We respectfully request that the City Council, by a 4/5ths vote approve the addition of this item to the Consent Calendar as item 5.8, at the regular meeting of April 21, 1992. To: City of San Jacinto Staff and San Jacinto City Council Members From: The Rancho San Jacinto Citizens Committee Date: April 14, 1992 Re: Request for placement on the City Council meeting agenda - April 21, 1992 Enclosed is a package from the Rancho San Jacinto Citizens Committee that supports our request for the City Council to assist us in eliminating the truck route between San Jacinto Avenue and Mountain Avenue. The items in the package are as follows: o A letter stating our reasons o List of committee members o Sheets of signed petitions o Copy of Truck Ordinance #931 o Map showing the affected area o Copy of survey sent to RSJ residents o Copy of survey results To All City Council Members and San Jacinto City Staff: The Rancho San Jacinto Citizen's Committee would like to request a position on the City Council meeting agenda the evening of April 21, 1992. The purpose of this request is to discuss the elimination of the truck route ordinance that effects the stretch on Esplanade between San Jacinto Avenue, traveling east to Mountain Avenue/Ramona Expressway. Our suggestion is to amend Ordinance No.931 (an Ordinance Of The Council of the City of San Jacinto, California, designating truck routes within the City) affecting section 4 paragraph "D". We suggest the paragraph reads as follows: Esplanade Avenue from the westerly most City limits, easterly to San Jacinto Avenue. By making this amendment the truck route will stop short of the Rancho San Jacinto Master Planned Community and American Village. Ordinance No. 931 was moved, passed and adopted on March 19, 1991. At this time, Esplanade Avenue between San Jacinto Avenue and Mountain Avenue was not a through street. The repercussions of making this a truck route could not have been fully realized as to its negative impact on the community. Please review the following reasons why we feel the truck route on Esplanade between San Jacinto Avenue and Mountain Avenue should be eliminated: 1. Park Hill Elementary School is located within this area. o Children have to cross Esplanade without the assistance of traffic control devices. o Trucks travel at excessive speeds and are most active during the time children are going to school. o The elementary school is located on a blind curve. 2. Rancho Park is also located within this area. • Again, children must cross Esplanade to play at the park. Many have to wait until a traffic break in order to cross. o The tot lot/playground area is immediately adjacent to the truck route. 3. Bicycle Paths o All the bike paths are located on one side of Esplanade, so most residents need to cross the truck route in order to use the path for it's designed purpose. o Meandering sidewalks abut street curbing. Rancho San Jacinto Citizen's Committee Page 2 4. Noise Pollution o The Rancho San Jacinto Developer se lots, which we interpret as a development in which to reside. The speed cause disruption starting early Not only does the noise disrupt the these trucks cause houses to vibrate. lls residential quiet housing trucks size and in the morning. residences, but 5. House Resale Value o Many Rancho San Jacinto residents purchased homes before the truck route was extended to Mountain Avenue. We purchased our homes at a premium rate, based on the master planned community concept, and will be hard pressed to sell our property with an active truck route dividing the community. o The truck route is a deterrent to prospective buyers. 6. Street Design/Road Repair o By eliminating the truck route, the potential costs of street repairs could be significantly reduced. The Esplanade truck route runs directly through the Rancho San Jacinto Master Planned Community, dividing the neighborhood. The hazards and dangers to the community's residents should be more important than a potential time savings/convenience to truck drivers. We thank the City Council and City Staff for considering eliminating the truck route on Esplanade Avenue between San Jacinto Avenue and Mountain Avenue. Your anticipated support in this matter will be greatly appreciated. Please review the signatures we have gathered on our petitions, which shows our community's commitment and support of this issue. IF there are multiple stop signs then people will not speed along Esplanade and Commonwealth. The kids park is ❑nly 20 Feet from thL main road, Cannot have a major thoroFare on Esplanade! TRAFFIC, CUNT. ADDITIONAL TRAFFIC COMMENTS CONT. More speed control Drivers are not honoring the posted speed signs. We have a serious saftey issue For our children. Also our property is being devalued. This information [traffic] was kept From us when we purchased our property. We need to lower the posted speed or install signals or stop signs........... Undeveloped triangle of land on Evans` Villinea and Old Mountain is an eyesore. Its