We are also enclosing a revised ballot to be voted on behalf of the Osborne Development Corporation, the owner of the property, along with an envelope which should be used for returning the voted ballot. As you know, the City needed to revise the engineer's report to account for the two acre park that will be maintained with the assessments levied on the property described above, which, in turn, required the public hearing to be continued to a later date. As you will note, the hearing will now be held at 7:00 p.m. on June 5. 2003. We recognize that the assessment ballot that we previously sent to you has already been voted and returned to the City Clerk. However, since the assessment amount has changed, a new assessment ballot is required. In order to properly vote the enclosed ballot, a cross (+) must be inserted in one of the voting squares on the ballot and the ballot must then be signed on behalf of the property owner. The ballot must then be enclosed and sealed in the envelope and returned to the City Clerk as follows: Dorothy Chouinard, City Clerk, City of San Jacinto, 201 East Main Street, San Jacinto, California 92583. In the alternative, the envelope and ballot can be delivered to the City Clerk at the time and place of the hearing. DATED this 5th Day of June, 2oa3. Jim Ayres, Mayor Chris Carlson-Buydos, Vice Mayor James M. Conner, Council Member Ken Shaw, Council Member Dale Stubblefield, Council Member June 5, 200 TO: Honorable Mayor and Members of the City Council FROM: City Attorney SUBJECT: Annexation of Property to Landscaping, Lighting and Park District No. 2 of the City of San Jacinto Annexation No. 5 (Tract No. 28858) RECOMMENDATION: Adopt the following resolutions: a. Resolution Initiating Proceedings for the Annexation of Property to Landscaping, Lighting and Park District No. 2 ("Annexation No. 5") b. Resolution Approving the Engineer's Report for the Annexation of Property to Landscaping, Lighting and Park District No. 2 ("Annexation No. 5"). c. Resolution Declaring Intention to Annex Property to Landscaping; Lighting and Park District No. 2 ("Annexation No. 5"). 2. Conduct Public Hearing and at the conclusion of the public hearing if the City Council determines that a majority protest does not exist, adopt Resolution Ordering Annexation of Territory to Landscaping, Lighting and Park District No. 2 and Levying Assessments. BACKGROUND: In connection with the development of Tract No. 28858, which is generally located on the southeast corner of Ramona Boulevard and Potter Road, the City has required that the property be annexed to Landscaping, Lighting and Park District No. 2 to finance the cost of maintaining and servicing various improvements that will benefit the property within that development. The property proposed to be annexed to the district will receive the special benefit of the improvements and will be assessed to pay the costs of maintenance of street lights, traffic signals, landscaping, drainage facilities and incidental expenses of the assessment district. Staff is recommending that the City Council take all action that is necessary to annex the property in Tract No. 28858 during the City Council meeting on June 5, 2003. The first step is to adopt the Resolution Initiating Proceedings, which initiates the annexation process by ordering the Engineer of Record, ,GFB Friedrich & Associates, Inc., to prepare the Engineer's Report, describing in detail the improvements to be financed by the assessment district, the estimated cost of such improvements and the special benefits that the property within the assessment district will receive. The next step in the annexation proceedings is to adopt a resolution approving the Engineer's Report and a resolution declaring the City Council's intention to annex the property in Tract No. 28858 to Landscape, Lighting and Park District No. 2. The resolution of intention also schedules the public hearing on the annexation and the levy of the assessments upon the property proposed to be annexed to the District for June 5, 2003. The purpose of the public hearing is to hear testimony from any interested persons and to consider objections or protests, if any, to the proposed assessments. As required by the Act, notices and assessment ballots have been mailed to the record owners of all property proposed to be annexed to the District with instructions to vote and return the ballot to the City before the conclusion of the public hearing on June 5, 2003. At the conclusion of the public hearing, the City Council should direct the City Clerk to tally the assessment ballots submitted and to determine whether a majority protest exists. A majority protest exists if assessment ballots submitted in opposition to the proposed assessments exceed assessment ballots submitted in favor of the proposed assessments. If a majority protest exists, the City may not annex the property to the District or levy the assessments and many of the services and improvements that would have been financed by the District probably will not be provided in the area proposed to be annexed to the District. If a majority protest does not exist, the City Council may proceed with the recommended action described above. If formed, the District would finance the cost of maintaining and servicing various improvements that will benefit the property located within the area proposed to be annexed to the District, including street lights, traffic signals, landscaping and drainage facilities. BUDGETARY IMPACT: No cost is attributed to this action. Consentini, City Manager New Hemet Unified School District High School Siting in San Jacinto RECOMMENDATION: Discuss this issue and give staff appropriate direction. BACKGROUND: Mayor Ayres requested that the siting of the new Hemet Unified School District High School be placed on the agenda for discussion. JUSTIFICATION: Provide appropriate direction to staff. Attached are the high school attendance boundaries as adopted by our Governing Board (Exhibit A). Staff and the Board Facilities Committee reviewed five sites which are central to the high school attendance area. In looking for initial sites, there were a limited