7.0 CITY DEPARTMENTS
7.1 Soboba Village #4 Update - McNabb
5
September 7, 1993
Community Development Director McNabb made a presentation as
contained in the staff report on file with the City Clerk. Advised that at a
meeting with the homeowners, staff and Council representative the
issues of financing, improvements and costs were discussed. Another
meeting was scheduled for the following week and suggested that a
resolution could be reached within the next two months.
Council representative Solorio pointed out it was in the best interest of
the community as whole to resolve and suggested that the concerned
parties needed to be present even at the Council meeting to resolve the
issues.
7.2 Calling of Performance Bonds (Tracts 21900 & 21900-1) - Village 4 of
Soboba Springs Specific Plan
Community Development Director McNabb advised that the issue of
concern was the capping of the streets to prevent further impact and the
developer's schedule for improvements, due to the economy, would not
prevent the further breakdown of the roads. Noted that the
correspondence received from the developer (and added to the Council
agenda packet for the record), was accurate. Staff still recommended
that the bonds be called. In response to Council inquiries, advised that
the process could be stopped at anytime, and depending upon the
bonding company, they may be called immediately or may require
litigation. Clarified that if the process were started and then called off,
cost would have been incurred. To proceed may cause a financial
hardship, however homeowners, although willing to work with the
developer, want the improvements complete. If the process is delayed
further damage would occur to the infrastructure. City originally
considered pulling bonds, but then due to bankruptcy of the property
owner, it was more feasible to work with the developer. However,
economic times had slowed the new developer and the City was back
where they started. Felt a 60 day delay would not hurt much, in order to
try to work matters out with the developer and the homeowners. Felt the
only thing a two week delay would provide would be additional input from
the homeowners and an opportunity for the developer to negotiate.
A MOTION was made by Councilmember Ford, seconded by
Councilmember Leahy, to call the bonds.
6
September 7, 1993
Councilmembers Solorio and Wlliams both concemed that the developer
had not voiced his concerns previously. However, felt that the
homeowners group had formed and the City was committed to meeting
their needs while still trying to work with the developer. Felt a delay
would provide the opportunity for the developer to enlighten the Council
on plans for financing, improvements to be made and their timing.
TION amended by Councilmembers Ford and Leahy to continue the
matter until September 21, 1993, for a public hearing and notify the
homeowners committee to be present.
Staff advised, in response to Council, that a public hearing was not
required that the matter could be addressed under City Departments and
the taking of testimony would be at the discretion of the Council.
MOTION withdrawn by Councilmembers Ford and Leahy.
COUNCIL CONSENSUS to direct staff to work with the committee and
developer and bring the matter back to the Council at the next meeting.
7.3 Inland Valley Cablevision Response to New FCC Regulations
Tom Unglaub of Inland Valley Cablevision reviewed the new regulations
pursuant to the Cable Act and explained the affects on service locally.
Briefly there were three main areas 1) the must carry, in which they
would be required to carry certain channels and some were yet to be
announced; 2) the retransmission consent which required them to
negotiate with broadcasters to carry their signals. That aspect in the past
had been free and the regulations now required negotiation prior to
October 6th and they were still negotiating with CBS and NBC; and 3)
rate regulation, which would result in some increases and some
decreases. Ultimately the number of channels would increase and the
additional outlets would be free. Until all the regulations had been
implemented the channels would probably continue to change until
everything had been resolved and negotiated. In response to Council,
advised that the preview channel was now on 37.
Wiliam J. Lopez Hertan, Resident of Hemet, attended because he saw in
paper the agenda item. Wanted to know why rates were raised a month
ago.
7
September 7, 1993
Mayor Hafliger suggested the meeting was not the proper forum for his
questions, the agenda item was to address the new FCC regulations.
At the request of Council, City Attorney Cox advised Mr. Hertan's
questions would be at the discretion of the Mayor, but agreed it would be
better for him to talk to Mr. Unglaub after the meeting.
Mr. Unglaub agreed to address individual questions following the
meeting.
Jack South, Resident of Hemet, stated he had no complaints with service
but had questions regarding pricing the channel selections, specifically
objecting to two shopping channels and two oriental speaking channels.
Felt that five or six PBS channels would be great.
Mr. Unglaub advised that nothing was confirmed yet on how many of
what type of channels.
Councilmember Leahy called point of order.
Mayor Hafliger suggested that unless there were specific questions
relating to the agenda item, that Mr. South address his questions
following the meeting.
Mr. Unglaub clarified that the consumers were not polled on broadcasting
choices because the selections were being mandated by the FCC.
Explained that some prices were regulated and the formula was difficult
to explain. Clarified for Council that the sharing of lines with other
utilities was a very competitive issue and still not resolved.
7.4 Beaumont Sphere of Influence and Annexation Application
Community Development Director McNabb advised that Beaumont's
Council was willing to meet with San Jacinto Staff to discuss and realign
the boundaries. The matter would be before LAFCO on November 23
and action by the San Jacinto Council could be taken on September 21,
1993, after meeting with Beaumont. Detailed the area in question on the
overhead projector.
Michael Lopez Hertan, Resident of Hemet, cited that matter as one which
would affect the entire valley and hoped the Council would oppose
Beaumont coming too far down the hill. Voiced concem on the ability to
respond to fires from the Beaumont area.
8
September 7, 1993
COUNCIL CONSENSUS that staff come back with a recommendation at
the next meeting.
7.5 Economic Development Strategy
City Manager Easter made a presentation as contained in the staff report
on file with the City Clerk. Anticipated that the commercial program
would be back forconsideration on September 21, 1993, in response to
property owners on Main Street. There would be various phases in the
plan which would come back for Council consideration at later dates.
A MOTION was made by Councilmember Solorio, seconded by
Councilmember Leahy to adopt the Economic Development Strategy.
Motion canned on a 5-0 vote.
7.6 Vosburg Hotel Update
Fire Chief Chadwick advised he had met with the property owner and the
architect. They were advised to provide plans of the work and a list to
complete prior to proceeding. They were advised to provide details prior
to anymore changes or alterations. Noted that some items in question,
i.e., kitchen were a matter of health and the removal of hazardous
materials needed approval from AQMD. Suggestions were made to
reduce costs and possible altematives. Some concems had been voiced
by citizens that the structure fell under the Beautification Ordinance and
staff was trying to work with the owner and obtain a schedule for
completion. Staff would be meeting with the County Historian to make a
determination on which codes could be followed for restoration. Staff
would report back in two weeks. In response to Council, advised that the
structure was not currently listed on any registry as historical, but many
felt it should be, and should be preserved.
COUNCIL CONSENSUS that staff relay to the property owner the
urgency for completion.

