At that time, as required by the Brown Act, the City Council reported out action taken with respect to the claim presented on October 19, 2000 by San Jacinto Sea Landing Inc. It is my recollection you had left the meeting by this time and I believe it was simply an oversight that you were not informed of the action taken. I would recommend that the November 2, 2000 minutes be amended by the City Council to reflect the public reporting/announcement as to the following: The City Council by unanimous vote of all present rejected the claim (significant exposure to litigation) presented October 19, 2000 by San Jacinto Sea Landing Inc. dba Tony's Sea Landing in the amount of $455,585 (or $455,595) for claimed money damages associated with alleged costs, losses and non- RVPLB''Di:G`.G05539 LAW OFFICES OF BEST BEST & KRIEGER LLP Grace Alvarez December 15, 2000 Page 2 economic damages related to construction and operation of restaurant facility in the City of San Jacinto. Please remember that the letter from David C. Roberts, Attorney at Law, dated October 19, 2000 to the City of San Jacinto and San Jacinto Redevelopment Agency on behalf of Tony's Sea Landing, giving notice of claim for damages, should be made available for public inspection under the Public Records Act. If you would like me to provide you with a copy, please let me know. I have discussed with the City Manager that in the inure it may be appropriate to use a standard form of memorandum to make use of any reportable action that might be taken by the City Council in Closed Session. I will prepare a suggested draft of the memorandum to be used for that purpose early next week. I have also discussed with the City Manager the possibility of briefly setting forth the facts and circumstances supporting the City Council dealing with anticipated litigation. JEB/pbh cc: John F. I, Grace Alvarez, City Clerk of the City of San Jacinto, do hereby certify that I caused to be posted the foregoing agenda this 27th day of October 2000, as required by law. 3 FROM: SUBJECT: November 2, 2000 The Honorable City Council Tim Hulls, Planning Director Conditional Use Permit 5-00 - Proposed Fue Corner State and Dillon Streets RFCOMMFNDATJON: Station and Mini Mart Southeast Approve Conditional Use Permit 5-00 based on the Findings of Fact and Conditions of Approval. BACKGROI IND: On September 13, 2000, the Planning Commission approved Conditional Use Permit 5-00. The approval authorizes the establishment of a fuel station with a 400 square foot mini -mart. The site is Iocated at 315 South State Street, on the southeast corner of State and Dillon Streets. The site is currently developed and previously operated as an automated fueling station. On October 5, 2000, the City Council opted not to ratify the Planning Commission approval and set the item for public hearing. The Council expressed concerns that an 80-foot wide driveway on State Street would allow uncontrolled access and pose potential safety problems. As a result of the Council concerns, the applicant opted to revise the plan to eliminate the 80- foot wide driveway on State Street. In lieu of the 80-foot driveway, the applicant is requesting a 40-foot wide driveway on State Street located as far south on the property as possible. In addition, the applicant has changed the configuration of the pump islands to run north and south, instead of east and west. Furthermore, the applicant is requesting to keep both. driveways on Dillon Street. The proposed modifications allow for better on -site circulation, as the access on State Street is consistent with County Standards. In addition, the State Street access is located away from the intersection to the greatest extent feasible further reducing circulation problems. However, the westerly driveway on Dillon Street has to remain, due to the reconfiguration of the pump islands from an east/west orientation to a north/south orientation. Ti JSTIFICATION: Refer to the attached Findings and Conditions of Approval. ATTACHMENTS: 1 Exhibits 1 Findings and Conditions of Approval FINDINGS OF FACT 1 CUP 5-2000 is not located within a known seismic zone. 2. CUP 5-2000 is located within an "X" Flood Zone (unshaded). To mitigate impacts on regional drainage systems, the property will be assessed the regional drainage fee prior to issuance of building permits. The existing General Plan designation is Community Commercial. The existing zoning is R-P, Residential Professional The proposed fueling station and mini -mart facility i consistent with the General Plan, and is conditionally permitted use in the R-P zone. s A 40-foot wide driveway on State Street and two driveways on Dillon Avenue will provide access to the site. 5. The proposed use would reestablish a fueling station and mini -mart that is currently constructed at the intersection of State and Dillon. Therefore, the proposed use will not create additional a significant demand for City services, or further impact existing facilities. 6. The proposed fueling station and mini -mart facility will be architecturally compatible with the neighborhood, because of the existing building materials used and installation of landscaping along State Street and Dillon Avenue. 