Richard Breese Deputy City Clerk TO: FROM: t(-o.ln tea L ` CITY OF SAN JACINTO REDEVELOPMENT AGENCY STAFF REPORT REDEVELOPMENT AGENCY BOARD Marc Grisham, Commercial/Industrial Advisor via Brian McNabb, Dir. of Community Development DATE: September 21, 1993 SUBJECT: Commercial Facade/Building Rehabilitation Program NEIGHBORHOOD Heritage RECOMMENDATION Agency staff recommends that the Agency authorize: 1) The adoption of the Commercial Facade/Building Rehabilitation Program as identified below, and; 2) Identify the Main Street/San Jacinto Commercial Area as the first demonstration area, and; 3) Set -aside a maximum of $210,000 in redevelopment funds for the program for the first year to provide up to $35,000 per business in loans and grants. FUNDING SOURCE The recommended funding would he from the Redevelopment Fund (96). PROGRAM DESCRIPTION The purpose of the Commercial Facade/Building Rehabilitation Program is to enhance and improve the visual attractiveness, appearance, and economic viability of commercial buildings located in specific target commercial areas in San Jacinto. The program offers assistance to business/building owners and tenant businesses in commercial buildings to perform facade or other interior and exterior improvements. By encouraging such improvements, this program should provide a stimulus for additional private investment and help to improve the overall business environment. The program offers both grants and loans or a combination of both depending on individual business needs. The maximum amount that any business can access from the Agency is a $25,000 loan and a $10,000 grant for a total of $35,000. The program will offer 50% matching grants of a maximum amount of $10,000 for facade/exterior improvements and for handicapped access/facilities that assist the business in meeting the Americans with Disabilities Act. (ADA) Typically this portion of the program would fund the following types of improvements: • Painting and stucco work. • Provision of awnings and canopies. • Front entrance, display window, and rear entrance improvements. • Facade design enhancements. • Signage on the facade and/or an anchor sign for larger commercial establishments. • Landscaping and parking lot improvements. • Provision of handicapped access and accessible bathroom facilities. • Construction of trash enclosures. Grant funds could also be used for architectural/engineering services, building permits and fees. As part of the program the Agency would provide for initial architectural services for the business. This would be for a maximum amount of $2,500. If the business proceeds with a grant/loan half of the amount, $1,250 would be returned to the Agency. The business would be required to match the Agency investment with an investment equal to 50% of the grant amount. This would mean that for a $10,000 grant the business would have to put $5,000 into the rehabilitation effort. This match would be provided from improvement work done by the business on the exterior and/or interior of the business. If the business proceeds to secure a loan from the Agency, a portion of the loan construction activities, up to $2,500, could be credited toward the match. This means that a business must invest $2,500 of its own money on a $10,000 grant when a Agency loan is involved. The loan program provides for a maximum of $25,000 for a low interest loan (4%) to businesses that require improvements that exceed the amount allowable within the grant and for improvements beyond the scope of the grant portion of the program. The loans would be for a maximum of ten years. The improvements that would be allowed include: Upgrading of utilities. Remediation of environmental hazards. • Construction of tenant improvements. • Upgrading of the building to meet seismic standards. Improvement of air conditioning and heating systems. Roof repairs and replacements. All loans would have to be secured by real property. In the event that the business does not own the space it occupies, some other form of real property would have to be used as collateral. 3 The loan documents consist of a Loan Agreement and Promissory Note secured by real property. The loan would go through escrow and there would be a processing fee, payable by the business, of $500. This could be included in the loan amount. These loans and grants would be targeted to demonstration commercial areas to insure that the largest focused impact of limited resources can be made. The first demonstration area would be Main Street between Hewitt and Estudillo and San Jacinto Avenue between Main and 7th. At the end of 120 days the program would be evaluated as to its effectiveness in the first demonstration area, and a determination would be made as to its applicability to other commercial areas of the City. The program would be initiated through a personal contact program and a mail out to business within the commercial demonstration area. In both the contact program and mail out there would be a description of the program and an application would be provided for the business to complete arid return. At the maximum loan/grant amount of $35,000 we would be able to assist 6 businesses. The Agency staff have already received serious inquiries from 3 businesses along Main Street as to Agency assistance. This program represents a major investment by the Agency in our business community. However, as an investment we will profit from additional job opportunities, increased sales tax, repayment of loan proceeds, property tax increment, and a healthy business community. Hopefully, this program will serve as a model for other assistance efforts to both large and small businesses in our community. As each loan is considered we will identify the benefits that are derived from the Agency's participation. 