RECOMMENDATION The Planning Commission recommends the City Council approve. Zoning Ordinance Amendment 2-93 subject to Exhibit "A" attached: DISCUSSION On July 14, 1993 the Planning Commission recommended that the City Council approve Zoning Ordinance Amendment 2-93 to allow restricted front yard fencing in limited neighborhoods at a maximum height of 42 inches. The Planning Commission is recommending that this be amended to allow front yard fencing in the Heritage, Ramona and Alessandro neighborhoods and mobilehome parks and subdivisions throughout the City when 20% of the homes on both sides of the street on the same block have front yard fencing already in place. Chain link fencing could only be considered an acceptable material when 50% of the homes with fencing have chain link fencing already in place. The maximum height for front yard fencing will remain 42" The Planning Commission also recommends that when a "reverse corner" exists, walls up to six up to six feet be allowed on the street side property line when the sight distance from the driveway is 136 feet in both directions, measured 15 feet from the curbfine in the driveway of the keylot, on local streets only. AGENDAL TO: FROM: DATE: SUBJECT: STAFF REPORT Honorable Mayor and Members of the City Council Brian McNabb, Director of Community Development via Pamela S. Easter, City Manager September 7, 1993 ZONING ORDINANCE AMENDMENT 3-93' APPLICANT: CITY INITIATED DESCRIPTION A proposal to amend the Zoning Ordinance, Ordinance 340, Article 16, pertaining to signage for retail, office and industrial/business park developments. ;RECOMMENDATION The Planning Commission recommends that the City Council introduce the attached Ordinance approving Zoning Ordinance. Amendment 3-93, waive the reading of the Ordinance in full and read by title only. BACKGROUND On August 11, 1993, the Planning Commission considered and recommended approval of the proposed amendment to the City sign guidelines. After considerable discussion, the consensus of the Commission was that the proposed standards were satisfactory: The modifications proposed pertain to wall signs; freestanding signs; establish a requirement for detailed sign programs for commercial, industrial and office developments; and establish general sign design guidelines. The following is a summary of the proposed changes: There are several changes proposed to the guidelines pertaining to wall signs. One change allows larger business, those with 20,000 square feet or more, to have accessory signs in addition to the main wall sign. This change would primarily accommodate supermarkets, large drug stores and large box retailers. Additionally, the method for calculating the size of wall signs was changed, establishing a minimum size all businesses would be able to achieve and a more liberal maximum size for the larger businesses proposing accessory signs. Additional changes were recommended which make the guidelines more clear and understandable. These pertain to signs suspended from roof overhangs and wall signs on walls which do not contain the main building entrance. City Council September 7, 1993 Page No. 2 The changes pertaining to freestanding signs include a reduction in height and area for small freestanding businesses, those which are not part of a shopping center or business park/office ;complex. These changes do not affect restaurants or gas stations, which have separate standards. Additionally, the requirement for the approval of sign programs for large commercial and office developments is proposed. The sign program would be prepared by the developer and submitted for each center. The sign program would essentially delineate the permitted signage for each center. Details such as permitted sign area, color and materials would be established on a center by center basis. The sign guidelines would provide the basic framework for the preparation of the sign program. Issues such as maximum sign area and number of signs would be established in the sign guidelines. This is only to ensure that shopping centers are on equal footing for signage: Other changes to the guidelines pertain to the establishment of general design standards and the reference to specific plans, essentially allowing specific plans to deviate from the regular sign guidelines. Deputy City Clerk - 2 - STAFF REPORT TO: Honorable Mayor and Members of the City Council FROM: Brian McNabb, Director of Community Development via Pamela S. Easter, City Manager DATE: September 7, 1993 SUBJECT: ZONING ORDINANCE AMENDMENT 5-93 APPLICANT: CITY INITIATED AGENDA. DESCRIPTION A proposal to amend the Zoning Ordinance, Ordinance 340, Article 17, pertaining to Conditional and Temporary. Use Permits and the processing related thereto. RECOMMENDATION The Planning Commission recommends that the City Council introduce the attached Ordinance approving Zoning Ordinance Amendment 5-93, waive the reading of the Ordinance in full and read by title only. BACKGROUND On August 11, 1993, the Planning Commission considered and recommended approval of the proposed amendment to the City Conditional Use Permit processing requirements. This proposal is in response to the recent City Council direction to streamline the development review