south side of Cottonwood Avenue, east of the City limits. A request
to establish a Planned Unit Development Overlay on Tract 25307. The
public hearing was closed November 21, 1989 and any action deferred
to December 5, 1989. The question of whether this project is for
families or senior citizens was again raised. John Culton, 43120
Johnston, Hemet, owner of the property was at the meeting to answer
questions. He was asked about the possibility of this development
being for senior citizens because of the size of the houses and the
question of play areas if there are families with children. These
questions were answered by Jim Fain, the developer, 6150 Lusk Boule-
vard, San Diego. who said a market study had been commissioned. The
target market is not senior citizens oriented, 75 percent will be
first-time buyers or moving -up buyers. There will be a green belt,
picnic tables, barbeques, etc. There will be two -car garages plus one
other space. There is no provision for RV parking.
Councilman Divine moved to defer action on the request to the meeting of

notice of appointment to the Committee although additional new mem-
bers were appointed by the Council at the October 17 meeting. He
asked about a strategic plan for the next twenty years, and also re-
quested direction for the Committee by the Council.
IV MAYOR AND COUNCIL MEMBERS REPORTS/COMMENTS
A. Councilman Rose: What is happening with street repairs on Esplanade?
Community Development Director McNabb said the County has a stop -order
on construction because of design problems west of Palm. The stop -
order should be released soon. There is a new mess on north Alessandro.
Could staff get the County to clean up the area. Mr. McNabb said he
would contact the County.
B. Councilman Redding: Asked if Fontana Paving's mining operation is in
the City .limits; .it is.
C. Councilman Boykin commented the work on Shaver -Hewitt intersection has
been so piece -meal.. There was a timing problem in moving a power pole.
The board fence between Minor and Alessandro is not attractive, and there
is a lot of trash accumulated along the fence. This will be cleaned up.
D. Councilman Divine: Eucalyptus trees along a dirt road in the 1000 block
between Shafter and 7th need attention. Public Safety Committee of the
League has been involved this year with fire arms. Also, Committee is
recommending sprinkler systems in residences. Perhaps staff could work
on the latter item; perhaps draft an ordinance.
E. Mayor Ford: Memorial Park, how far from starting? Assistant City Mana-
ger says the plans are being returned, rejected at this time. No formal
review. A bouquet to City crews for the cleanup at the corner of Shaver
and Hewitt. Also, to Bob Wilson and Ross Chadwick for their presentation
at the United Way meeting.

MEMO
TO: Honorable Mayor and Members of the City Council
FROM: Brian McNabb, Director of Community Development
DATE: December 14, 1989
SUBJ: Adoption of Ordinance 884 (Cottonwood Estates)
On December 5th, the City Council introduced to second reading
Ordinance 884, a request to establish a Planned Unit Development
Overlay on the southwest corner of Cottonwood and Palm Avenues.
There was some hesitancy on the part of some of the Council members
to take this action, because of questions over the parking and
open space on a plan seen for the first time the night of the
meeting.
The Council's action was to introduce the ordinance to second
reading, with instructions to the developer to satisfy Staff as to
the exact parking and open space/recreation. The plan was to be
submitted within seven days, so the Council could adopt the
ordinance on December 19th.
Staff met with the developer on Wednesday, December 13th. He had
somehow gotten the impression he had until the night of the next
Council meeting to comply. He was not ready to submit any plans
to Staff.
Staff, therefore, recommends the adoption of Ordinance 884 be
continued until January 2, 1990.
Respectfully Submitted,

Staff therefore, recommends the City Council adopt Ordinance 890
extending the moratorium until April 4, 1990 to allow adequate time
for Planning Commission and City Council hearings.

SUBJ: Public Improvement Agreement
The owners of 515 East Old Second Street, George and Susan
Beauchene, recently obtained a permit to construct a room addition.
As a condition of the permit, they were required to install curb,
gutter, and sidewalk. They consulted an engineer to determine the
feasibility of installing those improvements. The engineer advised
them it would be necessary to engineer the entire street, between
Hewitt and the back entrance to Hyatt Elementary School, which was
a prohibitive cost for one lot.
The property owners have asked the City defer, by agreement, the
required improvements until such time as others on the street are
also required to install the improvements.
Staff recommends the Council authorize the Mayor to execute the
agreement and its recordation with the County Recorders Office.

