A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
Now, 1 SAN JACINTO, CALIFORNIA, DESIGNATING THE SAN JACINTO
KIOSK PROGRAM ASSOCIATION AS THE RESPONSIBLE PARTY TO
2 OPERATE, MAINTAIN, MANAGE, AND ENFORCE THE KIOSK SIGH
PROGRAM FOR THE CITY OF SAN JACINTO.

41 WHEREAS, Ordinance 340 prohibits the installation of off-
site advertising except as specified in the ordinance.

WHEREAS, the City Council has the authority to designate
6 party or parties to construct and maintain structures within the
public right-of-way.

WHEREAS, the City Council has the authority to delegate
$ the enforcement of City regulations within the public right-af-
way.

WHEREAS, enforcement of City regulations will improve
10 the aesthetic environment of the City and can possibly provide a
financial basis to provide continued enforcement.

WHEREAS, the Council is interested in providing the
12 Valley Economic Development Corporation with a permanent source of
revenue.

BE IT THEREFORE RESOLVED AS FOLLOWS:

1. The San Jacinto Kiosk Program, a privately controlled entity
15 governed by a Board of Trustees consisting of three members
from the private sector and two members representing the City
16 of San Jacinto, is hereby designated to operate, maintain,
manage, and enforce the kiosk sign program for the City of San
17 Jacinto.
18 2. All sign kiosks shall be installed under an encroachment
permit granted by the appropriate governmental authority.

3. All enforcement measures shall be approved by City staff.

4. All kiosks shall be maintained in a neat and professional
11 manner as determined by the City. All structures shall be
kept clear of debris for an area 20' in all directions from
22 the base of the structure. All structures shall be repaired
and repainted as required.

5. The San Jacinto Kiosk Program and any companies hired
24 contracturally by the San Jacinto Kiosk Program shall
indemnify the City by agreement and shall provide a liability
25 insurance naming the City of San Jacinto, its elective and
appointed officials as co-insured. Said policy shall be in
26 the amount of one million dollars.
27 6. The San Jacinto Kiosk Program shall provide and install sign
kiosks for the City of San Jacinto, at designated locations.
28 Users electing to rent space on the kiosk shall become members
of the San Jacinto Kiosk Program.
7. The San Jacinto Kiosk Program shall pay to the City of Sanl
30� Jacinto the net proceeds from kiosk rental, less a monthly
payment to the Valley Economic Development Corporation. Net
y� 31 proceeds shall be the gross proceeds less the costs for kiosk
Association overhead.

8. The Valley Economic Development Corporation shall receive
minimum monthly payment of $400.00 up to a maximum of 10% c
net proceeds from the San Jacinto Kiosk Program.

9. The San Jacinto Kiosk Program shall make all accoun
2 ledgers open to the City of San Jacinto as requested.