process and to implement the Planning Commission direction to provide a mechanism to allow interim land uses. The Conditional Use Permit process requires City Council ratification of a Planning Commission approval of Conditional Use Permit applications. Staff would propose that the City Council ratification occur as soon as possible after the Planning Commission action. This would help to speed the implementation of the project and help economic development activities. Currently, the Council must wait 10 days after the Planning Commission action before ratifying the Commission approval. The ten day delay for ratification slows implementation of the project for much more than just ten days: The regular meeting dates of the City Council are the 1st and 3rd Tuesdays of the month. The. Planning Commission meets on the Wednesday of the week between the regular Council meetings. Therefore, the earliest the Council could ratify the decision would be approximately 20 days, City Council September 7, 1993 Page No.2 Currently, the Commission is authorized to approve temporary structures or uses that are valid for a one year period. The conditional use permit procedure is required to be followed and any conditions deemed necessary by the Commission may be established. The code section is limited and does not address the issue of land use designation inconsistencies, as previously addressed by the Commission. Staff would propose that the Commission be authorized to approve longer time frames, with the ability for the Commission to authorize extensions. Additionally, the code section should specifically address temporary land uses that may be inconsistent with the zoning or general plan. Furthermore, Staff would propose that the Community Development Director be authorized to grant temporary use permits for specific uses for up to a year. ORDINANCE NO. Easter, City Manager DAME: September 7, 1993 SUBJECT: CALLING OF PERFORMANCE BONDS TRACTS 21900 & 21900-1 (VILLAGE 4 OF SOBOBA SPRINGS SPECIFIC PLAN) NEIGHBORHOOD Soboba RECOMMENDATION Direct staff to call the bonds acting as security for the remaining public improvements for Tracts 21900 and 21900-1 (Village 4 of the Soboba Springs Specific Plan). BACKGROUND The City Council has, from time to time over the past two years, considered whether the bonds for Tract 21900 & 21900-1 should be called. The remaining improvements largely consist of capping the streets. Staff feels there is no certainty as to when the development will be built out, which is the normal time the developer caps the streets. In the meantime, trash trucks and moving vans are using the street and will have, over time, an adverse effect on the streets. Additionally, the lack of capped streets gives the existing homeowners a sense that they are living in an unfinished subdivision. Rmorowlistimgof moos frq Avis 202/032.000Z. August 20, 1993 EEC FACT 51EEET ON CABLERATE A.D.WSTFN"T$. Recent headlines suggest that consumers may actually experience widespread rate increases as a result of the rate adjustments now being made by cable operators attempting to comply with the FCC's new rate rules. • These reports seriously mischaracterize how the FCC rules work. The following information is designed -to correct the misimpression that have been created as result of the new: paper headlines, and to indicate that overall cable rates are going down, while some individual variations may occur. The FCC's new rate rules go into effect for most cable subscribers on September 1, 1993. With this deadline fast approaching, many cable operators are currently adjusting their program service and equipment rates to comply with the regulations by this date. When it adopted its cable rate regulations this past April, the Commission estimated that between two-thirds to three-quarters of all cable subscribers should see, on average, a 10 percent decrease in their overall cable bills. The cable industry itself has claimed that the new rules should save consumers more than S I billion a year. Moreover, alto calculating their new rates under the FCC's standards, several large cable operators already have conformed that their revenues, will decline on average up to 10 percent, as predicted by the Commission. Q: What benefits can consumers expect to see as a result of the new rate regulations? A: Under the Commission's new rate regulations, many consumers should see a rate reduction of roughly 10 percent in their total cable bill. In addition, rather than paying high fees to rent the equipment used to receive their cable service (such as remote controls and converter boxes), subscribers should see those rates fall significantly (in some casts. from 5 or 6 or more dollars a month to permits a month). Q. Are cable systems able to use the changes they are now making to increase their revenues before the effective di to of the rules? A: No change is permitted that is intended to increase an operator's average subscriber revenues From regulated services prior to the September 1, 1993, effective date of the rules, In order to avoid increases in rates prior to the mules taking effec, the Commission imposed a rate "freeze" on April 5, 1.,93 which will :cntinue :hrough November I5, 1993, During this