For sale —make it a park. Crosswalks are needed at thcsohool and at Commonwealth and Arroyo Viejo The police should enforce the existing traffic laws. 4ccordinc to the Calif. Peace Officers Assn. . cities receive 75% of the fines on traffic tickets. An average motor officer writes 1O tickets s day average Fine 50 dollars thats EOO dollars a day equals 375 dollars a day to the city, Enough to add 2 entry level officers to the police force. There is word around my street (Arroyo Viejo) that the speed limit will increase to 40 mph. IF this is true, I can't believe the rationale For such s decision. Ive tried to do 40 mph on my street, it`s not only impossible but the vehicle must be accelerated to the max From either end. I resent the Fact that in a Mella Foos funded "planned community" that our children are still not safe crossing to school and or the park due to the high speed, uncontrolled traffic, trucks in particular. Lack of proper street signs, they are placed in herd to see places Nicht lighting is poo-, some lights do not work, some east of San Jacinto turn off as you pass 13y. I would rather see the speed limit enFrroed (maybe even lowor-ed) then to see a zillion stop signs. Traffic lights are better but are very expensive ant I dont Fes' north the cost at. this timr. Tha i-itarseotion of Las Hoses and Roundelay concerns me. There is s block well on the NE corner making visibility difficult and cars are traveling to Fast going south on Las Rosas. My husband was almost hit in his oar End I was almost hit while crossing the street jogging. Esplanade should never have been designated a truck route. A truck route through a planned residential area is assinine. It is cancerous, noisy and more than likely unnessEsarliy depreciating the value of the homes that back up to it. TRAFFIC CONT. ADDITIONAL TRAFFIC COMMENTS CONT. Would like to see enforcement of the covenants that prevent perking in the street. Greatly increases the chances of accidents with children present. Esplanade should be eliminated aa e truck route from San Jacinto to Mountain, the school cross walk is unsafe (eek the crossing quard), speeding is commonplace and unenforced Traffic down Commonwealth is too Fast, average speed of traffic is about 40 mph and up since it is not properly marked, people still think that commonwealth is 40 mph and therefore go at least 40 but more go way over that. We need stop signs, 2E mph painted on the street` signs saying ''please drive slowly -children pleyinE," '`school ahead~pleese slow down" also additional 25 mph signs on both sides and 40 mph should he reduced going towards Hewitt. PAID FOR BIKE TRAILS BUT THEY ARE TOTALLY NOT USEABLE BECAUSE OF MUD AND WATER ALL THE TIME!! A TOTAL WASTE OF OUR MELLO- ROOS MONEY!! We need additional traffic control between our tract and the new pa e for a safe pedestrian and bike crossing. Portions of sidewalk are adjacent to the No. 2 lane of Esplanade and is dangerous with large trucks whizzing by. At least remove truck route sians.... People do speed down Esplanade.... The non-functioning street lights on Esplanade need to be repaired, I have advised city hall and they said the contractor still takes care of them,... Do you know there is no entry to the park on Espslnede coming from Hewitt? Whose idea was it to put a middle divider there. There is no-, enough room to make a w~turn. Commonwealth so far is not that busy` but with e park on Esplanade and children nearby, it's not safe. Safe crossings need to be provided near the park. Very bad, mud collects on bikes lanes. Will drainage overlow the bike trails? Poor drainage, terrible` terrible, terrible. Bikes trails not useable - waste of our money because drainage is so Should be cleaned out inadequate Stop the Erosion! Our First rain has come and left us with mudFilled swales, bike path crossings that become river deltas ( and then dry to create sever bumps), poor landscaping and baokfill of trenches and plants that create horrible erosion problems. The bike path/drainage system design is not Functionin-o because esthetic values took preoident over common sense. Opposed to paying for additional installation and city obligated to pay for maintenance. Mayor Boykin clarified that the action being taken was merely authorizing the engineer to prepare a report on the matter, and Mr. Smedley's concerns could be addressed at the time the report is considered. Public Works Director Evans explained the need to convert collection of assessments from the utility billing to the tax rolls to be equitable to all parcel holders and to incorporate a even spread for parks maintenance. Further, the Mello Roos covered only the installation and the ongoing maintenance is covered by annual assessments of the district, as it has been for many years. 