Andy Montoya, Jr. urged Council support for the program. Advised that his
family had purchased the former Post Office building and hoped to secure
assistance through such a program and in spite of significant loans to begin,
they would fall short for the improvements and renovation.
Mr. McNabb advised Council that staff was working with three businesses
who had shown in interest in the program, Mr. Montoya's was one. In

There being no further Agency business, the RDA was adjourned. The hour of
adjoumment being 8:10 P.M.
5.0 CONSENT CALENDAR
Assistant to the City Manager Anderson advised that Councilmember Leahy had
requested item 5.3 tabled to give the School District and the FFA an opportunity
to bid the project.
City Attorney Cox, in response to Council, advised that the bids were good for 30
days so it was not recommended to postpone. However, they could reject the bids
and re -bid and hope for a better bid from the School District.
Council concems as follows:
1) Suggested is considering removal should remove from consent for
separate vote. Project had drug on and on and should have been
complete 6 months ago and had already taking a lot of staff time.
The lowest bid was $10,000 below estimate and it would make no
sense at the present time to delay with no proposal from the School
District or even a show of interest.
2) Such a proposal would be a burden and imposition upon the School
District and inconvenient since they already had the curriculum set
for the semester.
3) Suggested the matter be removed from consent until the next
meeting to contact the school district to see if they were interested.
4) Concem that the processes had been followed and bids accepted,
and although there were good intentions, the city needed to show a
good faith effort to the bidders. Suggested the idea be considered
for future projects.
A MOTION was made by Councilmember Ford to remove item 5.3 from the
calendar. Motion fails for lack of a second.
September 21, 1993

