply with the order, the officer may cause the bees to be destroyed and the hive -structures to be removed. In each instance in which a bee colony is destroyed all usable components of the hive structure that are not damaged or rendered unhealthy by the destruction of the bees shall upon the beekeeper's request be returned to the beekeeper, provided that the beekeeper agrees to bear all transportation expenses for their return. 5 (d) The decision of the hearing officer my be appealed to the City Council by filing a notice of appeal with the city clerk within five days following the date that the hearing officer announces his decision, or if the decision is not announced at the conclusion of the hearing, then within ten days following the date that the hearing officer places written notice of his decision in the mail to the beekeeper. An appeal shall not stay the hearing officer's decision, and it shall be the responsibility of the beekeeper to remove the bees from the City pending the determination of the appeal. (e) The provisions of this section shall not be construed to require the conduct of a hearing for the destruction of (1) any bee colony not residing in a hive structure intended for beekeeping or (2) any swarm of bees or (3) any colony residing in a standard or man-made hive, which by virtue of its condition, has obviously been abandoned by the beekeeper. (4) Bees which impose a bee hazard to the public by exhibiting unusual aggressive behavior. INTRODUCED at a regular meeting of the San Jacinto City Council held on the day of , 1994. ADOPTED by the San Jacinto City Council on the day of , 1994 by the following vote: AYES: NOES: ABSTAIN: ABSENT: ATTEST TO: City Clerk Mayor STATE OF CALIFORNIA COUNTY OF RIVERSIDE CITY OF SAN JACINTO , City Clerk of the City of San Jacinto, do hereby certify the foregoing to be a full, true and correct copy of Ordinance No. of the City Council of the City of San Jacinto, adopted by said Council at a regular meeting on the day of , 199 . City Clerk 6 AGENDA S !v STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: Les Evans, Director of Public Works VIA: Pamela S. Easter, City Manager DATE: June 21, 1994 SUBJECT: Installation of STOP Signs on Commonwealth Avenue at Fuentes Avenue Recommendation Direct staff to install STOP signs for eastbound and westbound traffic on Commonwealth Avenue at Fuentes Avenue. Fiscal Impact The cost of installation of stop signs and appropriate pavement markings is about $500.00. Background and Analysis The Chief of Police and Public Works Director met with the Principal of Park Hill Elementary School several months ago to review a perceived problem with school children crossing Commonwealth at Fuentes Avenue. The City has a policy of utilizing Caltrans warrants for installation of 4-way STOP signs. The warrants require that minimum traffic volumes entering the intersection from all approaches must average at least 500 vehicles per hour for any 8 hours of an average day. In addition, the combined vehicular/pedestrian volume from the minor street, must average 200 units per hour for the same 8 hours, with an average delay to minor street vehicular traffic of at least 30 seconds per vehicle during the maximum hour. Although formal traffic counts were not taken, the school provided pedestrian counts and staff is certain that the warrants would not be met. Although the City may be open to increased liability for installing STOP signs which do not meet warrants, the risk is relatively small on low volume residential streets. By ordering the STOP signs the City Council would make a lot of people happy in exchange for the acceptance of additional liability. Fiscal Impact: Federal Funds will be utilized to construct the traffic signal, signing and street improvements installed at this intersection. Background and Analysis: The County of Riverside, Transportation Department is finalizing plans for the installation of a traffic signal at the intersection of Esplanade and Sanderson Avenues. The installation of "NO STOPPING ZONES" at this intersection is required in order to receive the federal funds. In accordance with City Ordinance No. 987, Concerning the Regulation of Vehicular Parking in the City and Providing Penalties for Violation Thereof, the Traffic Engineer may place appropriate signs "in order to eliminate dangerous traffic hazards at any place where the Traffic Engineer may determine such to -be necessary." Although it appears the signing could be authorized by City staff, it is doubtful that the Federal Highway Administration would accept anything other than a City Council Resolution. Therefore, the City Council is asked to adopt the appropriate resolution. RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO APPROVING "NO STOPPING ZONES" AT THE INTERSECTION OF SANDERSON AVENUE AND ESPLANADE AVENUE Whereas, the Traffic Engineer of the City of San Jacinto