AGEND
SUBJ: ACCEPTANCE OF PUBLIC IMPROVEMENTS TRACI 21564-5 AND
21564-6 AND FINAL MAP 21564-9
Tract 21564-1, through Tract 21564-8, (except 21564-4) were all recorded using
property as security for public improvements. Tentative Tract 21564-9 is now ready to
record. All plans and maps have been reviewed for applicable state and local
regulations by the Staff and Engineer and found to be in substantial conformance.
The public improvements for Tracts 21564-5 and 21564-6 have been inspected and
found to be completed in substantial compliance with plans and specifications.
The developer has requested to again use a lien contract as security. Staff has
reviewed the request and property appraisals and determined there is sufficient value
remaining on the undeveloped property to grant the request.
Staff, therefore, recommends the following:
1. Accept the public improvements for Tract 21564-5 and 21564-6.
2. Reduce the amount of security on all Tracts for which improvements have been
accepted to $10,000.00 except Tract 21564-1 which is $50,000.00.
3. Authorize the Mayor to execute the record map and Subdivision Agreement.
4. Release the previous lien contracts on the property.
5. Authorize the Mayor to execute a new substitute lien contract covering Tract
21564-1, through 21564-9 (except 21564-4).
For your information, Tentative Tract 21564-4 has not yet been processed, at the
owners request.

TO: Honorable Mayor and Members of the City Council
FROM: Brian McNabb, Director of Community Development
DATE: December 14, 1989
SUBJ: FINAL TRACT 25021
Staff and the City Engineer have reviewed Final Map 25021 and found it to be in
substantial compliance with the Conditions of Approval, the Subdivision Ordinance,
and Subdivision Map act. Staff recommends the Mayor be authorized to execute the
Final Map.
Please note the applicant is requesting the waiver of the requirement to install
improvements on both parcels in Tract 25021. A review of the subdivision map act
and the City's ordinance does not reveal any means to grant such a request.
Respectfully Submitted,
BRIAN MC NABB
Director of Community Development

RE: San Jacinto Village Apartments Tentative Final Map
Overview: Lot #434-070-019-6 along Idyllwild Drive,
San Jacinto, CA 92383, consisting of 5 acres
is being split into two sites.
A 36 unit affordable apartment complex, funded under the
United States Government and more specifically The Farmers
Home Administration section 515 for wage earners, is
proposed on one of the split lots. The City is requiring to
improve the street along both parcels.
San Jacinto Associates is asking for a variance to improve
the street only along the site that is being purchased and
built upon.
The Farmers Home Administration has taken the position that
they are not allowed by regulation to fund the improvements
not related to the project. The other improvements being
the water and sewer and the necessary street improvements
belonging to the other parcel.
Therefore, we respectfully request for The City to relieve
this affordable housing project from this requirement that
will put this funding of the entire affordable apartment
complex in financial jeopardy. Thank you.

SUBJ: Consulting Traffic Engineer
The City of San Jacinto has grown to the point where a
professionally trained traffic engineer should be available to
review traffic and traffic engineering issues as they arise.
Staff put out a request for proposal for traffic engineering
services, to which five responses were received. They were:
1. Herman Kimmel and Associates
2. The Keith Companies
3. J. F. Davidson Associates, Inc.
4. B. S. I. Consultants, Inc.
5. Justin F. Farmer Transportation Engineering, Inc.
Staff interviewed all respondents to determine their qualifications
and their compatibility with City Staff. At the conclusion of the
interviews, the four member panel unanimously recommended J. F.
Davidson be selected as traffic engineer for the City.
I have reviewed the panels recommendation and am in agreement. I,
therefore, respectfully request Chief Kozma be released from his
responsibilities as Traffic Engineer and J. F. Davidson be

