THOMPSON & ASSOCIATES LEGAL FIRM 152 South I-larvard Street • Hemet, California 92543 (951) 925-3808 • Fax (951) 925-3239 January 28, 2011 City Clerk/Agency Secretary 595 S. San Jacinto Avenue San Jacinto, CA 92583 Re: San Jacinto Redevelopment Agency Pertaining to The Proposed Amendments to the Redevelopment Plans for the San Jacinto and Soboba Springs Redevelopment Project Areas, The Final Environmental Impact Report, and the Amended Five -Year Implementation Plan To Whom It May Concern: On behalf of Mr. John Patterson, party in interest as owner of Quality Transmissions, which is located within the boundaries of the Merged San Jacinto Project Area, do herein oppose all of the proposed Amendments generally and specifically in regards to the proposed re -instatement of eminent domain authority in the existing San Jacinto Project Area for an additional 12 years, for the record and reserve further objection based on facts unknown, in accordance with the Notice supplied by Mr. Rick Miller, City Clerk, City of San Jacinto. Specifically, with the recent economic downturn that the entire state, and the San Jacinto area in particular is facing, which experts universally agree is years from fill recovery, the proposal to re- instate eminent domain authority threatens all residents and business owners whose property is located in the proposed Project Area as property prices are depressed and in many cases underwater. Although stated plainly in the Notice that the Agency is not contemplating any acquisitions within the Project Area at this time, there is no guarantee that any acquisition will not be soon contemplated and/or made should the eminent domain authority be re -instated. Contrary to the aforementioned position of the Agency, it is very likely that acquisitions are contemplated or there would be no need to re -instate eminent domain authority. Further, with property prices near their all-time lows, it makes ripe for picking properties to condemn as the cost of doing so will be far less than previously possible thus increasing the potential for condemnation. As a small business owner making a living from his trade, the fear of condemnation makes difficult the decision, inter alia, to expand, invest in the business and/or property housing such business, or plan for the future. Certainty in this regard, not fear, is the necessary ingredient for recovery in these uncertain economic times. Without certainty, persons located within the Project area cannot plan for the future and in fact it will be the new fear of condemnation that will prolong any community wide economic recovery as small business will be effected, which is the engine that drives economic recovery. Page I of 1 Although it is conceded that the Agency would be required to comply with all the legal requirements pertaining to the acquisition of real property by a public agency, as noted above, the legal requirements do not address nor redress for the depressed property values, which will entice condemnation. These times are like no other and to suggest that the condemnation laws or protections, which were designed for normal economic times, will afford affected property owners proper protection is misguided and therefore objection to any proposal to re -instate eminent domain authority at this time is necessary and made in good conscious. Box 1563 San Jacinto, Ca. 92581 Dear Community Members, My name is Brianna Wilson. I am a junior in high school and have been presented with a once in a life time opportunity. The People To People organization has invited me to further my education for three weeks over the summer of 2011 in Europe. It is an honor to be one of only twenty students who have been selected to participate with this delegation. I will be a student Ambassador representing the United States and learning about the history and cultures of Italy and Greece. This trip will allow me to discover international diversity and gain a better understanding of the world. During this educational experience I will meet with government officials, learn about ancient civilizations, interact with other students my age, and participate in educational activities. I have always been interested in architecture and I want to explore the places where architecture is an artifact. While traveling through Italy and Greece I will be able to study Roman and Greek architecture hands on. There are few places in the world that offer the amazing buildings that I will discover in these countries. I will visit the Sistine Chapel and the Colosseum and walk through the cobblestone streets of Italy, a veritable museum of architecture. I can only imagine the influence that this experience will have on the direction of my future career. I will also earn high school and college credit and I will have a life experience to add to my college applications. I am asking my family, friends, local businesses and organizations, and my community for financial support to help me with tuition. I hope that I can count on your donations. The program tuition is $6,499 which includes meals, transportation, accommodations, and educational activities. No contribution is too small. Your sponsorship will enable me to participate in this wonderful opportunity. Thank you in advance for your consideration and support. a Sincerely yours, , ` Brianna Wilson If you have any questions please contact me at my cell phone number (951) 973-8314 or my Mom's cell phone number (951) 764-5468. As a Student Ambassador, you join the