San Jacinto Ave Riverside, CA 92502-0751 San Jacinto, CA 92583 Office of Planning and Research Tel. (951)487-7330 P.O. Box 3044 Sacramento, CA 95812-3044 Attn: State Clearinghouse Subject: Filing of Notice of Determination for Responsible Agency's approval and adoption of the Project including Phase 1 Facilities Agreement, the Hemet/San Jacinto Groundwater Management Area Water Management Plan, and the Stipulated Judgment in compliance with section 21152 of the Public Resources Code and section 15094 of the State CEQA Guidelines (14 Cal. Code Regs. § 15000 et seq.). Project Title: Responsible Agency approval and adoption of the Project including Phase 1 Facilities Agreement, the Hemet/San Jacinto Groundwater Management Area Water Management Plan, and the Stipulated Judgment determining water production rights under the Hemet/San Jacinto Integrated Recharge and Recovery Program. State Clearinghouse#: 2003121068 Contact Person & Telephone Number: Tim Hults, City Manager 595 S. San Jacinto Ave., Building A San Jacinto, CA 92583 Phone: (951) 487-7342 Project Location (Include County): City of San Jacinto, County of Riverside, California. Project Description: The City of San Jacinto (City), the Eastern Municipal Water District (EMWD), the City of Hemet, the Lake Hemet Municipal Water District and the Riverside County Flood Control and Water Conservation District wish to undertake modifications to the previously certified 2004 EIR and approved Mitigation Monitoring and Reporting Program by agreeing to a Stipulated Judgment determining water rights (production rights), and implementing an associated Hemet/San Jacinto Groundwater Management Area Water Management Plan and an Agreement Regarding Phase 1 Facilities Construction Cost And Use; Cost And Use Of Unused Tribal Water ("Phase 1 Facilities Agreement"), which implements the Integrated Recharge and Recovery Program (the "Project"). On November 21, 2007, as required by CEQA, the EMWD's Board of Directors, at a noticed public meeting, reviewed and considered the Final Supplemental EIR, the Initial Study, a Mitigation Monitoring and Reporting Program, the Project, all oral and written comments received, and certified the Supplemental EIR, made written findings, adopted a Statement of Overriding Considerations, adopted a Mitigation Monitoring and Reporting Program, and approved the Project. 2443 8.4000 1\7231484.2 Thereafter, the United States Fish and Wildlife Service ("FWS") issued a Biological Opinion ("BiOp") detailing conservation measures which would further minimize the Project's potential impacts to the San Bernardino kangaroo rat. Because the BiOp required that two conservation measures be implemented which will result in minor modifications to the Project, the EMWD, as lead agency, prepared an Addendum to the previously certified 2004 EIR to describe these minor Project revisions and to analyze, with supporting substantial evidence, that no new impacts would occur as a result of these changes and that no further EIR or Mitigated Negative Declaration is required by CEQA. That Addendum was adopted on June 23, 2010. Subsequently, the FWS developed further conservation measures that required the relocation of the recharge basins back to the approximate location analyzed in the 2004 EIR, and EMWD therefore decided to prepare a Second Addendum to the previously certified 2004 EIR in order to describe this minor Project revision and to confirm, with supporting substantial evidence, that no new impacts would occur as a result of placing the basins back into the location previously analyzed in the 2004 EIR and verifying that no further EIR or Mitigated Negative Declaration is required by CEQA. This Second Addendum was adopted on November 16, 2011. With the Phase 1 Facilities Agreement now in its final form, the City Council has verified that the 2004 EIR, as supplemented through the 2007 Supplement EIR, and the 2010-2011 Addendums to the 2004 EIR fully and adequately analyze the potential environmental impacts associated with the City's limited role as a responsible agency in the implementation of the Project and the Phase 1 Facilities Agreement. Summary: This notice is filed, in compliance with State CEQA Guidelines sections 15096, to advise that the City of San Jacinto's City Council, acting in its capacity as a Responsible Agency under CEQA, approved the Project at a publicly noticed meeting on February 7, 2012 and made the following determinations: I. The Project will have a significant effect on the environment. 2. An Environmental Impact Report and two Addendum were prepared for this Project pursuant to the provisions of CEQA. 3. Findings were made pursuant to the provisions of CEQA. 4. Mitigation measures were made a condition of the approval of the Project. 5. A Mitigation Monitoring and Reporting Program was adopted. 6. A statement of overriding considerations was adopted for the Project. This is to certify that the documents which comprise the record of proceedings, including but not limited to the Environmental Impact Report, are available to the general public at: Custodian: City of San Jacinto's Planning Office Location: 595 S.