4 TO: FRO DATE: ;GEC CITY OF SAN JACINTO REDEVELOPMENT AGENCY STAFF REPORT REDEVELOPMENT AGENCY BOARD $a Marc Grisham, Housing Advisor via Brian McNabb, Dir. of Community Development September 21, 1993 SUBJECT: Selection Of Hone Builder NEIGHBORHOOD Heritage RECOMMENDATION Agency staff recommends that the Agency authorize staff to negotiate with A.A. Chamberlain & Associates, Inc. for the development of single-family affordable homes within the Brown/2nd Street Model Neighborhood, and return with a development agreement for final Agency review and approval within 45 days. BACKGROUND The Redevelopment Agency has acquired 1.75 acres within the Brown Street Model Neighborhood for $115,000 and has completed initial lotting studies on the site at a cost of $2,500. Over the last 30 days, based on Agency direction, the Redevelopment Agency has been soliciting proposals from local builders for the development of single-family entry level housing. Over 20 Requests For Proposals were sent out by the Agency. Only one builder, A.A. Chamberlain & Associates, Inc. based in San Jacinto, submitted a proposal for consideration. The submitted proposal met the basic criteria of the RFP. and is attached for your review. Key elements of the proposal include the following components: • Construct eight single-family residences, each with three bedrooms and two baths on standard size lots. Each detached unit has a two car garage. • Two homes would be 1,045 square feet, three homes would be 1,104 square feet, and three homes would be 1,175 square feet. • Home prices range from $75,900 to $79,900. • The 1,045 square foot and 1,175 square foot models allow for future expansion by the home owner. • Housing construction and sales would take place over a nine month period. Floor plans, elevations and the basic layout of the homes in the cul-de-sac are provided for your review. the homes would be sold to individuals that qualify under the household income requirements for low and moderate income households under state redevelopment law. The targeted market will be first-time home buyers, retirees, and/or small families seeking home ownership rather than continuing to rent. To provide affordable housing at the prices shown within the builder project budget (attached), and insure that the completed homes will be sold in a timely manner. the Redevelopment Agency will be structuring a development agreement that will include the following components: Utilization of the acquired Agency property as security for the construction financing. • Creation of legal parcels by the Agency based on the final lotting study. • Construction of the cul-de-sac and installation of necessary public improvements within the cul-de-sac with Agency funds. • Provision of a preliminary and final grading plan for the development. • Deferment of the payment of impact fees until the closed of escrow on the homes. • Participation with the developer in the securing of the necessary construction financing for the development of the homes. • Assistance in expediting the necessary approvals of the housing project through the regulatory process. • Provision of second trust deeds on the homes to assist buyers in qualifying to buy the homes. If required, additional assistance can be provided to insure that the homes are sold in a timely manner. Given the current market conditions and pioneering nature of Brown/2nd Street for single-family homes it is anticipated that the agency investment will not be initially recaptured. This investment including site acquisition, lotting analysis and engineering, but not including public improvements, will be approximately $135,000 or $16,875 per house. However, we will include resale provisions and equity sharing covenants in the sales documents to discourage speculation on the units and insure continued home ownership. Additionally, any increase in price beyond those currently shown in the builder project budget would result in an immediate financial return to the Agency. The builder A.A. Chamberlain & Associates, Inc. will construct and sell the finished homes. They will be required to give sub contractor preference to local firms based on a competitive bid process. They have set their profit margin in the project budget at 6.9%. In addition they will collect a fee for the management of the development and will directly sell the residences thus receiving a 2 1/2 percent commission. During the 45 day negotiating period, Agency staff will also explore the potential of including the construction of the eight units by this builder with the four homes across the street. This could result in economies of scale for construction and provide an increased product mix for sale. Building this project is an important element of improving the Brown/2nd Street Neighborhood. A neighborhood that was identified as being most in need of assistance. That there will be a need for a subsidization for the construction of units is not surprising given the lack of new construction in the downtown and the state of the market. However, creating new home owner opportunities in the downtown, turning a neighborhood around, and generating tax increment make this an important step in the revitalization process for the Heritage Neighborhood. 