4 THIS RESOIUTION IS ADOPTED WITH REFERENCE TO TILE FOLLOWING
FACTS

` WHEREAS, at this time hids have been publicly opened, examined
b and declared for certain of the proposed public works of improve-
ment and facilities as authorized for construction and financing
under proceedings for the formation of a Community FaciLities
V District pursuant to the terms and provisions of the "Hello-Roos
8 Community Facilities Act of :962" , being Chapter 1 . 5 , Part 1,
D Iv LsiOn 2 , Title 5 of the Government Code of the State cf
9 California , in a Community facilities district known and desLg-
nated as COMMUNITY FAf.:ILITiES DISTRICT NO . _2 { hereinafter
ID referred to as the ' District" ) .
11 NOW, THEREFORE, BE IT RESOLVED, by ttie City Council of the
City of San Jac Lrto, in regular session, this 19th day of
12 September, 19B9 , as follows :
13 1 . The above recitals are all true and correct .
14 2 . That this legislative body hereby rejects all of said
proposals or bids except that herein mentioned , and doers
15 hereby award the construction contract for doing said wo r':
and making improvements in the Assessment Distr Lct to the
16 lowest responsible bidder , to-wit :

18 at the prices named in the bid of said bidder on file with
the transcript of these proceedings, and open for public
19 inspection -
0 13 . -hat this award of contract hereby conditioned upon and
fI ;node subject to the receipt of monies and proceeds Frorn the
211 issuance and sale of bon(is . The Contractor sha 11 rot
r_ommence construction ❑r order -2quipment until he has
22 received a Notice to proceed . Any progress payment to the
contractor for work completed may he delayed if monies have
23 not been received from the sale of bonds .
24 4 . That the 4or k❑ of improvement shall be constructed in the II
manner and form as set forth in the plans and specif ica-
25 tions for these proceedings , as previously approved. Ikl
26 5 . That the Mayer and city clerk are hereby authorized to
execute the Agreement for the works of improvement relating
27 to said 1)istrLct , and a copy of said Agreement 3hall be on
file with the transcript of these proceedings.

6. That all monies to pay for the caste and expenses of the
29 above referenced District shall be paid from the funds as
deposited in the Improvement Fund, Including any interest
30 earned thereon .
31 7 . The C L t y Clerk shall certify to the adopt inn of this
Rceolution .