number of (1) 60-acre or greater parcels in general. (2) parcels that do not have obvious environmental issues, (3) are adjacent to water and sewer, and (4) central to the attendance area. We could not find any parcels of 50 to 60 acres in the area east of Sanderson and south of Esplanade except for one (Site # 1 on Exhibit B). The area west of Sanderson and north of Florida has 40-plus acre parcels; however, they are either far to the west or in areas with major drainage problems, subdivided or developed. I have attached air photo maps showing the limited large parcels available for the new high school (Exhibit B). Short -List of Parcels We initially narrowed our list to five possible sites. Site #1 was eliminated, and Site #4 was a hybrid of Site #5, extending easterly along Esplanade rather than up Sanderson. Site #1 was eliminated as being too narrow of a site and being located across the street from a senior citizen housing development. Staff was aware of the location of two of the sites in the City of San Jacinto. The three finalist school sites are shown in Exhibits C-1, C-2, and C-3. Phil Pendley, District May 29, 2003 Page Two Superintenden Prelimrti Environmental Impact and CaliforniaDepartment of Education Review The Planning Center preliminarily reviewed the top three sites based on several criteria. The district has also completed the biologic and air quality report on the three sites. All three sites are okay. The air quality report was completed on March 27, 2003, and the biologic study completed on April 21, 2003. The environmental matrix for Sites #2, #3, and #5 is attached. The matrix notes some significant concerns for Sites #2 and #3. The San Diego Aqueduct (pipeline) poses some concern. Also, Site #3 is already under construction. We reviewed the proposed school site options with San Jacinto Planning Department staff, Tim Hultz, on March 19, 2003. To this date we have not received initial comments or concerns on our proposed high school. Other Issues for Discussion Zoning and Land Use — When staff reviewed the site, we discovered that the site was not zoned, but the general plan map showed commercial (Exhibit E — Zoning, Exhibit F — General Plan). The City of San Jacinto has proposed to change the general plan for the Esplanade/Sanderson corner from commercial to low income housing over the objections of Mr. Dale Williamson, the property owner. Commercially Zoned Property It was stated to us that the City is concerned over the possibility of losing commercially zoned property. As noted above, the property is not zoned commercial; and although denoted in the general plan, the new general plan is supposedly recommending designating as residential. Exhibit G is an air photo of most of the commercially designated property in San Jacinto. Much of the property is vacant. We noted nearly 1,000 acres of commercially zoned property, not including the area of Ramona Expressway and Sanderson. There appears to be much designated vacant commercial property along Sanderson near Esplanade without including the high school site (Exhibit G — Page 2). Exhibits A, B, E, and F are maps not included with this memo. RMB/st Attachments facil:ncw HS site analvss.doc 1_1V. Introduction What Are the Clinical Signs? Exotic Newcastle disease (END) is a contagious and fatal viral disease affecting all species of birds. Previously known as velogenic viscero- tropic Newcastle disease (VVND), END is probably one of the most infectious diseases of poultry in the world. END is so virulent that many birds die without showing any clinical signs. A death rate of almost 100 percent can occur in unvaccinated poultry flocks. END can infect and cause death even in vaccinated poultry. In 1971, a major outbreak occurred in com- mercial poultry flocks in southern California. The disease threatened not only the California poultry industry but the entire U.S. poultry and egg supply. In all, 1,341 infected flocks were identified, and almost 12 million birds were destroyed. Eradication efforts cost taxpayers $56 million ($228 million in 2002 dollars), severely disrupted the operations of many producers, and increased the prices of poultry and poultry products to consumers. END affects the respiratory, nervous, and diges- tive systems. The incubation period for the disease ranges from 2 to 15 days. An infected bird may exhibit the following signs: • Respiratory: sneezing, gasping for air, nasal discharge, coughing • Digestive: greenish, watery diarrhea • Nervous: depression, muscular tremors, drooping wings, twisting of head and neck, circling, complete paralysis • Partial to complete drop in egg production • Production of thin -shelled eggs • Swelling of the tissues around the eyes and in the neck • Sudden death The death rate in END -infected flocks goes up drastically. There was a new IP in LA County on May 31st. Quarantine Status There are a total of 8,450 quarantines currently in place in Inland Desert. 1,221 quarantines have been released and there are over 2,000 quarantines currently being processed for release. Release Protocol For quarantine releases in the 1K circles around IP's, all IP's and dangerous contacts (DC's) in that 1K must be eligible for release. This means that cleaning and disinfection must have been completed and effective, and thirty days has to have passed since it was completed. There must not have been a repopulation of birds on these premises. Any of these conditions not met can delay the release of all quarantines in that 1K. Once the IP's and DC's are declared eligible for release, the other premises are reviewed for types of birds. Premises are selected for testing based on presence of poultry and/or proximity to IP's. Once negative results are received, all the quarantines are released either by hand or by mail. Though released and free to move, there are still the restrictions of the State and Federal area quarantines. Area Quarantines We have been working to survey and test flocks outside of an area we have designated as the Blue Chain. This will allow the shrinking of the Federal quarantine line to that of the State line and then further to the areas of greatest infection.