7. The proposed fueling station and mini -mart facility will not be detrimental to the surrounding properties or to the public health, safety and welfare of the community, because it will alleviate a potential nuisance, and occupy a building once used as a fueling station. In addition, the fueling service station and mini -mart will provide additional shopping and job opportunities for the surrounding neighborhood. CONDITIONS OF APPROVAL Before final acceptance of the project, alI conditions listed below shall be completed subject to the satisfaction of the City Engineer, Planning Director, the Chief of Police, or the Fire Chief, or their designee, depending on which department recommended the condition Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. BACKGROUND: As you are aware, some of the old street signs in the downtown area and major thruways are being replaced at this time. City crews are currently working on Phase I, which includes major thruways. Phase II will encompass the replacement of residential and damaged street signs, as budget allows. As our residents are seeing that these signs are being replaced, they have approached our city crews asking if they can have these old street signs, since for some of them these signs represent a part of the City's history. Our current Municipal Code has no provisions for granting this type of request. Section 3.08.250 addresses surplus property, and establishes the procedure for declaring it surplus, but does not address the gifts of city property such as street signs. Staff has analyzed the value of these signs and has found that there is only scrap value in them. Therefore, staff is asking the Council to determine that all street signs being replaced he deemed surplus and that the signs can be gifted to citizens on a first -came -first -serve basis. JUSTIFIC ATION: By setting this procedure, the City staff time would be reduced as these signs can immediately he given to the citizens who request them. BUDGETARY IMPACT: None - proper funds have been allocated this year to complete Phase I of the Street Sign Replacement Program. ATTACHMENTS: None TO: The Honorable City Council FROM: Jake Wage City Manager SUBJECT: Approve Employment Agreement Curator RECOMMENDATION: h Phil Brigandi — San Jacinto Museum By motion, approve Employment Agreement with Phil Brigandi, San Jacinto Museum Curator. BACKGROUND: At the present time the San Jacinto Valley Museum is being staffed by two part time individuals receiving minimum wage compensation whose basic function is to open and close the museum and count the number of visitors. The current museum hours are Tuesday through Sunday from 12:00 p.m., to 4:00 p.m. While this approach has maximized the number of hours that the museum is open, it has not helped grow the general public's awareness of the museum. In an effort to energize the potential of the museum, staff has been attempting to identify an individual whose experience, talent, and interest could help elevate the status of the museum above its current level. City staff believes it has now identified such an individual. As the Council will note, in the attached resume, Mr. Phil Brigandi has some highly desirable qualifications that render him a very strong candidate to help lead the growth and expansion of what now is a very modest museum. Mr. Brigandi is a published historical author, including two hooks on the history of this area (Temecula at the Cross Roads of History, published in 1998 and Building the Future, the Story of the EMWD, published just this year). Additionally, Mr. Brigandi has a long-standing association with the Ramona Pageant Association as both an employee (since 1990) and as a volunteer (since 1980). He has had numerous contracts as a historical researcher, writer, and archivist. His undergraduate degree is in history. In discussing the City of San Jacinto's interest, Mr. Brigandi has proposed to offer his services in the following way: • Operate the museum 10 hours per week (Thursday and Friday, 12:00 p.m. — 5:00 p.m.), fifty weeks a year. • Supervise activities of museum aide • Museum Aide, would operate the museum on Saturdays at a cost of $7.00/hour (Saturdays 12:00 p.m. - 5:00 p.m., fifty weeks a year) • Develop and maintain museum displays • Coordinate inventory and identification of museum collection • Develop a volunteer docent program • Schedule and present tours and talk up to an additional 3 hours per week. In exch ange for the above -described services, Mr. Brigandi would be compensated as follows: Curator's contract with the City shall be as an independent contractor for a term not less than six months Curator shall receive $610.00 monthly for the term of the proposed contract • Curator shall not be available for seven performance dates of the Ramona Pageant, but shall be responsible nevertheless for the operation of the museum on those days, either through the museum aide or volunteer docents • Curator shall recommend to the City Manager the hiring of a suitable candidate for the museum aide (the museum aide will be a part time employee of the City). Based on the proposed