The property is located within a designated flood zone. A master
drainage plan has been adopted for the San Jacinto area, but the
plan is incomplete as it relates to the subject property.
Compliance with the City's flood damage prevention ordinance will
be required at the time of development. Also, some form of master
plan implementation will no doubt be required.
There is no known seismic zone crossing the subject property.
The nearest zone is approximately 1/2 mile to the south.
Water is available to serve the site with main line extensions.
GPA 8-89 AND CZ 15-89 December 11, 1989 Page No. 1
Sewer is not currently available to the site. The master sewer
plan which includes a lift station in the vicinity of the
Expressway and Sanderson Avenue. Interim, above ground, sewage
disposal may be permitted on a short term basis. Ultimately, the
master sewer plan must be implemented. This will take coordination
with EMWD as they will be financing most of the trunk facilities.
Noise will be a factor to any development on the subject property
because of the proximity to three major roads. A
commercial/industrial development will not be substantially
impacted by this factor. It is assumed that such a development
will cause an incremental increase in the noise level.
The Ramona Expressway has a special designation on the General
Plan. Sanderson Avenue has an interim designation of urban
arterial (6 lanes). Ramona Boulevard is a secondary highway.
All other utilities not previously discussed are available with
mainline or system improvements.
DISCUSSION
The subject property is currently in Agricultural Preserve #3. In
order to develop it must be withdrawn from the preserve. A tract
map has been submitted for the property which will be processed at
a later meeting.
The property is extremely impacted by flood zones which makes it
generally undesirable for residential development, especially when
linked to the noise potential from the three neighboring roadways.
A means must be provided to complete and implement the master
drainage plan, simultaneously with development.
The location is an ideal location for industrial and commercial
due to its ready access to the Ramona Expressway and Sanderson
Avenue.
Staff is of the opinion that this property should be redesignated
as requested.

ENVIRONMENTAL ANALYSIS
This property is situated in an area that is slowly transitioning
from rural uses to urbanized uses. Portions of the subject
property are in a designated "A" flood zone. Development in this
area will need to comply with the City's Flood Damage Prevention
Ordinance.
A seismic zone crosses the property. Geologic report will have
to be approved by the County geologist prior to processing any
development plan in the affected areas.
The major street system is basically layed out in Sanderson,
Kirby, Lyon, Seventh and Cottonwood. One street must be
developed on the south side of the reservoir to connect Lyon to
Sanderson Avenue. Dedications and improvements will come as
developments are finalized.
This area will generally be serviced by E.M.W.D. for sewer and
water. The City may provide, sewer service to the north of
Cottonwood. The sewer treatment plant is located on the west
side of Sanderson Avenue. A main trunk into the facility runs
along Cottonwood Avenue with an extension south in Kirby and in
Sanderson Avenue.
Water exists in most of the existing streets, however the line
size is not generally adequate to provide the fire flows
necessary to serve single family or residential development.
Noise issues will be important as they relate to traffic on the
major roadways, particularly Sanderson Avenue. Mitigation by
walls, landscaping, setbacks, and building construction is
anticipated.
Impacts on public facilities such as highways, schools, public
safety, etc. will exist as development occurs. They cannot be
properly analyzed until such time as development is proposed.
Generally the land uses proposed by this application create the
least impacts on most public services.
The property is within the historic range of the Stephen's
Kangaroo Rat. Prior to development, a report by an acceptable
biologist shall be approved by the Department of Fish and Game,
certifying there is no Kangaroo Rat habitat in the area.
DISCUSSION
The property concerned is involved in the proposed annexation 65
to the City of San Jacinto. Prior to filing the annexation
application the general plan and zoning must be assigned. Two
subdivision maps have also been filed with the City within the
subject property, and are subject of other staff reports.