5.13 Cooperative Agreement with County of Riverside - Mortgage Credit Certificates Adopted Resolution No. 2029 approving the agreement and authorizing the County to submit an application to the California Debt Limit Allocation Committee permitting issuance of Certificates in lieu of qualified mortgage bonds. ITEM REMOVED FROM CONSENT CALENDAR FOR SEPARA I E. ACTION: 5.8 Agreement with County of Riverside Transportation Department for Materials Testing Services on Ramona Expressway Public Works Director Evans explained that the City was working on the reconstruction of Ramona Expressway, between State and Sanderson, due to the deteriorating pavement conditions. Grant funds were received to supplement the City's funds for the project, the cost of which is estimated to be 1/4 million dollars. Testing is necessary to determine the adequacy of the base and sub -base material, so that the work prposed would hold up for the next 10 years. Staff was expediting the project as quckly as possible. Hoped to have the test results within a couple of weeks, anticanticipating to advertisein mid May with a June 3rd bid opening and award on June 16th and proceed with the work in mid July. The fastest way would be to close the street for about 30 days, depending upon the affected property owners, and if accomplished a half street at a time would be closer to 60 days. In response to Council, staff advised they could try hot patch the pot holes, but would have to obtain someone to provide this service. Robert Angeleri, voiced concerns regarding the problems associated with the road conditions, i.e., cracked tiles and noise. Gilbert Torres, advised of the petitions delivered urging road repairs (included in agenda packet) and reiterated the statements by the previous speaker, Mr. Angeleri, regarding noise and cracked tile, and emphasized the seriousness of the problem. Also noted the high rate of speed being traveled on that section of the Expressway and the possible hazards. Requested a written response within ten days as to the actions be taken to remedy. 7 April 7, 1992 In response to Council inquiries, staff advised that considering a reduction of speed in that area would have to be reviewed by the traffic engineer and a recommendation made and brought back to the Council. Council consensus that staff look at the possibility of a speed reduction and hot patching. A report would be brought back to the Council at their next meeting. A MOTION was made by Councilmember Ford, seconded by Councilmember Leahy to approve the Agreement with the County of Riverside Transportation Department for Materials Testing Services on Ramona Expressway and authorize the Mayor to execute the agreement on behalf of the City. Motion carried on a 5-0 vote. 6.0 PUBLIC HEARING 6.1 1992 Weed Abatement Resolution Fire Chief Chadwick gave a brief report on the historical actions and advised that notices had been sent. Preferred that each property owner take care of their own, but if they failed to the City must abate and this process would provide for an appeal process to benefit the citizens. In response to Council, clarified that the Superintendent referred to in the resolution was in fact the Fire Chief. Further, the contract for abatement services would be through a bid process, possibly in conjunction with the County or another city, whichever was most equitable to residents. Mayor Boykin Opened the Public Hearing There being no speakers wishing to present testimony, the hearing was closed. A MOTION was made by Councilmember Leahy, seconded by Councilmember Hafliger, to adopt Resolution No. 2030 overruling objections and determining to proceed with the 1992 Weed Abatement RESOLUTION NO. 2030 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, OVERRULING OBJECTIONS AND DETERMINING TO PROCEED WITH ABATEMENT 8 April 7, 1992 7.0 CITY DEPARTMENTS 7.1 Agreement with Valley -Wide Recreation and Park District for the Use of City Park Facilities 7.1.1 Cooperation Agreement for Sallee Park Pool Operation and Maintenance Public Works Director Evans advised of the services provided by Valley Wide, historically and as presently proposed. Clarified for Council, the agreement calls for operation of the concession stand. A MOTION was made by Councilmember Richards, seconded by Councilmember Ford, to approve the Cooperation Agreement for Sallee Park Pool Operation and Maintenance and authorize the Mayor to execute the Agreement on behalf of the City. Motion carried on a 5-0 vote. 7.1.2 Cooperation Agreement for Rancho Park Ballfields Operations and Maintenance Public Works Director Evans gave the historical background on the operation of the youth baseball program at Sallee Park for the past 14 years. The City mows the lawn and Valley Wide maintains the fields, cost of lighting and general maintenance of the field and parks. Advised the city anticipates accepting Rancho Park from the developer on Friday, since it is substantially in the form of the specifications. The schedule developed for Rancho Park was determined in conjunction with residents and addresses their concerns related to limited parking, and how late games are played and minimizing the impacts on local residents. City Attorney