4 A. A. CHAMBERLAIN & ASSOCIATES, INC. September 2, 1993 San Jacinto Redevelopment Agency 201 E. Main Street, San Jacinto, CA 92583 Re: Request for Proposals Project: Brown Street, San Jacinto, CA 1.75 Acres APN # 435-151-014 Please be advised that the following proposal is hereby submitted for your consideration: Builder/Developer: A.A. CHAMBERLAIN & ASSOCIATES, INC, 1520 S. San Jacinto Ave., Suite #1, San Jacinto, CA 92583 (909) 554-9157 Allen A. Chamberlain, President Product design hy: ALPHA -TECH, Construction Consultants 2333 San Jacinto St., San Jacinto, CA 92581 Construction Contractor: A.A. CHAMBERLAIN & ASSOCIATES, INC. General Contractor License #643410 Sub -Contractors: Preference will he given to San Jacinto Valley sub -contractors based on competitive bids, Proposed Housing Products and Mix: Eight single family detached, three bedroom and two bath, residences. Two homes of 1045 square feet, three homes of 1104 square reet, and three homes of 1175 square feet, with two car garages. The homes are designed Le provide a small comfortable start- er home for first time home buyers, retirees or small families seeking home ownership rather than continued rental expense. 1520 SAN JACINTO AVENUE 5AN JACINTO, C.A 92383 ( 1 654-9157 a The homes are to be designed to convey the esthetics of an "eye -pleasing"` small hungalow-typedwelling. Each home is to have a front porch to allow interaction with neighbors and en- gender a small close-knit Lommunity within the cul-de-sac. With innovative use of design and materials, such as; 5:12 pitched roofs, mixture of siding, stucco, and cultured stone exteriors, the homes will be individual but the overall design will reflect the development as a specific project of that area. The 1104 sq. ft. model and the 1175 sq. ft. models have a unique design that allows for future additions to the homes for family expansion or improvement, to enhance the owners equity position and their commitment to staying in the home for a long period of time. Cost considerations will be paramount in the use of the latest methods of exterior insulation by the use of a Styrofoam -wrap" with an R-Value of R-6 in addition to the required R-13 value in a 2x4 exterior wall. The homes will feature a full fiberglass shower unit or tub/shower combination in each of the 'paths. Each of the master baths will have a double sink combina- tion to allow the personal space for the home buyers. The liv- ing- dining areas, and the master bedrooms, will feature vaulted or cathedral ceilings and a small walk-in closet in each model. Kitchens in the two larger models will have pantries and small eating bar tops or pass-throughs of formica. The furnished appliances will be of an entry level quality, with an eye toward the most energy and cost efficient cooking methods. Dependent upon cost, we intend to have the walls of the homes painted in a satin -finish to allow for easy cleaning in a family oriented home. The garage doors will be steel to prevent the sagging of the doors after a short time of occupancy. The homes will have good curb appeal, with functional floor plans and eye-catching interior design. Construction Cost Estimate and Sales Price: (See attached Project Budget) Construction Finance: Chuck Rogeness of Valley Merchants Bank has indicated an interest in taking part in this project, and wishes to explore the program further, as it develops. Steve Pluimer, Manager, Valley Bank, Moreno Valley, (909) 654-9157, has indicated an interest in the project. General Contractor has a long standing banking relationship with lender. Note: Although the present market conditions are conducive to getting the best prices for work from suppliers and sub- contractors, both Banks Indicated they are suspicious of the market. Rath indicate=d fiat their further consideration of 2 construction financing would be weighted heavily by the partici- pation of Lhe San jacInto Redevelopment Agency with the General Contractor. Time Schedule: The time frame of the construction is projected as nine months. The period covers actual construction, marketing, sales, loan approvals, and loan closings. A CPM (Critical Path Method) with specifics Lo this project is difficult, as starting dates, pre -sales, and financing are items that must be factored into a comprehensive time schedule. Marketing and Sales Program: Homes would be eligible for FHA or special program financ- ing, as well as, conventional sales. Marketing and pre -sales will be accomplished by an emphasis on local media advertising, to allow existing residents the opportunity to become a homeowner in their community. Major stress would be placed on the fact that the San Jacinto Redevelopment Agency is the lead entity in the endeavor and has placed restrictions on the program to enhance home ownership, pride, and independence. This would also put on notice those investors, speculators, and ineligibles, that the Agency has a serious concern that the project is and remains of benefit to the Community and those who are eligible. Pre -Sales would be accomplished through our existing office, conveniently located at Esplanade and San Jacinto Avenues. The home on the corner of Brown St, and the Cul-de-Sac would be used as a Sales Office, immediately upon its completion. With the prevailing interest rates, and bargain prices, we do not anticipate the need for a Sales Office, but it will he available. Project