December 11, 1989 Page No. 2
The existing General Plan designates the corner of Cottonwood and
Sanderson as commercial. Staff is recommending this designation '
remain and appropriate zoning be assigned
RECOMMENDATION
The Planning Commission adopted Resolution No. 89-90 and Staff
Report, approving General Plan Ammendment 15-89, ammending the
Land Use Element of the General Plan to Low Density Residential
and Community Commercial and grant a Negative Declaration suject
to City Council ratification.
The Planning Commission also adopted Resolution No. 89-91 and
Staff Report, approving Change of Zone 23-89, Pre -Annexation

FROM: Brian McNabb, Director of Community Development
DATE: December 15, 1989
SUBJ: General Plan Amendment 17-89 and Change of Zone 25-89
APPLICANT: City Initiated
Staff initiated this proposal as a result of annexation inquiries
from some of the involved properties, the owners of which hoped to
piggy -back on Annexation 65.
At the hearing on December 13th, testimony was received from
property owners who wanted the area to remain agricultural and from
owners supporting to Staff recommendation.
At the close of the public hearing, the Planning Commission moved
to approve the Staff recommended General Plan Amendment and Change
of Zone on the basis that the existing uses would remain legal even
if City zoning was applied.
If the City Council agrees it would be appropriate to adopt
Resolution 1858 amending the Land Use Element of the General Plan
and adopt Ordinance 887 assigning pre -annexation zoning on the
effected property.

DISCUSSION
At its November meeting the Planning Commission approved a pre -

plan designation requested in General Plan Amendment 17-89.
5. General Plan Amendment 17-89 and Change of Zone 25-89 is a
prerequisite for Annexation 65.
6. The northeast part of the subject area is located within a
known A Flood Zone.
7. Portion of the northeast corner of the subject site is
within the special seismic study zone.
8. Sanderson Avenue is currently designated as a 110' major
highway. Esplanade Avenue, Seventh Street, Cottonwood
Avenue, and Lyon Avenue are designated as an 88' secondary
highway. Kirby Street is designated as a 66' collector
street.
9. Eastern Municipal Water District main sewer trunk lines are
located in Cottonwood Avenue and Sanderson Avenue with an
extension to the south in Kirby Street.
10. Water lines are in most of the existing streets, however the
size of the lines may not be adequate to provide required
fire flows to future developments.

Circulation
The property is not located within a mapped flood plain. However
the San Jacinto River is within the annexation boundaries. The
river is protected in part by a rip -rap gunite covered levee
stretching from Lake Park Drive to Olmstead. The levee continues
GPA 16-89 CZ 24-89

westerly with earthen construction.
No seismic zone exists in the subject area. The nearest mapped
flood zone is across the river along Soboba Road.
Utilities are sparse for the subject area. Waterlines exist in
Alessandro, Main Street, Camino Los Banos, and Artesia. The
property south of the Ramona Expressway is located within the
City's water service area and the remainder will most likely be
served by E.M.W.D.
Sewer is existing in Main Street, First Street, Peach, Artesia
and Cypress. In some cases, these sewers are too shallow to be
extended. The master sewer plan for the Valley calls for a trunk
sewer in the Ramona Expressway. This sewer is several years off.
In order to provide sewer to a portion of the area, the City has
created a lift station district.
Other utilities such as gas, electric, and phone are generally
available in the area but main line extensions will be necessary
as development occurs in the area.
Noise along the Ramona Expressway and Main Street may be a
concern as development is proposed. This is likely to be
mitigated by walls, landscaping, fencing, and building
construction.
Circulation in the area are existing streets Alessandro, First,
Main, Artesia, Cypress and Camino Los Banos. Camino Los Banos is
a designated intersection with the Ramona Expressway. It is
projected Vernon Street will continue north of First Street as a
collector roadway and that a collector roadway will connect
Camino Los Banos to Alessandro.
Other environmental impacts which may come up as developments are
proposed are those related to public services such as police,
fire, schools, streets, etc. These can only be adequately
analyzed when a development proposal comes forward.
DISCUSSION
This pre -annexation General Plan Amendment and Change of Zone is
a prerequisite to filing the annexation application for
Annexation 59. Staff had received individual requests from the
Polverini's, owners of 46 acres of property located north of
Artesia, west of Camino Los Banos, and Stephanie Etchart, owner
of 10.55 acres, west of Camino Los Banos and southeast of the
Polverini request. Other major land owners are the Spice Ranch
and the Ramljak's.
Staff has merged the two applications on file into one case and
added the other property involved in the annexation.
GPA 16-89 CZ 24-89
December 11, 1989 Page No. 2
The current General Plan on the property is rural residential.
This was assigned primarily because of the lack of infrastructure
to serve the area. With the creation of the sewer lift station
district and the recent extension of water lines in the area, the
utility situation has improved.
Staff has considered other land uses for the area. The
intersection of Camino Los Banos and the Expressway and some of
the frontage of Main Street may be proper for commercial. Staff
feels it is premature to assign commercial designations at this
time. Multiple family may also be appropriate but the most
likely location would be transitional from commercial to single
family.
RECOMMENDATION
The Planning Commission adopted Resolution No. 89-92 and Staff
Report, approving General Plan Amendment 16-89, ammending the
Land Use Element of the General Plan to Low Density Residential
and grant a Negative Declaration subject to City Council
ratification.
The Planning Commission also adopted Resolution No. 89-97 and
Staff Report, approving Change of Zone 24-89, Pre -Annexation
zoning of R-1 single Family Residential and grant a Negative
Declaration subject to City Council Ratification.