7.1 call_Performance Bonds (Tracts 21900 & 21900-1) - Village 4 Soboba
Springs Specific Plan - (Continued from 9/7/93 )
Community Development Director McNabb made a presentation as
contained in the staff report on file with the City Clerk. Advised that Mr.
Bigham preferred option 1, but could live with option 3.
Robert Reents representing Mountain View Homeowners Committee,
suggested that staff had made three excellent recommendations.
Advised that residents would like the streets capped and sealed as soon
as possible to avoid deterioration and then need major repair. The
compromise seemed fair to allow the builder to work with the lender to
solve and come up with funding in 60-90 days, but residents would like
the bonds called no later than January 1, 1994.
Harry Bigham advised that staff had indicated that a delay would not
impact and there was a consensus to allow 90 days for negotiations, and
it not resolved by then could call the bonds January 1, 1994, and he was
agreeable to that.
A MOTION was made by Councilmember Solorio, seconded by
Councilmember Williams, to authorize staff to call the bonds in the
amount of approximately $200,000 for Soboba Village 4, commencing
January 1, 1994, unless the developer retums with an acceptable plan
and schedule for finishing the streets. Motion carried on a 4-0 vote with
Councilmember Leahy absent.

Community Development Director McNabb indicated staff had met with
the City of Beaumont and LAFCO staff. New sphere boundaries for both
cities were proposed and found agreeable to all parties.
A MOTION was made by Councilmember Williams, seconded by
Councilmember Ford, to authorize staff to send a letter to LAFCO
supporting the proposed amendments to the Spheres of Influence for
San Jacinto and Beaumont. Motion carried on a 4-0 vote with

STAFF REPORT

FROM: Dave Anderson, Assistant to the City Manager
via Pamela S. Easter, City Manager
DATE: October 19, 1993.
SUBJECT: RESOLUTION OF SUPPORT FOR PROPOSITION '172
Recommendation:
Adopt Resolution No. in support of Proposition 172, which extends the 1/2 cent
sales tax for public safety purposes.
Background:
As a followup to Kay Ceniceros' testimony at the City Council's October 5th meeting, a
resolution of support for Proposition 172 has been put together for Council's
consideration.
As you know, the State Legislature took $81,000 in local property taxes from the City
during its last session. This proposition is an attempt to backfill a portion of this taking
and, at the same time, dedicate its use for public safety purposes.
Proposition 172 extends the existing 1/2 cent sales tax and reserves its proceeds for the
exclusive use of public safety services. The City of San Jacinto stands to gain
approximately $81,000 per year for public safety purposes should this Proposition pass
in November.
RES ON NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO
SUPPORTING THE P AGE OF PROPOSITION NO. 172
WHEREAS, the Fiscal Year 1993-94 Califomia State Legislature shifted more
than $2 billion in local property tax revenues away from cities and counties; and
WHEREAS, the City of San Jacinto's share of this permanent loss of vital local
property taxes, historically assessed for the protection of life and property, totals
$221,000 yearly; and
WHEREAS, the San Jacinto City Council continues to allocate approximately
64% of all local discretionary revenues to support public safety services; and
WHEREAS, Proposition 172 (the Local Public Safety Protection and
Improvement Act of 1993) will allow voters to decide whether to extend the existing
half -cent sales tax to preserve local public safety services; and
WHEREAS, passage of Proposition 172 is projected to yield $47 million
annually to preserve County public safety services and approximately $2 million to
cities within Riverside County to fund city public safety programs, and approximately
• 1,000 for the City of San Jacinto; and
WHEREAS, passage of Proposition 172 is vital to providing safe communities
by funding public safety services; and
NOW THEREFORE, BE IT RESOLVED that the San Jacinto City Council does
hereby support passage of Proposition 172; and
BE IT FURTHER RESOLVED that the City of San Jacinto will join with elected
and appointed officials throughout the County of Riverside in an ongoing effort to
educate the residents of this County about the services at stake when voters consider
Proposition 172 as it appears on the November 23, 1993 special election ballot.