and Financial Reporting: Redevelopment Agency would be furnished'wAh a copy of the final Bank Budget and a Critical Path Schedule. Both would be updated on a monthly basis reflecting the financial, construction completion, and sales performance for the preceding period. Contractor Experience: (See attached Resume) Additional Proposal: It is our understanding that there is a San Jacinto Redevel- opment Agency plan to build four single family attached homes on small lots in the vicinity of the proposed 8 lots. As the profit in the 8 lots is minimal, we would propose that we construct the four units as part of our Agreement. We would propose that we be compensated for the completion of the units at the same rate per unit as reflected in our cost analysis (attached), with overhead costs at the monthly rate as indicated by the G&A analysis, for a period of four months. The advantage to the Redevelopment Agency and the General Contractor is that subcontract prices and materials would reflect all twelve units pricing. 3 Building the four units first would allow both the Redevel- opment Agency and the General Contractor the assessment of com- munity response to the project and determine the approximate absorption rate for the total project. We look forward to the opportunity to join the San Jacinto Redevelopment in a needed and necessary program. In these tough times, the Agency will afford some of its citizens, the possibil- ity of home ownership. This project may well set the pattern for small communities to establish infill projects with showcase developments. Your consideration of our proposal will be appreciated. Sincerely, ALLEN A. AG DA STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: Nathaniel Holmes 111, Acting Chief of Police via Pamela S. Easter, City Manager DATE: September 21, 1993 SUBJECT: Parking Enforcement Program RECOMMENDATION Waive the reading in full and read by title only (First Reading) Ordinance No. establishing parking regulations and repealing Ordinance No. 358, Adopt Resolution No. as the Parking Citation Fine Fee Schedule. FISCAL IMPACT The repeal of the old Ordinance and adoption of the proposed new parking ordinance in themselves will have no fiscal impact on the city. However, with the implementation of the mandated parking program, there could be a substantial increase in revenue which will now go directly to the City. BACKGROUND With the passage of Assembly Bill 408 in 1992, parking citations were decriminalized, and the courts will no longer accept them. This required that cities develop in-house methods of dealing with parking citations. The adoption of the attached Ordinance is the first step in implementing the requirements of A.B. 408. Also attached for Council consideration is a Resolution adopting a fine schedule relating to violations which are now decriminalized. It will be handled by city staff for enforcement and penalties. Assembly Bill 408 further recommended that counties or surrounding cities adopt similar fine schedules. This has been done with the area agencies, Beaumont, Banning, Hemet, Perris, Murrieta, California Highway Patrol and California State Parks Department. The fine schedule presented to you complies with this recommendation. Staff Report Parking Enforcement Program Page 2 The fine schedule was arrived at based upon existing bail schedules, plus Administrative costs and the required costs which must be forwarded to other agencies. The following are two examples of how the revenue would be distributed to the County, City, and citation processing company. Due to the still tentative nature of the exact fees, the figures have been approximated. Example: 1. RED CURB FINE $ 35.00 Courthouse Construction Fund Criminal Justice Construction Fund State Courthouse Construction Fund Bail Increases ESTIMATED TOTAL TO COUNTY ESTIMATED REVENUE TO CITY APPROXIMATE PROCESSING FEE 2. HANDICAPPED PARKING FINE Courthouse Construction Fund Criminal Justice Construction Fund State Courthouse Construction Fund Bail Increases Handicapped Parking Assessment ESTIMATED TOTAL TO COUNTY ESTIMATED REVENUE TO CITY APPROXIMATE PROCESSING FEE $ 1.50 $ 1.50 $ 2.00 $ 5.00 $ 10.00. $ 24.00 $ 1.00 $350.00 $ 1.50 $ 1.50 $ 2.00 $ 70.00 $ 50.00 $125.00 $224.00 $ 1.00 When the Parking Enforcement Program is fully implemented, the processing company will handle the collection of fines, the payments to the county, and the deposit of the City portion into the city parking account. It is anticipated that our parking citation program should be fully functional by the time the proposed parking ordinance is effective. ORDINANCE NO. Easter, City Manager DATE: September 21, 1993 SUBJECT: ZONING ORDINANCE AMENDMENT 5-93 APPLICANT: CITY INITIATED DESCRIPTION A proposal to amend the Zoning Ordinance, Ordinance 340, Article 17, pertaining to Conditional and Temporary Use Permits and the processing related thereto. RECOMMENDATION The Planning Commission recommends that the City Council introduce the attached Ordinance approving Zoning Ordinance Amendment 5-93, waive the reading of the Ordinance in full and read by title only. BACKGROUND On August 11, 1993, the Planning Commission considered and recommended approval of the proposed amendment to the City Conditional Use Permit processing requirements. This proposal is in response to the recent City Council direction to streamline the development review process and to implement the Planning Commission direction to provide a mechanism to allow