freeze perk: system operators may change (raise or lower) individual rate components such as specific, tier or equipment charges WESTERN CO)iKL' ___ IVC t?j003005 623 93 10:16 'Z41: 60236 0 24347 v0-° 415 E,760236:z in order to come into compliance with the rules. However, no change calculated or designed to increase the average monthly bill of its subscribers as a class is permitted. The Commission has granted no waivers of this freeze. This rate freeze has prevented cable operators from raising rates during this period. By forestalling rate increases of the type effectuated in prior years, this rate freeze will also save consumers hundreds of millions of dollars in cable rates this year. A leading independent research group, Paul Kagan Associates, Inc. Research, has estimated that the freeze will save consumers between $122 and S200 million. Finally, future rate increases sought by many cable systems will be strictly limited and generally should not exceed inflation plus a few other costs beyond the operator's control. Q: Are cable operators required to raise their rates under the FCC's new rate re • tion rules, as some have suggested? A: No. There is nothing in the new rules that requires cable systems to raise their rates for any service or any piece of equipment rented to subscribers. As they perform the calculations required by the rules, however, many operators arc discovering that while their rates for some services are below the reasonable level established by the Commission, rates for other services are much too • high. In this situation, the cable operator the FCC's rules permit (but do not • ___::. to increase the rate for the low-priced service (but not above the reasonable level) in order to offset the rate decrease that it must make for the high-priced service. The FCC's data show that nearly three-quarters of subscribers buy more than the basic tier. Moreover, where multiple tiers are offered, just 9 percent of subscribers buy only basic service. Since the vast majority of subscribers thus purchases more than one tier of cable service, the vast majority should see any rate increase accompanied by a rate decrease, and experience a net reduction in their monthly cable bills. In most cases, this net reduction should be approximately 10 percent. It should be remembered, however, that not all cable operators currently arc charging unreasonable rates. The Commission's best estimate to date is that roughly one -quarter to one-third of cable systems already have reasonable rates -- even without rate regulation. Therefore, the subscribers to these systems will not see a rate reduction in September, although they could well see lower rate increases in the future. Q: Why is the Commission allowing Some operators to raise rates, even for just a few services: A: As noted above, there are many situations in which a cable system's rates may be lower than the reasonable level for one service and higher than the reasonable level for others. This can happen, for example, when a system charges subscribers taking one service a higher rate so that it :.an charge subscribers taking another service a lower rate. In this situation, the first group of subscribers "subsidizes" the second group. The Commission's goal is tc make sure that onable for every service tier and gvery p1ece of equipment offered to consumers by regulated ra le 23/93 10:17 Z*415 60236 WESTERN COMMLI\, — IVC SENT Bi: ; -23 : 1:35 : 4.:24370: Z004:005 A4 ;cgr)27.7.— systems. It also wants to make sure that the subscribers who buy a particular service (or rent a particular piece of equipment) arc the ones who actually pay for it — that is, other subscribers should not. be forced to pick up the bill for services or equipment they didn't buy. Finally, the new cable rules guarantee that no one pays more for regulated equipment than its actual cost to the operator. When cable operators adjust their rates to comply with the new rules, they may choose to increase the rates for one service to a higher (but still reasonable) level in order to accommodate a rate reduction that they may be required to make for another service. The end result should be that the rates for at services arc reasonable, and the subscriber who purchases both services (as most subscribers do) willenjoy an overall rate decrease. In addition, subscribers who have been subsidizing their neighbor's lower equipment costs with higher program rates should sec those program rates go down (while their neighbor's equipment costs go up). Similarly, subscribers who have been paying higher equipment rates so that others can enjoy lower program rates should see their equipment charges go down (while program rates may increase). In this way, everybody ends up paying only for the services and equipment they actually purchase. It should be remembered, of course, that operators may still offer reasonable discounts to senior citizens or other economically disadvantaged groups. It is also important to remember that the cable industry is trarisitioning from an unregulated to a regulated environment, and the currer.t rate adjustments reflect this fact. Any short-term rate increases should be offset by larger rate decreases, and, where rates aft getienilly