terms, it is strongly recommended that a professional services agreement be approved. In addition to a resume fitted to the City's needs, Mr. Brigandi already possesses a working knowledge of the San Jacinto Valley Museum, and the Estudillo Mansion as well as with the individuals involved with both properties. Based on a forty hour a month minimal commitment, the City will have in its service a recognized local historian with a reserve of energy and a passion for this area's history. JUSTIFICATION: Operation of the museum has been impaired through the reliance on minimum wage part-time employees. BUDGETARY IMPACT: Sufficient funds are available through the approved Fiscal Year 2000-2001 budget. Based on a mid - November start and through the end of this fiscal year, the total cost for a curator would not exceed $4,880. Based on the same start date, the total cost for a museum aide for the balance of the fiscal year is approximately $1,900. At the end of October, staff has estimated $6,000 in available funds. MEMORANDUM October 17, 2000 From: Bernie Simon, Finance Director To: Jake Wager Subj: Museum Budget /Actual FY 2000-01 Estimated to 10/31/00 Museum budget shows that we have expended $7,643 to date, of which approximately $1,100 was spent on the Estudillo Mansion. I estimate that we will probably spend $8,450 through the end of October The $9,000 curator budget line item covers the services of three part time museum employees. The cost is approximately $750 per month, which is reimbursed to the Chamber of Commerce. Chamber believes they are in a deficit because the past costs were in excess of what the City reimbursed them. Per my discussion with Jo at the Chamber of Commerce, $750 per month is probably correct for current costs. The Chamber has currently billed us $2,200. However, we would owe them $3,000 though the end of October. My observation is that the Chamber would be very interested in doing something different. Assuming no change in the curator budget, $6,000 would be available for the rest of this FY for the curator budget line item. [1 Museum Aide to operate Museum on Saturdays; 50 weeks a year. [] It is understood that due to existing commitments, the Curator will not be available on the seven (7) performance dates for the Ramona Pageant each Spring, but will arrange for the operation of the Museum on those days (including Sundays) with the Museum Aide and/or volunteer Docents. SALARY: [1 [1 Museum Aide to receive approximately $7.00/hour = approximately $1,700 per year. Curator to receive balance of $9,000 currently budgeted = approximately $7,300. AGREEMENT: [] Curator's contract with the City as an independent consultan to be for a term of not less than six months, and not more than one year. Subject to re -negotiation and renewal at that time. These terms will, I trust, take care of the immediate needs in the Museum. As the Estudillo Mansion project progresses, we will need to define my involvement more precisely. In the meantime, I will concentrate on reworking the Museum displays and attempting to increase the visitation, especially among school children. I look forward to your response, and appreciate your concerns for the Museum. The agreement accurately reflects the proposal made by Mr. Phil Brigand', which is included in the City Council's agenda packet. It also accurately reflects the business points enumerated in the administrative report for Item No. 4.2. CITY COUNCIL TO: The Honorable City Council FROM: Ber e Simon. Finance Director SUBJECT: Appointment of Bond Underwriter fo RECOMMENDATION: CFD #2 Refinancing Approve Professional Service Agreement with O'Connor and Company securities to serve as the underwriter in connection with CFD # 2 workout. BACKGROUND: This item was continued from the October 19'h meeting in order to allow Council Members time to review the "Agreement For Investment Banker/Underwriter's Services" document. This agreement was not available to Council Members until the day of the last meeting. The attached agreement is a standard services contract that has been approved as to form by Kyle Snow of Best Best & Krieger. A copy of the staff report of October 19111 is attached. JUSTIFICATION: 0' Connor and Company is recommended due to their experience with restructuring troubled debt and defaulted land secured financing. 0' Connor and Company has also proposed the lowest fees to undertake this refinancing. BUDGETARY IMPACT: No impact to the City or Redevelopment Agency. Fees paid to the underwriter are funded with proceeds received by bonds issued by the workout of Assessment District CFD #2. Fees are contingent upon bonds being issued. October 19, 2000 AGENDA ITE The Honorable City Council Bernard Simon, Fin ce Director SUBJECT: Approve Professional Service Agreement with O'Co Securities for CFD No. 2 Bond Underwriter RECOMMENDATION: Approve Professional Service Agreement with O'Connor & Company Securities to serve as the underwriter in connection with the CFD No. 2 workout. or & Company BACKGROUND: The City is close to reaching an agreement on the terms of an MOU with the majority bondholder in CFD No. 2. The MOU covers the proposed terms of the