Cox clarified for Council the indemnification clause to protect the City. For the City to incur liability would require proof that a dangerous condition was known and allowed to exist which would not be the case if built in conformance with standards. Suggested if the two by fours were a concern to remove them. 9 April 7, 1992 Several expressions of concern were made regarding the two by four redwood boards installed as permanent foul line in the outfield. Council consensus to remove the two by fours. Mr. Evans advised that the two by fours are a part of the design and staff could remove them after acceptance. Mr. Evans further clarified for the Council that exclusivity was not reserved at other than the prescheduled times and all scheduling would be through Valley Wide. City Attorney Cox confirmed this interpretation of the agreement. Mr. Evans also advised that the scheduling was done to assure the field would not be dominated by groups and provide general public access. Valley Wide would handle scheduling since the City hasn't the resources for such a task. Police Chief Kozma advised that the upcoming parks ordinance would place the administration upon the City Manager, and public notices of use could be posted to ease concerns. Stacy Hunter, Rancho San Jacinto Residents Committee Chairperson, advised that the proposal was the best possible solution to address the resident's concerns. Would like to see the parking issue addressed in the future. Keith Gordon voiced the following concerns: 1. Entering into an agreement prior to park acceptance. 2. Agreement lacks a time limit, consideration, no provision for cancellation for failure to perform. 3. Needs to more specifically identify who the girls softball is. 4. Relinquishment of all power and authority to Valley Wide. 5. Agreement not legally enforceable. 6. Cited a number of situations he felt were detrimental to the public health, safety and welfare, and not in conformance with specifications. Suggested that light poles be padded and fencing the fields. 7. Lack of adequate parking. 8. Suggested the entire matter be tabled until the aforementioned items are resolved. 10 April 7, 1992 Wayne Stuart, urged postponement, felt that granting Valley Wide exclusive use would be a disservice to the community. Reiterated the proposal previously submitted to the Council (copy in agenda packet) for fee less baseball, softball and tee -ball. Requested the matter be tabled. In response to Council, City Attorney Cox advised that the contract was supported by consideration, and the granting to Valley Wide the right to schedule exclusively their youth programs was in exchange for providing maintenance, staff services and insurance. Felt the agreement was supported adequately by consideration and was enforceable. Mr. Evans clarified for Council that the agreement was approved the Mr. Goepp who was authorized to approve such agreements. Noted by Council that the decision many years prior, that Valley Wide was needed and established to provide recreational benefits to the community. In that vein, they have taken responsibility for insurance, staffing, administration and maintenance which the City lacks the resources to do. The recently submitted proposal by Messrs. Gordon and Stuart lack the parental support necessary and nothing concrete at this time. With such a short time as proposed with Valley Wide, the matter could be reconsidered following conclusion of the proposed schedule. Mr. Gordon advised he was only requesting a postponement and not disapproval. In response to Council stated they still needed to conduct a survey of those who would avail themselves of the program and obtain funding. Council clarified that with Valley Wide no child is turned away for lack of ability to pay. Local service clubs help to defray costs. Mr. Gordon, in response to the Council advised that he had not discussed the matter with Valley Wide and suspected they would say no. Mr. Evans advised that he had inspected the field with Mr. Goepp and Mr. Greenwood (Head of School District Maintenance) and determined the field to be in conformance with the U.S. Baseball Federation. Reminded this is a local park and not a professional field, meant to accommodate a number of activities. April 7, 1992 Mr. Evans, in response to Council, made the following amendments: Page 1 - add "1992" after August 31, in paragraph 5. Page 1 - add to the Monday through Thursday add "P.M." after each time noted and on Saturday times add "A.M." after 10:00, "Noon" after 12:00, and "P.M." after 2:00 and 4:00. Page 2 - Paragraph 1 - Add "1992" after August 31 and add another sentence at the end to read "Games will be scheduled with at least two hours between games. The ball fields will be scheduled only for San Jacinto residents. The City reserves the right to schedule games in colkil?...ktion with District." C" MU -A' iit\m. Page 2 - Paragraph 2 - Add "1992" after August 15. Page 2 - Time Schedules to add "P.M." after 5:00 and 10:00 and "A.M." after 8:00. Page 2 - Section 3 - delete "pool facility" and add "facilities". A MOTION was made by Councilmember Hafliger, seconded by Councilmember Richards, to approve the Agreement for Maintenance and Operation of Sallee Park and Rancho Park Ballfields, as amended and subject to acceptance of the park, authorize the Mayor to execute the Agreement on behalf of the City. Motion carried on a 4-0-1 vote, with Councilmember Ford abstaining, stating he was not opposed, but would prefer a chance to work out the changes to the agreement. At the hour of 9:40 P.M. the City Council recessed. At the hour of 9:47 P.M. the City Council reconvened with all members present. 