effort to bring the world together through education and friendship while experiencing a wonderful journey of discovery. My grandfather Dwight Eisenhower, the 34th president of the United States, said, "I like to believe that people in the long run are going to do more to promote peace than our governments." He believed encounters between people of different backgrounds would form the foundation for lasting world peace. He created People to People with the idea that ordinary citizens of different nations could solve their problems and live harmoniously with one another. By venturing beyond your local borders, you will represent the very best of your home to the rest of the world. You will gain insight intonewcultures, forge lasting friendships with global counterparts, and help promote peace and human dignity. Throughout my experience with People to People International, I have seen Student Ambassadors embrace diversity and celebrate the common human experience that fosters international goodwill. Perhaps most remarkably, I have observed people of other nations welcoming Student Ambassadors into their homes and building lifelong bonds. It is with great joy that I welcome you to the program. It is satisfying to know that, through your People to People Student Ambassador Program, you will experience the excitement of travel, the advantage of studying in another part of the world, and the joy of cultural discovery. You will see the world and yourself with new eyes, and you are sure to make memories and friendships to last a lifetime. Your partner in peace, Mary Jean Eisenhower President and CEO, People to People International www.ptpi.org PEOPLE TO PEOPLE STUDENT AMBASSADOR PROGRAMS "I have long believed, as have many before me, that peaceful relations between nations require mutual respect between individuals." — President Dwight D. Eisenhower HISTORY THE HISTORY OF PEOPLE TO PEOPLE President Dwight D. Eisenhower believed that ordinary citizens of different nations, if able to communicate directly, would solve their differences and find a way to live In peace. This simple thought —that people can make a difference where governments cannot —led to the foundation of People to People in 1956. Our 34th president called a special White House conference of American leaders including Olympic champion Jesse Owens, entertainer Bob Hope, Hallmark Cards founder Joyce Hall and Walt Disney, to develop a program of personal exchanges and firsthand experiences with other cultures. Over the past 50 years, People to People Ambassadors have fulfilled President Eisenhower's vision of a better world, gaining maturity, confidence, self-esteem and new friendships. People to People first built bridges between working citizens; however, the president recognized the power of young people as leaders. Since the first student delegation to Berlin in 1963, thousands of young Americans have safely traveled across international borders, returning home with a greater sense of what it means to be a global citizen. Today, our Ambassadors have the opportunity to journey to 34 countries on all seven continents. At the program office in Spokane, Washington, over 250 dedicated associates work to enure that every Ambassador has a life -changing educational experience. Our exhaustive safety practices have made us a leader in international travel safety, and we are constantly improving them and adapting to the changing world situation. Close relationships with our international friends and partners and the presidential legacy of our programs allow People to People to provide exclusive, high-level access to even the most remote destinations. As Ambassadors travel under the banner of People to People, they represent the best characteristics of our country hope, courage, openness and a love of peace. President John F. Kennedy said it best: The nature of People to People activities is as varied as the individuals involved. The housewife whose recipe contains the yeast of kindness, the soldier whose arms embrace homeless waifs, the doctor who heals with humility, all assert a single theme —the power of people, acting as indivickials, to respond imaginatively to the world's need for peace." Join the Soboba Band of Luiseno Indians and the Luiseno Women of Soboba for the Longest Walk 3, February 17th, Registration is required. This will be a 3 mile walk from the Casino Parking Area to State Street, start time is 9am. We hope you will join us! The City's priority this year as in previous years is the completion of San Jacinto River Stage 4 Levee and we appreciate the funding contribution of $12 Million and your leadership with the ongoing design and environmental process of the Levee. The City also requests continued support and funding for the following projects: • Master drainage plan update - continue funding for preparation of the Master Plan, • Continue the environmental and preliminary design for Lines "C", "C- 5" and associated laterals. If the final design is delayed to future years, we ask that you authorize City to perform this task via consulting contract utilizing the Zone 4 funds. Due to the reduction in development activities and funding contribution, we respectfully request that you increase the $1 Million contribution for Line "G" to $2 Million so we may implement this project. Please call if you have any questions or require additional information. Sincerely, City Engineer Cc: Tim Hults, City Manager City Engineer's Office 595 S. San Jacinto. River, Stage 