restructuring of the District's 1989 Special Tax Bonds, the credit bid process, tax savings for existing homeowners and development issues relating to the remaining undeveloped properties. It is now an appropriate time to select an underwriter to negotiate the sale of the bonds to be sold as part of the restructuring. It is important to bring in an underwriter at this time so the City's bond counsel and financial advisor can benefit from their input on the proposed refinancing structure as it pertains to the marketing of the series of the bonds secured by existing homes to the investing public, as well as the teems and conditions that may be established for the resale of the new district bonds (which will initially be owned by Elliott Associates) once development of the remaining property occurs. JUSTIFICATION: Proposals for underwriting services were solicited from four firms having experience in the area of restructuring troubled or defaulted CFD bonds. The City received proposals from Kinsell. Newcomb & De Dios, Inc., Solana Beach; O'Connor & Company Securities, Newport Beach; Seidler -Fitzgerald Public Finance, Los Angeles; and Stone & Youngberg, San Diego. Relevant underwriting experience was the key factor in determining which firm to select for recommendation to the City Council. The experience in restructuring troubled or defaulted land secured financing, in addition to the use of the credit bid process of each firm is shown below: Bond Issues Credit Bid Kinsell, Newcomb & De Dios 4 1 O'Connor & Company Securities 7 1 Seidler -Fitzgerald Public Finance 5 1 Stone & Youngberg 7 1 Several of the restructurings completed by O'Connor & Company Securities are for districts located in Riverside County, including transactions for the Val Verde Unified School District CFD 88-1, County of Riverside CFD No.'87-5 (Wild Rose) and City of Lake Elsinore CFD No. 93-1. In addition, the firm has underwritten numerous land secured bonds in neighboring communities such as Penis and Beaumont, which brings an added familiarity with bond marketing characteristics which may be unique to our area, as well as knowledge of what merchant builders in the area are looking for and doing. This will give the City some additional expertise in evaluating the development proposal made by Elliott Associates together with their consultant, Sage Development. BUDGETARY IMPACT: None. Fees paid to the underwriter are funded with proceeds of any bonds issued by the District. RECOMMENDATION: By motion, reject all bids for the Entry Monument and autho modifications and a subsequent bid advertisement. e Staff to proceed with project BACKGROUND: At the February 13, 2000, City Council meeting, the Council made a budget amendment of $25,000 to create an entry monument for the City. Furthermore, the project is listed in the Redevelopment Implementation Plan with a budgeted amount of $50,000. The project designer, Gaudet Design Group, estimated the project cost at S55,000. The bid opening was held on October 24, 2000 and only two proposals were submitted. Genesis Construction (S98,777) and Brandt Commercial Signs ($106,271) were the only two bidders. Both bids have been qualified to meet the project specifications. However, because both proposals are nearly double the estimated project cost and well in excess of the project budget, Staff would recommend that the plans and specifications be modified to more closely correlate to the budget for the project. After the modifications have been completed, the project would have to be re -advertised to solicit proposals. ,ITISTIFICATION: Both proposals are nearly double the estimated project cost and well in excess of the project budget. BUDGETARY IMPACTS: The source of funds will be Redevelopment. The amount of $25,000 is currently included in the FY 1999/2000 Redevelopment Budget. Even after plan modifications, Staff anticipates that a budget amendment will be necessary to increase the project amount to be consistent with the Redevelopment Implementation Plan. BACKGROUND: There are several CDBG projects that have been completed and not fully expended their allocated funds or have become unfeasible due physical constraints. As a result, there are outstanding fund balances that can be shifted to other feasible projects. There are two public service programs from previous years that did not fully expend their funds (Valley Restart Shelter-S1,750) or whose project came in below budget (V.I.P. Tots-$146). In addition, there is one public facility project, the City Hall Accessibility Upgrade ($4,172), that has been completed and has funds remaining; and another project, Victoria Avenue Phase III ($66,392), that due to significant and costly physical constraints is not feasible at the budgeted amount. As a result, the project funds remaining or not spent should be reprogrammed to another eligible project. There are three potential projects that funds could be allocated to: Sallee Park, Downtown Infrastructure, and Camino Los Banos Sewer Improvements. In order to assist in the implementation of the improvements conceptually approved by both the Council and the School Board, Staff would recommend that