A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
JACINTO ADOPTING A MITIGATED NEGATIVE DECLARATION FOR
THE SAN JACINTO AGRICULTURAL IN-LIEU WATER SUPPLY
PROJECT (SCH # 2007011020), APPROVING THE PROJECT, THE
FOUR-AGENCY AGREEMENT, AND THE ADDENDUM, AND MAKING
RESPONSIBLE AGENCY FINDINGS PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, the City of San Jacinto (the "City") is a municipality duly created,
established and authorized to exercise its powers under and pursuant to California law;
and
WHEREAS, the City, Eastern Municipal Water District ( the "EMWD"), the City of
Hemet, and the Lake Hemet Municipal Water district have agreed to cooperate with each
other and share some costs regarding efforts to reduce groundwater pumping from the
San Jacinto groundwater basin; and
WHEREAS, to facilitate this goal, the EMWD proposed the San Jacinto
Agricultural In-Lieu Water Supply Project, a proposal to install approximately 10,775
linear feet of 24-inch recycled water pipeline to deliver recycled water to two dairy farms
(the "Project"); and
WHEREAS, the EMWD served as lead agency for the environmental review and
analysis of the Project pursuant to the requirements of the California Environmental
Quality Act ("CEQA") (Pub. Res. Code, § 21000 et seq.) and the State CEQA Guidelines
(Cal. Code Regs., tit. 14, § 15000 et seq.); and
WHEREAS, the EMWD determined that a Mitigated Negative Declaration ("MND")
should be prepared to analyze the Project's potential environmental effects; and
WHEREAS, on January 5, 2007 and as required by CEQA, the EMWD prepared
and publicly circulated for 30-days its Notice of Intent to Adopt an MND for the Project
and made the MND available to the public and all interested agencies and individuals,
including the Governor's Office of Planning and Research; and
WHEREAS, the EMWD's Board of Directors, at its regularly scheduled public
meeting on March 7, 2007, reviewed and considered the MND, the initial study, a
Mitigation Monitoring and Reporting Program, the original Project (State Clearinghouse #
2007011020), all oral and written comments received from the public and other interested
agencies on the MND, and adopted the MND and the Mitigation Monitoring and
Reporting Program and approved the Project; and
WHEREAS, in an Agreement entitled "Four-Agency Agreement Re In-Lieu
Project" ("Agreement"), the Agencies agreed to participate in cost-sharing of the Project
and to certain arrangements involving construction of Project facilities and the sale,
purchase, and delivery of recycled water, among other provisions;
RVPUBWCUSHMAM749637.1 Page I of
WHEREAS, the Agencies subsequently created an Addendum to the Agreement

WHEREAS, pursuant to CEQA and the State CEQA Guidelines, the City is a
responsible agency for the Project and its implementation, the Agreement, and the
Addendum; and
WHEREAS, the City Council has independently reviewed and considered the
MND, the Project, the comment letters submitted on the Project, the Mitigation Monitoring
and Reporting Program, other related documents, and the Agreement and Addendum;
and
WHEREAS, all other legal prerequisites to the adoption of this Resolution have
occurred;
NOW, THEREFORE, the City Council of the City of San Jacinto does hereby
resolve as follows:
SECTION 1. Compliance with the California Environmental Quality Act. As the
decision-making body for the City of San Jacinto, and in the City's role as a responsible
agency under CEQA, the City Council has received, reviewed, and considered the
information contained in the EMWD's Final MND, Initial Study, comment letters, and
other related, on file with the City and available for review at the City's offices at 595 S

and all related documents, the City Council has received, reviewed, and considered the
information contained in the Agreement and Addendum, both of which are on file with the
City and available for review at the City's offices at 595 S San Jacinto Avenue, San
Jacinto, CA 92583.
SECTION 3. Findings on Environmental Impacts. In the City's role as a
responsible agency under CEQA, the City Council finds that neither the Project, the
Agreement, nor the Addendum will result in any potentially significant environmental

Council concurs with the environmental findings made by the EMWD and finds that there
is no substantial evidence in the MND, the Initial Study, the comment letters, the
Agreement, the Addendum, or other related documents supporting a fair argument that
the Project may result in any significant environmental impacts. The City Council further
finds that, as to those potential environmental impacts within the City's powers and
authorities as responsible agency, that the MND for the Project contains a complete,
objective, and accurate reporting of those potential impacts and reflects the independent
judgment and analysis of the City Council.