SUBJECT: SIDEWALK REPAIRS THROUGHOUT THE CITY
RECOMMENDATION:
Approve needed sidewalk repairs throughout the City by Alford & Puyear at rates equal
to CDBG bid prices. Project shall not exceed $28,900. Project will be funded
through GAS TAX ACCOUNT # 021-4150-410-3405.
BACKGROUND:
Alford & Puyear was awarded the current CDBG sidewalk project bid and has agreed to
do this proposed project for the same bid figures.
The. Public Works Department surveyed and listed all defective sidewalk throughout the
City. We listed approximately 4,280 linear feet of sidewalk in need of removal and re-
placement totaling 21.400 square feet. Alford &Puyear will remove and replace the
sidewalk for the current CDBG price of $1.61 per square foot for removal and_$1.42 per
square foot for placing new concrete (includes forming, pouring and finishing). The to-
tal would be $64,842 for all sidewalks needing replacement. These prices are very rea-
sonable in comparison to normal small jobs where concrete removal charges are
usually $3-$5 per square foot and replacement prices of $1.75-$2.25 per square foot.
By limiting the project to $28,900 we can concentrate on the higher pedestrian traffic
areas that were not included in the CDBG project, while increasing pedestrian safety
and convenience. The remainder of the defective sidewalk can be scheduled for fol-
lowing years of CDBG projects or utilize Gas Tax funds spread over three or four years.
The following are the areas we will concentrate on to repair:

FROM: Brian McNabb, Director of Community Development

DATE: October 19, 1993
SUBJECT: GENERAL PLAN AMENDMENT 2-93
D
RECOMMENDATION
The Planning Commission recommends that the City Council adopt the attached
Resolution approving GPA 2-93:
DESCRIPTION
This is a proposal to amend the Land Use Element of the General Plan to create a policy
to require residential developments to participate in an economic development program
toward job creation.
BACKGROUND
On September 15, 1993, the Planning Commission held a second public hearing on the
proposed Land Use Element Policy and recommended Council approval It was the
consensus of the. Planning Commission that there should be a linkage between residential
development and jobs: The Commission determined that there needs to be adequate
employment opportunities for existing and future residents to ensure a high quality of life
and establish a balanced community.
An additional impetus for the proposed policy relates to the processing of Annexation 66.
During discussions with the County, the City indicated that the jobs to housing link would
be addressed. At that time we were unable to guarantee to the County that we had or
would ever have a policy statement: The proposed policy statement will read as follows
"To ensure a balance of land use and provide adequate jobs and service
opportunites for City residents, all residential projects shall participate in a
program toward economic development or the establishment of a program
toward the creation of jobs within the City."
City Council Staff Report
October 19, 1993
Page No. 2
To implement this policy, future developments will be conditioned accordingly. One
example of future conditioning is that required for Sunrise Ranch, which reads:
"Prior to the occupancy of the 500th dwelling unit within Phase I, the
developer shall provide documentation of participation in or establishment
of a program toward the creation of 500 jobs within the City, subject to the
satisfaction of the Director of Community Development. Said jobs are to
meet the SCAG affordability criterion as established in the Regional Growth
Management Plan:"
Subsequent specific plans will be conditioned similarly, essentially required to establish
or fund a program. However, all residential development will be required to comply with
this policy. These developments may be asked to provide advertising on behalf of the
C'ty or pay a small fee toward the City', economic development program. It is not the
intent of the Planning Commission and Staff to require an additional and costly impact fee,
merely to encourage the development of job producing industry.