the funds be reprogrammed to Sallee Park. Combined with existing CDBG funds and Housing Funds already budgeted for the project, the total amount available for the project would be around $300,000. The other two projects both have adequate funds from Redevelopment and other sources to implement the proposed improvements. JUSTIFICATION: The reprogramming will have not have a significant impact on existing programs or projects. BACKGROUND: On October 5, 2000, the City Council awarded a contract to GDG to prepare concept designs and construction drawings for the monument at the Lake Park Bridge. GDG has developed 6 concept designs for the monument, labeled A, B, C, Al, B1 and Cl. The designs all use similar materials and treatment, with smooth plaster finish, river rock accent, and the same plant materials. The materials and features are modeled after the entry monument design approved for the Sanderson Avenue and Ramona Expressway intersection. While all six -concept designs are consistent with the entry monument design, Concepts C and Cl are most similar. After approval of a concept design, GDG will prepare construction plans and specifications. The estimated time of completion for construction drawings is four weeks. Memorandum dated September 26, 2000 A U MEMO UM September 26, 2000 From: George Kaenel, Interim Finance Director To: Jake Wager, City Manager Subj: Contingency Reserve for Water Fund (Fund 050) Just prior to closing the City's books for audit, the Water Fund had a deficit in cash of $242,309 and a deficit retained earnings of $381,660. To eliminate the cash deficit I transferred $241,309 in payments for capital improvements to the 1997 Bonds Capital Improvements Fund. This transaction still leaves a deficit in retained earnings of $140,352. The fund has $336,737 in contributed capital so there is now a positive fund balance of $233,426. I have placed a hold on the $190,000 in capital improvements budgeted this year until such time as the fund has a positive retained earnings balance. The annual operating budget for the water fund is around $2,000,000. The desired 8% reserve for contingencies, therefore, is around $160,000. Any budget for capital expenditures should be appropriated from retained earnings in excess of the reserve for contingencies. The current rate structure provides for water rate increases of 7.5% in fiscal years 2001- 02 and 2002-03 and 5% increases in fiscal years 2003-04 through 2006-07. The capital improvement in the amount of $190,000 in this year's budget is for a major repair to a reservoir. I believe that if this capital expenditure was transferred to the 1997 Bonds FINANCE DEPARTMENT Subj: Contingency Reserve for'Water Fund (Fund 050) Page 2 Fund the Water Fund could attain an 8% contingency reserve by fiscal year 2002-03 and maintain it from that point forward.` This would, of course, require prioritizing the projects now planned for the 1997 Bond Fund and delaying some of them until after fiscal year 2002-03. The delayed projects could then be budgeted subsequent to fiscal year 2002-03 from retained earnings in excess of the reserve for contingencies. TO: FROM: SUBJECT: November 2, 2000 AGENDA ITEM 5. I believe that if this capital expenditure was transferred to the 1997 Bonds FINANCE DEPARTMENT Subj: Contingency Reserve for Water Fund (Fund 050) Page 2 Fund the Water Fund could attain an 8% contingency reserve by fiscal year 2002-03 an maintain it from that point forward. This would, of course, require prioritizing the projects now planned for the 1997 Bond Fund and delaying some of them until after fiscal year 2002-03. ' The delayed projects could then be budgeted subsequent to fiscal year 2002-03 from retained earnings in excess of the reserve for contingencies. BACKGROUND: projects with the City of On August 29, 2000, the Cities of Hemet and San Jacinto held a joint Council meeting to discuss regional issues, including water projects. At this meeting staff was directed to work together, and investigate the possibilities in regards to water projects of mutual benefit to both cities. On October 13, 2000, the Water Subcommittees and city staff from both agencies met to discuss the following: 1. Groundwater Benchmark Data Project - Request for Proposals for Joint Project 2. Conjunctive Use Project Grant Opportunity - Buena Vista Basin 3. Resolution of Cooperation on Water Issues between Hemet and San Jacinto At the conclusion of the above -mentioned meeting, it was agreed that each agency considers adopting a resolution formalizing future joint ventures. Also, it was decided that a request for engineering proposal would be issued for the potential Buena Vista Recharge Basin, as well as installation of water tanks and wells at this site. The Subcommittee agreed that individual Memorandums of Understanding (MO U) would be needed for individual future projects, and those MOU's would still need to be approved, as each of them addresses specific issues related to funding, engineering, and use of consultants. This joint resolution would also allow joint applications to various funding sources as they become identified without requiring further Council action.
