RESOLUTION NO. 1809
1 A RESOLUTION OF THE CITY COUNCIL OF THE
2 CITY OF 5AN JACIhTO OVERRULING OBJECTIONS
AND DETERMINING TO PROCEED WITH ABATEMENT

The City Council adopted Resolution 1Jo. 1801 on January 17, 1989, wh-ch
4 by its terms the Council elected to proceed under Government Code Sections 39501_
39588 and did declare as a public nuisance all weeds growing upon streets, side-
s walks and private property in the city and all rubbish, refuse and dirt upon park
ways, sidewalks and private property in the city; and
b
A public hearing was held on February 21 , 1989 , and objections to the pro-
posed removal of weeds, rubbish, refuse and dirt y:, re made or presented either in
writing or orally;

NOW, THEREFORE, IT I5 FOUND, DETERMINED AND ORDERED as follows:

10 1 . The foregoing is true.
2. The Council fixed February 21 , 1989 at the hour of 7:30 p.m. o'clock
D-1 in the Council Chambers, as the time and place for hearing all objections to the
12 proposed removal of weeds, rubbish, refuse and dirt, and the director of public
works was designated as the person to perfonn the duties imposed by Government
13 Code se_tions 39560-39588 upon the superintendent, and he did prepare notices to
destroy and remove rubbish, refuse and dirt; the city did mail written notice of
14 the proposed abatement to all persons owning property described in Resolution No.
in the time, form and manner prescribed by law.
15 3. The City Council did hold a public hearing on February 21, 1989. ane
16 jections either written or oral to the proposed removal of weeds, rubbish,
and dirt were presented, and the hearing was closed on February 21, 1989.
17 4, The noxious and/or dangerous weeds growing in or upon or adjacent to real
18 property described in Resolution No. 1801 are seasonal and recurrent nuisances.
19 5. The superintendent is ordered to abate the nuisance declared by Resolu-
tion No. 1801 by having the weeds, rubbish, refuse and dirt removed, and for this
20 purpose the superintendent may enter upon private property to abate the nuisance,
and the superintendent is ordered to cause the abatement of the weeds from time-
21 to-time hereafter' as the weeds recur per section 39562.1 of the Government Code.
Before the superintendent arrives, any property owner may remove the weeds, -ub-
22 bish, refuse and dirt at his own expense.
23 6. The superintendent or the contractor awarded the work, as the case may be
shall keep an account of the cost of abatement in front of or on each separate
24 parcel of land where the work is done and modification and confirmation., an
itemized written report showing this cast, all as mare particularly described by
25 Government Code section 39574.