Re: Cable Rate Regulation

RECOMMENDATION: (1) Approve the Resolution entitled "A
Resolution Of The City Council Of The City Of San Jacinto To
Authorize City Regulation Of The Rates Charged For The Basic Tier
Of Cable Television Service"; and (2) authorize staff to do all
that is necessary to initiate rate regulation, including without
limitation, obtaining FCC certification.
DISCUSSION: The City has a franchise with Inland Valley
Cablevision ("cable operator") to provide cable television
service to subscribers within the City.
On and after October 1, 1993, pursuant to recent regulations of
the Federal Communications Commission ("FCC") and the federal
Cable Television Consumer Protection and Competition Act of 1992,
the City has the legal authority to regulate rates the cable
operator charges for basic tier cable television service.
Basic tier regulation by the City is optional and is not required
by the above law. If the City elects to regulate, upon
certification by the FCC, the City may review the cable
operator's schedule of rates charged to subscribers for the basic
tier of cable television service. If such rates are higher than
the FCC benchmark rate, the City may order a reduction to the FCC
benchmark rate, or.10%, whichever results in a smaller reduction
in rates.
...
The FCC instituted a freeze on basic tier rate increases, which
freeze will be lifted on November 15th. This freeze was created
to give local entities the opportunity to request authority to
regulate rates.>

Meeting of October 19, 1993
-Cable Rate Regulation
Page 2
If the City fails to seek FCC approval to regulate, the FCC, will
assume that the City does not desire regulation The FCC will
not undertake to regulate basic rates for a city that does not
choose to self regulate,. The -FCC will presume that there is
effective competition and that regulation is not needed. Without
the City's request for FCC approval to self regulate, the cable
operator will be free to establish rates for basic cable without
oversight by any person or entity. Also," no person will be
'empowered to review the Cable operator's rates to determine if
they have been established; within the benchmark rates recommended
by the FCC.
Other than the City of Temecula, I am aware of no other City
served by Inland that has requested FCC authority to regulate.
have also read -in the paper recently that the County of.Riverside
has decided to decline regulatory authority. It is my opinion
that at'least one agency within this valley should:undertake to`
review the rates for basic cable to assure that the rates are
within the parameters established by the FCC. It should be noted
that the FCC regulations allow neighboring cities to seek joint
authority to regulate. It may be of benefit to share the
responsibility with the City of Hemet and split the
administrative expense on an equitable basis.
FISCAL IMPACT: There is a fiscal impact to initiating and
administering rate regulation. The City many incur
administrativeexpenses in becoming certified by the FCC and in
conducting the review of the cable'operator's basic tier of cable
television rates. The amount of administrative expense incurred,
by the City will vary depending on the extent with -which the -
cable operator challenges the City's regulation of iterates.'
For the most part, regulation will entail the City's:review of
the figures presented by the cable operator to assure that the.
rates are within guidelines. This should involve minimal time
and expense. Additional expense will be required should the
cable operator seek extraordinary rate increases which are
,challenged by the City, thus requiring additional review and
public hearings