interim land uses. The Conditional Use Permit process requires City Council ratification of a Planning Commission approval of Conditional Use Permit applications. Currently, the Council must wait 10 days after the Planning Commission action before ratifying the Commission approval. The ten day delay for ratification slows implementation of the project for much more than just ten days. The regular meeting dates of the City Council are the 1st and 3rd Tuesdays of the month. The Planning Commission meets on the Wednesday of the week between the regular Council meetings. Therefore, the earliest the Council could ratify the decision would be approximately 20 days. Staff would propose that City Council ratification occur at the next regular Council meeting following the Planning Commission action. City Council September 21, 1993 Page No. 2 Staff is also recommending that the appeal period coincide with and end upon the date of ratification. The proposed appeal period is 5 calendar days following the Planning Commission action. The change to the ratification procedure and the reduced appeal period will help speed the implementation of the project and help economic development activities. Currently, following a public hearing the Commission can approve temporary structures or uses that are valid for one year. This code section limits the Commission from approving uses that are not consistent with the land use designation or zoning. Because this section is proposed for temporary uses, the Commission recommended that this requirement be eliminated. Additionally, the Commission recommended that they be authorized to approve temporary use permits for a five year time frame, with the ability to grant extensions. Furthermore, the Commission proposed that the Community Development Director be authorized to grant temporary use permits for specific uses for up to a year. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN JACINTO, CALIFORNIA, APPROVING ZONING ORDINANCE AMENDMENT 5-93 IS HEREBY APPROVED THEREBY AMENDING ORDINANCE 340, ARTICLE 17.05, ARTICLE 17.12 AND ESTABLISHING ARTICLE 17.13 THE CITY COUNCIL OF THE CITY OF SAN JACINTO DOES HEREBY ORDAIN AS FOLLOWS: Section 1. TO: N'ROM: DA'1'L: SUBJECT: AGENDA - CITY OF SAN JACINTO STAFF REPORT Honorable Mayor and City Council Members Brian McNabb, Director of Community Development via Pamela S. Easter, City Manager September 15, 1993 CALLING OF BONDS FOR TRACTS 21900 AND 21900-1 (VILLAGE 4) NEIGHBORHOOD - Soboba RECOMMENDATION Staff recommends the bonds, in the amount of approximately $200,000, be called for Village 4. BACKGROUND The attached Staff Report from the September 7th meeting outlines the Staff recommendation. Prior to that meeting, Harry Bigham submitted a letter to the Council in which he requested no action be taken for 60-90 days. The City Council continued the matter until September 21st to allow Staff to discuss the matter with the Homeowner's Group. A meeting was held on September 13th with the Homeowner's Group, Harry Bigham, Councilman Solorio, and Staff. As part of that meeting, Staff presented three possible actions the Council could make. 1. Table the matter until approximately January 1, 1994 2. Call the bonds immediately 3. Direct Staff to call the bonds commencing January 1, 1994 unless the developer returns with an acceptable plan and schedule for finishing the streets. City Council Staff Report September 21, 1993 Page 2 Mr. Bigham indicated option #1 would, of course, be his preference. However, he could live with option #3. Staff asked the Homeowners Group to discuss these three options and to present their preference to the City Council. Easter, City Manager DATE: September 7, 1993 SUBJECT': CALLING OF PERFORMANCE BONDS TRACTS 21900 & 21900-1 (VILLAGE 4 OF SOBOBA SPRINGS SPECIFIC PLAN) NEIGHBORHOOD Soboba RECOMMENDATION Direct staff to call the bonds acting as security for the remaining public improvements for Tracts 21900 and 21900-1 (Village 4 of the Soboba Springs Specific Plan). BACKGROUND The City Council has, from time to time over the past two years, considered whether the bonds for Tract 21900 & 21900-1 should be called. The remaining improvements largely consist of capping the streets. Staff feels there is no certainty as to when the development will be built out, which is the normal time the developer caps the streets. In the meantime, trash trucks and moving vans are using the street and will have, over time, an adverse effect on the streets. Additionally, the lack of capped streets gives the existing homeowners a sense that they are living in an unfinished subdivision. DISCUSSION This item was continued from the Council Meeting of September 7th to allow Staff to meet with the City of Beaumont to resolve Sphere of Influence questions. On September 14th, City Staff met with City of Beaumont representatives and LAFCO Executive Director George Spiliotis. At this meeting, George Spiliotis, the LAFCO Executive Director submitted the attached proposal which changes San Jacinto's Sphere to conform to a definable boundary and keeps the ridgeline in San Jacinto's Sphere of Influence. Beaumont's Sphere of Influence is being expanded under this proposal to allow for the development of the Potrero Creek Specific Plan and to include property clearly oriented toward Beaumont. There is also an area that is in neither Sphere of Influence. This is located just beyond and east of North Mountain. These proposals are highlighted on the attached map.
