HomeMy WebLinkAboutResolution - 1902 i RESOLUTION Na. 1902 y RESOLUTION OF THE CITY CUVNCiL OF THE CITY OF SAN JACINTO, CALIFORPIA, ESTABLISHING ANNUAL SPECIAL TAX FOR A COMMUNITY 2 FACILITIES DISTRICT •r 3 THIS RESOLUTION IS ADOPTED WITH REFERENCE TO THE FOLLOWING 4 FACTS.- 5 WHEREAS , the CITY COUNCIL of the CITY OF SAN JACINTO , CALIFORNIA, (hereinafter referred to as the legislative body" ) , 6 has initiated proceedings, held a public hearing, conducted an election and received a favorable vote from the quallfied 7 electors relating to the Levy of a special tax in a community facilities district , all as authorized pursuant Lo the terms and g provisions of the "Mello-Roos Community Facilities Act of 1982", being Chapter 2 . 5 , Part 1 , Division < , Title 5 of the Government g Code of the State of California . This Community Facilities District shall hereinafter be referred to as COMMUNITY FACILI- 1d TIES DISTRICT NO. 3 (hereinafter referred to as the "District " ) ,, and, 3.1 WHEREAS, this legislative body, by Ordinance as authorized by J.2 section 53340 of the Government Code of the State of California, has authorized the levy of a special tax to pay for costa and 13 expenses related to said Community Facilities District , and this legislative body is desirous to establish the specific rate of 14 the special tax to he collected for the next fiscal year. 15 NOW, THEREFORE , HE IT RESOLVED, by the City Council of the City of San Jacinto, in regular session , this 3rd day of 16 July 1990, as follows: 17 1 . That the above recitals are all true and correct , J,8 2 . That the specific rate and amount of the special tax to be collected to pay for the costa and expenses for the next 2.9 fiscal year ( ;989-1990 ) for the referenced District is hereby determined and established as net forth in the 20 attached, referenced and incorporated Exhibit "A" . 21 3 . That the rate as net forth above does not exceed the amount as previously authorized by Ordinance of this legislative ?2 body , and is not in excess of that as previously approved by the quallfied electors of the District . 23 4. That the proceeds of the special tax shall be used to pay, 24 in whole or in part , the coats of the following, in the following order of priority: 25 A. Payment of costa and expenses of authorized public 26 services . 27 H . Repayment of advances and loans, if appropriate . 28 The proceeds of the special taxes shall be used as set forth above, and shall not be used for any other purpose. 29 5. The special tax shall be collected in the same manner as 30 ordinary ad valorem property taxes are collected, and shall be subject to the same penalties and same procedure and sale l� 31 in cases of any delinquency for ad valorem taxes, and the Tax Collector is hereby authorized to deduct reasonable 32 administrative costs incurred in coilecting any Bald special tax . 6 . All monies above collected shall be paid into the Community Facilities District funds. i � 7 . The Auditor of the County is hereby directed to entgr in the 2 next County assessment roll on which taxes will become du, opposite each lot or parcel of land effected in a apa,, marked "puLlic improvements, special tax" or by any other suitable designation, the installment of the epecial tax , 4 and for the exact rate and amount of said tax, reference is made to the attached Exhibit "A" . 5 © . The county Auditor a h a I I then , at the close of the tax r collection period , promptly render to this Agency a detailed report showing the amount and/or amounts of ouch special tax 7 installments , interest , penalties and percentages ao collected and from what property collected, and also provide 8 a statement of any percentages retained for the expense of trakinq any ouch collection. 9 9 .