7.2 City Pride Week Briefing Fire Chief Chadwick reviewed the newsletter distribution and advised of upcoming events. 7.3 Report on Street Lighting - (Frank Ogg) Community Development Director McNabb advised that staff, in reviewing the matter, found that since Edison switched to low pressure vapors the lighting is not as bright as it used to be. However, research showed the standards are consistent with other jurisdictions, including the photometrics of the fixture showing a circular pattern for a distance of 2-3 times the pole height. Generally the lights are spaced at intersections, the end of cul-de 12 April 7, 1992 -sacs and every 300 feet, with a variance of 275-325, with only a couple of exceptions. A number of inoperative lights were found, both City, Edison and developers, and work had begun to remedy this. Advised that low level illumination was provided by Ordinance in the City in cooperation with the Palomar Observatory. Suggested that a decision be made as to the purpose of lighting, whether to provide low level illumination for streets and sidewalks or to provide security lighting for neighborhoods and yards. If the later, the City would need to double the standards and there would be significant costs related to installation and also increased energy. Looked at the option of higher wattage, which would be more intense but would not shine out farther, with the potential of more light shining in on residents. Could decrease the distance between lighting on longer stretches. However, felt being more proactive on inoperable lighting to be the best solution. Mr. McNabb, in response to Council inquiries, stated they could try adding another fixture to the same pole in a different direction, which would double the energy costs with only a small increase in lighting. Suggested two possible programs to encourage residents to seek their own sensored security lighting, could provide assistance through the RDA for low and moderate income but would not address the majority, or could approach a retailer to sponsor a program to provide fixtures at a discount. Staff could look at lowering the light pole heights and using a design Keeping with the neighborhood theme, with the down side being that the height has been determined to minimize breakage. Suggested that staff run some tests of the options, using the Ogg tract and come back to Council for a decision. Mr. Ogg stated that the lights on Esplanade were yellow on the sides and the bottom was white and spreads from one side of the street to the other, as opposed to the completely yellow lights in their tract. Staff advised that the lights on Esplanade belong to Edison and are different fixtures for specific reasons. Felt certain the Pacific Lighting would cooperate in running tests. Will have the Public Works Director review the height of poles. Ed Hadley, concurs with each resident providing their own security lights. However, voiced concerns with the lighting at Old Mountain and Mountain not making the cutoff visible. Council consensus for staff to test lighting variations along Esplanade and other areas in the City, including the Montage tract. 13 April 7, 1992 7.4 Tentative Tract 23198, Request for Third Extension (Marshall Gomes) Location: West side of San Jacinto Ave., approximately 1/4 mile North of Idyllwild Dr. Community Development Director McNabb made a presentation and advised of the unusual circumstances of this tract. Since prior approval, the flood control standards had been revised to require landscaped channels and this tract included a cement lined channel. The difference in the channels would require an additional right of way from 36 feet to 50-52 feet. Staff felt the old design would not be beneficial to neighboring properties nor lend itself to connection to future development on the north. Suggested a possible waiver of fees to redesign and bring in a new map, giving an additional 5 years of life to the map. Marshall Gomes, Applicant, advised that the channel was designed to hold its own in a flood in Line J were never built because of the lack of facilities to the south. Their intention is to get the map to a recordable stage and sell or joint venture with someone to completion. It would be a financial hardship to redesign at a cost of $50,000. Had not been able to discuss with the engineer