ICALIFORNIA, DECLARING THE RESULTS OF A "MELLO-RODS COMMUNITY

4 THIS RESOLUTION IS ADOPTED WITH REFERENCE TO THE FOLLOWING
FACTS:

i NHEREAS, the CITY CDUNC1i_ of the CTTY OF SAN JACINTO, CALIFORNIA
Thereinafter referred to as the "Ieaislative body of the local
Agency" ) , has previously declared its intention and held and

provisions of the "Hallo-Roos Community Facilities Act of 1982" ,

Code C,f Che State of California, said Community Facilities
District being referred to as COMMUNITY FACILITIES DISTRICT NO.
3 thereinafter referred to as the "District` ) ; and,

'WHEREAS, said legislative oodv did call for and order to be held
1 an election •..a submit to the qualified electors of the DietriOt
a proposition to authorise the levy of a special tax levy to pay
Z�_ for certain services in the District; and,
14 WHEREAS, at :his time said election has boon held and the
measure voted upon did receive the favorable 1/3 ' s vote of the

declare the favorable results of the election in accordance with
16 the provisions of Section 22932 of the Elections Code of the

A RESOLUTION OF THE CITY COUNCIL OF THE
2 CITY OF SAN JACINTO OVERRULING OBJECTIDNS
AND DETERMINING 10 PROCEED WITH ABATEMENT

The City Council adopted Resolution tic. 1901 on January 17, 1989 , which
4 by its terns the Council elected to proceed under Government Code Sections 39501_i
SI39588 and did declare as a public nuisance all weeds growing upon streets, side-
walks and private property in the city and all rubbish, refuse and dirt upon park
ways, sidewalks and private property in the city; and

A public liearing was held on February 21 , 1989 , and objections to the pro-
7 p.o5ed removal of weeds , rubbish, refuse and dirt irrre made or presented either in
writing or orally;

NOW, THEREFORE, IT IS FDUND, DETERMINED AND ORDERED as follows:

10 1 . The foregoing is true.
2. The Council fixed February 21 , 1989 at the hour of 7:30 p.m. o'clock
11 in the Council Chambers, as the time and place for hearing all objections to the
proposed removal of weeds, rubbish, refuse and dirt, and the director of public
12 works was designated as the person to perfu nn the duties Imposed by Government
13 Code sections 39560-39588 upon the superintendent, and he did prepare notices to
destroy and remove rubbish, refuse and dirt; the city did mail written notice of
14 the proposed abatement to all persons owning property described in Resolution No.
in the time, form and manner prescribed by law.
15 3. The City Council did hold a public hearing on February 21 , 1989, a&
16 jections either written or oral to the proposed removal of weeds, rubbish, r;
and dirt were presented, and the hearing was closed on February Z1 , 1989.
Z7 4. The noxious and/or dangerous weeds growling in or upon or adjacent to real
18 property described in Resolution No. 1801 are seasonal and recurrent nuisances.
19 5. The superintendent is ordered to abate the nuisance declared by Resolu-
tion No. 1801 by having the weeds, rubbish, refuse and dirt removed, and for this
20 purpose the superintendent may enter upon private property to abate the nuisance,
and the superintendent is ordered to cause the abatement of the weeds from time-
21 to-time hereafter as the weeds recur per section 39562.1 of the Government Code.
Before the superintendent arrives, any property owner may remove the weeds, rub-
22 bish, refuse and dirt at his own expense.
23 6. 71�@ superintendent or the contractor awarded the work, as the case may be
shall keep an account of the cost of abatement in front of or on each separate
24 parcel of land where the work is done and modification and confirmation, an
itemized written report shaving this cost, all as more particularly described by
28 Government Code section 39574.