4 (4-8-00020-04) - This project, a joint venture with the City of San Jacinto, was conceived as a multi -year plan to construct the ultimate levee system (approximately 1,200 feet river bottom width) between the existing Corps of Engineers' levee 9,500 feet upstream of State Street, and a point about 8,200 feet downstream of Sanderson Avenue, a distance of about 5 miles. Floodwalls on piles are required to be constructed over the Metropolitan Water District facilities just east of State Street. The District and the City began work on the project in 2000 after the Corps of Engineers prepared a Reconnaissance Study and determined there was no justification for Corps participation. The City, with funding from the District, contracted with CH2MHILL for preparation of a Biological Assessment of the area impacted by the proposed levee project. In December 2002, the District executed an agreement with the City to share the cost of design and construction of the proposed levee project up to a maximum of $7 million. An amendment to that agreement is pending District Board approval. The amendment would raise the District's contribution to $12 million, place the burden of property acquisition entirely on the City and establish the City as the Lead Agency for CEQA. A preliminary design report was prepared by Webb Associates in 2004. Work on the Final Design and EIR commenced in 2007. The City entered into a contract for Final Design with prime consultant Webb Associates, and sub -consultants CHJ (geotechnical, special pile design), PACE (sediment transport) and Terrain Engineering (floodwall design). On March 3, 2009 the District entered into a 50% cost share agreement on the design work with the City. The agreement was amended on February 9, 2010 to cover additional design work approved by the City Council on January 7, 2010. The most significant aspect of the additional design work was changing the preliminary alignment to avoid the Haringa Dairy. Plans are scheduled to be completed by March 2011. Webb Associates is also the primary consultant on the EIR document with Glenn Lukos and Associates providing the biological survey data. The District covered 100% of the cost for the environmental work. A CEQA Notice of Preparation of a DEIR was originally circulated in July 2007. Since the Notice of Preparation was circulated, the proposed project has changed in the following ways: , a shift in the alignment of the proposed southern levee; an increase in the extent of northern levee and floodwall enhancements; protection of the Metropolitan Water District underground pipelines; a reach of floodwall along the southern levee; preparation of an Operation and Maintenance Plan for the proposed facilities; and extension of the project area approximately 6,800 feet downstream (to the northwest). Another CEQA Notice of Preparation was circulated in July 2010 to address these project changes. The environmental work is ongoing and complex as the CEQA and MSHCP documents must address the above project changes and potential impacts to the Southwest Willow Flycatcher, least Bell's vireo, Los Angeles Pocket Mouse, San Bernardino Kangaroo Rat and riparian/riverine habitat. The Draft EIR is scheduled to be circulated for public review by the City in July 2011. Subject to the completion of right of way acquisition, construction is tentatively scheduled to begin in February 2012. • Until MDP/ADP is implemented the City has been implementing its own policy: • Developers pay fair share of regional cost and also implement interim measures onsite • Interim measures (including pumps and basins) ® Elimination of nuisance flows ® Low level storm events ® Increased runoff ® Water Quality Management rside County'Design St . ,rid 100-Year flood shall be contained within street R/W limits Stre Open Channel--' 10-Year flood shall be contained -within the top of the curbs 1' Typical Freeboard Underground Storm Drain 4SC4/345E6 WATER COURSE i 8 Ili WATER FLOW Br SWNF OR GIITER WATER FLOW BY STORM DRAIN OF EN WON BASIN rn RUMP B`ATION CA -CH BASIN January 24, 2011 Mr. Warren D. San Jacinto Avenue San Jacinto, CA 92583 ? ECEi D C—,y OF SAN JACiNTO 2.2_011 Re: San Jacinto Redevelopment Agency Pertaining to The Proposed Amendments to the Redevelopment Plans for the San Jacinto and Soboba Springs Redevelopment Project Areas, The Final Environmental Impact Report, and the Amended Five -Year Implementation Plan To Whom It May Concern: On behalf of Mr. Specifically, with the recent economic downturn that the entire state, and the San Jacinto area in particular is facing, which experts universally agree is years from full recovery, the proposal to re- instate eminent domain authority threatens all residents and business owners whose property is located in the proposed Project Area as property prices are depressed and in many cases underwater. Page 1 of I Although it is conceded that the Agency would be required to comply with all the legal requirements pertaining to the acquisition of real property by a public agency, as noted above, the legal requirements do not address nor redress for the depressed property values, which will entice condemnation. These times are like no other and to suggest that the condemnation laws or protections, which were designed for normal economic times, will afford affected property owners proper protection is misguided and therefore objection to any proposal to re -instate eminent domain authority at this time is necessary and made in good conscious.