the possibilities yet. Very close to putting something together at this time and to re -engineer would probably interfere. Mr. McNabb, in response to Council, does not see Line J coming about in the in near future, probably 5 years. Council does not have to act this evening, staff could pursue some alternatives. This tract being the only one with this situation. The design has nothing to do with mitigation of on -site runoff. Mr. Gomes requested that the Council continue the matter if they did not have enough information for approval. City Attorney Cox advised that tradeoffs could probably be by way of a development agreement. Voiced concern with conditioning the extension unless the developer is in agreement, appears to be a major reworking of the map and should require a new map. A MOTION was made by Councilmember Hafliger to pursue current policy and deny the extension and work with the developer in an agreement process under circumstances. Motion failed for lack of a second. 14 April 7, 1992 Mr. Gomes advised he is not the only owner, felt it more appropriate to continue the matter and discussion regarding issues. Mr. McNabb advised the matter could be continued up to May 1, 1992, and work out a waiver of obligation. Staff could have draft a agreement and Council could deny the request on April 21st if no agreement is entered into. City Attorney Cox felt the matter could be continued since the time limit was for the benefit of the applicant and the waiver would also be to the benefit of the applicant. Suggested continuing until April 21, 1992. Mr. Gomes, Applicant, concurred with the continuance. A MOTION was made by Councilmember Hafliger, seconded by Councilmember Leahy to continue the matter to April 21, 1992, to check on a waiver and continuation beyond 60 days to work on an agreement for redesign. Motion carried on a 5-0 vote. 7.5 1991-92 Budget Amendment No. 2 - Vega Finance Director Vega, advised of a shortfall of general funds and requested a decrease of $117,818 expenditures to fund next year. Clarified there were no decreases in the Personnel Budget. City Manager Easter clarified for Council that a recruitment would be conducted for Police Officer due to the extensive time involved for background checks, and the posting of an eligibility list would be established at this time with some costs involved. The new positions being approved were those with specific RDA responsibilities. They will be looking at the Main Street area, existing redevelopment areas, code enforcement and the Housing element. Clarified that the costs for legal counsel were not increases to the City Attorney, but rather other legal services provided. The City Clerk budget for contract professional services off set by not filling the position in the original budget. A MOTION was made by Councilmember Ford, seconded by Councilmember Leahy, acting in their capacity as the City Council and the Redevelopment Agency, to adopt Resolution No. 2031, amending the 1991-92 fiscal year budget. Motion carried on a 5-0 vote. 15 April 7, 1992 MOTION AMENDED by Councilmember Leahy, seconded by Councilmember Ford, acting in their capacity as the City Council and the Redevelopment Agency, to approve the job classifications and authorize recruitment. Amended motion carried on a 5-0 vote. Councilmember Richards submitted for the record, the FPPC ruling pertaining to a possible conflict of interest. Councilmember Richards inquired regarding the status of the parking lot request by Mr. Divine? City Manager Easter advised the Public Works Director is working with him on testing, had discussed some preliminary steps and the activity is moving ahead and will be following up on the matter. Community Development Director McNabb advised they are in the process of soliciting additional proposals before coming back to Council. Councilmember Richards extended invitations to attend the Valley Outlook Conference at Valley Wide on April 9. City Manager Easter advised that Chuck Smith from Calif. Muni. Golf would be making a presentation. Mayor Boykin advised that on May 2nd the cities of Hemet and San Jacinto would be hosting the Mayors and Council conference of the League of Cities, in conjunction with the Ramona Pageant. 16 April 7, 1992 9.0 CLOSED SESSION At the hour of 11:30 P.M. STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: Brian McNahh, Director of Community Development via Pamela S. Easter, City Manager DATE: April 21, 1992 SUBJECT: FAR WEST SPHERE OF INFLUENCE AMENDMENT, 3,000 ACRES LOCATED: Southerly of Gilman Springs Road, west of Sanderson Avenue and to east of Bridge Street and Middleton Street STAFF RECOMMENDATION Staff recommends that the City Council adopt Resolution No. confirming Resolution No. 1727A and commencing proceedings for amending the sphere of influence by adding the territory indicated above. BACKGROUND On November 17, 1987 the City Council adopted Resolution No. 1727A (attached) indicating it's intention to amend the City's Sphere of