ENVIRONMENTAL ANAL,S
The northerly portion of the is located totally within a designated
"A" flood zone. Development in those area designated as within an
"A" flood zone must comply with the City's flood damage prevention
regulations.
There is no known seismic zone crossing the property, the nearest
zone is approximately 1/4 mile to the north across the San Jacinto
River.
Utilities are available to serve the site with main line extensions
and system improvements.
Line J of the Master Drainage System is designated to run along
the westerly boundary of the subject site.
The Ramona Expressway is designated as a 142' expressway. San
Jacinto Avenue is designated as a 66' collector street. Montrose
Avenue is shown and its designation has not been determined at this
time.
Noise may be a factor for residences that may abut the Ramona
Expressway.
The subject site is within the historic range of the Stephens
Kangaroo Rat.
DISCUSSION
The request is for C-1 (Neighborhood Commercial) zone on property
located between Bergin Street and the Ramona Expressway and between
Alessandro Avenue and San Jacinto Avenue with the remainder, and
R-1 (Single Family Residential) north of Bergin Street.
The proposed general plan designation is for Neighborhood
Commercial south of Bergin Street and Low Density Residential north

is Low Density Residential to the west, Community Commercial to the
south and Rural Residential/Agricultural to the north and east.
General Plan Amendment 14-89 and Change of Zone 21-89 is a
prerequisite for the Annexation 64.
State regulations require the zoning designation be compatible with
the land use designation.
Change of Zone 21-89 and General Plan Amendment 14-89 will create

Attached for your use and information is the Staff Report to the
Planning Commission for Tract 24217, the proposed development for
Village 2 of the Soboba Springs Specific Plan. At the close of the
public hearing, the Planning Commission recommended approval of the
tract, subject to the review by the Redevelopment Agency.
Two letters of correspondence are also attached. A letter from Ed
Evans, the owner of Soboba Springs Mobilehome Park outlining some
concerns. Mr. Evans also addressed the Planning Commission. The
second letter is from Ron Goodwin in response to Mr. Evans letter.
If the Agency wishes to approve Tentative Tract 24217, it would be
appropriate to adopt Resolution RDA 89-9.

ENVIRONMENTAL ANALYSIS
This project is Village II of Specific Plan 1-85. the Soboba
Springs Specific Plan. An Environmental Impact Report was prepared
and certified. Environmental concerns included drainage, traffic
circulation, noise, seismic, and flooding. The environmental
mitigation set out in the environmental impact report must be met
by this development.

