1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JACIN,
CALIPORNIA, ANARDING THE CONTRACT FOR THE CONSTRUCTION OF
2 CERTAIN PUBLIC WORKS OF IMPROVEMENT IN A COMMUNITY FACILITIES

4 THIS RESOLUTION IS ADOPTED WITH REFERENCE TO THE FOLLOWING
FACTS:

WHEREAS, at this time bids have been publicly opened, Examined
6 and declared for certain of the proposed public works of improve-
ment and facilities as authorized for construction and financing
7 under proceedings for the formation of a Community Facilities
District pursuant to the terms and provisions of the "Mello-Roos
S Community Facilities Act of 1982" , being Chapter 2 . 5, Part 1 ,
Division 2 , Title 5 of the Government Code of the state of
9 California, in a community facilities district known and desig-
nated as COMMUNITY FACILITIES DISTRICT NO 2 ( hereinafter
10 zeferred to as the "District" ) .
11 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of San Jacinto, in regular session, this 20th day of
12 June 1989, as follows :
13 1 . The above recitals are all true and correct.
14 2 . That thin 'egislative body hereby rejects all of said
propogalg or bide except that herein mentioned, and does
15 hereby award the construction contract for doing said wor'•
and making improvements in the Assessment District to t
16 lowest responsible bidder, to-wit:
17 Kenko, Inc. dba McGrand and Associates
z8 at the prices named in the bid of said bidder on file with
the tranacript of these proceedings and open for public
19 inspection.
20 3 - That this award of contract is hereby conditioned upon and
made subject to the receipt of monies and proceeds from the
21 issuance and sale of bonds . The Contractor shall not
commence construction or order equipment until he has
22 received a Notice to proceed. Any progress payment to the
Contractor for work completed may be delayed if monies hav,
23 not been received from the sale of bonds.
24 4. That the works of improvement shall be constructed in the
manner and form as set forth in the plans and specifica-
25 tions for these proceedings, as previously approved .
26 5 . That the Mayor and City Clerk are hereby authorized to
execute the Agreement for the works of improvement relating
27 to said District , and a copy of said Agreement shall be on
file with the transcript of these proceedings.

6. That all monies to pay for the coals and expenses of toe
29 above referenced District shall be paid from the funds as
deposited in the Improvement Fund, including any interest
30 earned thereon.
31 7 . The City Clerk shall certify to the adoption of this
Resolution.

COUNCIL duly held the 20th day of June 1989 ,