Influence which would have included this area. That resolution never resulted in an application to LAFCO for such a change. However, in February of 1991, the City Council adopted a similar resolution confirming Resolution No. 1727A. That action was related to Annexation No. 66 and will be submitted to LAFCO concurrently with Annexation No. 66. The action currently proposed includes territory north and west of Annexation No. 66 and is a confirmation of the previous City Council action in 1987. An agent representing approximately 90 percent of the affected property owners approached the City to request that the area be included in our Sphere of Influence. The area in question encompasses approximately 3,000 acres and would increase the City Sphere of Influence to approximately 28 square miles. At this time, the area is predominantly in agriculture production. ectfullyySSuub4mitted, '4 '724.1 Res MC NABB Director of Community Development Attachments: 1. This was a project of the Water Department, funded in part by CDBG funds. B & SONS, the contractor on the job, apparently had financial problems which resulted in its failure to pay certain of its sub -contractors. The City received ten stop notices on the job, three of which have resulted in the filing of law suits naming the City as a defendant. As a result, I have had to expend significant time in defending the City against the claims and attempting to negotiate a resolution of all of the claims. In the midst of this, the City and B & SONS also disagreed with regard to the City's liability for additional work performed on the job, including asphalt paving not contemplated in the original contract specifications. The job was further complicated due to the City's re-routing of the water line from Third Street to avoid the Vosburg Hotel and the possible future abandonment of that street. B & SONS' bonding company, has agreed to pay, settle and release the City from the stop notice claims. Further, we have nego- tiated this last change order with B & SONS in final settlement of all claims made by them under the contract. The City is also crediting itself the sum of $3,630.00 as reimbursement for the attorney's fees it has paid to my office relating to the matter. Further specifics of the settlement are stated in the change order letter agreement enclosed with this memo. I will be happy to address any questions you may have. Respectfully submitted, James A. CITY OF SAN JACINTO STAFF REPORT TO: Honorable Mayor and City Council FROM: Brian McNabb, Director of Community Development via Pamela S. Easter, City Manager DATE: April 21, 1992 SUBJECT: TENTATIVE TRACT 23198, THIRD EXTENSION APPLICANT: Marshall Gomes • -2.1 LOCATION: West side of San Jacinto Avenue, approximately one- fourth mile north of Idyllwild Drive BACKGROUND This item was continued from April 7, 1992 to allow Staff and the applicant to explore a solution for the location and type of improvements to Line J of the Master Drainage Plan. When the subdivision was originally approved, the City was operating under the Master Plan prepared by Riverside County Flood Control. The approved tentative tract implements the County plan, proposing a 36 ft. wide concrete channel along the rear of the lots on the west side of the tract. Since the original approval, the City adopted its own Master Drainage Plan calling for grass lined channels in -lieu of concrete lined channels. Therefore, Staff has met with the applicant to implement the City Master Drainage Plan. Staff and the applicant discussed a number of alternatives which would serve to implement the Master Drainage Plan. These options and the Staff Recommendation will be presented to the Council in detail during the Oral Presentation regarding this project. Respectfully Submitted, Director of Community Development BKM:Ir STAFF REPORT DA 1'E: April 21, 1992 TO: Honorable Mayor and Members of the City Council FROM: Rick Vryheid, Public Works Superintendent SUBJECT: Ramona Expressway Repair RECOMMENDATION: Receive and file. -LI -g2 BACKGROUND: Ramona Expressway, between Potter Street and Chase Street has deteriorated significantly over the past few months. Heavy truck traffic, combined with wet weather, has accelerated the failures. Cold mix patching has proven ineffective in repairing the damage. The entire stretch of Ramona Expressway, between Sanderson and Chase is scheduled for reconstruction this summer. County Transportation Department is presently conducting tests to determine the proper structural section for the street reconstruction. Plans will be complete in early May and the bids for the project will be opened June 8, 1992. The award of bids is scheduled for June 16, 1992. Construction should take place between July 13 and August 15, 1992. In the interim period, between now and July 15, the City has received bids for hot mix patching. This process is similar to an asphalt overlay and will utilize hot asphalt and a roller. The cost of the repair will be approximately $20,000.