DISCUSSION
The applicant has submitted Tentative Tract 24217 Amendment No. 1
as the first stage of completion, the required comprehensive
development plan.
This property is zoned R-2, and R-1. The original proposal was
for an R-2 designation throughout. Staff felt there were access
problems on the river side of the tract. This resulted in the
split zoning. The developer now feels the best use of the property
is a traditional single family subdivision. This is consistent
with the approved Specific Plan 1-85.
Prior to approval of any tentative tract maps, the standard
comprehensive development plan package, including floor plans and
elevations must be submitted and approved.
Staff has reviewed the proposal and has set conditions accordingly.
RECOMMENDATION
The Planning Commission adopted Resolution No. 89-88, Staff Report,
the attached Findings of Fact and Conditions of Approval, approving
Tentative Tract 24217 of Specific Plan 1-85, the Soboba Springs
Specific Plan including environmental mitigation requirements and
grant a Negative Declaration subject to ratification by the City
Council.

RE: Amended Tentative Tract 24217
Ladies and Gentlemen;
E
NOV 14 19g9
Community Development
This letter concerns the physical and environmental impact of the
amended tentative Tract 24217 on Soboba Springs Mobile Estates.
FIRST: The map does not provide for a buffer or setback against the
perimeter streets within the mobilehome park. This means a fence or
wall could be placed immediately adjacent to the curb.
This would cause the narrow streets of the mobilehome park to be
tunnelized and the residents will suffer significant loss of amenity.
Further, all mobilehomes on the perimeter streets will be facing the
"rear" of the homes in the tract. Setbacks are required for
buildings and fencing on all city streets and should, for the same
reasons, be required in this case. The only setbacks shown on the
Tract map are for Lake Park Drive and. Soboba Road.
This concern is amplified along the north and east boundaries due to
obvious adverse grade in the two properties. The pad grades in the
proposed development will be higher than the streets and pads in the
mobilehome park, amplifying the need for the setback and slope banks.
In addition, the plan shows the lots bordering the mobilehome park to
be among the shortest in the entire tract development.
Recommendation: A minimum of a 10-foot setback be required for all
lot line fences or walls adjacent to the mobilehome park. This will
permit wall placement at the top of slope and permit the existing
landscape "oleander" buffer to remain. Soboba Springs Mobile Estates
will agree to maintain the area.
SECOND: The map does not accurately reflect the property boundaries.
Recommendation: Accurate boundaries should be reflected.
Planning Commission
City of San Jacinto
November 8, 1989
Page Two
THIRD: The mobilehome park has an Agreement requiring the relocation
of the existing RV storage area of like size to be provided at the
time of the development of subject property. The plan reflects what
appears to be a portion of such area; however, the developer's
intentions are not clear.
Recommendation: Provide for a resolution to this matter.
FOURTH: The plan does not appear to provide an emergency access from
or to the mobilehome park, other than the existing main entrance.
Should the existing entrance become blocked, serious safety concerns
would arise.
Recommendation: Provide for secondary emergency access.
These concerns will have a significant impact on the mobilehome
owners and the mobilehome park. We are therefore OPPOSED to the
project as currently designed, and recommend that these environmental
and physical impacts be adequately addressed.

Re: Amended Tentative Tract 24217
'Dear Mr. Evans:
DEC 4 19E39
Community Development
We are scheduled to be heard before the City Council of the City of San
Jacinto on December 19, 1989 regarding the above referred tract map.
During the recent Planning Commission hearing, issues were discussed
relative to concerns that you expressed as set forth in your letter to
the Planning Commission dated November 8, 1989. The City of San Jacinto
requested that we work among ourselves to resolve' said concerns. I
would like to address the specific issues that were expressed in your
letter and set forth mitigating measures that hopefully will resolve
this matter, as follows:
1. Buffer or Setback Area: You requested that a 10' setback
be established around the park perimeter. Brian McNabb,
from the City, has indicated a willingness to reduce our
street width by 8'. Our project would then be designed
whereas you would benefit from ground gained by that
reduction.
2. The Map does not accurately reflect the property boundaries:
Our civil engineers have double checked the boundaries and
it is their position that we are correct. If you have other
information to the contrary, please advise.
3. RV Storage Areas: The RV storage area provided within the
tract map is for your exclusive use. Our subdivision is
not conditioned upon providing RV storage areas for our
homeowners. Thus, the area set aside for such use is
adequate and meets our requirements pursuant to out
agreement with your organization.