has determined that stopping, standing or parking at the intersection of Esplanade Avenue and Sanderson Avenue may create a dangerous traffic hazard. Now, therefore, be it resolved that the City Council of the City of San Jacinto authorize the Riverside County Transportation Department to cause to be placed "NO STOPPING ZONES" at locations shown on the attached plan SRF No. 93-03-014 and dated 4-29-94. The Fiscal Year 1994195 Update of Landscaping, Lighting and Park District No. 1, An Assessment District, Pursuant To The Provisions Of Part 2, Division 15 Of The Streets And Highways Code. Recommendation: Receive public input. Fiscal Impact: At future meetings the City Council will be asked to establish property assessments for street lighting, park maintenance and landscape maintenance which will generate approximately $625,000. Background: The City has formed assessment districts for street lighting, park maintenance and landscape maintenance. Each year the City must prepare engineering reports, hold public meetings, mail official notices to property owners and establish assessments for each district. This year the recently annexed areas of Annexation Nos. 59, 66, 70 and 71 must be added to the districts. The notification process included a public notice to all 9,000 property owners in the assessment districts. Public information meetings were held on June 18, 1994. A Public Hearing is set for July 5, 1994 before the City Council and a Protest Hearing is scheduled for July 19, 1994, A brief description of the budgets for the 1994-95 Park , Lighting and Landscape Assessment Districts follows: June 21, 1994 LLMD Annexation Page No. 2 Parks The proposed park maintenance budget is up slightly from last year (about 17%) due primarily to increased costs for water. The proposed 1994-95 assessment of $14.68 for Parks is about the same as last year's assessment of $13.44 for a single family home. Street Lighting, Traffic Signals and Graffiti Abatement The proposed budget for maintenance and operation of street lighting, traffic signals and graffiti abatement is $265,000. The $24,000 increase is primarily due to the addition of street lights over the past twelve months. Each additional street light costs about $120 a year. Last year the City transferred $98,000 of Gasoline Tax Funds to the Street Lighting, Traffic Signal and Graffiti Abatement District in order to maintain an assessment of $17.12 for a single family home. This year the City Council has authorized a transfer of $50,000 of gasoline tax funds to help pay for street lighting, traffic signals and graffiti abatement. The annual assessment for a single family home will increase to $25.88 in 1994-95. Soboba Village Landscaping The special landscaping benefiting Soboba Village will be expanded this summer with the installation of landscaping along Soboba Road. The new landscaping will increase the Soboba Village Assessment from $164.50 to $229.95 annually for landscape maintenance. City-wide Landscaping The City has added approximately 15 acres of additional landscaping in Rancho San Jacinto, about 4000 lineal feet of medians on Esplanade Avenue and Ramona Expressway, and additional Ramona Expressway landscaping as part of the Sunny Hills Development. Plans for landscaping in Las Brisas, Summerchase and Mt. Valier are proceeding, and planting these areas should be accomplished soon. The cost of maintenance of these added landscaped areas is estimated at $120,000. In 1993-94 the City transferred about $35,000 in Gasoline Tax funds to offset costs of landscape maintenance in the public right of way. No Gas Tax Funds are available for this purpose in 1994-95. Spreading the full cost of maintenance of the special landscape areas to the entire City yields an annual assessment of $34.76 for a single family home. No increase in last year's Street Lighting assessment would create a shortfall in funding for street lighting, traffic signals and graffiti abatement of about $75,000. The funds could be made up by reducing expenditures on street maintenance. Parks. No increase in last year's Park Assessment would create a shortfall of about $155,000 in park maintenance funds.. Staff would recommend terminating turf maintenance in Druding Park to make up most of the shortfall. City-wide Landscaping. No increase in last year's City-wide Landscaping assessment would crate a shortfall of about $155,000 for maintenance of parkway and median landscaping and Rancho San Jacinto bicycle trails and flood control channels. Staff would recommend terminating turf and ground cover maintenance in all landscape areas and simply maintaining irrigation systems and cut back plant growth that interferred with vehicle or pedestrian traffic. June 21, 1994 LLMD Annexation Page No. 4 Proposal For Subsidy of Low Income Persons Assessments for single family homes have increased as much as $45 in the 1994-95 funding proposals. Assessments for mobile homes and apartments have increased as much as $31.50. Although the monthly increases are $3.75, or less, low income persons may still suffer. The City Council may wish to direct staff to develop a plan to rebate up to 50% of the total assessment to low income persons. h:\nary\staff.613 AGENDA S A N JACINTO Staff Report TO: Honorable Mayor and Councilmembers FROM: Les Evans, Director of Public Works via Pamela S. Easter, City Manager DATE: June 15, 1994 RE: ASSESSMENT DISTRICT 94-1 (SOBOBA SPRINGS) PROTEST HEARING Recommendation: Adopt Resolution Overruling Protests, Forming District, Ordering Acquisition of the Improvements and Confirming Assessments Adopt Resolution No. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO DESIGNATING THE DIRECTOR OF PUBLIC WORKS AS SUPERINTENDENT OF STREETS AND DESIGNATING THE TREASURER TO COLLECT AND RECEIVE ASSESSMENTS AND DIRECTING THE CITY TREASURER TO ESTABLISH A SPECIAL FUND FOR ASSESSMENT DISTRICT 94-1 (SOBOBA SPRINGS PROJECT) Adopt Resolution No. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO MAKING DETERMINATIONS, CONFIRMING ASSESSMENTS AND PROCEEDINGS, AND ORDERING PROPOSED IMPROVEMENTS IN THE MATTER OF ASSESSMENT DISTRICT NO. 94-1 (SOBOBA SPRINGS PROJECT) Award the bid for construction of the Soboba Springs Improvement Project to Nottson Construction for the amount of $875,199.10. Background and Analysis: City staff has been working with the residents of Soboba Village IV for over a year in pursuit of the following objectives: 1. Offer the property owners an opportunity to "buy-out" of the Community Facilities District for public improvements (Mello Roos). 2. Create a method of assessment to replace the Mello -Roos assessment which will be a fixed annual tax over the term of the obligation. Develop a financing mechanism for the assessment which will yield an annual tax which is less than the present CFD 2 (Mello -Roos) assessment. With the objectives in mind, City staff and a committee of Soboba IV property owners met to determine which public improvements should be installed under the proposed new assessment district. The improvements decided upon were installation of curb, gutter, sidewalk, landscaping, street lighting, pavement and drainage facilities adjacent to Soboba Village IV and the golf course. The engineer's estimate for the construction of these improvements was $726,660.65. In late May, a review of the design of the proposed debris basin located above Soboba Road by a geotechnical firm, revealed a potential need for upgrading the basin. In order to insure that funds would be available for this potential upgrade, $150,000 was added to the engineer's estimate. The new estimate of $876,660.65 was used by the City's financial consultant to develop estimates of the assessments. These estimates were presented to the property owners at a meeting on June 1, 1994. The property owners were informed that, based on the new engineer's estimate, the majority of them would have an assessment of $4,306.53. Bids for the improvement project were received on June 14, 1994. Only two bids were received. The low bid was $875,199 by Nottson Construction of Romoland. The other bid, by Stein Construction of Riverside, was 20% higher. The low bid is approximately $150,000 higher than the engineer's estimate on which the financial consultant based his $4,306.53 assessment. The high bids will add approximately $750 to the assessment. Alternatives: In view of the high bids and the unresolved geotechnical questions, the City Council may choose to reject all bids and direct the Engineer to complete additional investigations, revise construction plans accordingly and re -advertise the project. Although this approach would delay the creation of the new assessment district for a year, it may result in lower bids. RESOLUTION NO. Easter, City Manager FROM: Anna A. Vega, Finance Director SUBJECT: 1994-95 Appropriations Limit DATE: June 21, 1994 RECOMMENDATIONS Staff recommends that the City Council adopt the resolution establishing the 1994-95 Appropriations Limit according to Article XIIIB of the California Constitution. BACKGROUND Article XIIIB of the California Constitution specifies that appropriations made by State and Local Governments may increase annually by a factor comprised of the change in the greater of City or County population combined with either the change in California per capita personal income or the change in the local assessment roll due to local nonresidential construction. The State Department of Finance is mandated to provide the required changes in population and inflation for setting our 1994-95 fiscal year appropriation limit. Based on the percent change allowed pursuant to Section 7801 of the Government Code and Section 2227 & 2228 of the Revenue and Taxation Code, the appropriation limit for 1994-95 fiscal year is set at $11,148,564 (see attached calculation). RESOLUTION NO. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO CALIFORNIA, ESTABLISHING A SPENDING LIMITATION FOR FISCAL YEAR 1994-95 WHEREAS, Article XIIIB of the California Constitution provides for the establishment of a formal spending limitation; and WHEREAS, the spending limitation for Fiscal Year 1994-95 totals $11,148,564 adjusted by Per Capita Personal Income and January 1, 1994 population change. NOW, THEREFORE, BE IT RESOLVED the Fiscal Year 1994-95 spending limitation is hereby established as $11,148,564 subject to later adjustments for annexations, transfer and newly - assumed services and newly -established fees. Easter, City Manager DATE: June 21, 1994 SUBJECT: Las Brisas Landscape Status Recommendation Direct staff on whether or not to allow Windward Homes to proceed with the Las Brisas landscaping project. Background and Analysis Windward Homes has an obligation to install landscaping along Ramona Expressway and Chase Street adjacent to the Las Brisas Subdivision. This obligation is secured by a surety bond. On June 9, 1994, the City received a letter from Mr. Peter Seiersen agreeing to install the landscaping in exchange for release of his bonds. City staff agreed to his conditions. Mr. Seiersen expects to begin the installation of landscaping by June 22, 1994. Should the increased assessments for landscape maintenance not be approved, there will be inadequate funds to provide maintenance of this area. The City Council may wish to consider delaying any future landscaping of City right-of-way until maintenance funds are available. AGENDA 7• 2. STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: Les Evans, Director of Public Works VIA: Pamela Easter, City Manager DATE: June 21, 1994 SUBJECT: Removal of Medians on Esplanade Avenue, East of Santa Fe Avenue Recommendation: Do not remove the landscaped medians on Esplanade Avenue, East of Santa Fe Avenue. Fiscal Impact: Removal of medians, landscaping and irrigation systems and replacement with asphalt pavement is estimated at $25-$50 per lineal foot. Background and Analysis Mr. Ray Williams, owner of a commercial building on the North side of Esplanade Avenue, east of Santa Fe Avenue appeared at the April 5, 1994 City Council meeting and requested that the landscaped median in front of his business be removed. He has made the same request to City staff many times over the past year and each time staff has denied his request. Mr. Williams points out that the raised median makes it more difficult for customers to access his buildings and for trucks to make deliveries. While Mr. Williams is correct, the City has made the decision to install the landscaped median and spent several hundred thousand dollars installing it. Staff cannot support Mr. Williams request to remove the median. 36- 02 72 iJ 1;4 1 36-02 72 /R1-3) +04.46 SANTA FE 36- 90 72 7-5472 STREET (R1/R1-3) 6+19.79 c c w N R1 /R1-3) 37-8300 (64RIGHT) L'J z m IN) 36-9072 36+84.23 37-8471 8 38-1471 (6'LEFT) 38-43 00 - 92 00 38-9200 39-25 21 20' 1 12' S9-48 64 39-25 21 39-48 64 AGENDA^ 7. 3 - STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: Les Evans, Director of Public Works VIA: Pamela S. Easter, City Manager DATE: June 21, 1994 SUBJECT: Drainage Problem at 681 West Park Avenue Recommendation Receive and file. Fiscal There are no funds available for drainage improvements on Park Avenue. Background and Analysis Mr. Robert Gonzales (681 W. Park Avenue) appeared at the City Council meeting on April 5, 1994 to request City action in correcting a drainage problem. Mr. Gonzales' property is located on the north side of Park Avenue and his home has been constructed ten or more feet below the level of the street. Drainage from Park Hill runs off onto his lot and the properties to the west. All of these properties are low and are subject to flooding. Mr. Gonzales mentioned that he moved into his home in 1979 and his property has flooded five times since then. Most recently, there was flooding in the winter of 1993. There is no way to protect Mr. Gonzales' property from flooding by diverting water to the east, since that would only increase the flooding problem for his neighbors. Ultimately, an -underground storm drain system will have to be constructed which will discharge into a future Master Plan storm drain at Hewitt Avenue and Washington Avenue. The storm drain system is probably many years away. In the interim the Council may wish to direct staff to work with property owners to come up with a temporary drainage system crossing private property and discharging on Washington Avenue. A study would be required to calculate drainage volumes and do topographic surveys. The cost of the study could be as much as $15-20,000. Drainage improvements, including a pipe under Park Avenue and a concrete drain between Washington Avenue and Park Avenue may be $50-75,000. 439-2/ rR. A. a/o - /ZO POT hb.