too high, the typical subscriber should see an overall 10 percent reduction in his or her bill. Moreover, a key aspect of the Commission's rate regulation scheme is that rate increases in the future will be limited to inflation (plus some cots beyond the operator's control) -- thus providing even greater protection to subscribers from unreasonable cable rates. Q: Which rat will go up and which will go down as a result of the new rules? A: Cable orators have just begun to announce the new rams they will be charging pursuant to the new FCC rules. Thus, it is simply too early to tell exactly what the pattern of rate adjustments will be. However, as noted above, the FCC anticipates that the majority of cable subscribers should s-ee rate reductions of about 10 percent. The Commission will be closely monitoring developments in this area and will take additional action if necessary to ensure that regulated cable rates are reasonable. A few general observations nonetheless can be made. First, according to its survey of cable system rates, the FCC found that, for the average subscriber, the per channel rate for basic service was approximately 50 percent higher than the per channel rate for expanded basic. Thus, many of the rate adjustments now being made should result in basic rates going down, not up. Second, where cable operators have offered a very low price d basic tier, it typically consists primarily of retransmitted broadcast signals (so-called "antenna service'). Very few subscribers offered this service (usually less than 6 pl.trcznt) purchase this tier alone; virtually all take additional program servi=s. Thus, even if 3 S 22, 93 10:1S 'FIR I 960236 'AESTERN :vc Zoos. 005 2.1:; basic rates do increase, rates for the higher tiers should simultaneously decrease, providing the vast majority of subscribers with a net rate reduction. Third, many, if not most, :able operators who arc reportinz an increase in program rates of some sot., are also reporting substantial decreases in equipment charges. For example, in one trade press article (Cable World, August 9, 1993), although the headline cited a basic rate increase of .$.38, the article goes on to note the elimination of both a S6.95 monthly charge for an additional outlet and a S3.S0 monthly charge for a remote control -- two commonly purchased items. Similarly, a recent Washinzton Post article (August 18, 1993) noted it its hypothetical example that, although basic rates increased from $3.60 to SE.10, tie rates for expanded basic decreased from S14.40 to S8.10, an overall reduction of 10 percent. In addition, equipment charges dropped from $6 a month to S.35 a month, for a total savings to this "typical" subscriber of S7.45. Q: My operator says he h2s to raise rates now, becmse after September I he won't be able to charge more than imilation. Is this right? A: As noted above, there is no FCC requirement that any operator raise their rates in order to come into compliance with the new res. It is true that those systems that become subicct to rate regulation will not be able to increase their rates more than inflation (plus some costs beyond their control) in the future. However, this provision is designed to let cable operators recover r-,zonable increases in their costs while protecting consumers from unfounded rat: nikez. Q: How do I know if my cable operator has properly adjusted its rates, and how do I complain about them if I think they're still too high? A: Cable. consumers are not. r:cuired to apply the FCC's rules to their cable operators' rates when .-_sser--dng that those rates are too high, If you are a subscriber arid think that your basic rates ar t0-0 high, you snould contact your local franchising authority. Easter, City Manager DATE: September 7, 1993 SUBJECT: BEAUMONT SPHERE OF INFLUENCE AND ANNEXATION APPLICATION RECOMMENDATION The City Council authorize staff to oppose portions of Beaumont's Sphere of Influence and Annexation application. BACKGROUND The City of Beaumont has filed with LAFCO, applications for a sphere of influence amendment and annexation for all property owned by Lockheed. This property includes much of the mountainous area overlooking the Valley, with a finger down to Gilman Road (Highway 79), near Golden Era Studios. The application requires the amendment to San Jacinto's sphere of influence, reducing its area. Staff feels, at the very minimum, it is not practical for Beaumont's sphere of influence and city limits to extend to Gilman Road, as the area has no physical or historical connection to the City of Beaumont and would be a difficult area for them to provide services to if annexation were to take place. Staff is recommending, at the very least, the City oppose that portion of Beaumont's applications which include the face of the hillside down to Gilman Road. The Council may also want to consider whether it would support the changes that would allow the annexation of the hillsides overlooking the City. Certainly San Jacinto has no short-term proposals for any of this area. We don't know what long-term proposals might arise. Secondarily, maintaining the area overlooking the Valley within our sphere gives the City at least nominal control over what happens to the ridge line.