4. Emergency Access: We hereby agree that secondary emergency
access will be granted to your organization. The developer,
Soboba Springs Associates, retains the right to place the
location of said emergency access subject to the approval
of the City of San Jacinto. Of course, the access will be
at a point that will not impact existing mobile homes or
lots within your park.
5. Pad Elevations: You express concerns related to the higher
pad elevations for lots that border the mobile home park.
We are not able to address that concern at this time. As
you know, drainage is a critical matter relative to our
developing this site. The existing natural drainage
pattern is towards the mobile home park. We must design
our pads to reverse the direction of the natural flow
into our interior streets. Thus, it is likely that those
padswill be raised from existing grade to accommodate
this necessary consideration. We will not know the extent
of the grade change until such time as final grading and
drainage plans are prepared. Any restrictions regarding
pad elevations, at this time, would be totally unacceptable
to our organization.
I trust that the above adequately mitigates your concerns. If so, please
execute in the space provided below and forward a copy to Brian McNabb at
the City. It is our desire to be cooperative with our neighbors.. At the
same time, we expect like treatment relative to reciprocal cooperation as well.
Thanks.

SUBJ: AGREEMENT FOR PAVED PARKING IN SAN JACINTO BUSINESS
PARK
In 1987, Rudy and Beverly Van Pelt entered into agreements with the City to
construct a parking lot on two vacant lots in the San Jacinto Business Park. The
background to these agreements are this:
1. City regulations require all parking and maneuvering areas to be paved to City
standards.
2. Hurley's Automotive, without the City's knowledge or consent, fenced off the
lot to the north of his existing business to increase his parking and storage
area. The lot was not improved to City standards.
3. The County Building Department moved their operation to San Jacinto
Business Park in 1987. By ordinance, there was enough parking for the
proposed use. The County desired a fenced area for its vehicles. Mr. Van
Pelt leased him an unimproved lot.
The existing circumstances are virtually identical to those in 1987. Hurley Automotive
uses the lot for overflow parking and storage of inoperative vehicles. The County
uses their lot for parking both their vehicles as well as employee vehicles. The
substantial difference is the Lots are for sale and the agreements obscure title on the
properties. Another issue which exists today is the Air Quality Management Plan
which identifies unimproved parking lots as a source of air pollution.
Mr. Van Pelt has prepared the attached agreement which cancels the previous areas
as he feels storage of equipment and vehicles are exempt from the improvement
regulations. Staff seeks your direction in this matter.

SUBJ: LAND LEASE TO MATICH CORPORATION
Matich Corporation, who operates paving and concrete batch plenty
in a variety of locations filed a temporary use permit to
operate, for approximately 2 years, a portable concrete batch
plant in San Jacinto. Their proposed location was somewhere in
the Peacock-Radaker development.
Staff reviewed the request from the viewpoints:
1) environmental, 2) conflicts with surrounding uses. In the
case of environmental, the two concerns identified were air
pollution and noise. The air pollution issue is addressed by the
Air Quality Management District which requires a permit for the
plant. A visit to the plant which would be brought to San
Jacinto revealed tight dust control measures on the equipment.
The second concern was noise. The plant itself makes little
noise. However, the transit mix trucks make some noise, the
highest intensity of which occurs in the morning when the plant
starts up. Staff felt this noise issue was not compatible with
existing and pending uses in the southeastern portion of the
City. The temporary use permit was denied for the location.
Matich has subsequently inquired whether the City would be
willing to lease its newly acquired property on the corner of
Ramona Blvd. and Potter for a period of two years. Staff
reviewed this request and did not find the problem noted above.
There are three substantial benefits from this proposal:
1) The City will be generating revenue from its parcel.
2) There will be fewer road miles travelled by transit trucks.
This will result in less wear and tear on the roadways.
3) The sale of concrete will result in sales tax revenue, to
the City in an amount estimated to be $20,000 per year.
Staff views this request from Matich to lease City property
favorably. If the City Council concurs, Staff will finalize
negotiations with Matich, prepare a land lease, and return to
Council for final approval.
Respectfully submitted,
