I am appealing the denial of my CUP because I believe that during the last meeting
against the planning commision were not reviewed all points to approve my request.
During the previous meeting when the police department mention their Concerns
about having Live Band or Kareoke, I Explained thhat I was willing to remove that
from my CUP, I will not have any of that. It was also mentioned that Beer & Wine
permits is not in ordinance with the City, but according to Downtown Commercial
Zone it is permitted. (please review the attached form). Also the fact, that we are
In undue concentration, I have Contacted ABC and I was told that the is congested
with beer & wine licenses according to census tract 436.01, but even that 2 of those
licenses given are not open to the publi, they are clubs. Also It was even said That
the close proximity to residences and schools was going to be a Potentially negative
effect, but We have Delgado's restaurant right across the street from the park where
the kids play, Also Little Italy close to schools and to the church & residences, there
Is a liquor store and El Toro market ant the 5 point corner, They All sale beer &
wine. lam not asking fir an illegal procedure to be approved or imposed, I am
asking for what it is permited, every restaurant has a beer and wine license, and its
because it has always been a customer request.
Also a strain on the city is not my responsability, I am trying to conduct business not
use city resources, I am a small business and I am willing to make it in a safe way,
this is my source of living, my Husband and I support our 4 kids from the restaurant,
this is our future, what brings us our Income, the request for us to have a CUP for
Beer & wine approved is Because it has been a customer request since we
opened, we serve seafood and most people eat that with a beer or a glass of wine.
and the other reason concerning noise levels, my restaurant operates Sunday
through Thursday from 10:30am to 7:00pm and Friday and Saturday until 10pm. I
will comply with noise ordinance with it.
I also now that If I violate any City or ABC procedures the city has the possibility to
shut me down, but I am not going to do something unlawful to have that happen,
please in consideration I also request that my appeal fee to be refunded in
consideration of all I have invested in this CUP permit,
Miriam Jimenez