SUBJECT: Code Enforcement Program Priorities - 1993/94
RECOMMENDATION:
Endorse the City's Code Enforcement Program priorities for the remainder of the 1993/94
fiscal year.
BACKGROUND:
Code Enforcement Program Mission
Continue to furnish and improve a Code Enforcement Program that provides for
quick and courteous response, timely closure of cases, and proactive involvement
in identifying and processing code violations which may impact the health, safety,
welfare or beauty of our Community.
As a follow-up to the City Council Workshop of September 28, 1993, on our Code
Enforcement Program, Staff proposes the following priorities for the next nine months:
1 . Continue to enforce the Community Beautification Ordinance, Ordinance No. 978,
but stress health and safety as our first priority.
2 Focus our code enforcement activities on target areas that are crucial to the City:
a. Entry corridors into the City.
b. Business/industrial districts.
c. Downtown area.
d. Other high visibility areas along major streets and parkways.
Page 1
October 19, 1993 - Staff Report
Code Enforcement Program Priorities 1993/94
Implement a code enforcement log as a method of better informing the Council.
Staff will once a month as part of "This Week in San Jacinto" present a monthly
summary of code enforcement activities in . City.
4 Develop and implement a customer service program:
a. Train Staff on how to effectively and t'fficiently deal with our citizens in a
positive manner.
b. Review and simplify forms, letters and other written communications with
our customers.
c. Educate the community on the code enforcement process and enhance our
communications with our _stomers.
5. Work with a Council sub -committee to review our present weed abatement process
and then develop and establish an improved weed abatement program.
6. Introduce to Council a new Business License Ordinance prior to January 1994.
7. Research, develop and then present to Council two ordinances as part of the City's
Beautification Program:
a. Real Property Records Report Ordinance.
b. Rental Housing Inspection Ordinance.
8. Continue to use the Neighborhood Action Team (NAT) in problem residential
areas and develop a Commercial Action Team (CAT) to focus on commercial areas.
9. Complete the Code Enforcement Policies and Procedures Manual.
1 0. Present the concept of a Code Enforcement Abatement Officer as part of the 1994/95
budget. This full-time City employee would abate graffiti, weeds and other code
enforcement problems rather than the City employing a contractor as we do now.
1 1. In cooperation with the Corn unity Development Department, review the City's
sign Ordinance and establish priorities on enforcement.
1 2. Remove 150 abandoned/junk vehicles.
13. Either demolish, renovate or bring up to code the remainder of our existing sub-
standard housing.
1 4. Remove all the junk along the roadways in our new annexations. Reach out to
these new neighborhoods and promote code enforcement in a positive manner.

SUBJECT: OVERVIEW OF SIGN REGULATIONS

In the Code Enforcement presentation, issues related to illegal signs were discussed. At a
subsequent meeting with Staff, a Council Committee asked that more details on the sign
regulations be presented to the Council. Listed below are highlights of the 15 page
ordinance.
1. Signs can only be installed after permits are obtained.
2. With some exceptions, a sign is any display or structure used to advertise or draw
attention, whether on the ground, building, pole, or in the air.

unless the business changes, the sign changes, etc.
4. Illegal signs are a public nuisance and shall be abated immediately.
5. Signs are to be maintained in a safe and presentable condition.
6. Signs are not allowed in or over the public right-of-way without City approval.
7. Billboards are allowed by conditional use permit in certain zones and on the Ramona

SUBJECT: Joint Meeting with the San Jacinto School Board
DP
RECONWENDATION: Select an altemate date for the Joint Meeting with the San
Jacinto School Board.
BACKGROUND
We had scheduled to have a joint meeting with the San Jacinto School Board for
Tuesday, October 26, 1993. We have since determined that two Councilmembers will
be unable to attend on this date. However, Sandy Shackelford, San Jacinto School
Superintendent and I feel this joint meeting would be most beneficial if all
Councilmembers are in attendance. Please consider November 16, 1993 at 5:30 P.M.
as a possible altemative date and give us direction on whether we should schedule
that date with the School Board.
It is anticipated that the following will be the areas of discussion:
Brown and Second St. Cooperative Use with San Jacinto Elementary
Joint efforts in the areas of:
Maintenance, Meeting Areas, Park/School Usage
School Safe Zones
DARE Program
Redevelopment Update
If you have any comments, or additional items you feel would be appropriate for this
Joint Meeting, please contact Laurie or myself.
The City Council will still have a Study Session on October 26. A draft Capital
Improvement Program and Recycling are proposed agenda items.
