A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JACINTO AMENDING THE JOINT POWERS

WHEREAS, California Government Code Section 6508. 1 prnvidas
3 that debts, liabilities and obligations of a joint powers
authority are joint and several obligations of the member
4 organizations unless otherwise agreed; and
5 WHEREAS, the local governments and special districts which
have joined to create the Coachella Joint Powers Insurance
6 Authority originally intended to exempt themselves from joint
7 and several liability; and
8 WHEREAS, an amendment to the Joint Powers Agreement creating
the Coachella Valley Joint Powers Insurance Authority is necessary
to make clear the original intent of member entities not to be
9 jointly and severally liable for the debts, liabilities and
0 obligations of the Authority or its members; and
11 WHEREAS, Article 25 of the Joint Powers Agreement creating
the Coachella Valley Joint Powers Insurance Authority provides
for amendment thereof upon approval of two-thirds (2/3) of the

member organizations;
13 NOW, THEREFORE, BE IT RESOLVED THAT THE CITY OF SAN JACINTO,
14 as a member organization of the Coachella Valley Joint Powers
Insurance Authority, hereby agrees that the Joint Powers Agree-
15 ment creating the Coachella Valley Joint Powers Insurance
Authority shall be amended to add Article 29, as follows:

17 JOINT AND SEVERAL LIABILITY
1s No member shall be jointly and severally liable for any
19 debts, liabilities, and/or obligations of the Authority or any
of its members.
20 MOVED, PASSED AND ADOPTED by the City Council this 21st
21 day of August, 1990.
